property located on the north side of Warner Avenue approximately
200 feet west of Beach Boulevard.
The public hearing was opened.
Ron Hix addressed the Commission requesting clarification on the
request.
Jim Foxx addressed the Commission and requested that the area be desig-
nated R2-PD. He stated that he had 6.3 acres of property in escrow
and felt that the property could best be developed R2-PD rather than
R2.
David Dahl, representing L. Lindborg, owner of approximately 2 acres
in the area, spoke in favor of developing the property R2.
Ken King spoke in favor of developing the property as R2-PD. He
supported the development of the patio homes as proposed by Foxx.

Johnnie Demadarte spoke in behalf of a third property owner in this
area, stating that the property owner, Mrs. Rice, desired that the
land be zoned R2.

This is a request for a change of zone from RA-0---D, RA-0, Ml, R3 and
Cl to R2 and R2-0 located on the north side of Clay Avenue,south of
Garfield Avenue, east of Goldenwest Street and west of the Pacific Elec-
tric Railroad right-of-way, and also a change of zone from RA-0 to
M1-0 located on the north side of Garfield Avenue extending northerly
for a distance of approximately 183 feet between Goldenwest Street and
Crystal Street.

Mr. Chuck Balleson questioned the the zone case.
Mr. Bob Garvey, representing four owners, addressed the Commission and
requested that the property remain M1 since he want2d to expand his
business.
Mr. Jack Weid was in favor of Ml.
Don Wier addressed the Commission and stated that he was a land owner
and oil producer in the area and questioned the Staff and Commission on
oil operations. He was advised that he could continue oil operations
as a non -conforming use should the property be rezoned.

This is a reqest for a change of zone from Ml- A to R1 located on the
north side of Taylor Street approximately 660 feet west of Beach
Boulevard.
The public hearing was opened. A vugraph was shown.
Robert Miller inquired about the unsightly area which was proposed
at one time as a park site which abuts this property. He was in
favor of changing the zone.
Roxana Ross spoke in favor of single family housing.
Tom King spoke in favor of R1 zoning on this property.

The intent being to repeal Article 915 and establish new development
standards and provisions for the construction of single family homes
and triplex developments in applicable areas of the City.
Al Montes gave a brief summary of the latest proposal.

Michael Conder addressed the Commission and stated that he was in
favor of the recommendations.
Jim Foxx addressed -the Commission and suggested that if planned
development were allowed in the area a greater degree of flexibility
could be achieved.

Applicant: Frank J. Mola
This is a request for the construction of a handball/raquetball
club in conjunction with an office/professional complex. The
overall facilities would consist of four handball/racquetball
courts, and exercise room, locker and spa areas, and 5400 square
feet of office/professional floor area.
John Cope gave a brief history of this application.

Peter Von Elten, representing the applicant, addressed the Commission
and spoke in behalf of the development.
David Hanst read from the letter from Department of Transportation.
Art Nerio, Meadowlark Airport, spoke against the proposed development,
citing safety factors as the reason.
Olan Atherton, a pilot, stated that if there were any bright lights
coming from the proposed development they would present a hazard
to Pilots.
Neal Watts, a pilot, spoke against the proposed development.
Gordon Young, t-ie realtor representing the seller, addressed the
Commission ar-' ;poke in favor of approving the application.
Tom Paul, restaurant operator at the airport, spoke against the
application.

ZONE CHANGE NO. 76-25

Zone Change No. 76-25 is a requested modification to recently approved
Zone Change 76-01. This modification request will expand the C4
(Highway Commercial) zoning as the result of a deletion of approxi-
mately 3 acres of R2-PD zoning. These zoning revisions have resulted
primarily from the various governmental development processing pro-
cedures and approvals.
John Cope addressed the Commission and gave a brief background report
on this zone change request.

Mr. Maguire addressed the Commission and concurred with the staff's
recommendations.

1. The requested commercial zoning is consistent with the Commercial/
Residential land use designation of the General Plan.
2. The land uses resulting from the change in zone will be com-
patible with the proposed adjacent uses, and are also enumerated
in the Land Use Element.

