ORAL COMMUNICATIONS: None SCHEDULED ITEMS: CONDITIONAL EXCEPTION NO. 76-62 - APPEAL Applicant: Valley Consultants, Inc. for Jack Santiago Chairman Slates stated that since all necessary property owners have not been notified of the January 4, 1977 hearing date, this item has been rescheduled for a public hearing at the January 18, 1977 meeting. Chairman Slates opened the public hearing. There was no one present to speak on this item, and the public hearing was closed. ON MOTION BY PARKINSON AND SECOND BY BOYLE APPEAL TO CONDITIONAL EXCEPTION NO. 76-62 WAS CONTINUED TO JANUARY 18, 1977 BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman,'Boyle NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 76-31 Applicant: Dennis Vinciguerra This application is a request for a commercial skateboard facility to be located on the east side of Beach Boulevard midway between Atlanta Avenue and Hamilton Avenue. The facility will be open to the general public on an hourly basis. The staff requested a two week continuance, with the concurrence of the applicant, to allow time`for making a study of several existing skateboard parks in surrounding cities for comparison purposes. Planning Commission Tuesday, January 4, 1977 Page 2 ON MOTION BY PARKINSON AND SECOND BY BOYLE CONDITIONAL USE PERMIT NO. 76-31 WAS CONTINUED TO JANUARY 18, 1977 BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None "OLDTOWN SPECIFIC PLAN" - CODE AMENDMENT 76-12 RESOLUTION NO. 1180 Al Montes addressed the Commission concerning the revised boundaries of this area. The public hearing was opened. Gerald Lance addressed the Commission concerning the procedures which would follow Planning Commission action prior to zone changes becoming effective. Teresa DeGuelle requested clarification on how many units she could build on her property. When advised that she could build two units instead of three she protested. George Brayton spoke against the Code Amendment. Mike Clark addressed the Commission and spoke against down zoning. Mr. Jeffries spoke in opposition to the proposed plan. Mike Condor spoke in favor of the plan. Leonard Wright also spoke in favor of the plan. Roger Wark asked when it would go before the City Council if it was approved. He was advised that it would be forwarded to the City Council for its February 7 meeting and go into effect March 21, 1977. The public hearing was closed. Commissioner Shea stated that she felt that the majority of the people in the Oldtown Area are not in favor of the plan and that she would vote against it. I- I Commissioner Boyle stated that he felt it was good community development and he was in favor of it. Commissioner Parkinson complimented the staff and stated that he was in favor of it. Chairman Slates questioned the need of repealing the existing AR suffix because it applied to other areas outside of Oldtown, and expressed his opposition to the plan. -2- 1/4/77 - PC 1 Minutes: H.B. CODE AMENDMENT NO. 76-8 "PROJECTING DECKS AND WINDSCREENS" Dave Eadie addressed the Commission and stated that the homeowners in the Huntington Harbour area had been advised by their Newsletter of the concepts of the proposed amendment. The public hearing was opened. M. A. Cornell addressed the Commission and spoke in favor of the Code Amendment. Dick Footner complimented the staff on their work in preparing the Code Amendment. Don Hartfelder spoke in favor of the Code Amendment and discussed the structural requirements. John K. Minasian, a structural engineer, spoke on possibilities of certain violations resulting in a deck being turned into a room. The public hearing was closed. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY GIBSON CODE AMENDMENT 76-8 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 76-55 Applicant: ABS Developments #2 This application was referred to the Planning Commission by the Board of Zoning Adjustments and consists of a request to permit tenant identification wall signs to face interior property lines located on the west side of Gothard Street approximately 140 feet north of Edinger Avenue. It was the recommendation of the staff that inter -circulation remains the critical factor for a viable commercial shopping center and they recommended that the Planning Commission not grant -3- 1/4/771: - PC Minutes: H.B. Chairman Slates noted that he was in receipt of a letter from Mr. Burke, applicant, requesting a continuance to February 1, 1977. The public hearing was opened. There was no one present to speak on this and the public hearing was closed. ON MOTION BY SLATES AND