Feltrop To permit the establishment of a wholesale worm farm pursuant to Section 9530.2(c) of the Huntington Beach Ordinance Code, located at the east side of Palmdale Street approximately 180 feet south of Cain Avenue in an Ml, Light Industrial District. Chairman Crosby informed the Board that this request is exempt from environmental review per Section 15060 of the California Environ- mental Guidelines. The Chairman reopened the public hearing. Kenneth Feltrop was present at the meeting. There being no other persons present to speak for or against the proposal, the public hearing was closed. Secretary Palin reported that notice has been received from the office of the City Attorney that the litigation on subject property has been resolved. The Board reviewed the application with Mr. Feltrop, and he was informed that the Building Department will re- quire a more definitive plot plan showing the location of the build- ing in relation to -the property line. Street improvements were discussed and the applicant informed that, unless he filed a tenta- tive parcel map to segregate his parcel from the total property, he would be liable for improvements on the entire frontage. Board of Zoning Adjustments October 20, 1976 Page 2 ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-54 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated September 14, 1976, shall be the approved layout. In its approval action,,the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; • Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. The developer shall participate in the local drainage assessment district. 3. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Palmdale shall be improved to the centerline of such right- of-way. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-56 (Cont. from 10-6-76) Applicant: Superlative Development Company To permit the construction of two (2) duplex dwellings abutting an arterial street pursuant to Section 9201.4 of the Huntington Beach Ordinance Code, located on the north side of Warner Avenue between Lynn Street and Hoskins Street in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman reopened the public hearing. There being no one pre- sent to represent the application nor anyone to speak for or against the proposed project, the public hearing was closed. Secretary Palin reported that revised plans as requested have not been received from the applicant, and recommended a continuance to permit said plans to be submitted. ON MOTION BY CROSBY AND SECOND BY LIPPS USE PERMIT NO. 76-56 WAS CONTINUED TO THE REGULAR MEETING OF NOVEMBER 3, 1976, BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-55 (Cont. from 10-13-76) Applicant: Family Home Builders To permit the construction of an 82-unit apartment building pursu- ant to Section 9320 of the Huntington Beach Ordinance Code, located on the northwest corner of Wichita Avenue and Huntington Street in an R2-O-CD1 Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-81. The Chairman reopened the public hearing. John Mandrell and Dennis Taylor were present at the meeting. Mr. Mandrell presented two alternate plans, B and B1, drawn respectively to include or exclude the present street right-of-way at the northwesterly corner of the project, and discussed the layouts as shown on said plans. Extensive discussion among the Board members and the applicants followed in regard to the fact that the number of units on this plan is totally contingent upon the ultimate configuration of the precise plan of street alignment and the applicant's success in obtaining portions of street right-of-way which are under consider- ation for vacation by the City. It was pointed out that the plans presented are not accurately dimensioned, making it impossible to determine whether proper open space, building separations, and setbacks have been provided for. Secretary Palin indicated a willingness'to approve an alternative in concept only, with a revised plan to be resubmitted showing dimensions through the buildings, from buildings to drives, drive widths, sidewalk widths, dimensions of the green areas and recrea- tion areas. After further discussion John Mandrell said he would prefer a week's continuance, in order to dimension the plans and tighten the layout as much as possible without going into the final design. ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-55 WAS CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE REGULAR MEETING OF OCTOBER 27, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-49 (Cont. from 10-13-76) Applicant: Arciero & Sons, Inc. To permit a reduction in the required open space minimum dimension per Section 9103.3.1.1.3, from-25 feet to a minimum of 14 feet, 6 inches, with an average of 19 feet, located at the northwest corner' of Vineland Drive and Greentree Lane in an Rl, Low Density Residential District. Chairman Crosby informed the Board that this request is a Categori- cal Exemption, Class V, California Environemntal Quality Act, 1970. The Chairman opened the public hearing. Al Arciero was present, explaining that conformance with code would require a 25-foot high retaining wall at the rear of subject property. There being no other persons to speak on the project, the public hearing was closed. In the ensuing Board review the topographical constraints on the property were,considered; it was also noted that the applicant has ,provided the required open space at another location on the lot. Board of Zoning Adjustments October 20, 1976 Page 5 ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-49 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDI- TIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The unique topographic features, both of the subject property and the property to the west, make it prohibitive to increase the flat open space dimension to twenty-five (25) feet because of the difference in grade between the two properties. 2. The treatment applied for will afford the 1200 square feet of flat, usable open space area as required by Ordinance Code, as well as providing a much more aesthetic treatment through the shorter retaining wall with landscaping between the retaining wall on subject property and the retaining wall to the west. '3. The granting of this request will not be detrimental to the health, safety, or welfare of persons residing or working in the area. CONDITIONS OF APPROVAL: 1. The plot plan received and dated September 28, 1976, shall be the approved layout. AYES: PALIN, CROSBY, LIPPS NOES: NONE. ABSENT: NONE USE PERMIT NO. 76-59 Applicant: P4ark W. Gill To permit the establishment of a restaurant in an existing build- ing pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approxi- mately 1080 feet north of Anderson Street in the C4, Highway Com- mercial District. Chairman Crosby informed the Board that this request is a Categori- cal Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mark Gill was present at the meeting, as well as Mr. Hagen, property owner of subject site. The applicants explained the proposal to convert an exist- ing residence on the property. There being no persons to speak ' for or against the proposed project, the public hearing was closed. Board review ensued, considering setbacks of buildings from property lines, landscaping and parking, separation between build- ings, and required fire walls. BZA 10-20-76. Page 5 . Minutes, H.B. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-59 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping requirements on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. : 3. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and dev- ices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 4. The developer shall participate in the local drainage assess- ment district. 5. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Pacific Coast Highway shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Hunting- ton Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The separation fence and/or wall between the proposed pro- ject and the property to the north shall comply with the height restrictions for interior property lines and those heights necessary for construction of the wall within the front yard setback.- 2. The plan shall be revised to increase the landscaping in compliance with Article 979. 3. The property shall be fully improved in compliance with Article 979 in regard to parking, access, turning radius, and striping. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-94. Don Baker was present at the meeting and indicated his receipt of and concurrence with the suggested conditions of approval. ON MOTION BY CROSBY AND SECOND BY PALIN THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-94 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-48 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on October 8, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Heil Avenue and Saybrook Lane shall be dedicated to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. Gerald Jones was present at the meeting. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-93. Board review found the project to be in compliance with applicable code provisions. Reciprocal access and existing easements were reviewed and discussed. ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-93 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-152 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. Chairman Crosby informed the Board that this request is a Categori- cal Exemption, Class III, California Enviornmental Quality Act, 1970. No one was present at the meeting to represent the application. The request was reviewed by the Board. Secretary Palin discussed the inadequacy in width for front access to the unit on Lot 605. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-153 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated October 7, 1976, shall be the approved layout. C. GENERAL CONDITIONS: 1. That area between the front entry and the front property line on Lot 607 shall have an easement granted to Lot 605 for pedestrian access, and the proposed fence across this three _(3) foot side yard shall be moved towards the rear property line to a location approximately opposite the front entry on Lot 605. Board review found the proposed Project to be in compliance with applicable code requirements. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-154 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated October 7, 1976, shall be the approved layout. Chairman Crosby informed the Board that this request is covered by EIR 72-4. T. G. Tupman was present to represent the application. The request was reviewed in regard to parking and landscaping pro- posed to be provided for the model complex. ON MOTION BY LIPPS AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-155 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1.
