Chairman Spencer informed the -Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. Secretary Palin reported that the applicant has contacted the Planning Department in regard to redrawing the plan and possibly filing a variance on the project, and has requested a continuance. ON MOTION BY SPENCER AND SECOND BY PALIN USE PERMIT NO. 76-31 WAS CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE REGULAR MEETING OF FEBRUARY 2, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments January 12, 1977 Page 2 PLOT PLAN AMENDMENT NO. 76-11 Applicant: Norm Haynie To permit a minor plot plan amendment to a previously approved' Planned Residential Development pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. Minor amendments include but are not limited to a reduction of three (3) units, rearrange- ment of the units, and provision of a bicycle and foot paths. Said property is generally located on the east side of Pacific Coast Highway and north of Anderson Street in an R4, High Density Residential District. Chairman Spencer informed the Board that this request is covered by EIR 74-14, prepared for Tentative Tract 5813. The Chairman opened the public hearing. No one was present to represent the application or to address the Board, and the public hearing was closed. Secretary Palin reported that the tract map for this project is scheduled for review by the Subdivision Committee and the plot plan amendment should be reviewed by the Planning Commission. ON MOTION BY PALIN AND SECOND BY CROSBY, PLOT PLAN AMENDMENT NO. 76-11 WAS REFERRED TO THE FEBRUARY 1, 1977, PLANNING CO.MMIS- SION MEETING BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE PLOT PLAN AMENDMENT NO. 76-12 Applicant.: Rodney Miller To permit a minor plot plan amendment to a previously approved racquetball club pursuant to Section 9811.4 of the Huntington Beach Ordinance Code, to increase the front yard setback from 20 feet to 30 feet. Subject property is located on the east side of Bolsa Chica Street approximately 300 feet north of Argosy Drive in an M1-A, Restricted Manufacturing District. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 76-60, adopted on approval of C.U.P. 76-19. The Chairman opened the public hearing. No one was present to represent the application or to address the Board in regard to the project, and the public hearing was closed. Secretary Palin reported that the plan submitted is to comply with the conditions of approval imposed by the Planning Commis- sion on TT 8688x and CC&Rs of the Kaiser -Aetna tract for the 30 foot setback. Mel Ott noted that the Fire Department will require one onsite fire hydrant on subject property. ON MOTION BY PALIN AND SECOND BY SPENCER, PLOT PLAN AMENDMENT NO. 76-12 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The amendment does not constitute a substantial change. 2. The proposed use of the property remains the same. 3. The adjustment results in an improved plan. CONDITIONS. OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated December 28, 1976, shall be the approved layout. In its approval action, the Board of Zoninq Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; • Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. The revised layout shall he subject to all applicable conditions of approval imposed upon Conditional Use Permit No. 76-19 and TT 8688x. 3. The approved parcel shall be the parcel delineated upon the plot plan as Parcel 14. 4. Prior to issuance of building permits a parcel map shall be submitted to the City for acceptance and recordation. 5. Board of Zoning Adjustments January 12, 1977 Page 4 ADMINISTRATIVE REVIEW NO. 76-196 Applicant: Bruce R. Spohr To permit a 1000 square foot addition to an existing single- family dwelling pursuant to Section 9354.16 of the Huntington Beach Ordinance Code, located on the west side of 12th Street approximately 150 feet south of Orange Avenue in the Townlot Specific Plan Area One, Section B. Chairman Spencer informed the Board that this request is a Categorical Exemption, Class I(e). Bruce Spohr was present at the meeting. Board review noted the following deficiencies in the plan: 1) inadequate turning radius; 2) space dimensions for required onsite parking are not in compliance with code; 3) open space is deficient; 4) the building is 64 feet long and does not pro- vide the two -foot offset as required by the specific plan; 5) no trash area is provided; 6) the drive is too narrow; 7) alley dedication of two and one-half (2-1/2) feet will be required and may affect size and layout of the unit; and 8) space dimen- sions of the garage are inadequate. The Board also noted that the plans as submitted are not clear enough to permit a determination on whether the proposed addi- tion will constitute a complete separate unit from the main dwelling, and requested that revised plans be submitted to include a floor layout of the present dwelling as well as how circulation to the addition is to be provided. Review also took into consideration the lot coverage, and the applicant was cautioned that after dedication his lot will be 115.5 feet in depth and that he should dimension his plan to the centerline of the 20-foot alley and the street. After further extensive discussion applicant indicated that he will need to completely redraw his plot plan and agreed to a continuance. Board of Zoning Adjustments January 12, 1977 Page 5 ADMINISTRATIVE REVIEW NO. 76-197 Applicant: Richard Salmonson To permit the construction of a four (4) unit apartment build- ing pursuant to Section 9231.6 of the Huntington Beach Ordin- ance Code, located on the east side of 16th Street approximately 100 feet south of Walnut Avenue in an R4, High Density Residential District. Chairman Spencer informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Board reviewed the proposed plan, finding that is it not in compliance with code requirements for setbacks from side property lines or architectural features. