COMMISSIONERS PRESENT: Parkinson, Finley, Slates, Shea, Newman, Boyle Commissioner Gibson arrived at 7:25 P.M. PACIFICA COMMUNITY PLAN - CA 77-1 Commissioner Parkinson asked the Deputy City Attorney if it would be proper for him to act on the subject items since he had not been present at either the study session or public hearing of February 15, 1977. He was advised that he could participate in action on these items. Dave Eadie addressed the Commission and noted that Mr. Leonard Wright's letter,which had been provided to the Commission, provided background information. He then brought the Commission up to date on changes since the February 15 meeting in the Policy Plan. Discussion ensued on considering this Policy Plan for inclusion in the next Amendment to the General Plan. ON MOTION BY BOYLE AND SECOND BY SHEA THE STAFF WAS DIRECTED TO INCLUDE THE MULTI -STORY POLICY PLAN IN THE NEXT AMENDMENT TO THE GENERAL PLAN BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Slates, Shea, Newman, Boyle NOES: None ABSENT: Gibson Commissioner Gibson arrived at 7:25 P.M. ON MOTION BY NEWMAN AND SECOND BY SHEA CODE AMENDMENT NO. 77-2 WAS APPROVED BY RESOLUTION 1190 BY THE FOLLOWING VOTE: AYES: Gibson, Slates, Newman, Shea, Boyle NOES: Parkinson, Finley ABSENT: None CODE AMENDMENT 77-1/NEGATIVE DECLARATION NO. 77-10 "PACIFICA COMMUNITY PLAN" Chairman Slates stated that since he was involved with both the buyer and seller on this project he would have to abstain. He then turned the meeting over to Vice -Chairman Gibson. Dave Eadie addressed the Commission and briefly discussed the plan. A MOTION WAS MADE BY BOYLE AND SECONDED BY FINLEY TO REOPEN THE PUBLIC HEARING. AYES: Parkinson, Finley, Gibson, Shea, Newman, Boyle NOES: None ABSENT: None ABSTAIN: Slates Loraine Faber addressed the Commission and stated that she felt that covered parking requirements should be included in the plan. The public hearing was then closed. Commission discussion ensued on the Negative Declaration, No. 77-10. A MOTION WAS MADE BY FINLEY AND SECONDED BY BOYLE TO DISAPPROVE NEGATIVE DECLARATION NO. 77-10 FOR THE FOLLOWING REASONS: This specific plan allows a multi -story designation on a portion of the site. The initial study calls attention to problem areas: earthquake fault, sewer lines to capacity, drainage, etc. We have no previous environmental assessment of multi -story development on which to base a decision. If we grant a negative declaration (according to CEQA) we must find that there is no significant environmental impact. A decision to allow a multi -story designation to 140 ft. on a specific site has very significant environmental implications, which make a finding of no significant impact impossible. Used well, and starting early enough, the environmental assessment process can be integrated with planning to allow decisions based on adequate information. The new CEQA guidelines allow EIR's which focus only on the particular concerns revealed in the initial study, thus eliminating the need -2- 3/1/77 - PC Minutes: H.B. Planning Commission Tuesday, March 1, 1977 Page 3 for the complete EIR with all its excess and unnecessary verbiage. Used as a preliminary assessment at zone change (or in this case Specific Plan) time decisions can be made based on information,not speculation,and both planning and developer benefit. Planning Commission Tuesday, March 1, 1977 Page 4 At this time the Deputy City Attorney was consulted by the Vice Chairman as to the possibility of calling Chairman Slates to cast the deciding vote in order that this plan could be transmitted to the City Council for further action. The Deputy City Attorney stated that it would be acceptable to do so. A three minute recess was called at 8:30 p.m. Chairman Slates chaired the remainder of the meeting. CONDITIONAL USE PERMIT NO. 76-30 - NEGATIVE DECLARATION 76-15 Applicant: J. L. Norman This is a request for construction of an auto dismantling yard located at the northeast corner of Talbert Avenue and Gothard Street. John Cope reviewed the staff report and stated that based on the Industrial Land Use Study the staff recommended denial. The public hearing was opened. The applicant addressed the Commission and spoke in favor of the request, indicating the problems which would be encountered in changing the zoning for this area. The public hearing was closed. Commission discussion ensued. The proposed use is not consistent with the land use conclusions of the recently completed Industrial Land Use Study. 2. The use is not compatible with recent City industrial develop- ment policies that conserve industrial areas for uses that generate substantial economic benefits to the City and which do not create offensive or undesirable visual and aesthetic qualities. 