Chairman Crosby informed the Board that this request is covered by Negative Declaration 76-84, adopted by the Board of Zoning Adjust- ments on September 15, 1976, in conjunction with approval of Use Permit No. 76-52. Secretary Palin reported that a letter has been received from the applicant requesting continuance until such time as property con- figuration for future leasing of this project has been determined. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-38 WAS TABLED INDEFINITELY, AT THE REQUEST OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments September 29, 1976 Page 2 CONDITIONAL EXCEPTION NO. 76-43 (In Conj./UP 76-49) Applicant: Herbert E. Riley To permit a thirteen (13) space reduction in the required parking in lieu of Section 9793.1(a) of the Huntington Beach Ordinance Code and to permit an approximately eleven (11) foot encroachment into the required fifty (50) foot exterior side yard, located at the north- west corner of Newland Street and Atlanta Avenue in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Riley and Chuck Robinson were present at the meeeting and addressed the Board to explain their proposed project and its operation. Mrs. Marguerite Shore, an adjacent resident, addressed the Board asking that setbacks, fencing, trash enclosures, and hours of operation be carefully controlled in order to minimize the impacts of the proposed project upon nearby residences. There being no other persons to speak on the plan, the public hearing was closed. Secretary Palin noted that a revised plan has been received. He also informed the Board that a petition opposing this use has been received. The Board reviewed the unique size and configuration of the subject property (originally set aside for a service station use) and what effects this might have on the use presently proposed. Ratio of usable floor area to dead office and storage space was discussed. ON MOTION BY LIPPS AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 76-43 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The lot size and configuration and the ratio of dead storage and office space to working floor area justifies the requested reduction in parking spaces. 2. The granting of the Conditional Exception for the setback en- croachment is consistent with the intent of the Planning Commis- sion and the City Council to provide commercial development with the least possible effect upon the abutting uses for the following reasons: a. The requested location of the building will have less effect upon the privacy of adjacent residents than would siting the building farther back on the property, which would permit windows looking directly into the abutting rear yards. The present location will provide more landscaping along the property lines, further screening the project from the adjacent residences. 3. The granting of the Conditional Exception will not adversely affect the Master Plan of the City of Huntington Beach. 4. 'The granting of a Conditional Exception will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. CONDITIONS OF APPROVAL: 1. The revised plot plan received and dated September 23, 1976, shall be the approved layout. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-49 (In Conj./CE 76-43) Applicant: Herbert E. Riley To permit the construction of a 7900 square foot commercial building pursuant to Section 9472 of the Huntington Beach Ordin- ance Code, located at the northwest corner of Newland Street and Atlanta Avenue in a C4, Highwav Commercial District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, Section 15103(c), California Environ- mental Quality Act, 1970. The Chairman opened the public hearing. Mr. Riley and Chuck, Robinson were present to represent the application, and discussed the project for the Board's information. There being no other persons to speak on the proposed project, the public hearing was closed. The ensuing Board review took into consideration the parking reduction and encroachment approved under CE 76-43, as well as landscaping and screening, access to the use, and hours of operation and deliveries. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-49 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 9-29-76 Page 3 Minutes, H.B.,Board of Zoning;Adjustments September 29, 1976 Page 4 FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received September 23, 1976, shall be the approved layout, subject to the modification described herein: a. The driveway widths shall be modified to the standards of the Department of Public Works as may be determined by the Traffic Engineer. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted: a. A landscaping and irrigation plan shall be submitted to the Department of Building and Community Development. Said plan shall comply with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. A rooftop mechanical equipment screening plan shall be submitted to the Secretary of the Board. Said plan shall BZA 9-29-76 Page 4 Minutes, H.B. Board of Zoning Adjustments September 29, 1976 Page 5 indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval -by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departrants of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Construction of the approaches to the project shall be completed pursuant to standards and requirements of the Department of Public Works. C. GENERAL CONDITIONS: 1. An eight (8) foot high masonry block wall shall be constructed along the north and west property lines of subject project. 2. The hours of operation shall not extend beyond 12:00 midnight on Friday and Saturday nights, nor beyond 11:00 p.m. on other nights. 3. The designated specific uses for portions of the building designated to be used for offices, storage and dead areas shall be the only approved uses for those areas, based upon the approved plan and the reduced parking provided. 