SECOND BY BOYLE CONDITIONAL EXCEPTION NO. 76-55 WAS CONTINUED TO FEBRUARY 11 1977 BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 76-30 Applicant: J. L. Norman This is a request for the construction of an auto dismantling yard located on the northeast corner of Talbert Avenue and Gothard Street. John Cope addressed the Commission and discussed the request. He presented a vugraph. The public hearing was opened. Mr. Norman, applicant, addressed the Commission and discussed the proposed use. The public hearing was closed. It was the consensus of the Commission that this area is a critical one and under study by the City Council. Mr. Norman agreed to continue this application pending City Council's decision. ON MOTION BY PARKINSON AND SECOND BY BOYLE CONDITIONAL USE PERMIT NO. 76-30 WAS CONTINUED TO FEBRUARY 15, 1977 BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None Mr. Manthei, owner of the property at the northeast corner of Talbert Avenue and Gothard Street, addressed the Commission and stated that he would like to see reasonable action taken on this application. -4- 1/4/77 Minutes: H.B. Planning Commission Tuesday, January 4, 1977 Page 5 ZONE CASE NO. 76-26"H" Applicant: Initiated by Planning Department This is a request for a change of zone from C4 to R2-PD, located on the east side of Brookhurst Street and north of Hamilton Avenue. John Cope addressed the Commission and stated that this area had been advertised as both R2 and R2-PD. He further stated that since the hearing of December 7, 1976, the staff had met with the property owner on numerous occasions to discuss the potential residential development under both types of zoning, and that the property owners reached a conclusion that the property will support a viable planned residential development. The public hearing was opened. 'iThere was no one present to speak on this zone case. The public hearing was then closed. Commission discussion ensued. ON MOTION BY PARKINSON AND SECOND BY FINLEY ZONE CASE NO. 76-26"H" WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None TENTATIVE TRACT NO. 9635 Subdivider: Shaffer Development Engineer: Wonacott, Shah & Panchal, Inc. Tentative Tract Map 9635, filed on November 22, 1976,is a request to resubdivide a portion of old Map 184 into an 11 lot medium density subdivision. The subject property is located on the west side of Green Street approximately 200 ft. north of Pearce Street. Jim Palin presented vugraphs and slides and discussed the application with the Commission. Mr. Panchal addressed the Commission on the proposed plan. After a lengthy discussion it was the consensus of the Commission that the applicant and staff should work together to formulate a better plan. ON MOTION BY PARKINSON AND SECOND BY BOYLE TENTATIVE TRACT NO. 9635 WAS CONTINUED TO JANUARY 18, 1977 WITH CONCURRENCE OF THE APPLICANT BY THE FOLLOWING VOTE: AYES: Parkinson, NOES: None ABSENT: None Finley, Gibson, Slates, Shea, Newman, Boyle -5- '1.14/77 - PC Minutes: H.B. Planning Commission' Tuesday, January 4, 1977 Page 6 ZONE CASE NO. 76-26"A" Applicant: Initiated by the Planning Department Chairman Slates stated that he would be abstaining from this zone case as well as Tentative Tract 9600. He then turned the chair over to Vice Chairman Gibson Zone Case No. 76-26"A" is a request for a change of zone from R5 and C4 to R2. John Cope gave a brief history of this zone case which was continued from the December 7, 1976 meeting. Vugraphs were presented. The public hearing was opened. Dora Odom addressed the Commission and spoke in favor of R2 rather than R2-PD, stating that it would be more compatible with the area. Jim Foxx addressed the Commission and spoke in favor of R2-PD which he felt would result in lower density for the area. David Dahl, attorney for another property owner in the,area, spoke in favor of the R2 as opposed to R2-PD. The Commission noted that R2-PD could be developed in an R2 area. The hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BOYLE AND SECONDED BY-­FINLEY TO APPROVE ZONE CASE NO. 76-26"A" FROM R5 AND C4 TO R2 ZONING WITH FINDINGS. Jim Foxx requested permission to address the Commission again. ON MOTION BY PARKINSON AND SECOND BYE"INLEY THE'PU13LIC HEARING WAS REOPENED ON ZONE CASE NO. 76-26"A" BY THE FOLLOWING VOTE:. AYES: Parkinson, Finley, Gibson, Shea, Boyle NOES: None ABSTAIN: Slates, Newman ABSENT: None Jim Foxx again addressed the Commission and stated that a planned development would not be compatible with apartments in that area. Planning Commission Tuesday, January 4, 1977 Page 7 Gary Mulligan, representing Foxx Development, addressed the Com- mission and spoke in favor of R2-PD, stating that he felt it would be better zoning for the community. The public hearing was closed. VOTE: (ZONE CASE 76--26"A") AYES: Parkinson, Finley, Gibson, Boyle NOES: Shea ABSTAIN: Slates, Newman ABSENT: None THE MOTION PASSED FINDINGS: 1. State Planning Law mandates that zoning shall be consistent with the City's General Plan. 2. The subject property is no longer suited for development under its present zonings. 