Goodman To permit a reduction of the required common recreation and leisure area per Section 9320.14 of the Huntington Beach Ordinance Code from 3200 square feet to 540 square feet and to satisfy open space requirements with private patios and balconies, located on the east side of Cameron Street approximately 510 feet south of Slater Avenue in an R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-8, adopted by the Board on February 16, 1977. The Chairman opened the public hearing. Mr. Goodman was present at the meeting. There being no one present to speak for or against the proposed exception, the public hearing was closed. Secretary Palin reviewed the history of the project and the reason for filing of the exception,for the information of the Board. The Board reviewed the plan and concurred that it did provide a better layout to meet the constraints on the property. ON MOTION BY PALIN A14D SECOND BY LIPPS CONDITIONAL EXCEPTION NO. 77-11 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments March 2, 1977 Page 2 FINDINGS OF THE BOARD: 1. The alternative plan affords each unit either a ground -floor private patio area and/or a private balcony area, creating a much better living environment for residents in the develop- ment. 2. The size of the lot and its ratio of depth to width are such as to impose a physical restraint upon the property, and the physical layout of the alternative plan is the more desirable siting of the proposed units upon the lot. 3. The plan will not be detrimental to persons living or working in the area, as the proponent has not proposed the ultimate . density allowable on the property and has tried to create desirable living amenities thereon. CONDITIONS OF APPROVAL: The plot plan received and dated February 28, 1977, shall be the approved layout. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-8 (In Conj./CE 77-11) Applicant: William C. Goodman To permit the construction of a twelve (12) unit apartment build- ing pursuant to Section 9201.4(b) of the Huntington Beach Ord- inance Code, located on the east side of Cameron Street approxi- mately 450 feet south of Slater Avenue in the R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-8, adopted by the Board on February 16, 1977. The Chairman opened the public hearing. Mr. Goodman was present at the meeting; there being no one to speak for or against the proposed project, the public hearing was closed. Board review ensued. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 3-2-77 Page 2 Minutes, H.B. Board of Zoning Adjustments March 2, 1977 Page 3 FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF THE BOARD: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:• 1. The revised plot plan received and dated February 28, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvement in the immediate vicinity; . Past administrative action regarding this property. 2. The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if ap- plicable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's standards and requirements, an additional ten (10) feet of right-of-way on Cameron Street shall be dedicated. i BZA 3-2-77 Page 3 Minutes, H.B. Said reports shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the speci- fications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the De- partments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Cameron Street shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the Cite of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The gating apparatus for security of the complex shall be submitted to the Fire and Police Departments for review prior to the issuance of building permits. 2. If drainage on the project is such that surface drainage will be required to flow easterly, the plan shall come back to the Board of Zoning Adjustments for review prior to the issuance of building permits. 3. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air condi- tioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. BZA 3-2-77 Pane 4 Minutes, H.B. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be dis- posed of at an offsite facility equipped to handle them. 5. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 7. If the offstreet parking area is lighted, the use of energy -saving lighting such as high pressure sodium vapor lamps shall be considered. 8. Crime prevention techniques should be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). 9. Low -volume heads shall be used on all spigots and water* faucets. 10. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 _gallons if such facilities are available at the time of construction. