Applicant: Bruce R. Spohr
To permit a 1000 square foot addition to an existing single-family
dwelling pursuant to Section 9354.16 of the Huntington Beach
Ordinance Code, located on the west side of 12th Street approxi-
mately 150 feet south of Orange Avenue in the Townlot Specific
Plan Area One, Section B.
Chairman Lipps informed the Board that this request is a Categori-
cal Exemption, Class I(e), California Environmental Quality Act,
1970.
Secretary Palin reported that revised plans have been received
to comply with the original comments of the Board. Bruce Crosby
noted that the parkway from curb face should indicate a dimension
of 12'6". The Board reviewed the location and square footage of
the open space provided on the plan.

The plan submitted to the Department of Building and Com-
munity Development upon application for building permits
shall be revised to reflect the additional recreational open
space in front of the dwelling. Said open space shall be
physically separated from the remaining front yard area by
a fence or other physical means to a height of five or six
feet.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
• Lot width and lot depth;
• Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action -regarding this property.
2. In accordance with the City's standards and requirements
an additional two and one-half (2-1/2.) feet of right-of-
way on the alley shall be dedicated.
3. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm sys-
tems, and any other required fire protection and detection
systems or devices shall comply with the specifications of
the Huntington Beach Fire Code. Plans for such systems
and devices shall be submitted to the Pire Department and
shall be subject to approval by the Departments of Fire and
Public Works.
4. The developer shall participate in the local drainage assess-
ment district.
5. All applicable .fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Twelfth Street and the alley shall be improved to the
centerlines of such rights -of -way. Said improvement shall
include curbs, gutters, sidewalks, paving, street trees,
street lights, street signs, street drainage, and sewer and
water main extensions, in full compliance with the City of
Huntington Beach street standards and requirements.

ADMINISTRATIVE REVIEW NO. 77-3 (Lots 6 and 8, Block 415)
Applicant: Foxx Development Company
To permit the construction of one three (3) unit apartment building
pursuant to Section 9354.16 of the Huntington Beach Ordinance Code,
located on the east side of 16th Street approximately 50 feet north
of Orange Avenue in the Townlot Specific Plan Area One, Section B.
Chairman Lipps informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Dick Broadway was present at the meeting.
Flan check on the revised plan indicates that the plan is still some-
what short in total open space and will have to be conditioned to
comply. The open space for Unit 3 was extensively discussed and it
was determined that balconies do not necessarily have to be large
enough to serve the total open space requirements for upstairs units,
but that some of this open space can be provided at ground level.
Alternative methods of providing said open space for Unit 3 on this
plan were reviewed and it was the consensus that the space between
the stairway to Unit 3 and the building'wall of Unit 2 could be sep-
arated by fencing to provide part of the said open space requirement.
Circulation for adequate access to all units was reviewed, as well
as proper access to the laundry room and trash areas.
ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO.
77-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The site plan received and dated January 26, 1977, shall be
the approved conceptual layout, subject to the modifica-
tions described herein:
a. The open space area between the stairway to Unit 3 and
the face of the building on Unit 2 shall be physically
separated through the use of fencing for a private patio
area for exclusive use of Unit 3.
b. The plan shall comply with Ordinance Code requirements
for the total open space area for subject property.
A plan delineating said modifications shall be submitted
to the Department of Building and Community Development at
the time of application for building permits.
2. A landscaping and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping

and any other required fire protection and detection devices
or systems shall comply with the specifications of the

Works.

ment district.
7. All applicable fees shall be paid prior to issuance of

Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. Laundry area and trash enclosure doors shall be revised to
eliminate any type of encroachment upon the net dimensions
of the parking spaces immediately adjacent to these facilities.
2. The onsite pedestrian circulation shall be shown upon the
plan submitted to the Department of Building and Community
Development upon application for building permits, to assure
that the circulation is as shown upon the plan submitted
to the Board for review for access to all units.

