HomeMy WebLinkAbout1976-11-24MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, NOVEMBER 24, 1976 - 1:15 PM BOARD MEMBERS PRESENT: PALIN, CROSBY, BRUENING CITY STAFF PRESENT: CHUCK BURNEY, FIRE DEPARTMENT MINUTES: ON MOTION BY PALIN AND SECOND BY CROSBY, THE MINUTES OF THE REGULAR MEETING OF OCTOBER 13, 1976, WERE APPROVED AS TRANS- CRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY NOES: NONE ABSENT: NONE ABSTAIN: BRUENING REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 76-61 Applicant: Stan's Construction To permit a four (4) foot encroachment into the required ten (10) foot rear y4rd setback in lieu of Section 9103.3 of the Huntington Beach Ordinance Code, located on the south side of Carlow Drive approximately 70 feet west of Dundalk Lane in an R1, Low Density Residential District. Chairman Crosby informed the Board that this request is a Categori- cal Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Elmer E. Fetty, owner of the subject property, was present to represent the application. Mr. Fetty addressed the Board to explain the layout of the addition; he also noted that the project is needed for the care of a handi- capped child. There being no other persons to speak on the proposed project, the public hearing was closed. Secretary Palin reported that a field check had been made and the abutting residence had been granted an exception for a reduced rear yard setback in 1968; he also noted that proper separation will remain between the adjoining residence and the proposed addition to subject property. The Board also considered the size and orienta- tion of the remaining open space on the property. ON P'IOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 76-61 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments November 24, 1976 Page 2 FINDINGS OF THE BOARD: 1. The adjacent lot was previously granted a conditional excep- tion for a six (6) foot rear yard setback; therefore, granting of the subject request does not constitute granting of special privilege but only provides parity with the adjoining property. 2. The addition will provide a separate bedroom and play area for a handicapped child, and the configuration of the expan- sion will provide for the necessary constant observation and supervision of that child. 3. The granting of a -conditional exception will not be materially detrimental to the public welfare of injurious to property in the same zone classifications. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received November 9, 1976, shall be the approved layout. Chairmai. C'..osby informed the Board that this request is covered by Negatix-- Declaration No. 76-77, adopted by the Board on December 3i, 1975. The Chairman opened the public hearing. Frank Clendenen was pre- sent at the meeting and addressed the Board to inform them that the drainaUe problems on the site have been worked out to the satisfaction of the Department of Public Works. Board of Zoning Adjustments November 24, 1176 Page 3 Bruce Crosby informed the Board of the requirement for a pipe within a dedicated public easement to carry drainage; he also reminded the applicant of the necessary setbacks from that ease- ment line and cautioned that it might affect placement of units. Mr. Crosby emphasized that no surface water from this project is to drain into Greenleaf Lane. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-65 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1._ The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received November 23, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; . [larking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immedl.ite vicinity; . Past a,lministrative action regarding this property. 2. A landscape and irrigation plan shall be submitted to the Secretary of the Board. Said plan shall comply with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. BZA 11-24-76 Page 3 Minutes, H.B. Said reports shall be submitted to the Department of Building and Communitv Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire,Code. Plans for such systems and devices shall be submitted:to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assess- ment district.- 6. The developer shall participate in the Orange County Sanitation District #11 Sewer Annex District. B. GENERAL CONDITIONS: 1. A copy of the report prepared by the applicant's geological consultant shall he Submitted to the Department of Public Works. 2. Borings as specified'by-the Department of Public Works shall be taken and the results submitted to said Department in con- junction with issuance of grading permits. 3. A ten (10) foot easement shall be:provided along the easterly portion of the development- to.facilitate installation of the twenty-four (24) inch storm drain system. 4. Drainage for the project shall he approved prior to the issu- ance of building permits, said drainage plans to include provisions for siltation and erosion control both during and after construction -of the project. 