ZONE CASE NO. 76-26"B"
Applicant: Initiated by Planning Department
This is a request for a change of zone from RA-0-CD, RA-0, Ml, R3
and Ml to R2 and R2-0 (Medium Density Residential and Medium Density
Residential combined with oil production on property located north
of Clay Avenue, south of Garfield Avenue, east of Goldenwest Street
and west of the Pacific Railroad right-of-way.
Mr. John Cope outlined action of the previous hearing on Zone Case
76-26"B" to the Commission. Mr. Cope stated that the staff had
received a request to proceed with the rezoning of those properties
north of Garfield. Mr. Cope further stated that since the Land Use
Study is not anticipated to be completed prior to January 4, 1977,
the staff suggests separate rezoning of the industrial properties
that are north of Garfield Avenue.

Mr. Chuck Bowman addressed the Commission and stated that he had
submitted a letter to the Planning Department signed by property
owners in favor of rezoning that area north of Garfield.
Mr. Bruce Greer addressed the Commission and also voiced his approval
of the area north of Garfield being rezoned to Ml.
There being no other persons present to speak, the Chairman closed
the public hearing.
Commission discussion ensued.
ON MOTION BY SLATES AND SECOND BY NEWMAN THAT PORTION OF ZONE CASE
NO. 76-26"B" NORTH OF GARFIELD AVENUE WAS APPROVED WITH THE FOLLOWING
FINDINGS BY THE FOLLOWING VOTE:
FINDINGS:
1. Staff Planning Law mandates that zoning shall be consistent
with the City's General Plan.
2. The subject properties are no longer suited for development under
their present zonings.
3. The proposed changes of zoning will provide for more compatible
land uses for each of the surrounding uses.

ON MOTION BY PARKINSON AND SECOND BY GIBSON ZONE CASE NO. 76-27
WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE:
FINDINGS:
1. The requested "AR" suffix is permitted to be attached to properties
designated as medium density residential under the General Plan and
Huntignton Beach Ordinance Code.
2. The "AR" suffix on the subject property will result in compatible
land uses to the surrounding properties and will provide for a
diversity of housing types in the general area.

CONDITIONAL USE PERMIT NO. 76-29
Applicant: Ellis Avenue Baptist Church
This is a request for the expansion of an existing church complex
located on the north side of Ellis Avenue, approximately 1/4 mile
east of Beach Boulevard.
Mr. Cope addressed the Commission and presented a brief summary of
the proposal. Mr. Cope stated that the expansion development is
anticipated to be completed in three phases over the next 9 to 10
years. The facilities proposed will include a day care center,
Sunday School classrooms, a worship assembly auditorium, and the
addition of all required off-street parking and landscaping. Mr.
Cope further stated that upon construction of Phase 3, additional
parking will be required.
Commissioner Finley questioned the possibility of Phase 3 being
able to be constructed unless additional land is acquired by the
Church for parking.
Phasing of the project was discussed among Commission members.

The Chairman opened the public hearing.
Pastor James McCullen, representing the applicant, addressed the
Commission and questioned two of the suggested conditions of approval
presented in the staff report. He stated that he would like to be
able to park a bus on the premises at a future date and that such
activity would not hinder the aesthetics of the site. Pastor McCullen
stated that he would like a day care center at all times and lastly,
he requested that the occupancy be adjusted of people worshiping at
one time.
There being no other persons present to speak, the public hearing was
closed.
Commission discussed deletion of suggested conditions of approval
mentioned by Pastor McCullen. It was the consensus of the Commission
that it would not be aesthetically harmful to properly park a bus
on the site and also adjustments could be made on the maximum occupancy
for the assembly/sanctuary building.
Conformity of the proposal with the General Plan was discussed. Mr.
Cope stated that the Land Use Element of the General Plan designates
the property as Institutional Church use.

