Applicant: Family Home Builders
To permit the construction of an 81-unit apartment building pursu-
ant to Section 9320 of the Huntington Beach Ordinance Code,
located on the northwest corner of Wichita Avenue and Huntington
Street in an R2-0-CD, Medium Density Residential District.
Chairman Crosby informed the Board that this request is covered
by Negative Declaration No. 76-81.
The Chairman reopened the public hearing. John Mandrell and Dennis
Taylor were present at the meeting and submitted revised plans
as requested. There being no other persons to speak for or against
the proposed project, the public hearing was closed.
Secretary Palin reviewed the revised plans for the Board's informa-
tion, noting that the alternative plans are now sufficiently dim-
ensioned and also that -they reflect the one -unit reduction from 82
units to 81. He also informed the Board that a tentative parcel
map has been filed on the project and approval of the request must
be conditioned upon approval and recordation of that tentative map.
Treatment of the abandoned street sections was also discussed.
Bruce Crosby informed the applicants that it is the City's inten-
tion to pave 48 feet on Mansion Avenue (a 24-foot lane in each
direction). If the timing on the subject project is such that
construction will begin after letting of a cash contract for the
City street improvements, the developer will not be responsible to
the centerline of Mansion but will be required only to improve
that street to meet the improvements installed by the City.

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will not
be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the Master
Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received on October 20, 1976, and marked
as Alternate B-1 shall be the approved layout if the proponent
for the development is unsuccessful in gaining control of the
properties.at the northwesterly corner of the proposed project.
Should the proponent be successful in acquiring or gaining
control of said properties, the plan received and dated
October 26, 1976, and marked ris Alternate B, shall be the
approved layout for the 81 units in this development.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plans:
Traffic circulation and drives;
. Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Department of
Building and Community Development:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan, if applicable.
Said plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material proposed
to screen said equipment.

3. In accordance with the City's standards and requirements, addi-
tional right-of-way on the Mansion -Yorktown intertie, Huntington
Street, and Wichita Avenue shall be dedicated to the specifica-
tions of the Department of Public Works.
4. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the Depart-
ment of Building and Community Development and shall be subject
to approval by that Department.
5. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be submitted
to the Fire Department and shall be subject to approval by the
Departments of Fire and Public Works.
6.. The developer shall participate in the local drainage assessment
district.
7. All applicable fees shall be paid prior to issuance of building
permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Mansion Avenue, Huntington Street, and Wichita Avenue shall be
improved to the centerlines of such rights -of -way. Said im-
provement shall include curbs, gutters, sidewalks, paving,
street trees, street lights, street signs, street drainage,
and sewer and water main extensions, in full compliance with
the City of Iiuntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. The security apparatus for the entry off Wichita Avenue and
Huntington Street shall be submitted to the Fire Department
for review and approval prior to final inspection.
2. A tentative parcel map separating this property from property
held under the same ownership shall be filed and approved prior
to the issuance of building permits, and the parcel map shall
be recorded thereon prior to final inspection.
3. The drainage facilities for the development shall take into con-
sideration drainage for the tributary area to the north, as well
as providing for siltation and erosion control both during and
after construction of the project.

4. Fencing for the project for those areas fronting onto local
streets shall be submitted to the Board of Zoning Adjustments
for review and approval action prior to the issuance of building
permits.
5. The design and location of the vehicular access from Mansion
Avenue shall be subject to the approval of the Department of
Public Works.
6. If the developer elects to construct the meandering sidewalk
within the parkways as shown upon both plans, he shall enter into
a parkway maintenance agreement with the Department of Public Works
prior to approval of the offsite improvement plan.
7. If the developer proposes to provide air conditioning, the insu-
lation in ceilings and exterior walls shall be a minimum of R-19
and R-11, respectively. If no air conditioning is to be provided,
the insulation in ceilings and exterior walls shall be a minimum
of R-13 and R-7, respectively.
8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
offsite facility equipped to handle them.
9. Natural gas and 220V electrical shall he stubbed in at the loca-
tion of clothes dryers, and natural gas shall be stubbed in at
the locations of cooking facilities, water heaters, and central
heating units.

