Sterling Buck & Associates_ To permit the construction of a six (6) unit apartment building pursuant to Section 9162.3.2 of the Huntington Beach Ordinance Code, located on the west side of Torrey Lane approximately 500 feet north of Heil Avenue in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-14, adopted by the Planning Commis- sion on approval of TT8698. The Chairman opened the public hearing. Paul La Point was present to represent the application. There being no other persons to address the Board in regard to this project, the public hearing was closed. The Board discussed the phasing of the structures and timing of street improvements with the applicant. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGA- TIVE DECLARATION No. 76-14, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY SPENCER NOES: NONE ABSENT: NONE Minutes, H.B Board of Zoning Adjustments December 15 1976 Page 2 ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 76-51 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received September 1, 1976 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Department of Building and Community Development. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Fire protection system,:, includinq automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other_ required fire proL-ecLLori and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. An instrument shall be recorded granting reciprocal ingress and egress privileges over and between this lot and the lot to the east for access to both parcels. 2. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. Natural aas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 5. The structures on subject property, whether attached or det- ached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-30 (In Conj./AR 76-105) Applicant: George Bach To permit the creation of a legal parcel per a previously recorded record of survey pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. Secretary Palin reviewed the history of this application for the Board's information. Applicant has not been able to submit the necessary documentation on the creation of the parcel with proof of how said parcel was segregated originally. ON MOTION BY SPENCER AND SECOND BY CROSBY TENTATIVE PARCEL MAP 76-30 WAS DENIED WITHOUT PREJUDICE, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-105 (In Conj./TPM 76-30) Applicant: Frank Gonzales & Associates To permit the construction of a 4,000 square foot automobile ser- vice center pursuant to Section 9430.5 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-69. Secretary Palin informed the Board that, in view of the denial of the tentative parcel map for subject project, it will be necessary to deny the administrative review request as well, pending appli- cant's submittal of proof that the property constitutes a legal building site. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-105 WAS DENIED WITHOUT PREJUDICE, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-38 (Cont. from 11-17-76) Applicant: Glenn Busby To permit the separation of one (1) parcel into seven (7) parcels for commercial purposes pursuant to Section 9921 of the Hunting- ton Beach Ordinance Code, located on the southeast corner of Goldenwest Street and Edinger Avenue in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-84, adopted by the Board on Septem- ber 15, 1976, upon approval of Use Permit No. 76-52. 1 BZA 12-15-76 Page 4 Minutes, H.B. Board of Zoning Adjustments December 15, 1976 Page 5 George Ritzau was present to represent the application and indi- cated his receipt of and concurrence with the suggested conditions of approval. Bruce Crosby discussed vehicular access rights to the parcels and a portion of the property not presently dedicated as a public easement but which is presently a part of the flood control channel. He requested that this portion be shown.as a public easement on the parcel map. Jim Palin further informed the applicant that it will be necessary to submit a copy of the recorded ingress -egress easements to the Planning Department; the applicant agreed to each of the above additions to the conditions of approval previously sent to the developer. ON MOTION BY CROSBY AND SECOND BY PALIN TENTATIVE PARCEL MAP NO. 76-38 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. To be completed prior to use or occupancy of said parcels for any purpose: 1. The tentative parcel map received by the Planning Department November 9, 1976 shall be the approved layout. 2. A parcel. map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Edinger Avenue and Goldenwest Street shall be dedicated and improved to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. The flood control channel shall be fenced to Flood Control District standards and City standards at the time said parcels are developed. 9. A copy of the recorded agreement for ingress and egress and parking and any restrictions to be set forth shall be submitted to the Planning Department prior to the occupancy of the first structure upon the first parcel. 13. The portion of the flood control channel which has not been shown as a public easement shall be dedicated to the City of Huntington Beach on a parcel map as a public easement for such purpose. Elliott To permit an oil well activation pursuant to Section 15.40.020(B) of the Huntington Beach Municipal Code, located on the east side of Huntington Street approximately 500 feet south of Yorktown Avenue in an R2-0, Medium Density Residential combined with Oil Production District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-102, adopted by the Board on Novem- ber 24, 1976, upon approval of QWA 76-6. Mr. Elliott was present at the meeting and discussed the time and economic constraints under which he is attempting to process this request. The Board again reviewed the possible effects of future street realignment and park negotiations on this project. ON MOTION BY PALIN AND SECOND BY CROSBY OIL WELL ACTIVATION PERMIT NO. 76-7 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The plot plan received and dated November 8, 1976, shall be the approved layout in conjunction with the recommenda- tions of the Oil Field Supervisor, subject to the following: a. Before subject well is put on production the City shall analyze the street alignment on subject property. If a BZA 12-15-76 Page 6 Minutes, H.B. Board of Zoning Adjustments December 15, 1976 Page 7 new alignment is not deemed desirable and the existing street terminated as a cul-de-sac, said well shall not be put on production and the reactivation permit shall become null and void. b. Should the well be put on production and become a suc- cessful operation, the proponent shall agree and shall submit such agreement to the City in writing that said production will not be the basis for any increase in value of the property over its current value should the City desire to purchase the property for park purposes in the future. 