Secretary Palin reported that the applicant has contacted Pat

to indicate a desire for a continuance to permit time for further

Chairman Crosby reopened'the public hearing. Louis Graziadio
addressed the Board, discussing his approach to the project,and
his attempts to solve the problem of access to the site by the
use pf a reciprocal drive with the 6-plex project adjoining.
There being no other persons'to speak for or against the project,
the public hearing was closed.
The Board reviewed the project with the applicants, discussing
alternative access points and the need for the variance to permit
the plan as submitted.

PLOT PLAN AMENDMENT NO. 76-9
Applicant: James J. & Beverly H. Usey
To permit a plot plan amendment to allow an enclosed patio addi-
tion to an existing attached dwelling pursuant to Section
9811.4 of the Huntington Beach Ordinance Code, located on the
east side of Lures Lane approximately 100 feet north of Cornwall
Drive in an R3, Medium -High Density Residential District.
Chairman Crosby informed the Board that this request is a Cat-
egorical Exemption, Class III, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing. Mrs. Usey was present
at the meeting and described her proposed project. There being
no other persons present in regard to the project, the public
hearing was closed.
Board review ensued. It was noted that the file contains a letter
from abutting property owners indicating their approval of the
request. The Board discussed the proper procedures involved, and
it was determined that the application was unnecessary, as the
authority delegated by the City Council to the Building Department
for review of development rights within the planned developments
permitted ministerial issuance of building permits after evalua-
tion by that Department for compliance with code requirements.
Therefore, the request is to be referred to the Department of
Building and Community Development for review in conjunction with
criteria established by the City Council.

Mr. Casenza addressed the Board to indicate that the size and
shape of the subject property prohibits obtaining the required
open space and minimum dimension and constitutes a hardship on
the property owner. There being no other persons present to
speak on the proposed project, the public hearing was closed.
Board discussion included the intended use of the addition, the
necessary modification to footings to accommodate the second
story portion of the project, and the ratio of the proposed addi-
tion to the exisitng square footage of the dwelling (1200 exist-
ing, 1900 proposed to be added). It was the consensus of the
Board that an area of that size could not be added to a rectangu-
lar lot of equal square footage; therefore, no hardship exists
because of the shape of the lot.
ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION
NO. 76-58 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. Applicant has failed to justify sufficient hardship to allow
granting of the request for exception (the justification
presented by the applicant has been determined by the Board
to be a self-induced hardship).
2. Granting of this conditional exception would constitute grant-

Secretary Palin reviewed the intent of the Planning Commission
when the reduced setback was originally allowed on initial con-
struction. Review of the plan revealed that construction of the
fence parallel to the house as indicated by the applicant would
result in a setback at the edge of the garage of less than three
feet. Alternate layouts were reviewed with the applicant.
ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
76-60 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. Applicant has failed to demonstrate sufficient hardship to
justify granting of this request.
2. Granting of the conditional exception would constitute grant-
ing of special privilege not enjoyed by other property owners
in the general vicinity.
3. There is sufficient area upon which an enclosed front yard
could be provided and still comply with the initial approval
of the subdivision in which the subject property is located.

Chairman Crosby informed the Board that this request is covered
by Negative Declaration No. 76-59, adopted by the Planning Com-
mission on August 3, 1976, upon approval of TT9404.
George AINarez was pres.int at the meeting and said that the appli-
cant: has received and does concur with the suggested conditions
of. approval. Bruce Crosby requested modification of Condition #3
to =nclude street improvements, to which the applicant agreed.

The Board reviewed the request with the applicant, discussing the
separation between the main and the accessory buidings, the turn-
ing radius off the alley, and the requirement for filing of a
conditional exception when attachment takes place for the future
addition.

To permit trucking and loading facilities of an industrial build-
ing to face a public street pursuant,to Section 9518 of the
Huntington Beach Ordinance Code, located on the west side of
Chemical Lane approximately 550 feet south of McFadden Avenue in
a 100-Ml-A-20,000, Restricted Manufacturing District.
Chairman Crosby informed the Board that this request is covered
under EIR 73-16, adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Evan James was present at
the meeting and addressed the Board to explain the layout and use
of the proposed facility. There being no one else present to
address the Board on this request, the public hearing was closed.
Board discussion took into consideration the possibility of block-
ing of access during loading and unloading operations, with alterna-
tive methods of control being discussed.

APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-

played on the interior of the building.
The plan submitted to the Department of Building and Com-
munity Development upon application for building permits
shall have the above revisions delineated thereupon.

Manufacturing District.
Chairman Crosby informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Board review found the application to be in conformance with provi-
sions of the ordinance code.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO.
76-165 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated November 2, 1976, shall be
the approved layout, subject to the modifications outlined
in the Conditions of Approval for Use Permit No. 76-70.
In its approval action, the Board of Zoning Adjustments considered

2. The following plans shall be submitted to the Department of
Building and Community Development upon application for
building permits:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan, if applic-
able. Said plan shall indicate screening of all rooftop
mechanical equipment and shall delineate the type of
material proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall
be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler Sys
terns, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection device
or systems, shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and Public
Works.
5. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Street trees shall be installed concurrently with construction
of this project, in conformance with the Conditions of Approval
imposed upon TT 6948.
C. GENERAL CONDITIONS:
1. The overhead doors at the rear of the building shall be kept

Walter Frome was present to represent the application, and. indi-
cated his receipt of and concurrence with the suggested conditions
of approval. The Board discussed the parcel to the north of sub-
ject site, noting that approval of the tentative parcel map as
submitted would constitute creation of a legal parcel of that ap-
proximately 7.3 acre site and make it possible to convey it at a
later date. Secretary Palin recommended that it be made a part of
