trict.

Applicant: Sid Lance Construction
To permit the construction of two (2) industrial buildings (total
of 55,000 square feet) pursuant to Section 9511 of the Huntington
Beach Ordinance Code, located on the north side of Argosy Drive
approximately 1300 feet west of Graham Street in an Ml-A, Restric-
ted manufacturing District.
Chairman Lipps informed the Board that the above applications are
covered by EIR 73-16, adopted by the City Council on March 18,
1974.
The Chairman opened the public hearing on the Use Permit; there
being no one present to speak on the proposed projects, the
public hearing was closed.
Secretary Palin reported that the applicant has again requested
a continuance on these items.

Chairman Lipps informed the Board that this request is a Categ-
orical Exemption, Class III, California Environmental Quality
Act, 1970.
No one was present to represent the application.
The revised plan was reviewed by the Board, taking into consid-
eration whether the proposed jog in the wall complied with the
intent of the code requirements for yard and patio area desira-
bility and visual appearance.
ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO.
77-14 WAS APPROVED WITH THE FOLLOTIING CONDITIONS, BY THE,FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated January 25, 1977, shall be
the approved layout, subject to the modification described
herein:
a. The unit located at 604 16th Street shall be a reversed
plan and shall be constructed at zero common setback
with the adjacent unit on Lot 2 of Block 615.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. In accordance with the City's standards and requirements, an
additional two and one-half (2-1/2) feet of right-of-way on
the alley and a twenty (20) foot radius at the intersection of
Acacia Avenue and 16th Street shall be dedicated.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the Depart-
ment of Building and Community Development and shall be subject
to approval by that Department.
4. Fire protection 'systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any

other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be sub-
mitted to the Fire Department and shall be subject to approval by
the Departments of Fire and Public Works.
5. The developer shall participate in the local drainage assessment
district.
6. All applicable fees shall be paid prior to issuance of building
permits.
B. TO BE -COMPLETED PRIOR.TO FINAL INSPECTION:
1. Sixteenth Street, Acacia Avenue, and the alley shall be improved
to the centerlines of'such rights -of -way. Said improvements
shall include curbs, gutters, sidewalks, paving, street trees,
street lights, street signs, street drainage, and sewer and
water main extensions, in full compliance with the City of
Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. The revised plot plan incorporating the above conditions of
approval shall be submitted to the Board of Zoning Adjustments
for review and approval action prior to issuance of building
permits.

CONDITIONAL EXCEPTION NO. 77-6
Applicant: Michael Janes
To permit a two foot, six inch (2'6") encroachment into the five
(5) foot required building setback from an easement in lieu of
Section 9960.2(e) of the Huntington Beach Ordinance Code, located
at the northeast corner of Jib Circle and Rudder Drive in an R2,
Medium Density Residential District.
Chairman Lipps informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. George Alvarez was pre-
sent at the meeting; he explained that his company had been unaware
of the easement requirements when the project was designed, and
presented engineering drawings and calculations to show that there
should be no surcharge on the pipes within the easement as a
result of the encroachment.

Two owners of property in the general area questioned the Board
in regard to the exact location of the subject site and its
possible effects on their properties. There being no other
persons to address the Board on this request, the public hearing
was closed.
Bruce Crosby reported to the Board that the sewer pipe within
the easement will be located 3 feet south of the north line of
the easement and at a depth of 8.5 feet - said location will
place the pipe 9'6" from the footing of the encroaching structure.
ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION
NO. 77-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The location of the pipe seven (7) feet north of the south line
of the easement (rather than right in the center of the easement)
makes the pipe nine and one-half (9-1/2) feet away from the foot-
ing of subject building and the intent of the code requirement
was for a ten (10) foot separation; thus, the difference in set-
back will be minimal.
2. The intent of the ordinance code is to assure adequate room for
maintenance of the pipe and to assure that there will be no
surcharge on the pipe in the easement, and these requirements
have been met by the applicant.
3. The granting of the Conditional Exception will not be materially
detrimental to the public welfare or injurious to property in
the same zone classification.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plan received and dated January 24, 1977. shall be the
approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