3. A minor subdivision map shall be filed with the Planning
Department to eliminate the lot line between Lots 6 and 8
if such procedure is enacted by the City prior to occupancy
of the units. If no such procedure is in effect, a tenta-
tive parcel map shall be filed for said purpose.

suant to Section 9354.16 of the Huntington Beach Ordinance Code,
located on the west side of 16th Street approximately 100 feet south
of Pecan Avenue in the Townlot Specific Plan Area One, Section B.
Chairman Lipps informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Dick Broadway was present at the meeting.
Plan check on the revised plan indicated that the plan is still some-
what short in total open space and will have to be conditioned to
comply. The open space for Unit 3 was extensively discussed and alter-
native methods of meeting the open space requirement reviewed. It
was the consensus that the space between the stairway to Unit 3 and
the building wall of Unit 2 could be separated by fencing to provide
part of the said open space requirement. Circulation for adequate
access to all units, proper access to the laundry room and trash areas,
and the relationship of this property to the oil operation to the
south were also reviewed.

to separate this project from the oil well operation on
the abutting property.

Chairman Lipps informed the Board that this request is a Categori-
cal Exemption, Class III, California Environmental Quality Act,
1970.
Dick Broadway was present at the meeting.
Plan check on the revised plan indicated that the plan is still
somewhat short in total open space and will have to be conditioned
to comply. The open space for Unit 3 was extensively discussed and
alternative methods of meeting the open space requirements reviewed.
It was the consensus that the space between the stairway to Unit 3
and the building wall of Unit 2 could be separated by fencing to
provide part of the said open space requirement. Circulation for
adequate access to all,units and proper access to the laundry room
and trash areas were also reviewed.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The site plan received and dated January 26, 1977, shall
be the approved conceptual layout, subject to the modifi-
cations described herein:
a. The open space area between the stairway to Unit 3 and
the face of the building on Unit 2 shall be physically
separated through the use of fencing for a private
patio area for exclusive use of Unit 3.
b. The plan shall comply with Ordinance Code requirements
for the total open space area for subject property.
A plan delineating said modifications shall be submitted
to the Department of Building and Community Development at
the time of application for building permits.
2. A landscaping and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works

munity Development.
3. In accordance with City standards and requirements, an addi-
tional two and one-half (2-1/2) feet of right-of-way on the

5. Fire protection systems, including automatic sprinkler sys-

and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public

6. The developer shall participate in the local drainage
assessment district.
7. All applicable fees shall be paid prior to issuance of

1. Laundry area and trash enclosure doors shall be revised to
eliminate any type of encroachment upon the net dimensions

2. The onsite pedestrian circulation shall be shown upon the
plan submitted to the Department of Building and Community
Development upon application for building permits, to assure
that the circulation is as shown upon the plan submitted to

3. A minor subdivision map shall be filed with the Planning

Chairman Lipps informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
The Board reviewed the request, noting that the setbacks do not
conform to the minimum 15 feet required in the industrial park.
The possibility of applying for a variance to permit averaging
of setback was discussed with the applicant and alternative
approaches suggested. It was noted that parking provided is over
code requirements, the turning radius is 27 instead of the per-
mitted 25, and there is a permitted projection over a landscaped
planter area, all of which might serve to increase the efficiency
of the plan and attain the necessary setback. Reciprocal drives
were also discussed. After lengthy discussion, the applicant
determined to accept approval with a condition for the legal
setback, reserving the conditional exception option to exercise
at a later date if so desired. It was the consensus of the Board
that the columns could be considered an architectural feature
and allowed to project into the setback.

Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public
Works.
5. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
`l. Street trees shall be installed in compliance with the
conditions of approval imposed on Tentative Tract 6943.
C. GENERAL CONDITIONS:
1. Fencing and a gate as required by Section 9515 of the Hunt-
ington Beach Ordinance Code shall be at a minimum setback of
twenty-five (25) feet.
2. The plan shall be revised to indicate true setback from the
property line.
