The meeting was called to order by Acting Chairman Jim Palin,
in the absence of Chairman Crosby.
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 76-69 (In Conj./UP 76-76 & AR 76-177)
Applicant: Dunn Properties
To permit truck and loading facilities to face onto an arterial
highway in lieu of Section 9518 of the Huntington Beach Ordinance
Code, located at the southwest corner of Commercial Drive and
Graham Street in a 100-M1-A-20,000, Restricted Manufacturing
District.
The Chairman informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. Ray Sherman was present
to represent the application. There being no other persons to
speak for or against the proposal, the public hearing was closed.
Board review ensued.
ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
76-69 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF -THE BOARD:
1. The size and shape of subject property deprive the property
owner of the same degree of usability as obtained by other
similar parcels within the subdivision, through the odd align-
ment of Graham Street at this location.
2. The subject site is an exterior lot, and the City has encouraged
installation of additional landscaping along arterial highways
in the industrial park to improve aesthetic quality of the street
scene.

3. The granting of the Conditional Exception will not adversely
affect the General Plan -of the City of Huntington Beach.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The detailed plan received and dated December 15, 1976, shall
be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
• Past administrative action regarding this property.
2. The facility shall be constructed in the field, as shown
upon the landscaping plan, to include both the berm and
screening wall as delineated upon said plan.
3. The overhead door shall remain closed except when in use. -

Chairman Palin informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Ray Sherman was present
to represent the application., There being no other persons
to speak for or against the proposal, the public hearing was
closed.
Jim Palin reviewed the past actions on this project, noting
that the conditional exception to permit the truck loading fac-
ility on the arterial street has now been filed and approved.

Board review of the use permit request found it to be in compli-
ance with code requirements.
ON 140TION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-76 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL-
LOWING VOTE:
FINDINGS OF THE BOARD:
1. The proposal grants the property only parity with other proper-
ties within the area.
2. The City has approved similar types of trucking facilities
within the industrial park on previous applications.
3. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity;
b. Property and improvements in the vicinity of such use or
building.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plot plan received and dated December 15, 1976,
shall be the approved layout for depth and construction of
the overhead door for the truck facility facing onto
Commercial Drive.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
• Lot area;
. Lot width and lot depth;-
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. Should Conditional Exception No. 76-69 (approved in con-
junction with this Use Permit) be appealed and overruled,
the effectiveness of UP 76-76 shall also become null and
void.

Applicant: Dunn Properties
To permit the construction of a 9,000 square foot industrial
building pursuant to Section 9511 of the Huntington Beach Ordin-
ance Code, located on the southwest corner of Graham Street and
Commercial Drive in a 100-M1-A-20,000, Restricted Manufacturing
District.
Chairman Palin informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Ray Sherman was present to represent the application.
Board review of the request found it in compliance with code re-
quirements.
ON MOTION BY PALIN AND SECOND.BY LIPPS ADMINISTRATIVE REVIEW NO.
76-177 WAS APPROVED WITH,THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:

Said plan shall indicate screening of all rooftop mechanic
equipment and shall delineate the type of material propose

3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the De-
partment of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public
Works.
5. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Street trees shall be installed in conformance with the
conditions originally imposed upon TT 6948.
C. GENERAL CONDITIONS:
1. The grass turfed area to be installed within the right-of-way
shall be subject to approval by the Department of Public Works.
2. This Administrative Review shall become null and -void should
the Conditional Exception 76-69 and/or Use Permit 76-76 be
appealed and overruled.

Applicant: Ni-Mar Enterprises
To permit two (2) covered parking spaces in lieu of the required
three (3) covered spaces for a triplex per Section 9206.2.1 of
the Huntington Beach Ordinance Code, located at the northwest
corner of Warner Avenue and Green Street in an R3, Medium -High
Density Residential District.
Chairman Palin informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing. Nick Becker was present
at the meeting and addressed the Board to explain size constraints
on the subject property which had dictated the layout as proposed.

There being no other persons present to speak for or against
the project, the public hearing was closed.
Discussion by the Board included the hazards presented by the
proposed access to Warner Avenue and alternative access off the
Green Street radius, the density proposed in relation to the size
and configuration of the lot, and sound attenuation for the pro-
ject.
ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION
NO. 76-66 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. The reduction in parking spaces would establish a dangerous
precedent for similar types of developments in similar
locations within the City.
2. The proposed access point for subject project is a safety
hazard and would create traffic problems on a heavily traveled
arterial highway.
3. The design of the plan has not taken into consideration any
type of six-foot masonry wall along the exterior property line
to attempt to attenuate noise impacts from the arterial.

To permit the construction of a triplex abutting an arterial
street pursuant to Section 9201.4 of the Huntington Beach Ordin-
ance Code, located on the northwest corner of Warner Avenue and
Green Street in an R3, Medium -High Density Residential District.
Chairman Palin informed the Board that this request is a Categ-
orical Exemption, Class III, California Environmental Quality
Act, 1970.
The Chairman opened the public hearing. Nick. Becker was present
to represent the application. There being no persons to speak
for or against the proposal, the public hearing was closed.
It was the consensus of the Board, in view of the denial of the
conditional exception above, that this application should be
continued to permit applicant to work out access problems with
the Department of Public Works and to review the layout with
Planning staff.

CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR
MEETING OF JANUARY 12, 1977, BY THE. FOLLOWING VOTE:

USE PERMIT NO. 76-84
Applicant: Brass Hat Enterprises
To permit the addition of 760 square feet to an existing restaur-
ant pursuant to Section 9472 of the Huntington Beach Ordinance
Code, located on the north side of Warner Avenue approximately
410 feet west of Beach Boulevard in a C4, Highway Commercial
District.
Chairman Palin informed the Baord that this request is a Categori-
cal Exemption, Class I(e), California Environmental Qualitv Act,
1970.
The Chairman opened the public hearing. There being no represen-
tative present nor anyone wishing to address the Board in regard
to this project, the public hearing was closed.
Board review found the dimensions as indicated on the conceptual
plan inadequate to determine complete compliance with code require-
ments.
ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-84 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not have a detrimental effect on:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the Master
Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plan received and -dated December 13, 1976,
shall be the approved conceptual layout, subject to the
following:
a. The parkinq in front of the facility shall be dimensioned
in compliance with Article 979 of the Huntington Beach
Ordinance Code.
b. If additional parking is necessary, the plan shall
incorporate such additional spaces.
c. The architecture of the proposed addition shall comply
with the architectural theme of the existing building.
d. The plan shall incorporate all necessary dimensions to
enable the Department of Building and Community Develop-
ment to make a proper determination on the siting of
the building.
A plan delineating above modifications shall be submitted to
the Department of Building and Community Development upon
application for building permits.

turing District.
Chairman Palin informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Sid Lance was present
at the meeting. There being no one present to speak for or
against the proposal, the public hearing was closed.
Board review found the plan to be in compliance with code require-
ments.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY

6. All applicable conditions imposed upon Use Permit No. 76-85
shall apply to subject approval.
7. All applicable fees shall be paid prior to issuance of build-
ing permits.

TENTATIVE PARCEL MAP NO. 76-66
Applicant: Douglas Snyder
To permit a four (4) lot division of land pursuant to Section
9921 of the Huntington Beach Ordinance Code, located at the south-
west corner of Beach Boulevard and Garfield Avenue in a C2,
General Business District.
Chairman Palin informed the Board that this request is covered by
Negative Declaration No. 76-24, adopted by the Board upon approval
of A.R. 76-36.
No one was present at the meeting, but Mr. Snyder has been called
and indicated by telephone that he concurs with the suggested
conditions of approval as read to him (notice was improperly ad-
dressed and applicant did not receive a written copy).
Board review determined that the access to Beach Boulevard provided
on the map for Parcel 1 was unacceptable and should be deleted
from the proposal.

TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR
ANY PURPOSE:
1. The tentative parcel map received by the Planning Department
on December 20, 1976, shall be the approved layout, subject to
the following modification:
The thirteen and one-half (13-1/2) foot wide "panhandle" portion
of Parcel No. 1, providing access to Beach Boulevard, shall be
eliminated from said Parcel 1 and shall be incorporated into
either Parcel 2 or Parcel 3.
2. A parcel map shall be filed with, and approved by, the Depart-
ment of Public Works, and recorded with the Orange County
Recorder.
3. Florida Street, Garfield Avenue, and Beach Boulevard shall be
dedicated and improved to City standards at the time said
parcels are developed.
4. Water supply shall be through the City of Huntington Beach's
water system at the time said parcels are developed.
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcels are developed.
6. All utilities shall be installed underground at the time said
parcels are developed.
7. Compliance with all applicable City Ordinances.
8. The property shall participate in the local drainage assessment
district at the time said parcels are developed.
9. A copy of the recorded parcel map shall be filed with the
Planning Department.

TENTATIVE PARCEL MAP NO. 76-67
Applicant: Huntington Beach Company
To permit a five (5) lot division of land Pursuant to Section
9921 of the,Huntington Beach Ordinance Code, located at the
northeast corner of Main Street and Mansion Avenue in an
R5-0-CD, Office -Professional, Oil, Civic District.
Chairman Palin informed the Board that this request is covered
by Negative Declaration NO. 76-92, adopted by the Board upon
approval of A.R. 76-148.
Gunnard Johnson was present at the meeting to represent the ap-
plication and indicated his receipt of and concurrence with the
suggested conditions of approval.
The Board discussed phasing of the project construction with the
applicant and reviewed the number of oil wells to remain on the
site after finish of construction.
ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO.
76-67 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:

A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR
ANY PURPOSE:

Mr. Palin submitted the following reasons for his "no" vote:
1. The signs are not in keeping with the philosophy of the City
when it drafted the new sign ordinance, which encourages
the use of monument signs.
2. The proponent for the shopping center has made a site selection
for the main identification sign for the center which will
block out the view of the secondary pylon sign for the Winchell's
donut use.
3. Although the site plan approved by the Board of Zoning Adjust-
ments'for the center had one pylon sign at the intersection,
.approval for said sign was not included in the approval of the
center and should have been located further to the south so
that it would not conflict with the signal at the intersection
or with signs to the north.
4. The Winchell's donut house is, in fact, the freestanding
building at the intersection and it is the use which should be
granted the identification signing at that intersection.