3. Subject property is located on the east side of Brookhurst Street approximately 250 feet north of Hamilton Avenue. Tentative Tract No. 9735 is a request for a 1 lot division of land. A vugraph was presented. Jim Palin discussed the conditions of approval contained in the staff report and reviewed the schematic drawings on display for the Commission. The public hearing was opened. Gared Smith addressed the Commission and spoke in opposition to Condition No. 13 which required that natural gas be stubbed in. The public hearing was closed. Commission discussion ensued. The property was previously studied for this intensity of land use at the time the land use designation for medium density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Sub- division Ordinance. CONDITIONS OF APPROVAL: 1. The site plan received and dated February 22, 1977 shall be the approved layout for the 140 unit condominium development. 2. All utilities shall be installed underground. 3. All details and amenities of the development as shown on the site plan submitted for approval shall be constructed within the development, such as recreational building, swimming pool, tennis courts, etc., as well as those areas within the pedestrian and vehicular circulation area shown to be constructed with a textured pavement to aesthetically improve the project. 1 -6- 3/1/77 - PC Minutes: H.B. The exterior elevations of all buildings proposed for con- struction within the project shall comply with the architectural design of the structures submitted in conjunction with the site plan and tentative map. 5. If the developer chooses to build with a modified sidewalk section along Brookhurst, pursuant with the most recent standards on file with the Department of Public Works, a landscape maintenance agreement shall be entered into and approved by the City prior to the recordation of a final map. 6. The CC & R's and association rules shall set forth provisions for the exclusive use of the open parking spaces within the project as well as a restriction on the storage of recreational vehicles in such open parking spaces. 7. A decorative masonry wall shall be constructed to City speci- fications along the Brookhurst Street frontage. Said wall shall be six inches wide and a minimum of six feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. The structural design shall be approved by the Department of Public Works. 8. A landscape planter shall be provided along Brookhurst Street. Such planter shall conform to the plans and specifications on file in the Department of Public Works and to the requirements of the Planning Commission. It is the developer's responsibility to landscape such planter and provide irrigation facilities in conformance with the Department of Public Works'speci- fications and requirements. 9. A decorative masonry wall similar in color and material as used in the perimeter wall along Brookhurst shall be constructed on the north and south portion of the projects. 10. A fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifications of the Fire Department. 11. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 12. All building spoils such as unusable lumber, wire, pipe, and other surplus and unusable materials shall be disposed of at an offsite facility equipped to handle them. -7- 3/1/77 - PC Minutes: H.B. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. 14. All structures proposed for construction within the sub- division shall be constructed in compliance with the g-factors as indicated on the geologist's report. 15. Calculations for footing and structural members to withstand anticipated g-factors shall be submitted to the City for review and approval prior to issuance of building permits. 16. A chemical analysis as well as tests for physical properties of the soils on subject property shall be submitted to the City for review prior to the issuance of building permits. 17. The structures on subject property whether attached or de- tached shall be constructed in compliance with the state acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 18. Energy saving lighting, such as high pressure sodium vapor lights, shall be constructed within the parking and recreational areas. 19. Crime prevention techniques shall be designed into the pro- ject (e.g., single cylinder locks, etc.). 20. A low volume head shall be used on all spigots and/or water faucets. 21. All water closets for toilet facilities shall be equipped for a capacity of 3-1/2 gallons if such facilities are available at the time of construction. 22. The developer shall submit to the City a detailed and compre- hensive drainage study, including how the tract grading in conjunction with the grading conveyance systems (including adequate swales, channels, street flows, catch basins, storm drains, and flood water retardant), will allow building pads to be safe from inundation from all rainfall runoff. 23. An easement for vehicular access via the private street system shall be granted to the City for access to the pumping station. 24. All required on site covered parking shall be fully enclosed. 