5. If the developer proposes to redesign the bunker area on the subject property and use it as a recreation room rather than covering it with earth and adding it to the open space, the proposed exiting from said recreation room shall comply with Building and Fire Department requirements. 6. A six (6) foot high masonry wall shall he constructed at locations along,the easterly property line where no wall exists at the present time. 7. The wall of the garages constructed at zero setback shall not exceed nine (9) feet in height from the finished grade on the abutting property to the east. -I I -I rz ,,- 0 Minutes, H.S. The intersection of the east -west drive along the northerly portion of the proposed development with the north -south drive along the easterly portion of the development shall be reviewed by the Fire Department for proper inside and outside turning radius to facilitate access for fire -fighting apparatus. 9. The Board of Zoning Adjustments shall have further review of the garages on the east, north, and south property lines, both of height and architectural treatment of the garages located at zero setback on the easterly property line and for review of the treatment on the break in pad elevations of the garages on the northerly side of the development. 10. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off'site facility equipped to handle them. 12. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural qas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 13. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 14. All structures proposed for construction within this project shall be constructed in compliance with the g-factors as indicated by the geologist's report. 15. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. 16. use of energy -saving lighting, such as high pressure sodium v,Ipor lamps, should be considered in parking lots and recreational areas. 17. Crime prevention techniques should be applied to the design aspec._s of the project (e.g., AYES: PALIN, CROSBY, BRUENING NOES : NONE ABSEN2: NONE single -cylinder locks, etc.). Board of Zoning Adjustments November 24, 1976 Page 6 CONDITIONAL EXCEPTION NO. 76-55:(Cont. from 11-10-76) Applicant: ABS Development #2 To permit tenant identification wall signs to face interior property lines in lieu.of Section 9760.2.17 of the Huntington Beach Ordinance Code, located on the west side of Gothard Street approximately 140 feet north of Edinger Avenue in a C4, Highway Commercial District._ Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Bill Burke was present, to represent the application and presented elevations of the pro- posed signs. He informed the Board that he has contacted Mr. Murdy, owner of the total property, in regard to reciprocal easements, and the owner is amenable to the suggestion if the applicant can obtain agreement from the developers of the remain- ing parcels. However, he has not been able to obtain such agree- ments. There being no -other persons present to speak for or against the proposed signs, the public hearing was closed. Board discussion ensued, again taking into consideration the original conditions for easements imposed upon the property and the proposed signing. Secretary Palin expressed the opinion that the continuing use of variances for signing on uses in the subject shopping complex should be brought to the attention of the Planning Commission and left to the discretion of that body to establish a policy on such variances vs. the use of easements for access between parcels.. The applicant was.instructed that -he should prepare statistical data sufficient to justify his claim of economic hardship. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-55 WAS REFERRED TO THE PLANNING COMMISSION TO APPEAR ON ITS AGENDA ON DECEMBER 7,, 1976, AT THE HOUR OF 7:00 PM OR AS SOON THEREAFTER AS IT MAY BE SCHEDULED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, BRUENING NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-51 (In Conj./UP 76-58, Cont. from Applicant: Rodney B. Lauter 11-17-76) To permit: a) a fifteen (15) foot front yard setback for a build- ing on a six (6) unit apartment complex'in lieu of the required twenty (20) feet, per Section'9320.6 of the Huntington Beach Ordin- ance Cade; b) a twenty-five (25) foot driveway width in lieu of the required twenty-eight (28) feet per Section 9320.8(c)of the Huntington Beach Ordinance Code; c) a reduction of 15 percent BZA 11-24-76 Page 6 Minutes, H.B. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 74-14, adopted by the Board on pre- vious hearings on this project. The Chairman opened the public hearing. Mr. Lauter was present at the meeting. There being no one else to speak for or against the proposed project, the public hearing was closed. Secretary Palin reported to the Board that the plans for this proposed project have been revised to comply with previous dis- cussions and have now incorporated all the previous actions on the project into the two applications presently under considera- tion. Action on these requests will eliminate prior approvals on any previous applications. Review of the plan check now finds the plan to be in substantial conformance with code requirements for coverage, open space, density, etc. