HomeMy WebLinkAbout1976-12-01MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, DECEMBER 1, 1976 - 1:15 PM BOARD MEMBERS PRESENT: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: ROGER HOSMER, FIRE DEPARTMENT MINUTES: ON MOTION BY PALIN AND SECOND BY LIPPS THE MINUTES OF THE REGULAR MEETINGS OF OCTOBER 20 AND OCTOBER 27, 1976, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT:NONE REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 76-64 (In Conj./UP 76-56) Applicant: Superlative Development Company To permit a reduction in the required turning radius to fifteen (15) feet in lieu of 25 feet, and a reduction in the required garage setback from the edge of a drive to zero in lieu of 5 feet per Section 9206.4 of the Huntington Beach Ordinance Code, located on the northwest corner of Warner Avenue and Hoskins Street in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Evans Ambro and Louis Graziadio were present to represent the application. Mr. Graziadio explained the objective of the reciprocal drive between this pro- ject and the abutting six -unit development and the difficulty of providing access to the subject site. There being no other persons present to speak for -or against the proposal, the public hearing was closed. The,Board reviewed the plan submitted and discussed possible alter- native layouts. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-64 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments December 1, 1976 Page 2 FINDINGS OF THE BOARD: 1. If designed to stand on its own, the plan would create a traffic hazard either by providing access from the local street and/or by providing reciprocal easements for ingress -egress from Warner Avenue for both Lots 1 and 2. 2. Granting of the exception will not set a precedent, nor will it be detrimental to the health, safety, and welfare of persons residing or working in the area. 3. Granting of the conditional exception does afford the property owner his property rights under the zoning ordinance. 4. The size, shape, and configuration of the subject site after dedication creates substantial hardship. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated November 18, 1976, shall be the approved layout, subject to the following: a. The easements on Lots 3 and 4 shall be as described in Exhibit A, Page 2, submitted November 18, 1976. b. An additional five (5) feet of easement shall be provided over the northerly portion. of Lots 1 and 2, as shown on the November 18, 1976 plans. c. A six (6) foot high masonry block wall shall be provided along the ultimate right-of-way line of Warner Avenue to a point to coincide with the wing wall proposed upon the elevations received and dated September 22, 1976, with the application for Use Permit No. 76-56. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. Board of Zoning Adjustments December 1, 1976 Page 3 USE PERMIT NO. 76-56 (In Conj./CE 76-64)(Cont. from 11-17-76) Applicant: Superlative Development Company To permit the construction of two (2) duplex dwellings abutting an arterial street pursuant to Section 9201.4 of the Huntington Beach Ordinance Code, located on the north side of Warner Avenue between Lynn Street and Hoskins Street in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman reopened the public hearing. Evans Ambro and Louis Graziadio were present to represent the application. There being no one else to address the Board in respect to the application, the public hearing was closed. The Board reviewed the request in light of the exceptions granted in CE 76-64. ' ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-56 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons -residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plan received and dated November 18, 1976, shall be the approved layout, subject to the reciprocal easements conditioned upon approval of Conditional Exception No. 76-64. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan:' . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Approval of this Use Permit shall be valid only as long as the accompanying Conditional Exception No. 76-64 is effective. 3. A landscaping and irrigation plan shall be submitted to the Department of Building and Community Development. Said plan shall comply with Article 979 and landscaping specifications on file in the Department of Public Works. 4. In accordance with the City's standards and requirements, the following additional dedication of rights -of -way shall be made: a. Thirty. (30) feet on Warner Avenue b. Thirty-three (33) foot radii at the intersections of Warner Avenue and both local streets C. One (1) foot on Hoskins Street d. Two (2) feet on.Lynn Street 5. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 1 6. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 7. The developer shall participate in the local drainage assess- ment district. 8. The developer shall participate in the Orange County Sanitation District #11 Sewer Annex District. 9. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Warner Avenue, Lynn Street, and Hoskins Street shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, BZA 12-1-76 Page 4 1 Minutes, H.B. Board of Zoning Adjustments December 1, 1976 Page 5 street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A masonry wall shall be constructed, as conditioned on Conditional Exception 76-64, on the arterial street. 