PLOT PLAN AMENDMENT NO. 76-10

TENTATIVE TRACT NO. 6675 - REVISED
Applicant: Robert F. Maguire III
Plot Plan Amendment No. 76-10 is a request to permit revisions
to previously approved Conditional Use Permit No. 76-6. These
revisions are the result of reviews and approvals by the various
governmental agencies which have jurisdiction over the subject
property. They basically involve a reduction of 50 residential
units from the planned development portion of the project and
the installation of public walkways.
Revised Tentative Tract No. 6675 is primarily the result of the
deletion of these residential units and _the expansion of the
commercial/marina acreage as required by the various governmental
approvals. The tentative tract will subdivide approximately 35
acres into 30 lots.
John Cope briefly reviewed the above applications.

ON NOTION BY SHEA AND SECOND BY PARKINSON PLOT PLAN AMENDMENT
NO. 76-10 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL BY THE FOLLOWING VOTE:
Findings
1. The revised plan has not resulted in an increase in the number of
dwelling units, but has in fact been decreased by 50 units.
2. The proposed use of the property will remain the same, that is
a planned residential development and typical Rl subdivision.

the water, all result in an improved development proposal.

Conditions of Approval
1. The site plan received and dated November 10, 1976 shall be the
approved plan for the planned residential development.
2. All utilities shall be installed underground.
3. A decorative masonry wall shall be constructed to City specifica-
tions along Pacific Coast Highway along the boundary of the planned
residential portion of the development. Said wall shall be six
inches wide and six feet high. The height of said wall shall be
measured from whichever side is higher at finished grade. The
architectural design of said wall shall be approved by the Planning
Department. Structural design shall be approved by the Department
of Public Works and shall be included as part of the street improve-
ment plans.
4. The fencing materials for the separation fence and/or wall between
the planned residential and the commercial shall be subject to
review by the Planning Department for design and materials.
5. The exterior elevations of all buildings proposed for construction
within the Planned Development shall be subject to approval by the
Planning Department.
6. final details for the emergency access entries as well as gates
proposed for the entry of the planned residential development shall
be submitted to the Fire Department for review and approval action
prior to issuance of building permits.
7. The details for the emergency fire equipment between streets "C"
and "D" shall be submitted to the Fire Department for review and
approval action prior to the issuance of building permits.
8. The detailed landscaping plan for the development as well as the
treatment between the public street along the boundary of the Rl
and Planned Development shall be submitted to the Board of Zoning
Adjustments for review prior to the issuance of building permits
for treatment of the street section berming and separation wall.
9. If the devel(-.l_ r I-,j-)poses to provide air conditioning, the insulation
in ceilings and exterior walls shall be a minimum of R-19 and R-11
respectively. If no air conditioning is to be provided, the
insulation iT1 cp;l ings and exterior walls of all residential units
shall be a miniiau;n of R-13 and R-7, respectively.
10. Natural gas and 220V electrical shall be stubbed in at the locations
of clothes dryers. Natural gas shall be stubbed in at the locations
of surface units of cooking facilities and water heater and central
heating units within all residential units.

11. All residential structures on subject property whether attached or
detached shall be constructed in compliance with State acoustical
standards set forth for all units that lie within the 60 CNEL
contours of the property.
12. All building spoils such as unusable lumber, wire, pipe, and other
surplus and unusable material shall be disposed of at an offsite
facility equipped to handle them.
13. The CC&R's and association rules shall restrict the storage of
recreational vehicles from being located within any of the open
parking spaces within the planned residential portion.
14. The private open space area for Building Type No. 3 shall be
constructed having a minimum of 10-foot depth on ground floor patios
and shall retain the 160 square feet of balcony area as shown on
approved plans.
15. Each single family residential lot abutting upon water shall be
provided with plumbing facilities stubbing out through the bulkhead
of each lot: All other waterfront lots or residential units having
community dock and slip areas shall have sewage and pumping facilities
sufficient to accommodate the effluent from these areas, subject
to the approval of the Department of Public Works.
The commercial boat marina shall have sewage and pumping facilities
subject to the approval of the Department of Public Works.
1.6. Anderson Street shall be dedicated to the City of Huntington Beach
for public street purposes at a width no less than forty (40) feet
curb -to -curb.
17. The precise location and construction of the improvements for
Anderson Street shall be subject to the Department of Public Works
approval.
18. The developer shall be responsible for 50 percent (not to exceed
$20,000) of the cost to install a traffic signal at the intersection
of Anderson Street and Pacific Coast Highway.
19. A minimum ]? incli water main shall be installed in an easement
dedicated tc the City to the bulkhead in the vicinity of such

21. The design and materials to be used in the construction of the publi
beach area, public walkway system, and all natural habitat areas
shall be subject to review and approval by the Department of Public
Works and Planning Department prior to the issuance of building
permits for either the R1 or R2-PD developments.
22. The area designated for boat and recreational vehicle storage shall
be deleted from the plan.