ON MOTION BY SLATES AND SECOND BY SHEA CONDITIONAL USE PERMIT NO. 76-29
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
1. The conceptual plan dated November 5, 1976 shall be the approved
layout.
2. Soil reports as required by the Department of Building and Community
Development and the Department of Public Works shall be submitted
to such departments prior to the issuance of building permits.
3. Prior to the issuance of building permits for any building, a
landscape plan depicting plant type, size, location, and plan for
irrigation, shall be submitted to the Department of Building and
Community Development for review and approval.
4. Fire protection systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and devices
shall be submitted to the Fire Department and shall be subject to
approval by the Fire Department and Department of Public Works.

5. Prior to a final inspection for the Phase III, assembly/sanctuary
building, use of any of the buildings or premises for a day care
center, shall be permanently discontinued.
6. If the developer proposes to provide air conditioning, the insulation
in ceilings and exterior walls shall be a minimum of R-19 and R-11,
respectively. If no air conditioning is to be provided, the in-
sulation in ceilings and exterior walls shall be a minimum of
R-13 and R-7, respectively.
7. All building spoils, such as unusable lumber, wire, pipe, and other
surplus or unusable material, shall be disposed of at an offsite
facility equipped to handle them.
8. Natural gas and 220V electrical shall be stubbed in at the location
of clothes dryers, natural gas shall be stubbed in at the locations
of cooking facilities, water heaters, and central heating units.
FINDINGS:
1. The proposed facilities are in substantial conformance with the
Huntington Beach Ordinance Code.
2. The subject site is suitable for the proposed expansion of the
existing use, and will be compatible with surrounding uses.
I hereby certify that Conditional Use Permit No. 76-29 was approved by
the Planning Commission of the City of Huntington Beach on December 21,
1976 upon the foregoing conditions and findings.

TENTATIVE TRACT NO. 8694 - REVISED
Applicant: Huntington Beach Industrial Park
This is a request to allow approximately a 60 acre parcel of property
to be subdivided into a 46 lot industrial subdivision located on the
northwest corner of Springdale Street and McFadden Avenue.
Mr. Palin gave a brief summary of the proposal. He stated that this
map reflects the remaining portion of the property bounded by
McFadden Avenue, Graham Street, Bolsa Avenue and Springdale Street
which has not been recorded by the parcel map process.
Mr. Palin suggested amendments to the Conditions of Approval as suggested
in the staff report.
Commission discussion ensued.

ON MOTION BY SLATES AND SECOND BY PARKINSON REVISED TENTATIVE TRACT
NO. 8694 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
1. The map received and dated December 8, 1976 shall be the approved
layout.
2. The sewer, water and fire hydrant system shall be designed to City
standards.
3. The water system shall be through the City of Huntington Beach's
water system.
4. The sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The property shall be subject to local drainage assessment district
requirements and fees.
6. Drainage for the subdivision shall be approved by the Department
of Public Works prior to the recordation of a final map. This
system shall be designed to provide for siltation and erosion control
both during and after construction of the projects.
7. All utilities shall be installed underground.
8. Fire safety system shall be installed by the developer as required
by the Fire Department.
9. "A", "B", "C", "D", "E", and "F", McFadden Avenue and Springdale
Street shall be dedicated to the City.
10. "A" "B" "C" "D" "E" and "F" Streets shall be constructed having
a five foot easement on both sides of such street for utilities
and future walkways if needed.
11. McFadden Avenue shall be constructed having an 80 ft. street
section with no sidewalks on the north side at the time of initial
construction.
12. Springdale Street shall be constructed to City standards.
13. All areas within the standard street section of arterial high-
ways which have been reserved for future walk purposes shall be
flat and planted with a turf grass to accommodate pedestrian
circulation.
14. On -street parking shall be prohibited on arterial highways within
the park, and they shall be posted with "No Parking" signs.

15. Signs identifying the industrial park shall be subject to approval
of the Planning Department.
16. A conceptual landscaping plan shall be submitted to the Planning
Department for approval prior to issuance of any building permits
on any parcel within the industrial park.
17. Vehicular access rights to lots 18 and 34 shall be dedicated to the
City of Huntington Beach and access to any parcel from arterial
-highways shall be reviewed and approved -by the Department of Public
Works and Planning Department at the time of approval of development
plans. This review is to minimize the number of access points
through the use of common driveways.
18. Soils and compaction reports shall be submitted to the Department
of Building and Community Development and Department of Public
Works prior to the issuance of building permits. Such report shall
be submitted by a qualified soils engineer.
19. No vehicular access shall be permitted for east bound traffic
from a left turn pocket on McFadden Avenue into "F" Street.