2. Reciprocal easements shall be provided for ingress -egress, as conditioned on Conditional Exception No. 76-64. 3. Automatic garage door openers for parking spaces 1 and 2 of the six -units upon Lots 3 and 4 shall be provided. 4. Structures shall be in compliance with the transfer of noise requirements of those units located within the 60 CNEL contours of the subject property. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-62 Applicant: Valley Consultants To permit a five (5) foot encroachment in the required ten (10Y foot front yard setback per Section 9203.1 of the Huntington Beach Ordin- ance Code, located on the west side of Delaware Street, approximately twenty-seven (27) feet north of Elmira Avenue in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Ron Winterburn, Dr. and Mrs. David Schorr, and Jack Santiago were present to represent the appli- cation. Mr. Winterburn addressed the Board to explain how the en- croachment had come about and cited the expense of correcting the code violation. Jim Van der Hyden, owner of the adjacent property, addressed the Board in opposition to granting of the request because of the violation of the ordinance code involved and because it would constitute grant-' ing of special privilege and would adversely affect other properties in the vicinity. He also noted that the property has no size, config- uration, or topographical constraints which would justify granting of the request. There being no other persons present to speakifor or against the pro- posal, the public hearing was closed. BZA 12-1-76 Page 5 Minutes; H.B. Board of Zoning Adjsutments December 1, 1976 Page 6 The Board reviewed the request in regard to the self-imposed nature of the hardship and actions by the City on a prior violation of a similar nature in which the applicant had been required to bring his project into compliance. ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 76-62 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. No special circumstances exist as to the size, shape, and con- figuration of the subject property that would warrant granting of the Conditional Exception. 2. Granting of this request would constitute granting of special privilege not realized by other structures in the area. 3. It is readily apparent from a visual review without actual meas- urement that the structure is in violation of the ordinance code, and the building should have been correctly located prior to con- struction. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE 1 CONDITIONAL EXCEPTION NO. 76-63 Applicant: Coast Sign Display To permit the erection of a freestanding identification sign at the property line in lieu of the required 48 foot setback per Section 9763.3 of the Huntington Beach Ordinance Code, located on the west side of Goldenwest Street approximately 150 feet north of Warner Ave- nue in a C2, Community Business District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Jack Britton was at the meeting to represent the owner of the shopping plaza. Mr. Britton addressed the Board, saying that the plaza owner, the telephone com- pany, and Union Oil Company have all agreed to the location of the sign at the proposed site. He also indicated that the restaurant operator will remove the existing roof sign in the event the subject sign is approved. There being no other persons present to speak for or against the project, the public hearing was closed. The Board reviewed the request, taking into consideration the economic hardship claimed and whether or.not the requested sign would provide better visibility from Goldenwest as desired; the aggregate square footage within the center; and passible alternative locations for the sign. The legal setback requirements were also explained and discussed aith.the applicant's representative. It was the consensus of the Board BZA 12-1-76 Page 6 Minutes, H.B. Board of Zoning Adjustments December 1, 1976 Page 7 that insufficient information had been presented to substantiate the claim of economic -hardship. The relationship of the proposed sign to other uses and signs on the frontage was also reviewed. ON MOTION BY LIPPS AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 76-63 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. Granting of this request would constitute granting of special privilege not realized by other structures in similar locations. 2. The sign can be relocated to a site that will meet the code re- quirements and still provide proper identification for the use. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-73 Applicant: Vanderwood Associates To permit the construction of a five (5) unit apartment building abutting an arterial street pursuant to Section 9201.4(a) of the Huntington Beach Ordinance Code, located on the west side of Delaware Street approximately 79 feet north of Elmira Avenue in an R3, Medium - High Density Residential District. Chairman Crosby informed the Board that thisirequest is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Jim Van der Hyden was present to represent the application and described his project. There being no persons present to speak for or against the project, the public hearing was closed. The Board discussed missing dimensions on the plan, the ground floor patio areas, and the treatment of the roof and balconies. The applicant agreed to carry the mansard roof treatment around the corners of the building and to provide a tie-in with the top of the balcony for continuity of design. ON MOTION BY PALIN AND SECOND BY LIPPS USE PEIVIIT NO. 76-73 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. C014DITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan and elevations received and dated November 16, 1976, shall be the approved layout, as amended herein: A revised plan shall be submitted upon application for build- ing permits delineating the proper ground floor patio area for Unit 2. The revised plan shall also delineate the proper setback from the property line to the centerline of Delaware Street and the proper width of the parkways. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Maguire III To permit minor revision to a previously approved Planned Residential Development pursuant to Section 9811.4 of the Huntington Beach Ordin- ance Code, located on the north side of Pacific Coast Highway between Anderson Street and Admiralty Drive in an R2-PD, Medium Density Resi- dential District. Chairman Crosby informed the Board that this request is covered by Notice of Exemption No. 76-18, issued by the Department of Environmental Resources. The Chairman opened the public hearing. No one was present to speak in regard to the proposal. The public hearing was closed. Secretary Palin reported to the Board that the proposed revisions are required in order for the proponent to bring his development into compliance with requirements imposed by the Coastal Commission, and this request should be referred to the Planning Commission for review in conjunction with the scheduled revisions to the tentative tract map. ON MOTION BY PALIN AND SECOND BY CROSBY PLOT PLAN AMENDMENT WAS REFERRED TO THE PLANNING COMMISSION MEETING OF DECEMBER 7, 1976, BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 12-1-76 page 9 Minutes, H.B. Board of Zoning Adjustments December 1, 1976 Page 10 TENTATIVE PARCEL MAP NO. 76-59 Applicant: Ted R. Carpenter To permit a two (2) lot division of land pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the east side of Gothard Street approximately 600 feet north of Slater Avenue in an Ml, Light Industrial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-104, adopted by the Board on November 17, 1976, in conjunction with approval of A.R. 76-169. Ted Carpenter was present at the meeting and indicated he had received the suggested conditions of approval, with which he concurred after clarification of the timing of the street improvements on Gothard. Also reviewed by the Board was the method of draining the property and possible removal of large trees. Bruce Crosby informed the appli- cant that the Parcel 3 shown on the map should be removed. ON MOTION BY CROSBY AND SECOND BY PALIN, TENTATIVE PARCEL MAP NO. 76-59 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on November 17, 1976, shall be the approved layout, as amended to delete Parcel 3 from the map. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Gothard Street shall be dedicated and improved to City standards, Parcel No. 1 at the time of development of said parcel and Parcel No. 2 as determined by the Director of Public Works. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the•time said parcels are developed. 6. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-114. No one was present at the meeting to represent the application. Board review found the plan to be in compliance with code requirements in the Specific Plan Area. The provision of a six-foot walkway into the front of the units was discussed. ON MOTION BY PALIN AND SECOND BY LIPPS, NEGATIVE DECLARATION NO. 76-114 WAS ADOPTED BY THE BOARD BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-173 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan received and dated October 29, 1976, shall be the approved layout, subject to the modification described herein: A revised plan shall be submitted to the Department of Build- ing and Community Development upon application for building permits, said plan to indicate a three (3) foot area onsite as well as an adjacent three (3) foot easement, in order to provide a six (6) foot wide walkway access width to the front of each unit to be constructed upon subject site. Said plan shall comply with Article 979 of the Huntington Beach Ordin- ance Code and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley and a twenty (20) foot radius at the intersection of Olive Avenue and 20th Street shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall he submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. TO BE COMPLETED PRIOR TO FINAL, INSPECTION: 1. Twentieth Street, Olive Avenue, and the alley shall be improved to the centerlines of such rights -of -way. Said improvements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. Proof of the easements fot the six (6) foot walkway entrances shall be submitted to the Building Department prior to issu- ance of building permits. 