CONDITIONAL EXCEPTION NO. 76-65
Applicant: Glamour Awning
To permit an 18-inch encroachment into the required three (3) foot
side yard setback per Section 9242.8(c) of the Huntington Beach
Ordinance Code, located at the southwest corner of Newland Street
and Ellis Avenue in an MH, Mobilehome District.
Chairman Crosby informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman reopened the public hearing. Bill Fugate was present
to represent the application, and submitted a new drawing to the
Board. Said drawing consolidated the carports on the subject lot
and the adjacent lot into one 20 by 40 foot structure to house four
cars and to eliminate the center separation between the two lots.
There being no other persons present to speak for or against the
proposal, the public hearing was closed.
The Board reviewed the application, taking into consideration prior
communications between the developer and the City in regard to
property line adjustments and City and State regulations for mobile -
home parks.
ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO.
76-65 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE:

REASONS FOR DENIAL:
1. Sufficient flexibility currently exists (as outlined in letters
sent to the developer and his representative, Alpine Civil
Engineers, expressing the City's willingness to work out adjust-
ments to the property lines within the park and specifying the
restrictions to be placed on such adjustments) to enable the
operators to allow move -ins of larger coaches upon some spaces
without -the use of the conditional exception application.
2. At two other locations of similar design within the park, the
developer has been successful in working out similar problems
without benefit of the variance procedure.
3. By opting to apply for two covered parking spaces, the appli-
cant has exceeded code requirements, as the code requires only
one covered parking space per unit. The request would, there-
fore, constitute granting of special privilege and would not simply
grant parity with other spaces in the park.
4. The granting of this request would interfere with the free and
unobstructed access for fire fighting apparatus to each loca-
tion within the park.
5. Applicant has failed to demonstrate sufficient hardship to
justify granting of the conditional exception request.

CONDITIONAL EXCEPTION NO. 76-67 (In Conj./UP 76-83)
Applicant: Katella Realty
To provide a 12-foot wide driveway in lieu of the required 20-foot
width per Section 9792.7.1(a) and a 21-foot encroachment into the
required 50 foot front yard setback per Section 9434.1 of the
Huntington Beach Ordinance Code, located on the west side of Beach
Boulevard approximately 240 feet north of Cypress Avenue in a C4,
Highway Commercial District.
Chairman Crosby informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. Al Ledford was present to
represent the application and indicated that he had been unable
to obtain agreement from the abutting property owner to the south
for reciprocal easements to provide access. There being no other
persons to speak for or against the project, the public hearing
was closed.

Board discussion ensued. Mel Ott noted that access width for
fire apparatus was not a major problem, as the structures were all
within 150 feet of the street. However, a major problem is the
absence of water mains to serve the area, and he cautioned the
applicant that installation of a main will be a condition on the
project if approved.
The Board also discussed the size and shape of the subject parcel
as it affects siting of a building on the property.
ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 76-67 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The size and configuration of the subject property and the
orientation of the existing building on the property do create
a hardship in utilizing the parcel.
2. Granting of the variance will allow usability of the property
comparable to that realized by other property owners in the
vicinity.
3. Granting of the variance will afford additional onsite parking
which will lessen the impact of onstreet parking and will afford
additional landscaping to improve the aesthetics of the area.
4. The conditional exception, through relocation of the drive, will
improve access to the property and will allow turning movements
to be made onsite rather than having automobiles backing into
the flow of traffic on Beach Boulevard, creating a traffic hazard.
CONDITIONS OF APPROVAL:
TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated December 7, 1976, shall be the
approved layout, subject to the following modifications:
a. The concrete steps shall be removed.
b. The wooden screening fence and the block wall shall be
removed.
C. The sign shall be relocated upon the frontage.
d. The driveway shall be designed to a minimum width of sixteen
(16) feet, with the southerly "x" as a temporary line, to
facilitate future expansion to the south for a reciprocal
driveway along the southerly ten (10) feet of subject prop-
erty and along the northerly ten (1.0) feet of the property
to the south.

2. The proponent shall file a recordable agreement with the City
agreeing to participate with the property owner to the south for
reciprocal easement over and across the southerly ten (10) .feet
of the subject site for a depth of approximately one hundred and
ten (110) feet from the front property line.
3. The drive access to the site shall be constructed with a radius
curve, with the northerly "x" as the radius and the southerly "x"
as a temporary type construction, to the requirements of the
Department of Public Works.

Applicant: Katella Realty
To permit an 862 square foot addition to an existing office build-
ing pursuant to Section 9472.1 of the Huntington Beach Ordinance
Code, located on the west side of Beach Boulevard approximately
240 feet north of Cypress Avenue in a C4, Highway Commercial
District.
Chairman Crosby informed the Board that this request is a Categ-
orical Exemption, Class I(e), California Environmental Quality
Act, 1970.
The Chairman reopened the public hearing. Al Ledford was present
at the meeting to represent the application. There being no one
to address the Board in regard to this proposal, the public hear-
ing was closed.
The Board reviewed the request, considering parking and landscaping
and alternative methods for bringing in the water main.
ON MOTION BY CROSBY AND SECOND BY LIPPS USE PERMIT NO. 76-83 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.

2. The granting of a Use Permit will not adversely affect the Master
Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated December 7, 1976, shall
be the approved layout, subject to the modifications as
imposed upon Conditional Exception No. 76-67.
A plan delineating said modifications shall be submitted to
the Department of Building and Community Development upon appli-
cation for building permits.
In its approval action, the Board of Zoning Adjustments considered.
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. A landscaping and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works shall
be submitted to the Department of Building and Community
Development.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the De-
partment of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the Hunt-
ington Beach Fire Code. Plans for such systems and devices
shall be submitted to the Fire Department and shal•1 be subject
to the approval of the Departments of Fire and Public Works.
5. The developer shall participate in the local drainage assess-
ment district.

6. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District, if applicable.
7. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Beach Boulevard shall be improved to the centerline of such
right-of-way. Said improvement shall include curbs, gutters,
sidewalks, paving, street trees, street lights, street signs,
street drainage, and sewer and water main extensions, in full
compliance with the City of Huntington Beach street standards
and requirements.
C: GENERAL CONDITIONS:
1. Applicant shall obtain a demolition permit for the removal
of the accessory building on the rear of the subject property.
2. Screening and landscaping along the frontage shall be provided
in compliance with Article 979.
3. The driveway on Beach Boulevard shall be a radius -type
drive constructed to the standards of the Department of
Public Works.
4. A water main shall be installed in Beach Boulevard to serve
this facility. Said installation shall be constructed to
the requirements of the Departments of Fire and Public Works
and shall include all required fire hydrants.

Applicant: Joe Byron
To permit truck and loading facilities to face a public street
pursuant to Section 9518 of the Huntington Beach Ordinance Code,
located on the south side of Commercial Drive approximately 265
feet west of Graham Street in a 100-M1-A-20,000, Restricted Manu-
facturing District.
Chairman Crosby informed the Board that this request is covered
by.EIR 73-16, adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Joe Byron was present at
the meeting. There being no one to address the Board on this pro-
ject, the public -hearing was closed,

The Board reviewed architectural treatment and striping for the
proposed facility.
ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 76-87
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. Granting of the use permit request does not constitute granting
of special privilege, but only grants parity with other uses
in the industrial park upon which the City has previously approved
similar facilities.
2. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated December 20, 1976, shall be
the approved layout.
In its approval action, the Board of Zoning Adjustments considered

2. If the loading and unloading area is in fact a floor area,

similar material to that used for the main structure.

Applicant: Joe Byron
To permit the construction of a 12,000 square foot industrial
building pursuant to Section 9511 of the Huntington Beach Ordin-
ance Code, located on the south side of Commercial Drive approxi-
mately 265 feet west of Graham Street in a 100-M1-A-20,000,
Restricted Manufacturing District.
Chairman Crosby informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Joe Byron was present at the meeting.
The Board reviewed the request, considering turning radius required
by code and setbacks from interior property lines.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO.
76-194 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated December 20, 1976, shall
be the approved layout, subject to the following modifica-
tion:
If there have been plans previously approved for the abutting
properties to the west and south at zero setback, the six (6)
inch setback as shown on the plan shall he revised to reflect
zero setback. If, however, there are no plans approved for
the abutting properties or if the yard area for any plans
which have been approved for said properties is devoted to
open space or parking adjacent to the subject site, the six
(6) inch setback shall be permitted.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
. Parking layout;
Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;

2. The following plans shall be submitted to the Department of
Building and Community Development:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and landscap-
ing specifications on file in the Department of Public
Works.
b. Rooftop mechanical equipment screening plan, if applicable.
Said plan shall indicate screening of all rooftop mechan-
ical equipment and shlll delineate the type of material
proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and devices

increasing the overall square footage of the building.

To permit a two (2) lot division of land pursuant to Section 9921
of the Huntington Beach Ordinance Code, located on the east side
of Beach Boulevard approximately 660 feet south of Ellis Avenue
in a C4, Highway Commercial District.
Chairman Crosby informed the Board that this request is covered by
Negative Declaration,No. 76-113, adopted by the Board on December
3, 1976, upon approval of AR 76-175.
Louis Graziadio was present at the meeting and indicated his re-
ceipt of and concurrence with the suggested conditions of approval.
ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO.
76-68 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING
VOTE:

TENTATIVE PARCEL MAP NO. 76-66
Applicant: Douglas Snyder
To permit a four (4) lot division of land pursuant to Section 9921
of the Huntington Beach Ordinance Code, located at the southwest
corner of Beach Boulevard and Garfield Avenue in a C2, General
Business District.
Dick Hunsaker was present at the meeting and requested that this
item, which had been conditionally approved by the Board at its
December 29, 1976, meeting, be reconsidered for possible amendment
to the conditions of approval. He explained that one of the major
lessees for the subject shopping center had requested the extension
of Lot 1 as access to Beach Boulevard; he further indicated a
willingness to record reciprocal agreements on the total parcel
in order to maintain free access and use of the parking for all
uses within the center.
ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD VOTED TO RECON-
SIDER THE ABOVE -REFERENCED APPLICATION, BASED UPON NEW INFORMATION,
BY THE FOLLOWING VOTE:

The Board reviewed the request. Secretary Palin discussed the
possibility that a subsequent sign request might be filed on
Beach Boulevard on the thirteen foot panhandle, and noted the need
for a comprehensive sign program for the entire center to preclude
such action.
ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD AMENDED THE CONDI-
TIONS OF APPROVAL FOR TENTATIVE PARCEL MAP 76-66 AS FOLLOWS, BY
THE FOLLOWING VOTE:

A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR

The Board reviewed the submitted plan, which has also been
reviewed by the Department of Public Works.

Mr. Palin submitted the following reason for his "no" vote:
When the Board had granted approval to this request it had dis-
cussed with the applicant the provision of landscaping between
the first parking stall on the southerly portion of the drive and
the entry, and this landscaping is not depicted on the plan.
ELECTION OF OFFICERS:
Chairman Crosby informed the Board that according to the Board
of Zoning Adjustment Bylaws election of new officers for the year
was in order.
ON MOTION BY CROSBY AND SECOND BY PALIN THE REPRESENTATIVE OF
THE BUILDING DEPARTMENT WAS NOMINATED TO SERVE AS BZA CHAIRMAN
FOR THE YEAR 1977.