Chairman Crosby informed the Board that this request is covered by

USE PERMIT NO. 76-58 (In Conj./CE 76-51) (Cont. from 10-13-76)
Applicant: Rodney B. Lauter
To permit the construction of a six (6) unit apartment building
pursuant to Section 9161.4 of the Huntington Beach Ordinance Code,

Chairman Crosby informed the Board that this request is covered by

The Chairman reopened the public hearings on CE 76-51 and UP 76-58.
There being no one to speak on either application, the public
hearing was closed.
Secretary Palin reported that the applicant has asked for a contin-
uance on the two above items.

Applicant: Cager Properties, Inc.
To permit the construction of a 10-unit apartment pursuant to Sec-
tion 9320 of the Huntington Beach Ordinance Code, located on the
east side of Cameron Street approximately 320 feet south of Slater
Avenue in an R3, Medium -High Density Residential District.
Chairman Crosby informed the Board that this request is covered by
Negative Declaration No. 76-96.
The Chairman opened the public hearing. Craig Etcheboyen was
present to represent the application and explained the proposed pro-
ject. Owners of the adjacent property were also present. There
being no one else to speak on the project, the public hearing was
closed.
In its review of the application the Board considered what uses
are presently existing on adjacent sites, the access and layout
planned, and how the subject site was originally segregated from
the adajcent property. After extensive discussion it was the con-
sensus that the project should be continued to permit applicant to
submit a preliminary title report or some other proof of legal
separation and to allow staff time to research prior City action in
the area.

Applicant: Frank J. Mola
To permit the construction of an apartment building abutting an
arterial street pursuant to Section 9201.4 of the Huntington Beach
Ordinance Code, located on the north side of Adams Avenue approxi
mately 140 feet west of Huntington Street in an R3-0, Medium -High
Density Residential District.
Chairman Crosby informed the Board that this request is a Categ-
orical Exemption, Class III, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. Frank Mola was present at
the meeting. There being no other persons to address the Board on
the proposal, the public hearing was closed.
Board review touched upon the drainage on the subject site and the
elimination of lot lines where applicant is building across them.
Mr. Mola was also informed of the required ten by ten corner cut-
off and advised that the plan submitted for building permits
would require that balcony projections be indicated.

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The site plan and elevations received and dated October 12,
1976, shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered the
following issues relating to the conceptual plan:
. Traffic circulation and drives;
• Parking layout;
. Lot area;
• Lot width and lot depth.
. Type of use and its relation to property and improvements in the
immediate vicinity;
• Past administrative action regarding this property.
2. In accordance with the City's standards and requirements, the
following additional right-of-way widths shall be dedicated:
A 10 x 10 foot corner cutoff at the intersection of the two
alleys; a twenty (20) foot dedication off Lots 25 through 31;
a two and one-half (2-1/2) foot dedication off the side of
Lot 32; and a two and one-half (2-1/2) foot dedication off the
rear of Lots 25 through 32.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach

1. Adams Avenue, alley A, and alley B shall be improved to the
centerlines of such rights -of -way. Said improvements shall
include curbs, gutters, sidewalks, paving, street trees, street

lights, street signs, street drainage, and sewer and water main
extensions, in full compliance with the City of Huntington Beach

centerline of said alley to provide for the 25-foot turning
radius according to a determination to be made by the Director of
Public works.
C. GENERAL CONDITIONS:
1. A retention basin with a capacity of .7 acre feet shall be pro-
vided on subject site or upon adjacent property if under control
of the applicant.
2. Improvements on Adams Avenue shall be delayed until the drainage
system presently under construction is complete, for surface
drainage of subject property and the tributary area to the north.
3. A tentative parcel map shall be filed prior to the issuance of
building permits to eliminate the lot lines between Lots 25 and
26, between Lots 27 and 28, between Lots 29 and 30, and between
Lots 31 and 32. Recordation of said parcel map shall take place
prior to occupancy of subject project.

