Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 76-39, adopted by the Board on February 2, 1977. No one was present to represent the application as required by provisions of the State Map Act. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Environmental Quality Act, 1970. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-157 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plan received and dated February 10, 1977, shall be the approved layout, subject to the modifi- cations described herein: a. The plan shall show a continuous two (2) foot offset in all portions of the building exceeding fifty (50) feet in length or a zero setback shall be shown along the common property line. b. The plan shall indicate the required dedications on the alley and at the intersection. C. The plan shall provide a twenty-seven (27) foot turning radius off the alley. C. A trash enclosure area shall be provided. The plan submitted to the Department of Building and Community Development concurrently with application for building permits shall be revised to delineate the above modifications. 2. In accordance with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley and a twenty (20) foot radius at the intersection of Acacia and 17th Street shall be dedicated. 3. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Department of Building and Community Development. 4. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Seventeenth Street, Acacia Avenue, and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and require- ments. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 77-12. j The Chairman opened the public hearing. Roy Johnson was present to represent the application and explained the phasing of the handball court construction, the relocation of the gym facilities, and the placement of the observation walkway overlooking the hand- ball courts. He noted that the employment office within the com- plex is expected to generate a traffic count of 18.75 people per hour for an 8-hour day. There being no other persons present to address the Board in relation to the plot plan amendment, the public hearing was closed. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1: The plot plan received and dated February 2, 1977, shall be the approved layout, subject to the modifications described herein: a. The striping as shown on the plan shall be revised to reflect parking from the right hand lane throughout. b. A radius shall be provided at the easterly and westerly ends of the northerly drive sufficient to allow Fire Department access. C. The entry off Beach Boulevard and the main entry off Terry Drive shall be modified to reflect a radius -type drive to the specifications.of the Department of Public Works. d. There being no persons in the audience to speak for or against the project, the public hearing was closed. ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD ADOPTED NEGATIVE DECLARATION NO. 77-12, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE IMPACT UPON THE PHYSICAL ENVIRON- MENT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE The Chairman opened the public hearing on the Use Permit. Roy Johnson was present at the meeting. There being no persons present to address the Board in regard to this project, the public hearing was closed. Board review included consideration of the parking provisions in the total complex, drive access and width, circulation throughout the project, and landscaping to be provided. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. In its approval -action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; . Parking layout; - Lot area; . Lot width and lot depth; . Type of use and it's relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Department of Building and Community Development:. a. Landscape and irrigation plan complying with Article 979 of -the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if appli- cable. Said plan shall indicate screening -of all rooftop mechanical equipment and shall delineate the type of material proposed to -screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assess- ment district. 6. The -developer shall participate in the Orange County Sanita- tion District #3 Sewer Annex District, if applicable. 7. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. The screening from Beach Boulevard and Terry Drive for the parking area compound shall comply with minimum standards of Article 979 for screening, which shall be a minimum of a six (6) foot wide area. 2. If a request should be submitted to the City in the future for conversion of the proposed health club facility and/or the employment office to retail sales facilities, additional parking shall be required to be provided for such uses prior to such conversion. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. Use of energy -saving lighting, such as high pressure sodium vapor lamps, shall be considered in parking lots. 5. Low -volume heads shall be used on all spigots and water faucets within the proposed health facility. 6. The parking to the east and north of the facility shall be restricted to use by employees and health club members only. Board of Zoning Adjustments February 23, 1977 Page 8 USE PERMIT NO. 77-11 Applicant: George Renek & Ron Fought To permit the construction of a 7-unit apartment on an arterial street pursuant to Section 9201.4(a) of the Huntington Beach Ordinance Code, located at the northeast corner of Atlanta Avenue and Huntington Street in an R3, Medium -High Density -Residential District. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 77-16. The Chairman opened the public hearing. John King and George Renek were present to represent the application. Mr. Forrest Lewis addressed the Board in opposition to the proposed project, indicating that he is also speaking for three other residents in the immediate vicinity of the subject site. Mr. -Lewis noted -that this area is a long-established single-family area and will prob- ably remain so due to the recently approved Code Amendment 76-12 and its effects on the sub -standard lots in the vicinity (most of which he reported to be 46 feet in width). 