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 76-197 WAS DENIED BY THE FOLLOWING VOTE, FOR THE FOLLOWING REAS 014 : REASON FOR DENIAL: Request is in non-compliance with the, provisions of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-198 Applicant: Richard Salmonson To permit the construction of a four (4) unit apartment building pursuant to Section 9231.6 of the Huntington Beach Ordinance Code, located on the east side of 16th Street approximately 50 feet south of Walnut Avenue in an R4, High Density Residential District. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. Board review found the plan to conform to or exceed requirements of the ordinance code. Reciprocal easements for access were discussed. ON MOTION BY PALIN AND SECOND BY SPENCER AD.MINISTRA'.T'IVE REVIEW NO. 76-198 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: BZA 1-12-77 Page 5 Minutes, H.B. Board of. Zoning Adjustments January 12, 1977 Page 6 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUA?ICE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated December 30, 1976, shall be the approved layout, subject to the modifi- cation described herein: The plan shall be reversed on the lot to provide the oppor- tunity for use of a reciprocal driveway along the common property line between subject site and adjoining site for ingress -egress. A plan delineating said modification shall be submitted to the Department of Building and Community Development upon applica- tion for building.permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscaping and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall he submitted to the Department of Building and Community Development. 3. In accordance with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fird protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection device shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by.the Departments of Fire and Public Works. BZA 1-12-77 Page 6 Minutes, H.B. All applicable fees shall be paid prior to issuance of building permits. B. TO�BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Sixteenth Street and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A document agreeing to the provision of reciprocal drive- way easement over and across the rear twenty-five (25) feet of Lot 11o.16 shall be filed with the City. AYRS: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: TENTATIVE TRACT 9286 (Revisions to Landscaping Plan) Applicant: Foxx Development Revisions to landscaping plan as required by conditions of approval imposed on an 8-lot subdivision located at the northwest corner of Yorktown Avenue and Florida Street. Pat Spencer explained that the original plan had indicated a dec- orative masonry wall along'Yorktown. Applicants now propose to stagger the wall back to the patio areas and provide a green belt between property line and wall. The sound attenuation capabilities of the proposed wooden portions of the wall were reviewed as they would compare to the capability of a masonry wall. It was noted that the original map had been conditioned for no parking along Yorktown Avenue, precluding the possibility that the wall setback might encourage persons to park on the street. ON MOTION BY PALIN AND SECOND BY SPENCER THE REVISED LANDSCAPING LAYOUT FOR TT 9286 WAS APPROVED WITH THE FOLLOWING STIPULATION, BY THE FOLLOWING VOTE: STIPULATION: Plan is approved with the stipulation that the acoustical analysis of the wall shall be adjusted to take into consideration the wood construction vs. masonrv. Board of Zoning Adjustments January 12, 1977 Page 8 PROPOSED PROJECT ON ARGOSY DRIVE Applicant: Charles Giles The Board reviewed informally a tentative proposal for four industrial buildings at a location on Argosy Drive. Secretary Palin reported that the proponent is proposing creating a common wall construction through the middle of the rear building with openings in the wall for an interim period of indefinite time. Proponent is also desirous of constructing one wall only between these buildings, instead of two walls at zero setback. It was the consensus of the Board that this type construction could not be permitted. Mel Ott recommended that two onsite fire hydrants will be required or, if the buildings are sprinklered, one at a location in the middle of the site should be adequate. Circulation was discussed, and it was noted that in order to provide adequate space for circulation it was possible that some of the parking would have to be deleted from either side of the buildings. SIGN REQUESTS: Sign Request Applicant: Film Ad Corporation Proposal for banners to advertise a grand opening sale at a market located at the southeast corner of Brookhurst Street and Adams Avenue. The Board reviewed the requested banner signs. ON MOTION BY SPENCER AND SECOND BY PALIN THE SIGN REQUEST 14AS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received and dated January 7, 1977, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. 3.
