Mayor Wieder called the adjourned regular meeting of the City Council of the City of Huntington Beach to order at 7:00 P.M. ROLL CALL Present: Bartlett, Pattinson, Coen, Gibbs, Shenkman, Wieder Siebert (arrived at 8:20 P.M.) Absent: None DRAFTING ASSISTANCE - AUTHORIZED - (CA 76-148) The Assistant City Administrator presented a communication t❑ the Council regarding the need to obtain drafting services pending the return of an employee out on disability. On motion by Shenkman, second Pattinson, Council authorized informal bidding procedures for a services contract not to exceed $2,500 for engineering drafting. Motion carried by the following roll call vote: AYES: Bartlett, Pattinson, Coen, Gibbs, Shenkman, Wieder NOES: None ABSENT: Siebert V EMPLOYMENT OF REDEVELOPMENT LEGAL CONSULTANT - APPROVED - (CA 76-149) The Assistant City Administrator presented a resume' regarding the need to employ a redevelopment legal consultant to assist the City staff in meeting the technical and legal requirements of Community Redevelopment Law in preparation of the Downtown Plan. The following three specific areas were presented in seeking assistance by special legal counsel: The review of processes followed to date in compliance with State law; the direction of current activities leading to the October 11, 1976, public hearing on the Redevelopment Plan; and attendance at the October 11, 197.6, public hearing to provide legal information to Council and the public. The Acting Planning Director presented information concerning a legal consultant and stated that the consultant would be helping with the hearing only. On motion by Bartlett, second Shenkman, Council approved the letter agreement from redevelopment attorney, Joseph E. Coomes, Jr., of McDonough, Holland, Schwartz d Allen and authorized execution of same by the Mayor and City Clerk. Motion carried by the following roll call vote: AYES: Bartlett, Pattinson, Coen, Gibbs, Shenkman, Wieder NOES: None ABSENT: Siebert 11 Y0 Page #2 - Council Minutes - 9/27/76 ENVIRONMENTAL IMPACT #76-3 - BOLSA CHICA ANNEXATION #7 The City Clerk presented a request from staff for Council to reconsider their action on September 20, 1976 to re -past Environmental Impact Report 76-3 for a 30-day period and that staff make this Environmental Impact Report adequate and acceptable to the majority of Council for presentation to the Local Agency Formation Commission, for annexation approval. Mayor Wieder acknowledged the request and stated that .she felt that the public had insufficient time to meet with staff, and requested that Environmental Impact Report #76-3 be taken off the agenda. The Mayor's request was granted by Council. RE UEST FOR WAIVER OF DRAINAGE FEES FOR H.B. INDUSTRIAL PARK - APPROVED The City Administrator presented a memorandum from the Acting Director of Public Works relative to the drainage facilities being constructed by Huntington Beach Industrial Park, which are a part of the City's Master Plan of Storm Drain Facilities. These drainage facilities will serve Drainage District 2A. According to Huntington Beach Municipal Code, drainage fees in the amount of $90,802.00 are payable prior to issuance of building permits. It is contemplated that Huntington Beach Industrial Park will apply to the City for a Reimbursement Agreement to refund the difference in construction cost and drainage fees which will be $40,509.61; said fees to be collected from subsequent development in the area and refunded to Huntington Beach Industrial Park. On motion by Bartlett, secoaA Gibbs, Council authorized the issuance of building permits, with the requirement of a letter from Huntington Beach Industrial Park agreeing to formalise a Reimbursement Agreement with the City. Motion passed by the following roll call vote: AYES: Bartlett, Pattinson, Coen, Gibbs, Wieder NOES: None ABSENT: Shenkman, Siebert CITY COUNCIL RETREAT - SRACLIFF COUNTRY CLUB ' Councilman Pattinson referred to the facilitator to be utilized to conduct the Council Retreat, on October 29, 1976, questioning the authority by which the decision had been made, further stating that he was against having a facilitator and felt it was an unnecessary expense and that he would not approve it. Mayor Wieder stated that at the time the Council approved the retreat, the cost and the facilitator were also approved. When the retreat was postponed, only the date and place were changed. Mayor Wieder further stated that this was not the time to discuss the matter. JOINT MEETING - CITY COUNCIL AND MAYOR'S ADVISORY COMITTEE ON THE HANDICAPPED Advisa Committee on the Handicapped - Members present McIntosh, Stephens, Gerson, Trumaine, Miller, Alganzar, Himes, Vogelsang, Stein, Engle Mr. Ron Miller, acting chairman, addressed Council stating that the committee has tried to educate the City of Huntington Beach on problems encountered by the handicapped in Huntington Beach. He stated that their aim is to bring the minority