'It is _the .feeling of the residents in the block that the effect of this code amendment would be to repeal the existing R2 and R3 zoning and that the sub- ject lot should be developed at a lesser density more compatible with the surrounding residences. There being no other persons to address the Board in regard to this request, the public hearing was closed. Secretary Palin and Bruce Crosby noted that the status of the alley to the rear of the property has not been determined. Mr. Lewis reported that he has owned the one foot wide strip running from 110 to 114 Huntington Street for 25 years, and that the City had accepted the alley as a 10-foot wide alley in 1950. The width of this alley would be substandard if it is a -public alley, and -Bruce Crosby discussed the possibility that the City might vacate the right-of-way; however, other lots on Huntington are presently using the alley for access. Mr. King indicated that if additional dedication is necessary to bring the alley up to code requirements such dedication should come off the easterly side. It was also noted that additional radius at the corner of Huntington and Atlanta will be required, which will have an effect on the layout submitted. Minor discrepancies in the plan were reviewed, including drive width, location of the trash bins, parking on -site, and minimum dimension for garages, but it was felt that complete plan review would not be appropriate until a determination has been reached in regard to the alley problem. Bruce Crosby requested a continu- ance to permit Public Works time to research the history of the alley and make a determination on what action should be taken. BZA 2-23-77 Page 8 Minutes, H.B. Board of Zoning Adjustments February 23, 1977 Page 9 ON MOTION BY CROSBY AND SECOND BY SPENCER USE PERMIT NO. 77-11 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF MARCH 2, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-27 Applicant: Ni-Mar Enterprises To permit the construction of a 21,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located on the southwest corner of Chemical Lane and Business Drive in a.100-M1-A-20,000, Restricted Manufacturing District. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. No one was present to represent the application at the meeting. Board review found the proposal to be in conformance with code except for width of the front landscaping and width and location ! of driveways. No one was present at the meeting to represent the application. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Board review found the plan `to be in conformance with code re- quirements; however, it was noted that the existing sidewalk and street improvements had not been included on the site plan. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 77-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. Ricahrd Seleine was present at the meeting. Chairman Spencer informed the -Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Board review included the use of the handball court and the need for interior connections between the two shop areas. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 77-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO THE ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated February 15, 1977, shall be the approved layout. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. No one was present at the meeting to represent the application. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. No one was present to represent the application. Board review found the plan to be in compliance except for the inter- ior setbacks and location of the handicapped parking area. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEM: USE PERMIT NO. 76-64 (Revised) Applicant: W & D Commercial Properties (Del Taco) To permit minor revisions to a -previously approved plot plan for a 73,000 square foot shopping center pursuant to Section 9472 of the Huntington Beach Ordinance Code, located at the northwest corner of Atlanta Avenue and Magnolia Street in a C4, Highway Commercial District, for Del Taco restaurant. Kelly Hesheim (of W & D) and William Galloway of Del Taco were present -at the meeting. Secretary Palin reported,to the Board that the plan in the vic- inity of the Del Taco restaurant has been revised for the drive through facility and 16 parking spaces immediately adjacent to the vicinity of the restaurant have been deleted, from 27 to 11. The -Board reviewed the number required for the total center and the reciprocal agreements in effect; it was determined that con- formance with Article 979 for total overall parking can be achieved through plan check. The Board then discussed extensively the proposed changes in the landscaping.plan along the northerly property line of the complex. Pat Spencer expressed the opinion that no modification of a previously imposed condition of approval should occur in this case without another public hearing, to permit adjacent residents an opportunity to review the plan. The Board generally expressed reservations on using offsite landscaping to satisfy a condition for onsite landscaping, as is proposed by the appli- cant. The developer was instructed to submit a revised plan showing existing conditions-- location of the buildings and the adjacent landscaping, with a proposal for trees or groupings of trees on the north property line to take up the slack where there is nothing existing to the north. Board of Zoning Adjustments February 23, 1977 Page 19 In response to a query from the applicants Secretary Palin instructed them that the relocation of the Del Taco building four feet to the south of its indicated location need not be brought back to the Board for approval. Building permits for that restaurant facility can be issued prior to the next hear- ing on the revised landscaping plan. ON MOTION BY PALIN AND SECOND BY CROSBY, THE REVISED PLAN FOR USE PERMIT NO. 76-64 (DEL TACO LOCATION) WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual plan received and dated February 8, 1977, shall be the approved plan for layout and circulation for the Del Taco restaurant portion of the project. 2. A revised landscaping plan for the complex shall be submitted to the City showing existing conditions and locations of buildings to the north. The plan shall include a proposal for tree groupings along the northerly side of the onsite drive to permit City evaluation of Condition No. A-l(c) of the original conditions of approval (which called for 15-gallon trees at 45 feet on center along the northerly property line of the project).
