ON MOTION BY BOYLE AND SECOND BY FINLEY THE MINUTES OF SEPTEMBER 21,

In the Chairman's absence Vice Chairman Gibson presided over the meeting.
SCHEDULED ITEMS:
CODE AMENDMENT NO. 76-12 - "OLDTOWN SPECIFIC PLAN"
The staff requested that this item be continued to allow more time
for a survey to be made of the area as well as prepare a detailed
land use map of the Oldtown Area.
The public hearing was opened.
Mr. Thomas Wickstrom addressed the Commission and discussed the results
of surveys he had taken. He suggested that property owners in the
area conduct the survey rather than college students, or that a
property owner accompany the students.
Dave Eadie stated that this survey was being made in conjunction
with the HCD survey which would take more time. He stated that
there were three students who would do the survey and that they
would be instructed by the staff on the manner in which the survey
would be conducted. Any questions pertaining to the Code would be
directed to the staff rather than answered by those conducting
the survey.
Ed Farber stated that he was opposed to students making the surveys.
Dave Eadie stated, in response to a question from a property owner,
that he would be mailing out questionnaires to those property
owners who do not reside in the area.

CODE AMENDMENT NO. 76-8 - SUNDECKS, WINDSCREENS, AND YARD REQUIRE-
MENTS ON WATERFRONT LOTS
Dave Eadie gave a brief background of this Code Amendment, indi-
cating that the proposed Code Amendment has not been published in
the Huntington Harbour Property Owners' Association Newsletter and
many residents of the area have valid issues which should be addressed.
He stated that the staff felt that the amendment should be continued
'for approximately 30 days to allow time for further staff discussion
with affected residents of the area.
There was a discussion on enforcement and the City's stand on exist-
ing structures.
The public hearing was opened. There was no one present to speak
on this Code Amendment and the public hearing was closed.

CODE AMENDMENT NO. 76-15 - MISCELLANEOUS REVISIONS TO ARTICLE 939
TEMPORARY COMMERCIAL HORSE FACILITIES STANDARDS
John Cope reviewed the background information on this code amend-
ment and summarized the information contained in the staff report.
There was a discussion on the minimum side yard setbacks and
public improvements and dedications.
The public hearing was opened. There was no one present to speak
on this code amendment and the public hearing was closed.
Further discussion ensued.

CONDITIONAL USE PERMIT NO. 76-25
Applicant: Glenn S. Enomoto
Conditional Use Permit No. 76-25 is a request to allow the develop-
ment and operation of a wholesale nursery operation. The proposed
site is a portion of the Southern California Edison Company
right-of-way that extends northerly for approximately 600 ft. from
Warner Avenue between Bressel Lane and Ross Street.
An aerial photograph was shown of the property.
John Cope noted that he had handed out detailed site plans for the
Commission's information. He stated that the staff felt that the
proposed wholesale nursery operation was a compatible land use.
There followed a discussion on the conditions of approval.
The public hearing was opened.
Mr. Enomoto, the applicant, addressed the Commission and discussed
his plans for the wholesale nursery and stated that he felt the
conditions suggested by the staff would present no problems.
The public hearing was closed.

NO. 76-89 WAS APPROVED BY THE FOLLOWING VOTE:

ON MOTION BY BOYLE AND SECOND BY FINLEY CONDITIONAL USE PERMIT
NO. 76-25 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed site is adequate to serve the proposed use.
2. The proposed use has resulted in positive environmental effects,
including weed and rodent control and an improvement in the
visual aesthetics of the site.
3. The proposed use is compatible with the surrounding uses.
CONDITIONS OF APPROVAL:
1. The site plan dated October 19, 1976 shall be the approved
layout.
2. All vehicles operating within the nursery shall not exceed a
speed of 10 miles per hour.
3. The taller and larger plant material shall only be stored away
from the residential properties to the west. Lower growing
trees and shrubs shall only be permitted adjacent to these
residential properties, and this plant material shall be no
higher than one foot lower than the top portion of the wall
which they abut.
4. All soil anten3ments or planting mix materials shall be kept
damp to minimize the possibility of such material blowing
onto adjacent properties.
5. Spraying of plant materials shall be done from the property
line onto the premises of the site or inwardly away from the
residential ,pr-)perties.
6. The onsite access roads shall be treated so as to control dust
that may be raised by veicles.