3. The proposed change of zoning will provide for more compatible land use for surrounding areas. TENTATIVE TRACT NO. 9600 Subdivider: Family Home Builders Engineer: RMG Engineering, Inc. Tentative Tract 9600 filed on Decemberl, 1976 is a request to sub- divide approximately a nine acre parcel of land into a 39 lot R-1 single family subdivision. Subject property is located on the north side of Palm Street approximately 250 ft. east of Goldenwest Street. Jim Palin addressed the Commission and discussed the conditions of approval. He stated he had received a letter from the Beachwalk Homeowners Association requesting a continuance to allow time for the developer to review the plans with them. David Baron, representing Beachwalk, addressed the Commission and stated that the residents in that area would like to have a better knowledge of what is proposed and for this reason they requested a continuance. Louis Graziadio, applicant, addressed the Commission and stated that a representative of his firm had supplied the Huntington Beach Company with preliminary elevations on the overall concept. David Baron again addressed the Commission and stated that the Beachwalk citizens would like to meet with the developer. Commission discussion ensued. The Commission noted,. - that Mr. Graziadio would be happy to meet and discuss the plans for - the proposed project. 77- 1/4/76 - PC Minutes: H.B. Planning Commission Tuesday, January 4, 1977 Page 8 ON MOTION BY BOYLE AND SECOND BY PARKINSON NEGATIVE DECLARATION NO. 121 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Shea, Newman, Boyle NOES: None ABSTAIN: Slates ABSENT: None ON MOTION BY BOYLE AND SECOND BY SHEA TENTATIVE TRACT NO. 9600 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: The Planning Commission of the City.of Huntington Beach does hereby find that the proposed subdivision, along with its design and improvements, is consistent with general and specific plans for the area in that: 1. The proposed subdivision -of this 9+ acre parcel of land zoned R1 (which allows 7.0 units per gross acre) is proposed to be con- structed having only 4.2 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for th' type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for Low Density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifi- cations on file with the City, as well as in compliance with the State Map and supplementary City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. �!The_map received and dated December 1, 1976 shall be the approved layout. 2. The sewer, water, and fire hydrant system shall be designed to City standards. 3. The private street sections as proposed within the development shall be designed to City standards. 4. The water system shall be through the City of Huntington Beach's ,water system. 5. The property shall be subject to local drainage assessment require- ments and fees. 7. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 8. Vehicular access rights along Palm Avenue shall be dedicated to the City of Huntington,Beach except at.the street intersection. 9. All utilities shall be installed underground. 10. All buildings on lots abutting City easements shall be set back five feet from the edge of such easement. 11. If the developer proposes to provide air conditioning, the insu- lation in the ceilings and exterior walls shall be a minimum of R-19 and R-11 respectively. If no air conditioning is provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7 respectively. 12. All building spoils such as unusable lumber, wire, pipe, and other surplus and unusable material shall be disposed of at an offsite facility equipped to handle them. 13. Natural gas and 220V electrical shall be stubbed in at locations of clothes dryers. Natural gas shall be stubbed in at locations of surface units for cooking facilities, water heaters and central heating units. 14. The structures on subject property, whether attached or detached shall be constructed in compliance with state acoustical standards set forth for all the units that lie within the 60 CNEL contour for subject property. 