2. The applicant shall comply with all requirements of the Huntington Beach Oil Code. 3. Should the applicant propose to use internal combustion engines, said engines shall be muffled to a level to assure that there will be no interference with surrounding resi- dential uses. Otherwise, electrical motors shall be utilized. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-65 (Cont. from 12-8-76) Applicant: Glamour Awning To permit an 18-inch encroachment into the required three (3) foot side yard setback per Section 9242.8(c) of the Huntington Beach Ordinance Code, located at the southwest corner of Newland Street and Ellis Avenue in an MH. Mobilehome District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Bill Fugate was present to represent the application and reported to the Board that the future tenant on the abutting lot (Lot 122) is also going to be installing a two -car covered parking facility. There being no other persons to address the Board in regard to the proposal, the public hearing was closed. The Board reviewed the request with the applicant and discussed discrepancies between the plot plan he has presented and the re- vised plan submitted for the park by the applicants on December 13, 1976. Secretary Palin noted that other residents in the park are complying with code requirements without benefit of a variance and that in his opinion granting of this request would constitute granting of special privilege not available to other owners within the park. After further discussion it was the consensus among Board members and the applicant to continue the request to permit field investigation, consideration of alternative methods of BZA 12-15-76 Page 7 Minutes, H.B. Board of Zoning Adjustments December 15, 1976 Page 8 providing covered parking for this particular lot and the ad- joining space, and review of State codes and Division 9 require- ments. The applicant was instructed to meet with the park developer to resolve the configuration of the subject property. ON MOTION BY PALIN A14D SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 76-65 WAS CONTINUED, WITH THE CONCURRENCE OF THE. APPLICANT, TO THE REGULAR MEETING OF JANUARY 5, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 76-75 (In Conj./AR 76-176) (Cont. from 12-8-76) Applicant: Michael Janes To permit the construction of six (6) fourplexes and one (1) triplex abutting an arterial street pursuant to Section 9164.4 of the Huntington Beach Ordinance Code, located on the west side of Bolsa Chica Street approximately 200 feet north of Pearce Street in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. George Alvarez was present and displayed revised, colored elevations for the units facing the arterial. There being no other persons present to address the Board on this request, the public hearing was closed. Board review found the treatment presented to be in compliance with the intent of the Planning Commission for the street scene on arterials. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 76-75 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised elevations received and dated December 14, 1976, shall be the approved elevations for the street scene along Bolsa Chica Street. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this.property. No one was present to speak for or against the proposed project; the public hearing was closed. Secretary Palin reported that a request for continuance has been received. Chairman Crosby informed the Board that this request is covered by Negative Declaration 76-105, adopted by the Board on December 8, 1976, upon approval of A.R. 76-171. Michael Geslef was present at the meeting and indicated that he had received and does concur with the suggested conditions of ap- proval. The Board reviewed the request with the applicant. Bruce Crosby noted that the parcel map to the north of this property has not been recorded which will require that this map be amended or that it be conditioned not to record prior to the TPM 76-24 on the ad- joining property. The Board reviewed the legal description and boundaries of the project with the applicant. ON MOTION BY CROSBY AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 76-63 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. Chairman Crosby informed the Board that this request is a Categori- cal Exemption, Class III, California Environmental Quality Act, 1970. No one was present to represent the application. The Board reviewed the plan submitted and found it to comply with code requirements. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 76-130 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Seventeenth Street and the alley shall be improved to the centerlines of such rights -of -way. Said improvements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A parcel map shall be filed and recorded to eradicate the property line between Lots 5 and 7 and to consolidate those lots as a single legal building site. Jones To permit the construction of a 17,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the east side of Redondo Circle approximately 330 feet south of Talbert Avenue in an Ml-A, Restricted Manufacturing District.
