The regular meeting'of the Board was called to order by Jim Palin,
acting as chairman in the absence of Bruce Crosby.
MINUTES: ON MOTION BY SPENCER AND SECOND BY PALIN, THE MINUTES OF
THE REGULAR MEETINGS OF NOVEMBER 17 AND NOVEMBER 24, 1976, WERE
APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE:

REGULAR AGENDA ITEMS:
ADMINISTRATIVE REVIEW NO. 76-187
Applicant: Department of Mental Health, Region IV, County of Orange
To permit the 24-hour care of six (6.) nonrelated,persons pursuant
to Section 9730.27 of the Huntington Beach Ordinance Code. Ages of
the nonrelated persons will range from 11 to 18 years. Subject
property is located on the south side of Marshall Drive approxi-
mately 60 feet west of Clubhouse Lane in an R1, Low Density Residen-
tial District.
Acting Chairman Palin informed the Board that this request is ex-
empt from environmental review per Section 15060 of the California
Environmental Quality Act, 1970, guidelines.
The chairman opened the public hearing. Gene Bolman, County social
worker, was present to represent the application. Mr. Bolman
addressed the Board,and repeated a request for continuance of this
item which had already been submitted in writing by the County. It
was the consensus of the Board to hold the public hearing before
makin5 a determination on granting a continuance. Mr. Bolman then
explained the purpose and method of operation of the proposed pro-
ject.

Morris Wells, resident of the neighborhood in which this project
is proposed to be located, presented a petition from approximately

387 residents and property owners in opposition to the establish-
ment of such a use at this location.
Mr. Wells and numerous other residents addressed the Board to
express specific objections to the project. They cited social and
physical adverse effects which would result from placement of the
facility in what they described as a weakening community already
in pressing need of stabilization - present crime and police
problems were cited in support of the above contention, as well as
the changing character of the area which is resulting from more and
more investment/speculation buying with more renter -occupied homes.
Those addressing the Board also noted the original covenants and
restrictions placed on the tract and questioned the reasons for the
site selection by the County. Added traffic and crime dangers to
the community, the adverse effect on property such a facility could
have, and the cost of implementation of the program were also
items of concern. Daniel Hagarty, scout leader from Meadowview
School, addressed the Board and asked that there be no continuance
of this item.
There being no other persons to add to the discussion on this matter,
the public hearing was closed.
Extensive Board review followed, taking into consideration the
issues and points raised by the speakers and the County representa-
tive. It was the Board's determination that the opposition to the
project would not be abated by any further meetings or presentations
by the Department of Welfare and that a continuance would not he
justified.
ON MOTION BY PALIN AND SECOND BY ELLSTROM ADMINISTRATIVE REVIEW
NO. 76-187 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. The County had failed to contact residents in the area and out-
line its proposed program prior to filing of the application,
as it had indicated to the City Council was its intent at the
time the Council adopted the cooperative agreement to allow ap-
plications of this nature within the City.
2. Neighborhood opposition to the proposal is overwhelmingly against
establishment of this type of facility at this location.
3. Statistical data, although not documented factually at the
public hearing, was presented to indicate that there is a crime
problem existing within the general vicinity of this request
which could weaken the program and prevent accomplishment of its
goals and objectives.

USE PERMIT NO. 76-82 (In Conj./AR 76-184)
Applicant: Sid Lance Construction
To permit truck and loading facilities to face a public street
pursuant to Section 9518 of the Huntington Beach Ordinance Code,
located on the south side of Business Drive approximately 415 feet
west of Graham Street in a 100-M1-A-20,000, Restricted Manufactur-
ing District.
Chairman Palin reported that this request is covered by EIR 73-16,
adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Sid Lance was present at
the meeting; there being no one present to address the Board in
regard to the request, the public hearing was closed.
Board review ensued, including consideration of what construction
exists on abutting lots and its effect on allowed setbacks on
the subject project.
ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 76-82 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plan received and dated December 7, 1976, shall be
the approved layout.

Chairman Palin informed the Board that this request is covered by

The Board reviewed the plot plan and found it to be in compliance
with code requirements.

scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan, if applic-
able. Said plan shall indicate screening -of all rooftop
mechanical equipment and shall delineate the type of
material proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to
the Department of Building and Community Development and
shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public.
Works.
5. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Street trees shall be installed in accordance with the
conditions imposed upon the approval of TT 6948.

Chairman Palin informed the Board that this request is a Categori-
cal Exemption, California Environmental Quality Act, 1970, Class V.
The Chairman opened the public hearing. W. A. Ledford was present
to represent the application and addressed the Board to explain
the project. There being no other persons present to speak for or
against the proposed project, the public hearing was closed.
The Board discussed the existing use on the lot and the difficulty
of access presented by the depth of the lot in relation to its
width. Proposed occupancy and parking were reviewed, and the
possibility of reciprocal common drives with abutting property was
suggested to provide better access to both parcels and to increase
the substandard curb cut proposed. The applicant agreed to pursue
such reciprocal easements with abutting owners.