ON MOTION BY SHEA AND SECOND BY PARKINSON TENTATIVE TRACT 6675 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY
THE FOLLOWING VOTE:
Findings
1. The proposed subdivision of this 35.85 acre parcel of land is zoned
R1, R2-PD, and C4 which allows 7 units per gross acre within the
Rl; 14.58 units per gross acre for the R2 and sets forth provisions
for development of commercial boating facilities as well as
commercial shopping centers in the commercial district and as this
development is proposed to be constructed having only 5.1 units
per acre in the Rl and 13.38 units in the R2-PD portion.
2. The General Plan has set forth provisions for this type of -land
use as well as setting forth objectives for implementation of this
type of housing and commercial development.
3. The property was previously studied for this intensity of land use
at the time the land use designation for low, medium density
residential and commercial were placed on said property.
4. The lot size, depth, frontage, street width and all other design
and improvements features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifica-
ti.ons on file with the City as well as in compliance with the
St,-t'.- reap Act and supplementary City Subdivision Ordinance.

4. The sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The property shall be subject to local drainage assessment district
requirements and fees.
6. Drainage for the subdivision shall be approved by Department of
Public Works prior to the recordation of the final map. This system
shall be designed to provide for siltation and erosion control
both during and after construction of the project.
7. Vehicular access rights shall be dedicated to the City of Huntington
Beach along Pacific Coast Highway except at street intersections
and the most southerly driveway to the commercial development.
8. An engineering geologist shall be engaged to submit a report indica-
ting the surface acceleration of earth movement for subject property.
9. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review
prior to the issuance of building permits.
10. A chemical analysis as well as test on physical properties on the
soil on subject property shall be submitted to the City for review
prior to the issuance of building permits.
11. All structures proposed for construction within the subdivision
shall be constructed in compliance with the g-factor acceleration
and the chemical and physical soils analysis.
12. Each single family residential lot abutting upon water shall be
provided with plumbing facilities stubbing out through the bulkhead
of each lot. All other waterfront lots or residential units
having community dock and slip areas shall have sewage and pumping
facilities sufficient to accommodate the effluent from these areas,
subject to the approval of the Department of Public Works.

This is a request to permit tenant identification wall signs to face

Edinger.

Jim Palin stated that he had received a request from the applicant to

John Cope stated that the Planning Commission at its meeting of September
21, 1976 conditionally approved the above applications. These approvals
allowed for the continued operation of existing commerical horse stables
located on Ellis Avenue on th, west side of Goldenwest Street.
Since these stiles were existing operations the Commission imposed
some deadlines for completion of the various conditions of approval.
It was determined that both applicants shall have all the necessary
requirements fulfilled prior to December 1, 1976, and that a status
review of each applicant's progress would be held on December 7, 1976.

John Cope noted those conditions on each application which had
not been met.
There followed a discussion between the Commission and the two
applicants on their problems in meeting the conditions of approval.
Mr. Hennes asked for a thirty day continuance and Commissioner
Shea stated that she felt he should be given a 30 day extension.
Further Commission discussion ensued.

This application is a request to permit the construction of a 50
unit planned residential development on the east side of Pacific
Coast Highway and north of Anderson Street.
John Cope stated that the staff had received a request from the
applicant for an extension of time on Conditional Use Permit
No. 74-15. The original approval date expired on November 4, 1976
for the Ccndi!:ional Use Permit, however, the Tentative Tract
Map 5813 doe: not :::spire until March 4, 1977.
Commission discussion ensued.

The Commission unanimously agreed to continue discussion on this item
to the December 21, 1976 meeting.
