MINUTES: ON MOTION BY CROSBY AND SECOND BY SPENCER THE MINUTES
OF THE REGULAR MEETING OF JANUARY 5, 1977, WERE APPROVED AS

CONDITIONAL EXCEPTION NO. 77-4
Applicant: Rick Annigoni
To permit a zero (0) building setback from a dedicated easement
in lieu of the required five (5) foot setback per Section
9960.2(c) of the Huntington Beach Ordinance Code, located on the
east side of Cameron Street approximately 450 feet south of
Slater Avenue in an R3, Medium -High Densitv Residential District.
Chairman Spencer informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. Jack Lopresti was present
to represent the application and explained that the reduced set-
back is necessary to the proposed site plan. There being no other
persons to address the Board on this matter, the public hearing
was closed.
Bruce Crosby noted that the Department of Public Works has
received a grant deed for the easement along the south property
line and a hold harmless letter from the applicant, absolving
the City from liability for potential damage to structures.which
may be sited within the reduced setback. Mr. Crosby informed
the applicant's representative that it will be necessary to
submit proof to the City that the footings of proposed structures
will have no surcharge on the 36-inch drainage pipe to be in-
stalled within the easement. The drainage system is to be a

master -planned system to serve the entire area; the developer
of subject project will install the pipe within his easement,
plug both ends, and connect when the City completes the drain
system. In the meantime drainage will be handled by a temporary
open channel designed to the approval of the Department of
Public Works.
Secretary Palin reviewed the history of applications on this
site, noting that a previous use permit for this project had
been withdrawn and not resubmitted. After review of the code
requirements, it was the consensus of the Board that a use permit
will be required, and the applicant agreed to a continuance until
such time as'said request is submitted.

To permit a four (4) lot division of land pursuant to Section
9921 of the Huntington Beach Ordinance Code, located at the
northeast corner of Beach Boulevard and Atlanta Avenue in a C4,
Highway Commercial District.
Chairman Palin informed the Board that this request is covered
by'Negative Declaration No. 77-1.
Mr. Williams was present at the meeting and indicated his re-
ceipt of and concurrence with the suggested conditions of approval
forwarded to him.
The Board discussed the need for a radius on Lot 4; Public Worka
will determine if such radius will be obtained by City vacation
of a portion of the street or by dedication. In either case, it
will be reflected on the parcel map. Street improvements were
also discussed.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR
ANY PURPOSE:
1. The tentative parcel map received by the Planning Department
on January 4, 1977, shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works and recorded with the Orange
Countv Recorder. Said parcel map submitted for acceptance
and recordation shall be revised if necessary to reflect a
radius on the northwest corner of Parcel 4, subject to the
approval of,the Department of Public Works of the City of
Huntington Beach.
3. Beach Boulevard and the street presently designated on the
parcel map as "A" Street shall be dedicated and improved to
City standards at the time said parcels are developed.
4. Hater supply shall be through the City of Huntington Beach
water system at the time said parcels are developed.
5. Sewage disposal shall be through the City of Huntington
Beach sewage system at the time said parcels are developed.
6. All utilities shall be installed underground at the time
said parcels are developed.
7. Compliance with all applicable City ordinances.
8. The flood control channel shall be fenced to Flood Control
District and City standards at the time said parcels are
developed.

Specific Plan Area One, Section B.
Chairman Spencer informed the Board that all of the above
requests are Categorical Exemptions, Class III, California
Environmental Quality Act, 1970.
Dick Broadway was present at the meeting.
The site plan was found to be deficient in total open space
and the third unit short of the required recreation area by
approximately 50 square feet. Also, the unit floor area exceeds
the maximum allowed under the specific plan, and the Board dis-
cussed how the calculations had been made and the interpretation
of the code as it applies to staircases_ and the laundry areas.
It was the determination that the ,laundry areas must be included
in the calculations and applicant was instructed to revise his
plans accordingly. The encroachment of the laundry doors into
the clear net dimension of the adjacent parking space was dis-
cussed - the revised plan will be redesigned to correct this en-
croachment.
Applicant was instructed to resubmit one plan revised to reflect
the above discussion. Plan shall be crosshatched in open spaces,
shall reflect the additional recreation space for Unit 3, and
the redesign for the laundry doors. Plan shall also indicate
reduced floor area as noted and show how calculations were arrived
at. This revised plan shall suffice for all of the above -listed
administrative review applications.
