Applicant: Superlative Development Co.
To;permit the construction of two (2) duplex dwellings abutting
an*arterial street pursuant to Section 9201.4 of the Huntington
Beach Ordinance Code, located on the north side of Warner Avenue

Chairman Crosby informed the Board that this request is a
Categorical Exemption, Class III, California Environmental Quality
Act, 1970.
The Chairman reopened the public hearing. No one was present to

Secretary Palin informed the Board that the applicant has requested
a continuance in order to determine whether or not a variance to

Ordinance Code, located on the east side of Bolsa Chica Street
approximately 1000 feet south of Warner Avenue in both an R2 and
an R3, Medium and Medium -High Density Residential District.
Chairman Crosby informed the Board that this request is covered
by Negative Declaration No. 75-77, adopted by the Board on December
31, 1975.
The Chairman opened the,public hearing. Frank Clendenen was
present at the meeting. There being no persons to speak for or
against this project, the public hearing was closed.
Board review ensued concerning drainage problems on the site, in-
cluding the amount of water subject property had been accepting
from the property to the north in the natural state before develop-
ment, methods of handling runoff to the south, and possible
participation of the -developer to the north in construction of
drainage facilities. It was the consensus that further information
was needed prior to a determination on the project.

The Chairman opened the public hearing. John Hawkins was present
to represent the application and explained the need for the signs
at the requested locations, citing economic advantages therefrom.
There being no other persons to speak for or against the proposal,
the"public hearing was closed.
The Board reviewed prior conditions of approval on the shopping
center.in which the subject project is.located and,discussed the
possibility of obtaining reciprocal easements to provide,inner cir-
culation as an alternative to,the"sign placement..IThe applicant
was also informed that in order to justify the request documenta-
tion regarding vacancy rates, tenant turnover, and revenues generated
would be required..

Chairman Crosby informed the Board that this request is a Cat-
egorical Exemption, Class V, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing. Darrell Rowe was present
at the meeting. There being no one present to speak for
or against the proposal, the public hearing was closed.-'
Board review of the ordinance code determined that the balconies
on a structure abutting a public waterway could be permitted to
go to zero setback, making the conditional exception application
unnecessary in this case. Also discussed was the future use of
the area of the structure over the garage and the surcharge on
the bulkhead which could result from the reduction in setback of
the structure. The applicant reported that he has checked with
Public Works and there will be no problem with the bulkhead.

Chairman Crosby informed the Board that this request is covered
by Negative Declaration No. 76-96.
The Chairman opened the public hearing. Craig Etchegoyen was
present at the meeting to represent the application. There being
no other persons present in regard to this project, the public
hearing was closed.
Roger Hosmer pointed out that if the buildings are moved any further
toward the rear property line it would be necessary to lengthen
the drive also; otherwise, the plan as submitted is acceptable to
the Fire Department.
The Board reviewed the request and discussed the field investiga-
tion of the project. The plan check indicates that the project is
in conformance with the minimum requirements of the ordinance code.

Secretary;Palin expressed his continuing dissatisfaction with
the layout, noting that although,the size and configuration of
the parcel do create some building constraints the Board should
not compound the problems in the field.which have resulted from

2. A landscape and irrigation plan shall be submitted to the
Department of Building and Community Development. Said plan
shall comply with Article 979 of the Huntington Beach Ordin-
ance Code and with landscaping specifications on file in the
Department of Public Works.
3. In accordance with the City's standards and requirements, an
additional ten (10) feet of right-of-way on Cameron Street
shall be dedicated.
4. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall be
subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or sys-
tems shall comply with the specifications of the Huntington
Beach Fire Code. Plans for such systems and devices shall be
submitted to the Fire Department and shall be subject to
approval by the Departments of Fire and Public Works.
6. The developer shall participate in the local drainage assess-
ment district.
7. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District.
8. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR.TO.FINAL INSPECTION:
1. Cameron Street shall be improved to the centerline of such
right-of-way. Said improvements shall include curbs, gutters,
sidewalks, paving, street trees, street lights, street signs,
street drainage, and sewer and water main extensions, in full
compliance with the City of Huntington Beach street standards
and requirements.
C. GENERAL CONDITIONS:
1. A tentative parcel map shall be filed and recorded on the
property prior to final occupancy..
2. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is to
be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.

3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. Natural gas,and 220V.electrical shall be stubbed in at
the location of clothes dryers, and natural gas shall be
stubbed in at the locations of cooking facilities, water
heaters, --and central heating units.