15. In addition to those street trees required by the Huntington Beach Ordinance Code for Palm Avenue, the developer shall be required to plant a minimum of one on -site 30-inch box tree within the front yard area of each of the lots and one 30-inch box tree within the exterior side of all exterior lots. 16. A decorative masonry wall shall be constructed to City specifications along lots 1 through 12 which back onto Palm Avenue. Said wall shall be six inches wide and six feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. The structural design of said wall shall. be desiqned by the Department of Public Works and shall be included as part of the street improvement plans. -9- 1/4/77 - PC Minutes: H.B. Planning Commission Tuesday, January 4, 1977 Page 10 17. Landscape planters shall be provided along Palm Avenue at the lo- cation of the meandering right-of-way. Such planter shall conform to the plans and specifications on file in the Department of Public Works and to the requirements of the Planning Commission. It is the developer's responsibility to landscape said planter and to pro- vide irrigation facilities in conformance with the Department of Public Works specifications and requirements. 18. A parkway maintenance agreement shall be entered into with the City prior to the issuance of building permits. Such agreement shall insure for the irrevocable maintenance of the landscaping proposed along Palm Avenue. 19. A fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 20. A six inch wide and six foot high separation wall shall be constructed along the westerly property line where the lots abut the neighborhood park site. 21. The developer shall comply with the provisions of the ordinance code in effect at the time of recordation of the final map for public and/or private streets within this subdivision. 22. The security apparatus proposed on the entry street shall be sub- mitted to the Fire Department for review and approval prior to construction of such facility within this subdivision. 23. A minimum of 5500 square feet of each lot shall be in a level lot area and that all required open space in compliance with the ordinance code shall be designed as level, usable open space. AYES: Parkinson, Finley, Gibson, Shea, Newman, Boyle NOES: None ABSTAIN: Slates ABSENT: None CONDITIONAL USE PERMIT NO. 76-16 and CONDITIONAL USE PERMIT NO. 76-17- The Planning Commission at its meeting of September 21, 1976, con- ditionally approved the above referenced applications. These approvals allowed for the continued operation of existing commercial horse stables located on Ellis Avenue on the west side of Goldenwest Street. Since these stables were existing operations, the Commission imposed time deadlines for completion of the various conditions of approval. It was determined that both applicants shall have all the necessary requirements fulfilled prior to December 1, 1976, and that a status review of each applicant's progress would be held on December 7, 1976. 1/4/77 Minutes: H.B. Planning Commission Tuesday, January 4, 1977 Page 11 The Commission at its meeting of December 21, 1976, reviewed the status of each of these applications. The Commission was unable to reach a majority position on a recommendation to the City Council that a public hearing be held to consider revocation of the permits. The matter was therefore continued to allow for a full Commission in de- ciding a majority position. John Cope discussed the precise deficiencies on each use and then projected the time estimates necessary for total completion. The Commission discussed this information. ON MOTION BY GIBSON AND SECOND BY BOYLE CONDITIONAL USE PERMIT NO. 76-16 WAS CONTINUED TO JANUARY 18, 1977 BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None ON MOTION BY GIBSON AND SECOND BY BOYLE CONDITIONAL USE PERMIT NO. 76-17 WAS REFERRED TO CITY COUNCIL FOR CONSIDERATION OF REVOCATION FOR NON-COMPLIANCE WITH CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None MISCELLANEOUS: None ORAL COMMUNICATIONS: A. C. Marion addressed the Commission and discussed problems he had encountered on his commercial stable operation. T. J. Hennes addressed the Commission and discussed dedication prob- lems that he had encountered on his stable operation. COMMISSIONERS' COMMENTS: Commissioner Gibson stated that the U.S. Department of ::ousina and Urban Development will issue request for Grant Applications for the third cycle of its integrated Solar Demonstration Projects in January.
