Chairman Lipps informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Sid Lance and Webb Morrow were present to represent the application. Mr. Lance addressed the Board to explain the reasons for the request and to respond to the Board's questions on reciprocal access to the buildings. There being no other persons present to speak on the proposed pro- ject, the public hearing was closed. Board review ensued, taking into consideration the need for screen- ing the view of the truck wells from the arterial street and the methods by which vehicles would have to enter each area as shown on the plan. ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 77=8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments February 16, 1977 Page 2 FINDINGS OF THE BOARD: 1. When originally drafted, the ordinance code provisions had not taken into consideration the layout and design of the tentative tract as 'subsequently approved by the City. 2. The location of the truck well on the front of the building affords ease of operation not otherwise available. 3. Granting of the conditional exception does not constitute the granting of a special privilege not realized by similar lots of similar design on local streets. 4. The proponent has proposed that the wells will not be entered directly from the arterial highway and has proposed that adequate maneuverability will be provided onsite. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated February 7, 1977, shall be the approved .layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. Reciprocal easements for access and maneuverability shall he recorded over each lot for use by the abutting lot to obtain access to the truck wells. These areas shall be designated along the common property lines for a width of twenty (20) feet on each property line, to extend from the face of the building to within thirty-three (33) feet of the front property line. 3. Finished grade along the common property line shall be con- structed in such a fashion that drainage from one property surface into the truck well on the abutting property shall be eliminated. 4. Screening of a minimum height of six (6) feet.shall be provided along the front property line for a distance of seventy (70) feet, thirty-five (35) feet on each lot, for BZA 2-16-77 Page 2 Minutes, H.B. This screening may be a combination of berming, landscaping, and screening wall, with the screening wall not to exceed 50 percent of the overall height. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-1 (In Conj./CE 77-8 & UP 77-1) Applicant: Sid Lance Construction To permit the construction of two (2) industrial buildings (total of 55,000 square feet) pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the north side of Argosy Drive approximately 1300 feet west of Graham Street in an M1-A, Re- stricted Manufacturing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The request was reviewed by the Board. Mel Ott informed the -71 applicants that it will be necessary to install onsite fire hydrants at locations to be determined, because of restrictions of the Fire Code on distances allowed from hydrants. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 77-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated February 7, 1977, shall be the approved layout, subject to the following: a. All conditions imposed upon the approval of C.E. 77-8 shall be complied with. b. Should the Conditional Exception No. 77-8 be appealed and the approval of the Board of Zoning Adjustments overruled, this application shall become null and void. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; . The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscap- ing specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if applic- able. Said plan shall indicate screening of all roof- top mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and dev- ices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of building permits. B . GENERAL CONDITIONS: 1. The landscaping area within the street right-of-way shall be designed in compliance with the conditions of approval imposed upon the tentative tract. 2. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-1 WAS WITHDRAWN AT THE APPLICANT'S REQUEST, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-2 (In Conj./AR 77-2) Applicant: Sid Lance Construction To permit trucking and loading facilities to face a public street pursuant to Section 9518 of the Huntington Beach Ordinance Code located on the south side of Argosy Drive approximately 310 feet west of Graham Street in an M1-A, Restricted Manufacturing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Sid Lance and Webb Morrow were present at the meeting and requested withdrawal of the use permit, as the plan has been revised to make it unnecessary. There being no other persons present to speak on the request; the public hearing was closed. Board of Zoning Adjustments February 16, 1977 Page 6 ADMINISTRATIVE REVIEW NO. 77-2 Applicant: Sid Lance Construction To permit the construction of a 41,697 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ord- inance Code, located on the south side of Argosy Drive approxi- mately 310 feet west of Graham Street in an M1-A, Restricted Manufacturing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Sid Lance and Webb Morrow were present at the meeting. Board review noted a deficiency in the parking space count and alternate layouts were discussed as a means of picking up addi- tional.spaces; it was the consensus of the Board that 82 of the required 83 spaces would be adequate. The applicant was informed of the need for one of the curb cuts to be common with the ad- joining property on the west, the landscaping requirements, and the need for a physical barrier of some kind between the driveway and the truck well on the side of the building. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated February 7, 1977, shall be the approved layout, subject to the modifications de- scribed herein: a. The plan shall be revised to show a reciprocal driveway for ingress -egress over the common property line with the property to the west. h. The revised plan shall reflect a minimum of eighty-two (82) parking spaces. The above modifications shall be delineated upon the plan submitted to the Department of Building and Community De- velopment upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if applicable. Said plan shall indicate screening of all rooftop mechani- cal equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the De- partment of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants (including an onsite hydrant), fire alarm systems, and any other required fire pro- tection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of build- ing permits. B. GENERAL CONDITIONS: 1. A minimum of two (2) 20-inch box trees shall be incorporated in the landscaping along the front property line. 2. The plan shall incorporate the standard treatment for the turfed area within the ultimate right-of-way for installation and maintenance. Goodman To permit the construction of a twelve (12) unit apartment build- ing pursuant to Section 9201.4(b) of the Huntington Beach Ord- inance Code, located on the east side of Cameron Street approxi- mately 450 feet south of Slater Avenue in the R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by ND 77-8. The Chairman opened the public hearing on the Negative Declara- tion. The Board reviewed the information contained in•the nega- tive declaration request form and considered mitigation measures applicable to the project. There being no persons present to address the Board in regard to this negative declaration, the pub- lic hearing was closed. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-8 WITH THE FOLLOWING MITIGATION MEASURES, BY THE FOLLOW- ING VOTE: MITIGATION MEASURES: 1. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. The structures on subject property, whether attached or det- ached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 5. If the offstreet parking area is lighted, the use of energy - saving lighting such as high pressure sodium vapor lamps, shall be considered. 6. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). BZA 2-16-77 Page 8 Minutes, H.B. Board of Zoning Adjustments February 16, 1977 Page 9 7. Low -volume heads shall be used on all spigots and water faucets. 8. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are avail- able at the time of construction. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE The Chairman opened the public hearing on the use permit. William Goodman was present at the meeting. There being no one to speak for or against the proposed project, the public hearing was closed. The Board discussed the revised plan with the applicant. Items taken into consideration were the balconies provided, the means of entry to the second -floor units, the method of control on the security gate, and the narrow side yards indicated on the plan. Alternate orientation of the buildings or offsets were discussed in order to provide some more meaningful open space areas than exist on the present plan, and the applicant indicated that he had a plan prepared which he felt would provide more individual, private open space for future tenants. However, this plan would not conform to code requirements for common open space. After extensive discussion of the apartment standards and their applicability to apartment complexes of this size, it was the consensus of the Board that the applicant should submit a condi- tional exception application for consideration of this alternate plan; however no commitment on approval or disapproval of said plan could be made. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 77-8 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF MARCH 2, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-17 Applicant: Ronald O. Montgomery To permit the construction of a 14,000 square foot industrial building pursuant to Section 9530 of the Huntington Beach Ord- inance Code, located on the west side of Crabb Lane at Liberty Avenue in an Ml, Light Manufacturing District. BZA 2-16-77 Page 9 Minutes, H.B. Board of Zoning Adjustments February 16, 1977 Page 10 Chairman Lipps informed the Board that this request is covered by ND 77-7. No one was present to represent the applicant. The Chairman opened the public hearing on the negative declara- tion request; there being no one present to address the Board, the public hearing was closed. The Board reviewed the information presented in the negative declaration request and considered mitigating measures applicable to the project. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARA- TION REQUEST NO. 77-7 WITH THE FOLLOWING MITIGATION MFASURES, BY THE FOLLOWING VOTE: MITIGATION MEASURES: 1. Crabb Lane shall be fully improved, said improvements to include concrete curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. A tentative parcel map shall be filed, approved, and recorded to consolidate the three (3) lots within subject project. Said map should indicate the purpose of the ten (10) foot easement designated on the plan. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-25 Applicant: Ni-Mar Enterprises To permit the construction of an 11,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ind- ustrial Code, located at the southwest corner of Graham Street and Industrial Lane in a 100-M1-A-20,000, Restricted Manufactur- ing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Nick Becker and Fred Mayer were present to represent the applica- tion. Secretary Palin noted that the plan appears to show an overhead door on Graham Street, as well as overhead doors on Industrial Drive. The applicant was informed that no door could be per- mitted on Graham without the filing of a variance, and that a use permit application would be required for the doors on Ind- ustrial. Mr. Mayer told the Board that the door on Graham would be changed to a double glass door for access into the building. In its review the Board considered parking, landscaping, and turning radius into the facility. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 77-25 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL:' A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated February 8, 1977, shall be the approved layout, subject to the modifi- cation described herein: a. If the proponent chooses to pursue the design and layout of the ramp facility on Industrial Drive, a Use Permit applica- tion shall be filed and approved prior to the issuance of building permits. 3. The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscap- ing specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the De- partment of Building and Community Development and shall be subject to approval by that Department. 5. Board of Zoning Adjustments February 16, 1977 Page 14 ADMINISTRATIVE REVIEW NO. 77-26 Applicant: Ni-Mar Enterprises To permit the construction of a 17,700 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ord- inance Code, located at the northwest corner of McFadden Avenue and Chemical Lane in a 100-M1-A-20,000, Restricted Manufactur- ing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Nick Becker and Fred Mayer were present at the meeting. Board review included discussion of the following: 1) Due to the vacation of a portion of the right-of-way on McFadden by the City, the property lines are not correct. Revisions to show true property line can be made on the plan submitted to the Department of Building and Community Development upon applica- tion for building permits; 2)-The turning radius can be reduced to 25 feet from 27, if the proponent desires; 3) The 10-foot screening for parking shown on the plan on Chemical Lane is to be increased to eleven (11) feet per code requirements; 4) A planting buffer will be required between this use and the abutting residential property, with trees of sufficient size to provide maximum screening from noise and visual intrusion; and 5) The plan should be revised to delete the reciprocal drive off Chemical Lane, but there will still a requirement for recorded documents showing reciprocal access over the north/south driveway. Rooftop mechanical equipment screening plan, if applicable. Said plan shall indicate screening of all rooftop mech- anical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire,protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants (including a possible onsite hydrant), fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. Street trees shall be installed in compliance with the condi- tions imposed on TT 6948. 2. If the separation wall as required as a condition of approval on TT 6948 has not been constructed, it shall be constructed prior to final inspection of subject building. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 76-39, adopted by the Board on February 2, 1977. No one was present at the meeting to represent the application. Due to the requirements of the State Map Act, it was the determin- ation of the Board that it could not act on the request without the applicant's concurrence with the suggested conditions of approval forwarded to him. ON MOTION BY CROSBY AND SECOND NO. 77-4 WAS CONTINUED TO THE BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEM: BY LIPPS TENTATIVE PARCEL MAP REGULAR MEETING OF FEBRUARY 23, 1977, USE PERMIT NO. 76-64 (Revised Plan) Applicant: Del Taco (W & D Developers) Bill Galloway was present to represent the Del Taco restaurant and presented a revised site plan for his portion of the project showing reduced parking and deletion of the access off the service road. The Board reviewed the plan and found it to be in conflict with the originally approved layout for the shopping center. It was the consensus of the Board that the responsibility for revising the layout rested with W & D, and that the Board would analyze the proposed changes and determine whether or not they were exten- sive enough to require a plot plan amendment to be processed.
