PRESENTATION OF COMMENDATION TO EDWARD H. KERINS
Chairman Slates presented a plaque to former Commissioner Kerins
commending him for his service to the City. Mr. Kerins accepted the
plaque and expressed his appreciation.

Tallas Margrave addressed the Commission and discussed the delays
he had encountered in this request for a change of designation.

Chairman Slates stated that he was in receipt of a letter from
Grace Swartz favoring this request for redesignation. He opened
the public hearing. There being no one present to speak on this
area, the public hearing was closed.

CODE AMENDMENT NO. 76-8 - WINDSCREENS AND PROJECTING DECKS
This amendment was prepared to amend development standards and
criteria for allowing projecting decks and windscreens on water-
front lots.
Chairman Slates stated that the staff had recommended a continuance
on this code amendment to allow time for staff to contact more
homeowners in the affected area.
Commissioner Newman asked the Deputy City Attorney, John O'Connor,
if consideration had been given to"grandfathering in" windscreens
and projecting decks. John O'Connor stated that this had been
discussed.

Applicant: Signal Landmark, Inc.
This is a request to permit the construction of a 68 unit planned
residential development located on the south side of Yorktown Avenue
west of Newland Street.

The proposed 68 unit planned residential development is an integral
part of the total 103.9 acre parcel, Tentative Tract 7742.
The public hearing was opened.
Irwin Haydock, member of the Environmental Council, addressed the
Commission and express concerns of the project insofar as schools
are concerned and also egress onto Yorktown.
George Stringer, representing the applicant, addressed the Commission
and discussed the improvements to be made on Yorktown.
Virginia Parson addressed the Commission on the archaeological sites
and discussed with the staff how this was conducted.
Mike Zambory, Public Works Department, was requested to report in
further detail on Yorktown improvements to Mr. Haydock.

ON MOTION BY SLATES AND SECOND BY SHEA CONDITIONAL USE PERMIT NO. 76-27
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING
VOTE:
FINDINGS:
1. The proposed project of the 12.2 acre parcel of land zoned R2
(which allows 14.5 units per gross acre) is proposed to be con-
structed having only 5.6 units per acre.
2. The General Plan has set forth provisions for this type of land use
as well as setting forth objectives for implementation for this
type of housing.
3. The property was previously studied for this intensity of land use
at the time the land use designation for medium density residential
was placed on said property.
4. The parcel size, depth, frontage, street widths, and all other design
and improvements features of the proposed project are proposed to
be constructed in compliance with standard plans and specifications
on file with the City, as well as in compliance with the State
Map and supplementary City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. Conditional Use Permit 76-27 received and dated November 1, 1976
shall be the approved layout.
2. The sewer, water, and fire hydrant systems shall be designed to
City standards.

3. The water system shall be through the City of Huntington Beach's
water system.
4. The sewage disposal shall be through the City of'Huntington Beach's
sewage system.
5. The property shall be subject to the local drainage assessment
district requirements and fees.
6. All required improvements shall be constructed under the inspection
of and to the approval of the City Engineer. Cost of the in-
spection shall be paid by the subdivider. 3Z percent of the
amount of improvement bond shall be deposited with the City
Engineer for inspection cost.
7. All utilities shall be installed underground.
8. Drainage for the subdivision shall be approved by the Department
of Public Works prior to the recordation of a final map. This
system shall be designed to provide for siltation and erosion
control both during and after construction of the proposed project.
9. A decorative masonry wall shall be constructed to City speci-
fication along Yorktown and Coldwater. Said wall shall be six
inches wide and six feet high. The height of said wall shall be
measured from whichever side is higher at finished grade. The
architectural design of said wall shall be approved by the Planning
Department. The structural design shall be approved by the Depart-
ment of Public Works and shall be included as a part of the street
improvement plans. The intent of this condition is to improve
the street scene along Yorktown.
10. Landscape planter area shall be provided at locations along
Yorktown and Coldwater Lane as shown on the approved tentative
map. Such planter shall conform to the plans and specifications
on file with the Department of Public Works and the requirements
of the Planning Commission.
11. The developer shall install full street improvements on Coldwater
Lane with the exception that no sidewalk shall be constructed along
the westerly right-of-way lane at this time.
12. A 14 foot setback shall be provided from the ultimate right-of-way
of the adjacent arterial highways to the living quarters of the
units adjacent to such highways.
13. The structures shall be constructed in compliance with the State
Acoustical Standards set forth for multi- or attached units, for
all units that lie within the 60 CNEL contours on this property.

14. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum of
R-19 and R-11, respectively. If no air conditioning is to be'pro-
vided, the insulation in ceilings and exterior walls shall be a
minimum of R-13 and R-7, respectively.
15. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of.at an
offsite facility equipped to handle them.
16. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers. Natural gas shall be stubbed in at
the locations of cooking facilities, water heaters, and central
heating units.
17. Prior to any additional grading along the westerly property
line at the top of the existing slope bank on the proposed
project, a qualified archaeologist shall review the area for
artifacts, remnants, or burials.
18. An engineering geologist shall be engaged to submit a report
to the City indicating the ground surface acceleration from
earth movement for subject property.
19. All structures proposed for construction within this project
shall be constructed in compliance with the g-factors as
indicated by the engineering geologist's report.
20. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
21. A chemical analysis as well as tests for physical properties of
the soils on subject property shall be submitted to the City for
review prior to the issuance of building permits.

ZONE CASE NO. 76-24
Applicant: H.A. Chamberlain
This is a request from R3 to C2 on the north side of Owen Avenue and
west of Beach Boulevard.
The public hearing was opened.
Mr. Chamberlain, applicant, addressed the Commission and spoke in
behalf of his request.
Mr. Jameson, a resident in the area, addressed the Commission and
expressed concerns about traffic which a commercial use would generate.

ON MOTION BY BOYLE AND SECOND BY SHEA ZONE CASE 76-24 WAS APPROVED
WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE:
1. The requested change of zone implements the previously adopted
land use designation, and therefore is in conformance with the
General Plan.
2. The resultant land uses are enumerated in the Land Use Element
and provide for the highest compatibility with the existing
adjacent uses.

TENTATIVE TRACT 9617
Applicant: Mola Development
This is a request to subdivide approximately 3.1 acres of land into
an 8 lot medium density conventional subdivision. The subject
property is located on the north side of Heil at the intersection
of Algonquin and Heil.
It was the recommendation of the Staff that this application be
denied because the size, shape and configuration of the property
does not lend itself to the intended use for subdivision into
fourplex and triplex lots, and the layout and design of this pro-
posed subdivision is not physically suitable for the type of
development as some of the lotswould require approximately 45 per-
cent of the lot area to be used for vehicularaccess.
Mr. Mola, applicant, addressed the Commission and requested that
he be permitted to withdraw this application and work with the
staff to come up with a better plan.

COMMISSIONERS' COMMENTS:
Commissioner Boyle requested that he be apprised of the flooding that
occurs at the Mobilehome Park located at Garfield and Brookhurst.
Mike Zambory, Public Works, was requested to do this. It was noted
that the City Council had also requested a report on this.
Commissioner Gibson requested, with concurrence of other Commissioners,
that the staff submit policies for consideration which would encourage
the use of solar energy in the City. Staff will pursue with alterna-
tives.
Commissioner Gibson also stated that it would be helpful to Commission
if the staff would reference all of the elements in their findings.
The Commission discussed formalizing a Planning Commission Policy
Manual and the staff was directed to pursue this and report back as
soon as possible.
STAFF'S COMMENTS:
Acting Secretary Selich discussed the action taken at the November 15
City Council meeting.