CODE AMENDMENT NO. 76-20
"Right -of -Way Dedication"
This Code Amendment proposes changes to the Huntington Beach Ordinance
Code, the intent being to allow dedication of right-of-way by precise
plan or Public Works standards.
Commission reviewed the Code Amendment.
The public hearing was opened.
There being no persons present to speak, the public hearing was closed.
Mr. Palin suggested a change on the code amendment whereby he wishes
the code amendment to state ...all yard requirements shall be measured
from the existing property line or from the ultimate right-of-way line...
No other changes were made to the code amendment.

CONDITIONAL USE PERMIT NO. 76-16
Applicant: A. C. Marion
This is a request to re-establish a commercial horse stable located
on the northwest corner of Goldenwest and Ellis.
IN CONJUNCTION WITH:
CONDITIONAL USE PERMIT NO. 76-17
Applicant: T. J. Hennes
This is a request for the -continuance of an existing commercial
horse stable located on the southwest corner of Goldenwest Street
and Ellis Avenue.
Mr. Cope stated that both applicants had made a great effort to pursue
the conditions of approval and that the applicants will have completed
complying with all conditions imposed upon them prior to the public
hearing process. Commissioner Finley questioned the placement of public
restrooms on the proposed site. Mr. Cope stated that the possibility
of a septic tank was being pursued by the applicants.
A MOTION WAS MADE BY GIBSON AND SECONDED BY FINLEY TO REQUEST THE
CITY COUNCIL TO REVOKE CONDITIONAL USE PERMIT NO.-76-16 and
CONDITIONAL USE PERMIT NO. 76-17 AND DIRECT STAFF TO PROVIDE
INFORMATION AS TO THE STATUS OF COMPLIANCE OF CONDITIONS OF APPROVAL
ON THIS DATE AND HAVE SUCH COMPLIANCE OF CONDITIONS OF APPROVAL
PRESENT AT PUBLIC HEARING.
VOTE:

NOES: Slates, Shea, Newman
ABSENT: Boyle
Chairman Slates stated for the record that he felt the applicants were
making an effort to comply with the conditions of approval.
Commissioner Gibson stated that he would like the applicants to he
aware that when conditions of approval are imposed on a project, that
the applicant is obligated to comply with such conditions.
Timing on the proposal was discussed. Commissioner Finley stated that
she would like to see a check list of conditions of both applicants
that have been complied with to date on the proposals.
Chairman Slates stated that the aforementioned motion would place
Conditional Use Permit No. 76-16 and Conditional Use Permit No. 76-17
on the agenda of January 4, 1977 Planning Commission meeting as continued
items.

MISCELLANEOUS:
Discussion - State Surplus Properties
It was the consensus of the Commission to delay this item to a
future study session.
Review of a possible realignment of Whitesands to be brought back
to the Planning Commission at a future date.
ON MOTION BY SHEA AND SECOND BY NEWMAN STAFF WAS DIRECTED TO PURSUE
ALTERNATE ROUTES AT TIME OF CONSTRUCTION BY THE CITY.

Chairman Slates discussed a letter from the Chairman of the Charter
Revision Committee requesting input on proposed revisions to the City
Charter. Chairman Slates suggested that any comments from the
Commissioners should be directed to the Committee.
ORAL COMMUNICATIONS:
Ted Hennes addressed the Commission and requested clarification of
conditions of approval imposed on his application, Conditional Use
Permit No. 76-17. Mr. Hennes was directed to request clarification
from staff members.
COMMISSIONERS' COMMENTS:
Chairman Slates wished everyone a Merry Christmas and a Happy New Year.
Commissioner Gibson thanked the staff for including a Surplus Land Map
and requested that this kind of map be included in more applications to
more easily identify project sites.