2. A "hold harmless" letter shall be submitted to the City and

3. Calculations proving that the reduced setback will not
result in surcharge on the drainage pipe shall be sub-

Applicant: Gary Cheatley
To permit a reduction of the minimum required open space dimen-
sion from 20 feet to 15 feet for only 100 square feet of the re-
quired 900 square feet in lieu of Section 9103.3.1.1.2 of the
Huntington Beach Ordinance Code, located on the west side of Aria
Circle approximately 70 feet north of Prelude Drive in an R1,
Low Density Residential District.
Chairman Lipps informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. Mrs. Cheatley and Bill
De Mille were present at the hearing and explained their reasons
for requesting the exception. There being no other persons to
address the Board on this project, the public hearing was closed.
Board discussion ensued.
ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 77-7 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The granting of a Conditional Exception will not be materially
detrimental to the public welfare, or injurious to property in the
same zone classifications.
2. There will be 1254 square feet of open space remaining within
the rear two-thirds of the yard, which would comply with the
open space standards in effect when the map was recorded on
March 19, 1969.
3. The subject request is for a reduction in the dimension on only
100 feet of the overall 900 feet which was required of the
dwelling when it was constructed.
4. The Planning Commission in recent revisions to the ordinance
code has set forth open space ratios on width of properties,

and subject property would comply with those requirements
only for the date of recordation of the map.

an RA-0, Residential -Agricultural combined with Oil Production
District.
Chairman Lipps informed the Board that this request is covered
by Negative Declaration No. 77-6.
Herb Day was present to represent the application.
The Board reviewed the location of the proposed reactivation, the
information contained in the negative declaration request, and
the letter of recommendations from the Oil Field Supervisor.

Chairman Lipps informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Jeri Tarrant was present to represent the application, and indi-
cated her receipt of and concurrence with the suggested conditions
of approval.

Chairman Lipps informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Jeri Tarrant was present at the meeting.
Board discussion included reciprocal access easements, setbacks,
and landscaping. Mel Ott informed the applicant that the Fire
Department has not yet made a determination on the number or loca-
tion of both on- and off -site fire hydrants which may be needed
on this and the subsequent AR applications nos. 19, 20, 21, 22,
and 23 scheduled to be reviewed at this meeting, but that she
should be aware that some will be required.

77-18 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:.
1. The plot plan received and dated February 2, 1977, shall
be the approved layout, subject to the following modifica-
tion:
a. If the proposed building is adjacent to an already -
developed property which does not have open yard area
abutting subject construction, the plan shall be revised
to reflect zero setback at that location.
A plan delineating said modification it necessary shall be
submitted to the Department of Building and Community Devel-
opment upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

. Lot width and lot depth;

immediate vicinity;

2. An agreement shall be filed and recorded granting reciprocal
easements over and across the easterly fifteen (15) feet of
subject property for ingress -egress to the parcel to the east.
3. The following plans shall be submitted to the Department
of Building and Community Development:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan, if applicable.
Said plan shall indicate screening of all rooftop mechani-
cal equipment and shall delineate the type of material
proposed to screen said equipment.
4. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall be
subject to approval by that Department.

5. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems,and any
other required fire protection and detection devices or sys-
.tems shall comply with the specifications of the Huntington
Deach Fire Code. Plans for such systems and devices shall be
submitted to the Fire Department and shall be subject to ap-
proval by the Departments of Fire and Public Works.
6. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Trees shall be installed in compliance with the conditions
of approval imposed upon TT 6948.
C. GENERAL CONDITIONS:
1. A landscaped area shall be provided between the parking spaces
on this Parcel 5 and the parcel to the east, to facilitate
the planting of at least one fifteen (15) gallon tree.
2. The above site would be a desirable location for a fire
hydrant if one is required by the Fire Department.

mately 375 feet west of Chemical Lane in a 100-M1-A-20,000,
Restricted Manufacturing District.
Chairman Lipps informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Jeri Tarrant was present at the meeting.
The Board reviewed the request. Secretary Palin informed the
applicant of the required depth of the screening landscaping along
the local street (11 feet back of curb line) and the allowed
25 foot turning radius for the MI -A zone. Setback requirements
were also explained.

NO.-77-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated February 2, 1977, shall
be the approved layout, subject to the following modifica-
tions:
a. If the proposed building is adjacent to an already -
developed property which does not have open yard area
abutting subject construction, the plan shall be revised

Chairman Lipps informed the Board that this request is covered
by EIR 73--16, adopted by the City Council on March 18, 1974.
Jeri Tarrant was present at the meeting.
Board review ensued. -It was noted that a 25 foot turning radius
is shown on this plan, but the curb break is shown immediately
adjacent to the interior property line, which will be disallowed by
the Department of Public Works. Setbacks and landscaping were
reviewed as above noted.

Secretary Palin advised the applicant of the eleven (11) foot
width required for screening of parking on the front property
line, the allowed 25 foot turning radius, and the setback require-