25. Pedestrian access to the Santa Ana River trail shall be provided via the 10 ft. strip extending southerly from the project to Hamilton Avenue and shall be provided with a security gate to restrict trespassing. -8- 3/l/77 - PC Minutes: H.B. Montgomery IN CONJUNCTION WITH: TENTATIVE TRACT NO. 9617 Applicant: Mola Development Conditional Use Permit No. 77-3 and Tentative Tract No. 9617 are requests to permit the construction of a 25 unit planned residential development on 3.1 acres of R2 property. The development concept is for detached units on individually conveyed lots in conjunction with common open space and recreational areas. The property is located on the north side of Heil at Algonquin. John Cope addressed the Commission and gave a brief background report on these applications. He further discussed the revisions which had been made to the plans previously submitted. The public hearing was opened on Negative Declaration 77-9 and Conditional Use Permit No. 77-3. Ron Montgomery addressed the Commission and stated that he would be willing to answer any questions which the Commission might have. The public hearing was closed. Commission discussion ensued. The design and materials of said wall shall be subject to approval by the Planning Department. 7. The CC&Rs and Association Rules shall prolilbit the storage of recreational vehicles within the planned residential development. 8. Rogers Plot Plan Amendment No. 76-11 is a request to permit a minor plot plan amendment to a previously approved planned residential develop- ment located on the east side of Pacific Coast Highway and north of Anderson Street. Revised Tentative Tract No. 5811 is a request for one lot subdivision. An aerial slide was shown of the property, and John Cope discussed the problems the applicants had in obtaining approval from the Coastal Commission. He discussed the staff's concerns on the revisions necessitated by the Coastal Commission's approvals. MODIFY SANITARY SEWER LIFT STATION "D" The proposed project involves replacing existing pumps and enlarging the wet well. The project is located southeast of Warner Avenue and Edgewater Lane. 3. CONSTRUCTION OF SEWER LINE IN STEWART STREET The proposed project is located on Stewart Street between Garfield Avenue and Ernest Avenue and calls for the construction of an eight inch sanitary sewer line to service the adjacent land uses. 4. REINFORCED CONCRETE CHANNEL LINING IN EXISTING FLOOD CONTROL DISTRICT The proposed project is adjacent to Edwards Street, south of Slater Avenue and extends along the north property line of Central Park be- tween Edwards Street and Goldenwest Street. 5. INSTALLATION OF TRAFFIC CONTROL SYSTEM The proposed project is located along Beach Boulevard between San Diego Freeway (Route 405) and Pacific Coast Highway. The project will provide for development of a modern signal system, using computer technology to permit progressive traffic movement that will minimize the present traffic congestion. 6. INSTALLATION OF TRAFFIC SIGNALS The project involved the installation of traffic signals at the inter- sections of Bushard Street and Indianapolis Avenue and at the inter- section of Bushard Street and Yorktown Avenue. -15- 3/1/77 - PC Minutes: H.B. SPRINGDALE STREET BICYCLE LANE The proposed project is located between Edinger Avenue and Glenwood Drive and will provide bicycle lanes for use by commuter bicycle traffic. 8. INDIANAPOLIS AVENUE BICYCLE LANE The proposed project is located on Indianapolis Avenue between Newland Street and the Santa Ana River Trail and will provide a commuter and recreational bicycle lane which will also serve several schools in the area. 9. CONSTRUCTION OF STREET IMPROVEMENTS ALONG ELLIS AVENUE AND RAILROAD UNDERPASS The proposed project will consist of constructing Ellis Avenue west of its present terminous point to intersect with Gothard and will also include a railroad underpass. 10. CHANNELIZATION OF TRAFFIC ALONG WARNER AVENUE The proposed project would provide positive control for left turn vehicular movement across Warner Avenue between Goldenwest Street and St. George Lane. 11. CONSTRUCTION OF STREET IMPROVEMENT AND BRIDGE WIDENING WITH TRAFFIC SIGNAL INSTALLATION The proposed project is to construct street improvements along Brook- hurst Street between Hamilton Avenue and Pacific Coast Highway, and will include a bridge widening to ultimate configuration along Brook- hurst Street. The traffic signals at Pacific Coast Highway and at Hamilton Avenue will be upgraded. 12. CONSTRUCTION OF STREET IMPROVEMENT ALONG MANSION AVENUE The proposed project is to improve Mansion Avenue between Main Street and Huntington Street to four travel lanes, two bike lanes, and median islands. 13. CONSTRUCTION OF STREET IMPROVEMENTS ALONG HEIL AVENUE The proposed project is to improve Heil Avenue between Bolsa Chica Street and Springdale Street to provide for a minimum of four travel lanes and two bike lanes. 14. OLDTOWN STORM DRAIN, PHASE II The proposed project involves construction of storm drain facilities in the Oldtown Area to eliminate storm flooding problems in the area. Commissioner Boyle stated he would like to see the staff pursue dis- cussion of doing an environmental assessment on the entire General Plan.