2. The garage on Lot 301 shall have a three -sided parapet and/or mansard roof treatment to match the architectural treatment of the dwelling. 1 BZA 12-1-76 Page 12 1 Minutes, H.B. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. Natural gas and 220V electrical shall be stubbed in at the locations of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: 14ONE ADMINISTRATIVE REVIEW NO. 76-175 Applicant: Family Home Builders To permit the construction of a 21,300 square foot commercial office building pursuant to Section 9471.4 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard approximately 100 feet south of Ellis Avenue in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-113. Jim Corcoran was present to represent the application. The Board discussed the street to be installed by this applicant be- tween this property and an adjoining parcel under the same ownership, and reviewed the provisions for determining contiguity of parcels con- tained in the State Map Act. It was determined that a tentative parcel map would be required to separate the two adjacent developments. Review found the proposed project to be in conformance with code re- quirements, and the Board discussed the recommendations of the Depart- ment of Environmental Resources with the applicant. A rooftop mechanical equipment plan shall be submitted to the Department of Building and Community Development. Said plan shall indicate:screening,of.all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Soil and compaction reports shall be submitted -by a certified soils engineer. Said reports shall be submitted to -the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler sys- tems, standpipe.systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply -with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be sub- ject to approval by the Departments, of Fire and Public Works. 6. The developer shall participate in the Orange County Sanita- tion District ff3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Beach Boulevard and A Street shall be improved to the center- lines of such rights -of -way. Said_improvements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements'. C. GE14ERAL CONDITIONS: 1. A tentative parcel map shall be filed prior to issuance of building permits and recorded prior to occupancy of the subject project. 2. A decorative masonry wall in earth tones and of a minimum height of six (6) feet shall be constructed as a separation wall along the westerly and southerly property lines of subject property. 3. The final landscaping plan shall be in substantial compliance with landscaping on the preliminary plan submitted to the Board. 4. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in celings and exterior walls shall be a minimum of R-13 and R-7, respectively. In commercial and industrial projects, the "U" value of the structures shall offer the equivalent thermal insulation characteristics and may be calculated using ASHRAE methods. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material shall be disposed of at an offsite .facility equipped to handle them. 6. Use of energy -saving lighting, such as high pressure sodium vapor lamps, should be considered in parking lots and recreation areas. 7. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). Secretary Palin reviewed the proposed site revisions, which consist of addition of a passenger pickup area in front of the restaurant and widening of the street at that location by an extra 8 feet with a reduction of rear yard setback to 5 feet to provide for the widening. The sign plan was reviewed and found to be in conformance with code. ON MOTION BY PALIN AND SECOND BY CROSBY THE REVISED SITE PLAN AND SIGNING PROGRAM FOR USE PERMIT NO.' 75-61 WERE APPROVED BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-41 (Revised Plan) Applicant: J. A. Stewart Construction Co. Revisions to site plan for two industrial buildings located on the south side of Edinger Avenue approximately 450 feet west of Gothard Street in an Ml, Light Industrial District. Secretary Palin reported to the Board that the applicant is now re- questing to offset to provide some parking along the rear of the structures and to get,additional parking in the front by the staggered setbacks, as well as providing better identification for the uses. He also noted that the setback at the rear of Building B has been increased from 22 feet to the 28 feet required by the original condi- tions of approval, bringing the plan into compliance. Malt Lipps reported that the proposed sign meets code requirements. ON MOTION BY BY PALIN AND SECOND BY CROSBY THE ABOVE -NOTED SIGN REQUEST WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received and dated November 17, 1976, shall be the approved sign. 2. The sign shall be located at a legal location within a raised landscaping area. 3. The roof sign presently identifying said use shall be temporarily removed during the time that the subject freestanding sign is in operation. 4.