To permit the construction of a 4200 square foot commercial build-
ing -pursuant to Section 9472 of the Huntington Beach Ordinance
Code, located on the,west side of Beach Boulevard approximately
150 feet south of Utica Avenue in a C4, Highway Commercial District.
Chairman Crosby informed the Board that this request is covered
by Negative Declaration No. 76-97.
The Chairman opened the public hearing. Robert J. Long was pre-
sent to represent the application,and explained the proposed use
of the building for minor repair and installation of hardware and
special gear on boats. No trailer or hull assembly would take
place within the structure or the site. There being no other
persons present to speak on the:,proposal; thb'public hearing was
closed.
The Board reviewed the request. Roger-Hosmer cautioned the appli-
cant that no fiberglassing,spraying,,or other operations involving
chemicals would be permitted. 'Circulation on the site and methods
of providing adequate security systems were reviewed.

as defined by the Huntington Beach Ordinance Code, and for
the customizing of boats.
B. GENERAL CONDITIONS:
1. Office areas in the new building (if heated and/or air condi-
tioned) should be designed to exhibit the same thermal insu-
lation characteristics as required in similar structures
(i.e., R-19 and R-11 with air conditioning or R-13 and R-7
without air conditioning).

center pursuant.to.Section 9472 of ,the Huntington Beach Ordinance
Code, located at the northwest corner of Atlanta Avenue and
Magnolia Street,in a C4, Highway,Commercial;District. .
Chairman,Crosby,informed the Board that this,request is covered
by Exemption Declaration No. 74-135.
The Chairman opened the public hearing., Al Cruz, architect, and
Jerry Decker of W & D were present1to represent the application_
and expressed their -intention to construct the center with only
minor modifications to a previously approved layout,for the site.
They reviewed the architectural features, types of occupancy,
signing program,'and landscaping and parking for the project.
Mr. and Mrs. Sam'Elkins,,residents,of the neighboring' Signal Land-
mark tract, addressed the Board, questioning how the project
would affect the abutting property owners in regard to traffic
noise and security provisions. There being no other persons to
speak on the subject, the public hearing was closed.
Board review included discussion of main access points to the
project, handling of truck delivery,to the shops, traffic and
setback problems at the location of the future Savings and Loan
facility, fencing and landscaping for buffering of the project
from adjacent properties, and possible pedestrian access directly
into the project from the Signal adult,. community, which had been
one of the mitigating measures of the environmental impact report
approved for that project. Mr. and Mrs. Elkins expressed strong
opposition to any type of foot traffic from one development into
the other, saying it would create an invasion of privacy and a
danger to the security of the homes in the tract. It was deter-
mined that a survey should be'conducted 'in order to ascertain
the wishes of the majority of the homeowners in the Signal tract
in regard to the pedestrian access and the height of the separa-
tion wall needed between the two complexes.

WAS APPROVED WITH THE FOLLOVING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:

vicinity;

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan and elevations received October 28, 1976, shall
be the approved conceptual layout, subject to modifications
described herein:
a. If it shall be determined by a majority of the homeowners
within the adult community to the north that there is a
desire to have a pedestrian access into the subject devel-
opment from that community, the plan shall be revised to
facilitate the location of a gate with proper walkway
opening between the market and the shop area along the
northerly property line. Said gate and opening shall
be of a similar design to that shown on the plan sub-
mitted to the Planning Department on November 12, 1975.
b. The plan shall be revised to amend the location, config-
uration, and orientation of the Savings and Loan facility
in order to bring that facility into compliance with the
sight angle encroachment as well as to provide the
desired circulation for automobiles using the, drive -
through window and preclude the creation of a head-on
traffic conflict at that location.
C. The plan shall be revised to reflect a minimum three (3)
foot wide area along the northerly property line to
facilitate the planting of minimum 15-gallon trees on
forty-five (45) foot centers, the species of which shall
be determined by the Street Tree Superintendent.

d. The circulation pattern immediately south of the super-
market shall be reviewed by the Traffic Engineer for
possible conflicts and, if necessary, revisions shall be
made at that location to ,comply with his recommendations.
e. The most northerly driveway on Magnolia Street and the
most westerly driveway on Atlanta Avenue shall be rede-
signed to facilitate the radius curb return, pursuant to
City standards.
f. If a majority of the homeowners in the adult community
to the north prefer an eight (8) foot wall adjacent to
.,the two structures closest to the property line, the
separation wall shall be increased to a minimum of eight
(8) feet in order to attenuate noise generated by truck
deliveries.
A plan delineating said modifications shall be submitted to
the Board of Zoning Adjustments for review and approval
action.
2. Concurrently with the submittal of the revised plan•to the
Board, the developer shall stipulate the allowed.hours of
truck deliveries to the facility.
In its approval action, the Board•of,Zoning Adjustments considered
the following issues relating to•the,conceptual plan:
• Traffic circulation -and drives;
• Parking. layout;
• Lot area;
• Lot width and lot depth;;
• Type'of use and its -relation to property and improvements- in:the
immediate vicinity;
• Past administrative action regarding -this property.
3. A landscaping and irrigation plan shall be submitted to
the Board of Zoning Adjustments for review and approval
action. Said plan shall comply with the above -mentioned
conditions, with Article 979•of the Huntington Beach Ordin-
ance Code, and,with landscaping specifications on file in
the Department of Public Works.
4. A rooftop mechanical equipment screening plan -shall be sub-
mitted to the Department of Building and Community Develop-
ment prior to issuance of building permits. Said plan
shall indicate screening of all rooftop mechanical equipment
and shall delineate the type of•material proposed to screen
said equipment.
5. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the.
Department of Building and Community Development and shall be
subjecttD approval by that Department.
