Schwartz To permit the construction of a self-service car wash facility pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the north side of Warner Avenue approximately 400 feet west of Springdale Street in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption; Class III, Calfiornia Environmental Quality Act, 1970. The Chairman opened the public hearing. John Schwartz was present at the meeting and addressed the Board to express his concurrence with provision of inner circulation for the total project, instal- lation of landscaping to screen the use from the street, and use of architectural treatment to match the existing shopping center. There being no other persons to address the Board on this matter, the public hearing was closed. After review it was the consensus of the Board that the applicant had responded satisfactorily to the concerns previously raised on the project. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated October 18, 1976, shall be the approved layout, subject to the modifications described herein: a. A new eight (8) foot wide planter shall be constructed at the westerly side of the main entry drive from Warner Avenue westerly, to be at a perpendicular offset to the corner of the proposed structure. b. The driveways upon this plan shall be graded identically to and be tied into the driveways on the existing . property, in order to properly facilitate drainage and vehicular access. A plan delineating said modifications shall be submitted to the Department of Building and Community Development upon ap- plication for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating•to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscape and irrigation plan shall be submitted to the Department of Building and Community Development. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall. be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assess- ment district, if applicable. 6. All applicabld fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. The flood control channel shall be fenced in compliance with the conditions imposed upon the approval of Use Permit No. 68-15 on June 5, 1968, which authorized construction of the overall shopping center in which subject project is located. 2. The materials for the structure shall be of similar nature to those used within the existing shopping center. 3. Landscaping areas shall be provided as shown upon the site plan received and approved. 4. The parapet or roof treatment shall be of similar color and design to the design of the existing shopping center. 5. A tentative parcel map shall be filed and approved prior to issuance of building permits for the proposed facility. Said parcel map application shall incorporate reciprocal agreements for ingress -egress and, if necessary, parking (if the original approval carried a condition for an overall integrated parking plan for the total shopping center [UP 68-151). Elliott To permit an oil well activation pursuant to Section 15.40.020(B) of the Huntington Beach Municipal Code, located on the east side of Huntington Street approximately 500 feet south of Yorktown Ave- nue in an R2-0, Medium Density Residential combined with Oil Production District. Secretary Palin reported that the applicant has been contacted and has agreed to a further continuance to permit the City to arrive at a determination on the street alignment and park acquisition in the area. ON MOTION BY PALIN AND SECOND BY LIPPS OIL WELL ACTIVATION PERMIT NO. 76-7 WAS CONTINUED TO THE REGULAR MEETING OF DECEMBER 15, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-171 (Cont. from 11-24-76) Applicant: Michael Gesler & Associates To permit the construction of a fast food restaurant pursuant to Section 9430 of the Huntington Beach Ordinance Code, located on the west side of Brookhurst Street approximately 800 feet south of Garfield Avenue in a C2, Community Business District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-105. Michael Gesler was present at the meeting. Secretary Palin reported that the applicant has complied with pre- vious suggestions of the Board, incorporating easements for reciprocal access and for the storm drain easement along the south- erly property line. A parcel map has been filed on the property. Mel Ott instructed the applicant that there will be a requirement for extension of a water main and installation of a fire hydrant to serve the site. ON MOTION BY CROSBY AND SECOND BY PALIN THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-105, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 76-171 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: BZA 12-8-76 Page 4 Minutes, H.B. The plot plan received and dated December 3, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assess- ment district. 6. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. 7. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. A tentative parcel map shall be submitted to the City prior to the issuance of building permits. A chain link fence (or equivalent) with a minimum height of five (5) feet shall be constructed along the northerly line of t storm drain channel. 3. At the northerly property line of subject property there shall be a reciprocal easement for ingress -egress, with a minimum width of fifteen (15) feet on either side of the property line, for a total width of thirty (30) feet. 4. The elevations and photographs submitted with the application shall be the approved elevations, materials, and colors for the proposed facility. 5. If the developer proposes to'provide air conditioning, the* insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 7. Use of energy -saving lighting, such as high pressure sodium vapor lamps, should be considered in parking lots and recreatio areas. 8. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). To permit the construction of a 1920 square foot fast food rest- aurant pursuant to Section 9472 of the Huntington Beach Ordinance Cede, located on the south side of Warner Avenue approximately 150 feet west of Springdale Street in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-116. The Chairman opened the public hearing. Eva Sloan was present to represent the application. There being no other persons present to speak for or against the proposal, the public hearing was closed BZA 12-8-76 Page 6 Minutes, H.B. Board of Zoning Adjustments December 8, 1976 Page 7 The Board reviewed the height of the canopy in regard to clear- ance for trash trucks and circulation. It was noted that this parcel has 12 parking spaces for the use within the shopping cen- ter and that the agreement for these spaces is recorded in Book 9370, pages 930, 931, and 932 in the Orange County Recorder's office, and that these spaces bring the plan into compliance for required parking. ON MOTION BY PALIN AND SECOND BY LIPPS NEGATIVE DECLARATION NO. 76-116 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-74 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVPL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated November 18, 1976, shall be the approved conceptual layout, subject to the following modification: The trash enclosure area shall be reoriented to facilitate trash pickup from the west with a modification to the parking immediately adjacent thereto to facilitate an area for the trash truck access. The placement and construction of the landscaped area alongside the parking spaces to the west as well as between those park- ing spaces and the•one-way drive shall be as shown upon the approved plan. 3. The following plans shall be submitted to the Department of Building and Community Development for review and approval: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 4. Soil and 'compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department'of Building and Communitv Development and shall be subject to approval by -that Department. 5. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems,.fire.hydrants, fire alarm systems, and any other required fire protection and detection devices or systems, shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. C. The developer shall participate in the -local drainage assess- ment district.. 7. All applicable fees shall be paid prior to issuance of building permits. C. GENERAL CONDITIONS: 1. The landscaping areas shown outside of the boundary of the proposed project shall also be installed at the responsibility of the proponent for subject project, with irrigation to be included upon the landscaping plan submitted for approval on the facility. The subject facility shall comply with all covenants and restrictions on file and recorded with the Orange County Recorder's office for parking, signing, and compatibility of use for this facility. 3. Chairman Crosby informed the Board -that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. Ge.)rge Alvarez was present to represent the application. The Board reviewed the approaches to the units and instructed the applicant on the necessary widths for common drive access points. Also discussed was the type of separation to be provided between this project and the abutting development. The common drives shall be a minimum width of twenty (20) feet instead of the ten (10) feet shown. b. USE PERMIT NO. 76-75 (In Conj./AR 76-176) Applicant: Michael Janes To permit the construction of six (6) fourplexes and one (1) triplex abutting an arterial street pursuant to Section 9164.4 of the Huntington Beach Ordinance Code, located on the west side of Bolsa Chica Street approximately 200 feet north of Pearce Street in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. George Alvarez was present at the meeting. Board review of the elevations found that they did not comply with the standards the City is attempting to establish on the arterials, and alternative approaches were discussed. ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-75 WAS CONTINUED , WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF DECEMBER 15, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 12-8-76 Page 11 Minutes, H.B. Board of Zoning Adjustments December 8, 1976 Page 12 USE PERMIT NO. 76-76 (In Conj./AR 76-177) Applicant: Dunn Properties To permit truck and loading facilities to face a public street pursuant to Section 9518(a) of the Huntington Beach Ordinance Code, located at the southwest corner of Graham Street and Commer- cial Drive in a 100-PRl-A-20,000, Restricted Manufacturing District. Chairman Crosby informed the Board that this reauest is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened ,the public hearing. Ray Chermak was present to represent -the application. In response to concerns expressed by the Board, Mr. Chermak stated that it was the proponent's in- tention in this particular building to have all loading take place within the structure itself, with no projection of the rigs. The request is for two loading doors at grade level, in each case allowing the truck to penetrate the building. There being no other persons to address the Board in regard to the proposal, the public hearing was closed. The Board reviewed the request, noting that there might be enforce- ment problems. It was also noted that a portion of the outside loading area blocks the turning radius for two parking spaces, and Secretary Palin expressed the need for proof that the area would be properly sdr.iped and posted to assure that no trucks would be blocking the parking,access or projecting into the public right- of-way. The 9-inch setback was also reviewed, and alternative setbacks discussed with the applicant. It was the consensus of the Board that the request should be continued to permit time for the proponent to consider alternative layouts and to investigate what construction exists or is planned for the adjoining Lot 32, in order to provide more flexibility in setbacks and layout of the subject property. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-76 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGU- LAR MEETING OF DECEMBER 15, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-177 (In Conj./UP 76-76) Applicant: Dunn Properties To permit the construction of a 9,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located on the southwest corner of Graham Street and Commercial Drive in a 100-141-A-20,000, Restricted Manufacturing District. Ray Chermak was present at the meeting. In view of the continuation of the above Use Permit 76-76, it was the determination of the Board to continue this application for investigation of alternative layout. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-177 WAS CONTINUED TO THE REGULAR MEETING OF DECEMBER 15, 1976, WITH THE CONCURRENCE OF THE APPLICANT AND BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-77 (In Conj./AR 76-178) Applicant; Dunn Properties To permit truck and loading facilities to face a public street pursuant to Section 9518(a) of the Huntington Beach Ordinance Code, located on the north side of Business Drive at the northeast end of Chemical Lane in a 100-M1-A-20,000, Restricted Manufactur- ing District. Chairman Crosg informed the Board that this request is covered by EIR 73-16,_µzdopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Ray Chermak was present at the meeting. There being no other persons present to address the Board on this request, the public hearing was closed. Board review included the setback of the proposed loading facility from the street and the grade differential and retaining wall provided at that location. An architectural treatment similar to that upon the face of the building shall be incorporated into the doors, for aesthetic purposes. Mr. Lynch was present at the meeting, presenting a colored layout and explaining the proposed signing program, noting that the layout had been designed to be within the intent of the new signing ordin- ance adopted by the City Council at its most recent meeting. Secretary Palin noted that the layout has been drawn to scale as closely as possible to show exact sign locations and dimensions.