groups into the main stream of life. 461 Page #3 - Council Minutes - 9/27/76 Mr. Miller presented a resumer of the activities and general aims of the committee, and spoke further on their efforts to gain employment for the handicapped through the Comprehensive Employment Training Act Program. Mayor Wieder suggested that a person from the Manpower program sit in as an ex-officio member of the Committee. A five minute recess was called by.,the Mayor. The meeting was then reconvened. JOINT MEETING - CITY COUNCIL AND PLANNING COMMISSION - INDUSTRIAL LAND USE PLAN Planning Commission - Members Present Parkinson, Newman, Finley, Shea, Gibson Members Absent Slates, Boyle The Acting Planning Director presented an overview of the Planning Commission activities and referred to their review of State land use laws and revision of land use plans to re-evaluate land use. Monica Florian, Senior Planner, presented slides and a resume' covering areas of concern and maximum city commitments. Mrs. Florian stated that there were three main areas of concern; Examination of existing status of industrial uses in the city; analysis of long range industrial mutters; and a look at industrial policy alternatives. She also presented a wall map showing the industrial corridor and other industrial areas. The maps displayed showed alternatives that Council could choose to consider in future planning. Each Councilman and Commissioner was given the opportunity to present their views and preference to Alternates #l, #2, or #3, or any combinations thereof. It was cited that there was need for policy direction and staff informed Council that such policy suggestions would be prepared. Considerable discussion was held between the Planning Commission and City Council. Mayor Wieder thanked the Planning Commission for the opportunity to meet with them jointly. .. ANNOUNCEMENTS ✓ Santa Ana Flood Control Project - Alternate #6 Mayor Wieder stated that a telegram had been received from Congressman Patterson stating that the Santa Ana River Flood Control Project Alternate Plan #6 on the Public Works Omnibus Bill passed in Congress this date. Conservation - Matt Kin - Science"Advisor Mayor Wieder stated that Matt King, Science Advisor, had brought to the attention of Council a firm in Costa Mesa that can aid cities in recovering overcharges or duplications on utility bills and can perform engineering services to reduce utility costs. Mayor Wieder stated that a committee has been formed to meet with this firm. Page #4 - Council Minutes - 9/27/76 J FREE TRADE ZONE Mayor Wieder spoke of the industrial quarter and the Redevelopment Plan Report,stating there were 171 manufacturing facilities in Huntington Beach.,:Mayor Wieder,further . advised that Council was exploring an application for a free trade zone for Huntington Beach, which would be another incentive for businesses coming to the'City. Mayor Wieder .stated .that ,OctQber 11, ,1976. was set for the Redevelopment p0lie .haari,ng,; and Novembex.8,,1976 for a joint meeting with the Allied Arts Commission, Personnel Board, and the Equal Employment Opportunity Commission. ODOR PROBLEM - BUCCELLA PROPERTY Mr. Joel Babic, 17151,Greenleaf, and,Mr. Doug,McFarland, 11072 Newquister Lane, City, addressed Council and stated their concern regarding the obnoxous fumes emanating from Frank Buccella,ls, property. He was concerned both about the health hazard and property values in the area. Mr. Babic requested that the City request assistance from appropriate. federal and state authgrities,. Mr. Frank Buccella presented data on the efforts he has made to eliminate the problem. He explained the, progress and the proposed solutions he is nether striving to attain. On motion by Wieder, second Pattinson, Council declared a public nuisance to exist and authorized the staff and the Mayor to implement any appropriate action necessary,to eliminate the problem on the Bucceila yroperty. Motion carried.by the following roll call vote: AYES: Bartlett, Pattinson, Coen, Gibbs, Siebert, Shenkman, Wieder NOES: None ABSENT: None The Mayor Wieder presented the pity Clerk with a,list of .signatures submitted by Mr. Joel Babic in favor of a 'temporary restraining order in the hope of solving the odor problem which they feel i potentially jeopardizing their health and, property values. '7v - y� FOUFL SEASONS FARMS ;-'REQUEST FOR RE -ZONING ORDINANCE Mrs. Donna Colbert, City resident, presented a letter to Council, stating that there was an urgent need to amend the City Code, delay of which would cause undue hardships. Under the present code, construction of"a home site under the existing RA Zone would not be allowed. Discussion was held'and it was ascertained that no immediate help'couald be legally forthcoming. Council requested Staff to prepare a proposed Code'Amendment for Planning Commission consideration, with the understanding that a code change would take approximately three months'time.
