TENTATIVE PARCEL MAP NO. 76-30 (In Conj./AR 76-105) Applicant: George Bach To permit the creation of a legal parcel per a previously recorded Record of Survey pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. Chairman Crosby informed the Board that these requests are covered by Negative Declaration No. 76-69. Secretary Palin reported that a request has been received from the applicants for a continuation of these items in order to permit further research into the legal constraints on the tentative parcel map. Board of Zoning Adjustments October 6, 1976 Page 2 ADMINISTRATIVE REVIEW NO. 76-140 Applicant: Rock Enterprises To permit the construction of a 10,700 square foot mini -warehouse industrial building with 84 recreational vehicle parking spaces pursuant to Section 9530 of the Huntington Beach Ordinance Code, located on the northwest corner of Morgan Lane and Speer Avenue in an Ml, Light Industrial District. The Chairman informed the Board that this project is covered by Exemption Declaration No. 73-91. Secretary Palin reported that a meeting has been held with the applicant in an effort to resolve problems with right-of-way widths, parkways, and setbacks, and it has been decided that he will file for a variance for a two -foot encroachment into the setback. It was the consensus'that this application should be heard in conjunc- tion with that conditional exception request. Feltrop To permit the establishment of a wholesale worm farm pursuant to Section 9530.2(c) of the Huntington Beach Ordinance Code, located at the east side of Palmdale Street approximately 180 feet south of Cain Avenue in an Ml, Light Industrial District. Chairman Crosby informed the Board that this request is exempt per Section 15060 of the California Environmental Guidelines. No one was present to represent the application. Secretary Palin notified the Board that the Office of the City Attorney has requested continuance of this request, in order not to jeopardize litigation currently in progress. Board of Zoning Adjustments October 6, 1976 Page 3 USE PERMIT NO. 76-55 Applicant: Family Home Builders To permit the construction of an 82-unit apartment building pursuant to Section 9320 of the Huntington Beach Ordinance Code, located on the northwest corner of Wichita Avenue and Huntington Street in an R2-0-CD, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-81. The Chairman opened the public hearing. John Mandrell, Louis Graziadio, and Dennis Taylor were present at the meeting. There being no other persons to speak for or against the project, the public hearing was closed. Secretary Palin reviewed the history of the application, the meetings which have been held with the applicants and with the Orange County Transit District, and the opinion which has been obtained from the Office of the City Attorney. Said opinion is that the applicant may submit two alternative plans and have his project approved on an either/or basis, but one of the plans must approach the project as the lot configuration currently exists with buildings plotted thereon according to existing rights -of -way. The alternative plan may take the pending Precise Plan of Align- ment and the vacation of portions of the Mansion Avenue right-of- way into consideration, under the assumption that the applicant will be successful in obtaining the vacated right-of-way. Other items discussed were the number of units which can actually be constructed on the parcel (Planning Department figures indi- cate 78 as the maximum), and the applicant was informed that he cannot use any area from his Parcel 2 as a basis for calculations on the density for Parcel 3. Access from Mansion Avenue was also reviewed, and it was noted that the Traffic Department will not take a hard and fast position on this access, relinquishing the decision to the Board of Zoning Adjustments. After further extensive discussion it was determined that the applicant would supply the separate plan, moving encroaching buildings out of the present right-of-way line, clarifying the questions on the number of units, and certifying dimensions on the site plan. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. No one was present to represent the application, and the public hearing was closed. Secretary Palin reported that an opinion has been received from the Office of the City Attorney supporting the Board's position that the applicant cannot apply both of two alternative provisions of the code in relation to this sign request. It was the consen- sus of the Board to continue to permit the applicant to be present. ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 76-47 WAS CONTINUED TO THE REGULAR MEETING OF OCTOBER 13, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76742 Applicant: Mrs. Anderson To permit a two (2) lot division of land pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the northeast corner of Blanton Street and Milo Avenue in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-88. Mrs. Anderson was present at the meeting. The applicant has submitted a copy of a recorded parcel map splitting the subject property from the two lots to the rear of this parcel. The Board reviewed the request and the suggested Conditions of Approval with the applicant; Bruce Crosby requested an additional condition providing for installation of street im- provements. Zehnder To permit the construction of a single-family dwelling pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the northwest corner of 17th Street and Acacia Avenue in the Townlot Specific Plan Area One, Section B. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Zehnder was present at the meeting. The Board reviewed the revised plan submitted by applicant and found that it does conform with the provisions for recesses in the building -wall as required. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-138 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received October 6, 1976, shall be the approved layout. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Zehnder was present at the meeting. The Board reviewed the submitted revised plan and found it to be in conformance with code requirements. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. No one was present to represent the application. ON MOTION BY CROSBY AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 76-48 WAS CONTINUED, TO ALLOW THE APPLICANT TO BE PRESENT, TO THE REGULAR MEETING OF OCTOBER 13, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-50 Applicant: Edward Brady To permit a waiver in the required two (2) covered, offstreet parking spaces in lieu of Section 9106 of the Huntington Beach Ordinance Code, located on the north'side of Devon Circle approxi- mately 50 feet east of Channel Lane in an R1, Low Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mrs. Brady was present at the meeting and reviewed the history of this application and her reasons for the conditional exception request. She noted that the waiver has the unanimous approval of her neighbors. There being no other persons to speak for or against the project, the public hearing was closed. t- r Secretary Palin reviewed the direction received from the City Council that staff handle this matter in the most expeditious manner possible as the Council felt that there was no need to require construction of a carport to provide offstreet parking, and the Board considered the requested variance in light of that Council directive. ;. Board of Zoning Adjustments October 6, 1976 Page 10 ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-50 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDI- TIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. To require the construction of a carport to provide covered parking onsite would create an unsightly structure which might not be compatible with the aesthetics of the area. 2. There is not sufficient room on the existing property, because of prior construction and the ten foot front yard setback, to accommodate a legal carport without further encroaching upon the required setbacks. 3. The proponent has indicated an intention to use only the existing apron approach for open parking, and said approach is sufficient to accommodate two automobiles. 4. Waiving the onsite covered parking through the proposed variance will not be detrimental to the health, safety, and welfare of people working or residing within the area. CONDITIONS OF APPROVAL: 1. To permit the construction of two (2) duplex buildings abutting an arterial street pursuant to Section 9201.4 of the Huntington Beach Ordinance Code, located on the north side of Warner Avenue between Lynn Street and Hoskins Street in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Problems found on the plot plan included provision of reciprocal ease- ments over and across a ten (10) foot driveway in lieu of the twenty (20) foot width as required by code and improper turning radius which provided only thirteen feet in lieu of the 25 foot minimum required by ordinance code. Length of the drives and the relationship of the subject project to abutting properties were also discussed. It was the consensus that the project architect should meet with staff to attempt to work out the problems on the proposed plan. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-56 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF OCTOBER 20, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-41 Applicant: William Tater To permit a lot line adjustment to consolidate two parcels into one parcel pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the southeast corner of 20th Street and Olive Avenue in the Townlot Specific Plan Area One, Section B. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. Mr. French was present to represent the application and indicated his concurrence with the suggested conditions of approval. Bruce Crosby noted that the 20 foot corner radius should be shown on the tentative parcel map. Norman To permit a four (4) lot division of land pursuant to Section 9921 of the Huntington Beach Ordinance Code, located at the northeast corner of Talbert Avenue and Gothard Street in an M1-CD, Light Industrial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-91. Mr. Norman and Ron Winterburn were present at the meeting. The Board reviewed the request, noting that the map must be revised to incorporate the A & Z Auto yard abutting, in order to segregate that parcel legally. The revised map must also have plotted on it the locations and dimensions of the existing dwellings on the property, showing setbacks and separations and yard areas. Access easements were discussed to be taken through Parcel 3 off Talbert Avenue, and the applicant informed of the minimum allowable width of twenty (20) feet for such easement. Bruce Crosby informed them of the necessary radius at the intersection; he also noted that the blue line border of the map should go to street center- line. ON MOTION BY CROSBY AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-45 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF OCTOBER 13, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 10-6-76 Page 12 n Minutes, H.B. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-169, previously adopted by the Board. Gerald Jones was present at the meeting. Mr. Jones indicated that he has received and concurs with the suggested conditions of approval. The Board reviewed the history of past actions on the subject property as they affect access rights to Talbert Avenue. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-46 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on September 28, 1976, shall be the approved layout. 2. Talbert Avenue shall be dedicated to City standards at the time said parcels are developed. 4. Bruce Crosby pointed out that no map has recorded on the tract in which this project is located; therefore, there are no legal street lines, setbacks, etc., to which the project can be con- structed. The Board reviewed this problem with the applicant. Also discussed was the problem of providing proper circulation between this project and the remainder of the tract. It was the consensus that the applicant should meet with Gordon Mountjoy, the developer of the tract, to determine what procedure will be fol- lowed in recording either a final or a tentative parcel map and what provisions will be made for access; also, the plan must be revised to comply with setback requirements. Robert Drechsler, tenant of Space 26 in the mobilehome park, was present at the meeting. Secretary Palin reported to the Board that the prior approval of these modifications (granted on September 29, 1976) had been based upon misinformation as to the effects such modifications would have on adjacent spaces within the park. He also noted that some coaches had, in fact, already been moved in on some of the lots upon which the Board had acted. Walt Lipps noted that some of the people whose coaches were already in place now find that their units are too close to the space lines and are subject to reloca- tion. Mr. Drechsler, one of the tenants so affected, has filed an appeal to the Board's actions of September 29.