240 feet north of Cypress Avenue in a C4, Highway Commercial Dis-
trict.
Chairman Palin informed the Board that this request is a Categori-
cal Exemption, Class I(e), California Environmental Quality Act,
1970.
W. A. Ledford was present to represent the application.
It was the determination of the Board that this request should also
be continued to permit investigation of the possibility for common
drive easements with the abutting property, as noted in the continu-
ance of CE 76-67.

The Chairman opened the public hearing. Sid Lance was present at
the meeting. There being no other persons present to speak on
the proposed project, the public hearing was closed.
Board review included setbacks and deletion of parking spaces.

Chairman Palin informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Sid Lance was present at the meeting.
Board review found the plan to be in compliance with applicable
code requirements.

Chairman Palin informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Mr. Ewing was present
at the meeting and explained that the only construction already
done is the slab - no work has been completed on the patio cover
itself. There being no other persons present to speak for or

against the proposal, the public hearing was closed.
The Board reviewed the layout, discussed possible alternatives
to placement of the patio. Materials proposed to be used were
also reviewed, and the applicant warned of the use of combustible
materials close to his property line.
ON MOTION BY SPENCER AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION
NO. 76-68 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The lot is of an irregular shape, and granting of the exception
will permit maximization of the use of the rear yard.
2. The relationship of subject property to properties to the south
and east is such that construction would not encroach upon nor
interfere with the privacy of other people.
3. The granting of a conditional exception will not be materially
detrimental to the public welfare nor injurious to property in the
same zone classifications.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plan received and dated December 7, 1976, shall be the

Mr. Palin presented the following reasons for his negative vote:
1. Although there is a definite differential in grade between
subject property and the adjoining parcel, it will still set
an undesirable precedent to permit the projection of the roof
of the structure as well as to allow columns so close to a
property line.

2. Other areas exist upon subject property upon which a facility
affording essentially the same types of amenities as those pro-
posed could be constructed within the requirements of the
Ordinance Code.
TENTATIVE PARCEL MAP NO. 76-64
Applicant: John E. Schwartz
To permit the consolidation of three (3) parcels of land into one
(1) parcel pursuant to'Section 9921 of the Huntington Beach Ordin-
ance Code, located on the north side of Warner Avenue approximately
410 feet west of Springdale Street in a C4, Highway Commercial
District.
Chairman Palin informed the Board that -this request is a Categori-
cal Exemption, Class V(a), California Environmental Quality Act,
1970.
Mr. Palin reported that the applicant has submitted a revised map
and indicated at that time that he has received and does concur
with the suggested conditions of approval. The Board reviewed the
conditions imposed upon the project when Use Permit No. 76-63 was
approved for the car wash facility on subject property.
ON MOTION BY PALIN AND SECOND BY ELLSTROM TENTATIVE PARCEL MAP NO.
76-64 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR
ANY PURPOSE.
1. The tentative parcel map received by the Planning Department
on December 9, 1976, shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works, and recorded with the Orange
County Recorder.
3. Warner Avenue and Springdale Street shall be dedicated and
improved to City standards at the time said parcel is developed.
4. Water supply shall be through the City of Huntington Beach's
water system at the time said parcel is developed.
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcel is developed.
6. All utilities shall be installed underground at the time
said parcel is developed.

Planning Department.
11. Reciprocal easements shall be provided over and across both
driveways to provide for ingress -egress and if necessary
parking for both parcels, as conditioned upon approval of
Use Permit No. 76-63 on -December 8, 1976.

George Alvarez was present at the meeting and explained that this
map is filed to incorporate an additional parcel of land into an
already approved subdivision. He informed the Board that he has
received and does concur with the suggested conditions of approval.

and Magnolia Street in a C2, General Business District.
Chairman Palin informed the Board that this request is covered by
Negative Declaration No. 76-122.
Ray Grage was present to represent the application.
The Board discussed obtaining of reciprocal easements between the
subject project and the adjoining furniture store to the west (com-
mon drives were a condition of approval on that project). Mel Ott

5. The developer shall participate in the local drainage assess-

1. Warner Avenue and Magnolia Street shall be improved to the
centerlines of such rights -of -way. Said improvement shall

water main extensions, in full compliance with the City of
Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. Proof in record form shall be submitted to the Department of

Chairman Palin informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Mr. Williams was present to represent the application.
The Board reviewed the plan and instructed the applicant in regard
to the required front setbacks. Alternative parking arrangements
were discussed to pick up the spaces lost in providing for the re-
quired 11 foot setback area. The plot plan was found to be other-
wise in conformance with code.
