REGULAR MEETING OF JANUARY 19, 1977, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 77-5 (In Conj./UP 76-81) Applicant: Ni-Mar Enterprises To permit a 10-foot encroachment into the required 10 foot rear yard setback in lieu of Section 9203.3 of the Huntington Beach Ordinance Code, located at the northwest corner of Green Street and Warner Avenue in an R3, Medium -High Density Residential District. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Michael Mueller was present to represent the application and addressed the Board, citing other buildings in the area which are at zero setback. He indicated that the architect has met with the Department of Public Works and ob- tained concurrence with the access on Warner Avenue. He also noted that the dedication was made on Warner Avenue about six months ago. There being no other persons to address the Board in regard to this project, the public hearing was closed. Bruce Crosby explained that the Department of Public Works had determined that there is practically, no frontage on Green Street available for access and for this reason had decided not to adhere strictly to the code requirement for no access from the arterial. The Board reviewed' -the uses and structures on surrounding proper- ties, the density permitted by code, and possible alternative duplex development which would fit the.site and comply with code. Board of Zoning Adjustments February 2, 1977 Page 2 ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-5 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The hardship is a self-imposed hardship resulting from the proponent's desire to have a third unit on this property rather than a two -unit development similar to those projects which the Board has recently approved on lots of the same size and shape to the west of subject site. 2. The granting of a variance would establish a dangerous prece- dent in the community by: a. Permitting utilization of an arterial highway for access; and b. Allowing the proposed intensity of development within the close proximity to a major arterial, thereby subjecting future residents to massive noise levels, particularly within Unit 3 which is proposed to be constructed over the garage. 3. The design and layout of the garages could create a safety hazard by allowing a situation where people may attempt -to back out into the flow of traffic on Warner Avenue. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PER!1IT NO. 76-81 (In Conj./CE 77-5) Applicant: Ni-Mar Enterprises To permit the construction of a triplex abutting an arterial street pursuant to Section 9201.4 of the Huntington Beach Ordinance Code, located on the northwest corner of Warner Avenue and Green Street in an R3, Medium -High Density Residential District. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality. Act, 1970. The Chairman opened the public hearing. Michael Mueller was pre- sent to represent the request. There being no one present to address the Board on this matter, the public hearing was closed. The Board determined that the same objections raised on the condi- tional exception applied here also, and discussed possible alterna- tive design or reduction in density to accommodate construction. ON P4OTION BY PALIrI AND SECOND BY SPENCER USE PERMIT NO. 76-81 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The above application could not be approved, as the Board had not found sufficient ,justification for .approval ,of Conditional Exception 77-5, filed in conjunction with this request, 2. The proponent has submitted for review and approval action a plan which through its design and layout creates a situation whereby ',the third additional -onsite covered parking space j c'ould' require `an 'automobile 'to back into the flow of traffic on Warner Avenue if there'wereIa vehicle parked•in'front of the other two onsite covered parking spaces. 3. This application is denied without prejudice. Jack Lopresti, Leonard Wood, and Rick Annigoni were'present at the meeting. There being j no other.persons present to address the Board on this request, the public hearing was closed.• ; :The,Board'reviewed'the request, noting that the proposed encroach- ment is minimal. Bruce Crosby explained the City's plans for the drainage of the area and said that Public Works`•sees'no difficulty with the proposed structure. The location of proposed structures to the immediate south of the easement on the adjacent property was also,discussed. ON -MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL -EXCEPTION NO. 77-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY .THE FOLLOWING VOTE: BZA 2-2-77 Page 3 Minutes, H.B. Board of Zoning Adjustments February 2, 1977 Page 4 FINDINGS OF THE BOARD: 1. The granting of a Conditional Exception will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 2. The topographical features of the area impose certain constraints upon subject property which make granting of the conditional exception necessary to provide the developer with parity to sur- rounding properties (the,property is at the lowest grade in the vicinity, requiring installation of the drainage easement there- on for the drainage of this and other properties). 3. It has been determined that the applicant has met the intent of the code for adequate access for maintenance of the pipe within the drainage and for assuring that no surcharge will re- sult upon said pipe. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated January 7, 1977, shall be the approved layout. 2. The applicant shall submit a "hold harmless" letter to the City to. absolve the City of any responsibility if necessary maintenance work within the easement should result in any damage to subject property or structures. Said letter shall be subject to the approval of the City Attorney for form and content and shall become a part of the permanent file on subject project. 3. The applicant shall provide proof that there will be no surcharge on the drainage pipe by submitting engineering calculations for the footings along the southerly property line for that portion of the building encroaching into the easement. Said proof shall be submitted to the Departments of Public Works and Building and Community Development and shall be subject to approval by said departments. 4. Applicant shall construct a 36" RCP drain through his property, to be plugged at both ends. This pipe will be a part of the City's Master Plan Storm Drain system and will be within the 10-foot drainage easement dedicated to the City. 5. Applicant shall construct an interim drainage channel along the south property line capable of carrying 25 c.f.s. The above permanent and temporary installations must be shown on the project improvement plans for final approval. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 77-6 (In Conj./CE 77-4) Applicant: Rick Annigoni To permit the construction of an apartment building extending more than the 150 feet from a public street pursuant to Section 9202.3.1.4 of the Huntington Beach Ordinance Code, located on the east side of Cameron Street approximately 450 feet south of Slater Avenue in an R3, Medium -High Density Residential District. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 76-39. The Chairman opened the public hearing. Jack Lopresti, Leonard Wood, and Rick Annigoni were present at the meeting. There being no persons in the audience to address the Board on this request, the public hearing was closed. Secretary Palin reported to the Board that the Negative Declara- tion for this proposal had been tabled to permit the drainage to be worked out, which has since been accomplished to the satisfaction of the Department of Public Works. The negative declaration request form was reviewed by the Board members. The Board discussed extensively the grading of the site and its effects on the design for the drainage system. Conflicts of the temporary system with open parking areas, decorative planters, and the trash area indicated for the south side of the property were also reviewed, with Mr. Annigoni agreeing that the planter and trash area could be relocated if necessary. He was instructed by the Board to design some type of radius approach with a raised curb to provide adequate maneuverability into the parking at this location. ON MOTION BY PALIN AND SECOND BY SPENCER NEGATIVE DECLARATION NO. 76-39 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY SPENCER USE PERMIT NO. 77-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The general welfare of persons residing or working in 'the vicinity; b. Property and improvements in the vicinity of such use or building. 2. CONDITIONS OF'APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated January 7, 1977,'shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual pla : Traffic circulation and drives; Parking layout; . Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the IF immediate vicinity; Past administrative action regarding this property.. 2. A landscaping and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Department of Building and Community Development. 3. In accordance with the City's standards and requirements an additional ten (10) feet of right-of-way on Cameron Street shall be dedicated. 4. Soil and compaction reports shall be submitted by -a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hvdrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntingt Beach Fire Code. Plans for such systems and devices shall b submitted to the Fire Department and shall be subject to approval by the Departments of"Fire and Public Works. BZA 2-2-77 Page 6 i ! Minutes, H.B. The developer shall participate in the Orange County Sanita- tion District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Cameron Street shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 2. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 3. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 4. Low -volume heads shall be used on all spigots and water faucets. 5. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. 6. ADMINISTRATIVE REVIEW No. 77-1 (In Conj./UP 77-1) Applicant: Sid Lance To permit.the construction of two (2) industrial buildings (total of 55,000 square feet) pursuant to Section 9511,of the Hunt- ington Beach Ordinance Code, located on ,the north ,side of Argosy Drive approximately 1300 feet west of Graham Street in an M1-A, Restricted Manufacturing District. Chairman Spencer opened the public hearing on the Use Permit; there being no one present.to represent the application or to address the Board in regard to the project, the public hearing was closed. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. No one was present to ! represent the application nor to address the Board from the audi- ence in regard to the proposal, and the public hearing was closed. Review by the Board determined the request to be in conformance to code requirements for percentage of floor space and signing per- mitted. Montgomery To permit the construction of two (2) duplex dwellings abutting an arterial street pursuant to Section 9161.4(a) of the Huntington Beach Ordinance Code, located on the east side of Delaware Street approximately 200 feet north of Utica Avenue in an R2, Medium Density Residential District. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. No one was present to ad- dress the Board, and the public hearing was closed. Board review found the proposed elevations to be acceptable, but it was noted that fences are proposed within the front yard set- back area in violation of code requirements. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-7 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The plot plan received and dated January 25, 1977, shall be the approved layout, subject to the following modifi- cation: Any structure over forty-two (42) inches in height located within the front yard area on either Delaware Street or j the local street shall comply with front yard setback requirements of the Huntington Beach Ordinance.Code. The plan submitted to the Department of Building and Community Development upon application for building permits shall deline- ate the above required setbacks. i In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Dorothy Walker -was present to represent the application, and indicated her receipt of and concurrence with the suggested conditions of approval. The Board reviewed the plan and discussed additional conditions of approval, to which the applicant also concurred. ON MOTION BY PALIN AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 77-2 WAS APPROVED WITH,THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on January 21, 1977, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of'Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 4. Sewage disposal shall be through the City of Huntington Beach sewage system at the -time said parcels are developed. 5. All utilities shall be installed underground at the time said parcels are developed. 6.- Compliance with all applicable City ordinances. 7. A copy of the recorded parcel map shall be filed with the Planning Department. 8. Ingress -egress and turning radius rights shall be granted over and across the common driveway for each parcel to the other. 9. Montgomery To permit the construction of two (2) single-family dwellings pur- suant to Section 9354.16 of the Huntington Beach Ordinance Code, located at the northeast corner of 16th Street and Acacia Avenue in the Townlot Specific Plan Area One, Section A. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. Board review determined that there are difficulties with the pro- posal (excessive length of building without required inset, lack of adequate provision for utility and trash area, and improper setbacks for the construction'as proposed). It was the consensus that the request should be continued to permit applicant to work out the problems. He noted that the staff had met with the developers and agreed that if applicants could provide proof that there is sufficient landscaping existing within the Signal - Landmark tract adjacent to the center to meet the intent of the original condition (which was to provide buffering between the two projects for noise and visual intrusion), the Board might reconsider the requirement through reapproval of a revised plan. It was the determination of the Board that the hedge as shown on the property line does not reflect the information conveyed by staff to the pro- ponent, and that photographs showing existing landscaping should be submitted for evaluation as well as the originally requested section through the landscaping showing relationship of landscaping to elevations of the structures. Upon receipt of said information, the Board will review and make a determination on whether to consider a revised landscaping plan.