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-51 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Granting of the variance for the front yard setback will grant parity with the existing front yard setbacks in the area for parcels of the same size and configuration. 2. A number of years ago prior to amendments in the ordinance code, a project was approved on subject property which, if the appli- cant had pursued development at that time, would have permitted development of a complex with more units, less open space, and additional reductions in all setbacks. 3. The total number of units within the complex is such that the full twenty-eight-(28) foot drive width is not necessary. 4. The applicant has provided a turnaround area in compliance with code provisions sufficient to facilitate access for emergency vehicles. 5. The reduction in common open space area is justified through the addition of private open space areas by means of private patios for each unit. BZA 11-24-76 Page 7 Minutes, H.B. The revised plan received and dated November 8, 1976, shall be the approved layout for the ultimate development of the total site through the use of a reciprocal driveway `easement across the southerly portion of the northerly parcel and the northerly portion of the southerly parcel to a depth of approximately one hundred and seventy-five (175) feet into the complex. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Lauter, To permit the construction of a six (6) unit apartment building pursuant to Section 9161.4 of the Huntington'Beach Ordinance Code, concurrently with the addition of one (1) unit to an existing non -conforming four (4) unit apartment complex pursuant to Sec- tion 9715 of the Huntington Beach Ordinance Code, and providing a reciprocal drive between the two apartment complexes, located oil the west side of Delaware Street approximately 245 feet north of Yorktown Avenue in an R2, Medium Density Residential District. Chairman Crosbv informed the Board that this request is covered by Negative Declaration No. 74-14, adopted by the Board on pre- vious rearings on this project. The plan now provides use of reciprocal drive for the six units on the southerly 55 feet of the lot, allows the split of one unit on the northerly 55 feet, and conversion of the single-family dwelling on the property into a duplex. Plan check found the plan to be in substantial conformance to code requirements. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. John Cowles was present at the meeting to represent the application. There being no other persons to speak in regard to the proposed project, the public hearing was closed. The Board reviewed the elevations and treatment of the subject project. Also discussed were the future bike trail on the arter- ial and its effect on onstreet parking, the power pole located in front of the parcel, and access to the project. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. Whether or not the onstreet parking as shown on the plan will be permitted will be at the discretion of the City Traffic Engineer. If it is not allowed, a revised plan shall be submitted to the Building Department depicting the revised onsite parking as required. 2. The wall on the entry drive shall be offset five (5) feet on either side of the proposed driveway. 3.. Reciprocal easements for ingress -egress and turning radius shall be provided. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-16, adopted by the Board on March 23, 1976. The Chairman opened the public hearing. George Alvarez was pres- ent at the meeting to represent the application and discussed the site plan. There being no other persons to speak in regard to the proposed project, the public hearing was closed. Board review included the treatment of the parkway and wall on Bolsa Chica, the relationship of the subject project with the ad- jacent development, dedication of Green Street through the project, and signing for the complex. Board of Zoning Adjustments November 24, 1976 Page 28 Dan Bruening explained that the proposed sign is to take the place of an originally approved sign which was never erected on the site. The sign is proposed next to an entrance on top of a mound, and does comply to code except that one foot will have to be removed to make it a legal height. The Board reviewed the sight clearance at the proposed location. ON MOTION BY BRUENING AND SECOND BY CROSBY THE ABOVE -NOTED SIGN REQUEST WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan and layout received November 24, 1976, shall be the approved layout. 2. Applicant shall comply with all applicable conditions imposed upon Use Permit No. 75-11. 3. The proposed height of the sign shall be reduced by one (1) foot. 4. Sign No. 5 as shown on -the previously approved plan shall be deleted and placed at the southwest corner of the main entry drive and Edinger Avenue.