7. Chemicals and their application shall only be permitted if
approved by the Orange County Department of Mental Health.
8. Employees shall be continuously instructed on the above
recommended procedures. Violation of these procedures shall
subject the applicant to revocation of the Conditional Use Permit.
9. The hours of operation shall be such that no physical dis-
turbances are endured by the residents of adjacent properties.

ZONE CASE NO. 76-23
Applicant: Initiated by the Planning Department
Zone Change No. 76-23 is a proposal initiated by the Planning
Department to rezone the old city yard site from M2 (Heavy Industrial)
to R2 (Medium Density Residential. This rezoning is necessary to
implement the previously Adopted General Plan Land Use designation
on the site. The property is located at the northwest corner of
Alabama Street and Memphis Avenue, approximately 172 feet east of
Lake Street.

street alignment was initiated in order to provide access to several
land -locked parcels that exist approximately 300 feet north of
Utica Avenue.

PRECISE PLAN OF STREET ALIGNMENT 76-8
Applicant: Initiated by Planning Department
The purpose of this precise plan is to effectuate the following:
1. The cul-de-sacing of Shipley Street at 17th Street.
2. The precise alignment of a 20 ft. north/south alley right-of-way
between Adams Avenue and 17th Street. Said alley will be
located approximately 118 ft. west of Main Street.
3. The precise alignment of a 25 ft. nortl-/south local street
between Adams Avenue and Shipley Street. Said street will
be located approximately 118 ft. east of 17th St.
Jim Palin gave a brief background history of this precise plan.
An aerial photograph was shown.
Vice Chairman Gibson opened the public hearing.
Larry Bartman felt that while the proposed precise plan would be
nice for the new homeowners it could possibly increase the traffic
on the 20 ft. alley.
The public hearing was closed.
Acting Secretary Selich spoke on the precise plan and what it
proposed to do.

There was a discussion by Commission and staff on parking problems
with the school. Mr. Palin stated that he would bring back a report
to the Commission on the timing of the development of the community
park.

Staff was directed to bring back further information on working with
the school district to analyze traffic impacts of the existing park-
ing -lot facility and to provide suggestions on how to eliminate the
potential problem of auto access on the alley south of 17th Street.
ADOPTION OF SCENIC HIGHWAYS AND NOISE ELEMENTS
Acting Secretary Selich addressed the Commission and summarized
the information contained in the staff report. He noted that
neither of these elements has been adopted and to accommodate the
Redevelopment Plan schedule it will be necessary to adopt the
Scenic Highways and Noise Elements separately after a public
hearing on November 2, 1976.
The Commission expressed some concern over the short period of
time allowed them for adoption of the Noise and Scenic Highways
Elements.
Acting Secretary Selich explained that they were only interim
Elements and that revisions could be made prior to adoption of
the complete General Plan Document. He stated that they could
be on the Agenda for the October 27, 1976 adjourned meeting for
discussion.

ON MOTION BY BOYLE AND SECOND BY NEWMAN THE STAFF WAS DIRECTED
TO SET THE NOISE ELEMENT AND SCENIC HIGHWAYS ELEMENT FOR PUBLIC
HEARING ON NOVEMBER 2, 1976, BY THE FOLLOWING VOTE:
AYES: Gibson, Newman, Boyle
NOES: Finley
ABSENT: Parkinson, Slates, Shea
Deputy City Attorney John O'Connor stated that the motion did
carry..
MISCELLANEOUS:
John Cope addressed the Commission and discussed the anticipated
disposition of City surplus property on the northwest corner of
Florida and Yorktown Avenue. Mr. Cope indicated that the property is
designated medium density on the General Plan and that no civic
facilities or City use is anticipated by the City at this time and
therefore recommended that its disposition would be in conformance
with the General Plan. Commissioner Boyle expressed his concern that
stated policies in regard to findings of consistency with the General
Plan on surplus properties was not being adhered to. It was there-
fore the consensus of the Commission that a report be submitted to
the Commission and the item placed on its next agenda. Staff con-
curred and indicated that this item would be brought back at a
future meeting.
ORAL COMMUNICATIONS:
Jim Hensley, a resident of Huntington Beach, discussed the Redevelop-
ment Plan and asked for clarification on what it entails.
COMMISSIONERS'COMMENTS:
There was a discussion among the Commissioners on the Redevelopment
Plan and the role the Planning Commission plays in it.
STAFF'S COMMENTS:
Acting Secretary Selich stated that he would be editing and
distributing the ULI Report from Palm Beach which would contain
a brief biographical background on the panelists.