4. The 15-gallon trees to be planted along the west and north property lines of subject property shall be shown upon the landscaping and improvement plan, and the species thereof approved by the Street Tree Superintendent prior to occupancy of the use. 5. An on -site lighting plan shall be submitted to the Department of Building and Community Development prior to issuance of building permits, to assure that no lighting is directed upon abutting properties. 7. The trash enclosure area and ice vending machine enclosure wall shall be of similar materials to those used within the struc- ture, to assure compatibility of colors and materials. 8. No future use of this building for any other purpose shall be allowed until a subsequent application has been filed and approved for such use, to assure that adequate parking can be provided on the site. 9. No deliveries shall take place at any time other than between the hours of 7:00 a.m. and 9:00 p.m. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-134 Applicant: Forest Olsc,.z To permit construction of a 1480 square foot addition to an existing real estate office pursuant to Section 9471 of the Huntington Beach Ordinance Code, located on the northwest corner of Edinger Avenue and Edwards Street in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-85. Robert Coles was present to represent the application. Board review found the application to be in conformance with applicable code provisions. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-85 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 76-134 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: i BZA 9-29-76 Page 6 i 1 Minutes, H.B. The plan received and dated September 10, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Chairman Crosby informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. John King was present at the meeting; also present was Mrs. Slevin, owner of the subject property. The project was reviewed and found to be in compliance with code with the exception of open space area, which will be reduced by 200 square feet by the required radius dedication at the inter- section of 16th and Orange. ON MOTION BY LIPPS AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 76-26 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 9-29-76 Page 7 Minutes, H.B. Board of Zoning Adjustments September 29, 1976 Page 8 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received and dated September 20, 1976, shall be the approved layout. NOTE: The Board has taken into consideration the 200 square feet of open space area which will be taken by the dedication of a twenty (20) foot radius at the intersection, and has determined that the plan as submitted shall be the approved precise plan and shall not need to be revised to increase the open space provided to replace that 200 square, feet. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. In accordan(-e with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley and a twenty (20) foot radius at the intersection of 16th Street and Orange Avenue shall be dedicated. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Sixteenth Street, Orange Avenue, and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-54 Applicant: Kenneth G. Feltrop To permit the establishment of a wholesale worm farm pursuant to Section 9530.2(c) of the Huntington Beach Ordinance Code, located at the east side of Palmdale Street approximately 180 feet south of Cain Avenue in an Ml, Light Industrial District. Chairman Crosby informed the Board that this project is categori- cally exempt per Section 15060 of the California Environmental Guidelines. The Chairman opened the public hearing. Kenneth Feltrop and Jack Weinstein were present at the meeting and addressed the Board to explain the history of the use on the subject property. There being no other persons present to address the Board, the public hearing was closed. Walt Lipps informed the Board that there is pending litigation regarding to illegal uses on the site, and recommended that no action be taken prior to this action being resolved. After review it was the consensus that the Board inspect in the field what uses are presently existing and obtain an opinion from the office of the City Attorney on the proper procedure in this case. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-54 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF OCTOBER 6, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 9-29-76 Page 9 Minutes, H.B. Board of Zoning Adjustments September 29, 1976 Page 10 USE PERMIT NO. 76-55 Applicant: Family Home Builders To permit the construction of an 82-unit apartment building pursuant to Section 9320 of the Huntington Beach Ordinance Code, located on the northwest corner of Wichita Avenue and Huntington Street in an R2-O-CD, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-81. The Chairman opened the public hearing. John Mandrell, Louis Graziadio, and Dennis Taylor were present to represent the application. The Chairman closed the public hearing. The Board discussed the proposed project with the applicants, noting that two alternative plans have been submitted to allow for possible differing alignments of Lake -Mansion Avenue improvements. Open space, lot coverage, parking and landscaping, and access to the site were reviewed, as well as the effects on this project of the' possible aband- onment of the Pacific Electric right-of-way and disposition of that right-of-way as determined by the City Council. The recommendation of the Traffic Engineer that no permanent vehicular access be granted from Mansion Avenue will also have an effect upon the layout of the subject project. Ater extensive discussion, it was the consensus that this application should be continued to allow the staff to inves- tigate access and parking off Mansion Avenue, to discuss with Public Works the problem of the legal creation of the parcel, and to permit applicants to submit area calculations for a properly dimensioned plan for Alternate A. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-55 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANTS, TO THE REGULAR MEETING OF OCTOBER 6, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-132 Applicant: Moses and Patricia Simon To permit the care of two (2) non -related persons in a mobilehome pursuant to Section 9730.27.1 of the Huntington Beach Ordinance Code,loc- ated northwesterly of Beach Boulevard and Pacific Coast Highway in an R5 Office -Professional District. Chairman Crosby informed the Board that this request is exempt per Section 15060 of the California Environmental Guidelines. BZA 9-29-76 Page 10 Minutes, H.B. Secretary Palin read into the record a letter of concurrence from the manager of the mobilehome park in which the proposed use is to be located. There being no other persons present to address the Board, the public hearing was closed. The Board reviewed the request. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-132 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan and description of the project received and dated September 9, 1976, shall be the approved layout. 2. The applicants shall comply with all provisions of Section 9730.27.2 of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-47 Applicant: Downey Savings & Loan To permit an additional freestanding sign on a site having three (3) existing in lieu of Section 9764.3.1.2(2) of the Huntington Beach Ordinance Code, located at the southeast corner of Brook- hurst Street and Adams Avenue in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Tom Lynch and Bill Mills were present to represent the application, explaining that the exception is being requested due to changing use in the second - story portion of the building, which they feel justifies separate signing. There being no other persons to speak, the public hearing was closed. The Board discussed the conditions of approval as originally placed upon the use, existing signing on -site, and interpretations of the code as it applies to said request. It was the consensus that an opinion should be obtained from the office of the City Attorney prior to action on this application. ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 76-47 WAS CONTINUED, WITH THE CONCURRENCE OF TN , APPLICANT, TO THE MEETING OF OCTOBER 6, 1976, BY THE FOLLOWING VOTE: BZA 9-29-76 Page 11 Minutes, H.B. Board of Zoning Adjustments September 29, 1976 Page 12 AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-42 Applicant: Mrs. Anderson To permit a two (2) lot division of land pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the northeast corner of Blanton Street and Milo Avenue in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-88. Mrs. Anderson was present at the meeting. Chairman Crosby pointed out that the suggested conditions of approval will have to be amended to indicate that Blanton Street will be improved on the parcel map itself as the lots are already developed without improvements. The Board discussed the history of the subject property and how the lots had originally been divided. It was determined that no action could be taken until the applicant has submitted a preliminary title report or other proof of the legality of the original lot split. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-42 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF OCTOBER 6, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-43 Applicant: RMG Engineering To permit alteration to existing lot lines to allow for drainage ease- ment pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the west side of Parlay Circle at the intersection with Stallion Circle in an Rl, Low Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-18, adopted at the time of approval of TT 9275. John Mandrell outlined his reasons for the lot line adjustment and indicated his concurrence with the suggested conditions of approval. ON MOTION BY CROSBY AND SECOND BY PALIN TENTATIVE PARCEL MAP NO. 76-43 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 9-29-76 Page 12 Minutes, H.B. The tentative parcel map received by the Planning Department on September 20, 1976, shall be the approved layout, with the following amendments: a. The map shall show the storm drain easement at ten (10) feet instead of 8'6". b. The map shall indicate that all buildings shall be set back at least five (5) feet from the edge of an easement line. C. The map shall indicate the existing lot lines, as well as the proposed. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. The map shall comply with all applicable City Ordinances. 4. To permit the construction of a single-family dwelling pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the northwest corner of 17th Street and Acacia Avenue in the Townlot Specific Plan Area One, Section B. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Zehnder was present at the meeting. The Board reviewed the plan, with Secretary Palin expressing the opinion that the required two (2) foot offset located as it is does not meet the intent of the code provision to provide relief and interest in the exterior wall. JIM PALIN MADE A MOTION THAT ADMINISTRATIVE REVIEW NO. 76-138 BE DENIED. Motion failed for lack of a second. ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-138 WAS CONTINUED TO THE MEETING OF OCTOBER 6, 1976, TO PERMIT STAFF TO MAKE A FIELD REVIEW, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-139 Applicant: Lowell D. Zehnder To permit the construction of three (3) single-family dwellings pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the west side of 17th Street approximately 25 feet north of Acacia Avenue in the Townlot Specific Plan Area One, Section E. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Lowell Zehnder was present at the meeting and submitted revised plans for the project which were reviewed by the Board.