Following the above item, the Board discussed the extent of the
review which it should undertake on applications submitted under
the new requirements for projects abutting arterial highways. It
was determined that direction will be solicited from the Planning
Commission in regard to its intent in this area.
PLOT PLAN AMENDMENT NO. 76-8
Applicant: Four Seasons Farms
To permit an amendment to a previously approved plot plan for a
commercial horse facility pursuant to Section 9811.4 of the Hunting-
ton Beach Ordinance Code, located on the south side of ,Ellis Avenue
approximately 660 feet west of Goldenwest Street in an RA-O-CD,
Residential Agricultural District.
Chairman Crosby informed the Board that this request is a Categ-
orical Exemption, Class I, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. No one was present to dis-
cuss the project, and the public hearing was closed.

Applicant: Juanita Bray
To permit the 24-hour care of non -related persons in a single-
family home pursuant to Section 9730.27 of the Huntington Beach Ord-
inance Code, located on the east side of Dale Vista Lane approximately
60 feet south of Fountain Lane in an Rl, Low Density Residential
District.
Chairman Crosby informed the Board that this request is exempt from
environmental review per Section 15060 of the California State Envir-
onmental Guidelines.
The Chairman opened the public hearing. Juanita Bray, a Mr. Bonetti,
and a representative from the County Department of Social Services
were present at the meeting. Mrs. Bray addressed the Board to
outline the project, which she indicated will be for the care of
females from the ages of 18 to 64. Mr. Bonetti will be the manager
and will reside on the premises. There being no other persons to
speak on the project, the public hearing was closed.
Board review ensued.

uct Lane in a 100-M1-A-20,000, Restricted Manufacturing District.
Chairman Crosby informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Sid Lance was present at the meeting.
Secretary Palin noted that the request is an expansion on a previously
approved plan for the site, adding square footage on the building
and affecting landscaping and parking to a certain extent. The ex-
panded plan does comply with code requirements except that it does
not reflect adequate turning radius in the front of the building.
The Board reviewed with the applicant the possibility of a later
application to permit truck loading facilities on the site.

TENTATIVE PARCEL MAP NO. 76-49
Applicants: Joe and Geraldine Muniz
To permit a minor lot line adjustment to incorporate a 15-foot
wide strip of land into an existing parcel pursuant to Section 9921
of the Huntington Beach Ordinance Code, located on the west side
of Crystal Street approximately 145 feet north of Garfield Avenue
in an Ml-O, Light Industrial District.
Chairman Crosby informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality Act,
1970.
Joe Muniz was present at the meeting.
The Board reviewed the proposal, which involves consolidation of
a surplus strip of property to be disposed of by the City into a
parcel already under ownership of the applicant. Mr. Muniz indi-
cated his receipt of and concurrence with the suggested conditions
of approval.
ON MOTION BY CROSBY AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO.

grand opening event between the dates of October 27, 1976
and November 27, 1976, on property located at 16401 Beach Boule-
vard.
The Board reviewed the request. Walt Lipps cited the problems
the Building Department has had in the past in getting flags removed
after expiration of the permit, and suggested bonding for removal
as a condition on the approval.
ON MOTION BY LIPPS AND SECOND BY PALIN, THE ABOVE -NOTED SIGN
REQUEST WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING

CONDITIONS OF APPROVAL:
1. The sign plan received and dated October 27, 1976, shall be the
approved layout.
2. The applicant shall comply with all requirements of Article 976
of the Huntington Beach Ordinance Code.
3. A bond shall be posted with the Department of Building and Community
Development for the removal of the flags on the building roof of
the expiration of this sign approval on November 27, 1976. Said
bond shall be in the amount of 150 percent of the value of said
signs or $100, whichever is greater.