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-11 (Cont. from 2-23-77) Applicant: George Renek & Ron Fought To permit the construction of a 7-unit apartment on an arterial street pursuant to Section 9201.4(a) of the Huntington Beach Ordinance Code, located at the northeast corner of Atlanta Avenue and Huntington Street in an R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-16. The Chairman reopened the public hearing. John King and George Renek were present at the meeting. Secretary Palin reported to the Board that the staff has investigated and has found the alley to be a public alley, dedicated in 1950. The staff has made the following recommendations: 1) abandonment of the 11-foot alley for a total depth of 81 feet along the rear of subject property; 2) elimination of the intersection of that alley with Atlanta BZA 3-2-77 Page 5 Minutes, H.B. Board of Zoning Adjustments March 2, 1977 Page 6 - Avenue; and 3) provision of access to subject project from Huntington Street, which can be obtained by reversing the plan. John King submitted a revised plan which took into consideration the configuration of the property after alley abandonment, but was advised that if applicants wish to proceed with the project prior to alley vacation it will be necessary to maintain the integrity of the alley on the plan. Timing of the vacation was discussed, as well as a precise plan for a 2-way alley from the north property -line of subject property northerly to Baltimore Avenue to retain access to other properties presently taking access off the substandard alley. Time from initial request to aband- onment was estimated at approximately three months. Forrest Lewis addressed the Board in opposition to the project, saying that abandonment of the alley would render useless his property on the east. He also noted that in his opinion access to this project from Huntington Street would compound an already difficult and hazardous traffic and parking situation on that street. There being no other persons to speak on the proposed project, the public hearing was closed. The Board reviewed possible alternative approaches to the project with the applicants, and the applicants will submit a revised plan showing access from Huntington. ON MOTION BY LIPPS AND SECOND BY PALIN USE PERMIT NO. 77-11 WAS CONTINUED TO THE MEETING OF MARCH 9, 1977, WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY,-LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-9 (In Conj./UP 77-13) Applicant: George Armstrong To permit the thirty-five (35) foot maximum height limit to be exceeded by thirty (30) feet in lieu of Section 9102.6 of the Huntington Beach Ordinance Code. USE PERMIT NO. 77-13 (In Conj./CE 77-9) Applicant: George Armstrong - To permit an addition to a structure having non -conforming yard setbacks pursuant to Section 9719 of the Huntington Beach Ordin- ance Code, located at the northwest corner of Los Patos Avenue and Marina View Place in an R1, Low Density Residential District. Chairman Lipps informed the Board that the conditional exception application is a Categorical Exemption, Class V, and the use permit application is covered by Negative Declaration No. 74-73; I. BZA 3-2-77 Page 6 Minutes, H.B. Board of Zoning Adjustments March 2, 1977 Page 7 adopted by the Planning Commission on September 4, 1974, upon approval of TT 7743. The Chairman opened the public hearings on the two applications. George Armstrong was present to represent the application, and outlined for the Board the proposed project. There being no other persons present to address the Board, the public hearing was closed. Secretary Palin noted that the authority of the Board for approval of height variation is limited to a 10 percent increase in the base district height; therefore, the request will have to be re- ferred to the Planning Commission. Since the use permit is con- tingent upon approval of the variance that application also should be referred. The Board reviewed the procedural steps with the applicant, and instructed him to provide more specific information for the Commission's review: i.e., type of access, floor layout, use of the tower if approved, escape routes to be provided, and how light, air, and ventilation will be provided. It should also be shown how the use will be connected to and related with the main structure of the dwelling. ON MOTION BY PALIN AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 77-9 AND USE PERMIT NO 77-13 WERE REFERRED, WITH THE CONCUR- RENCE OF THE APPLICANT, TO THE REGULAR MEETING OF THE PLANNING COMMISSION ON MARCH 15, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-10 Applicant: Gordon Sadofski To permit a sixteen (16) foot encroachment into the required 22 foot front setback for garage door entered directly from the street in lieu of Section 9166.5 of the Huntington Beach Ordinance Code, located at the northwest corner of Sandra Lee Street and Orion Street in an R2, Medium Density Residential District. Chairman Lipps informed the Board that this request is a Categori- cal Exemption, Class-V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. and Mrs. Sadofski were present at the meeting. Sumi Odero, owner of an adjacent lot, addressed the Board to request clarification on the proposal, but did not oppose it. There being no other persons to speak for or against the proposed project, the public hearing was closed. Board discussion ensued. Secretary Palin expressed concern with the intensity of use on this small lot, noting that the request would grant a privilege to the applicant not otherwise enjoyed by other property owners within the City. Walt Lipps said that the BZA 3-2-77 Page 7 Minutes, H.B. Board of Zoning Adjustments March 2, 1977 Page 8 plan is in compliance with the code except for the garage set- back and that the lot configuration and size present constraints in siting the unit without reducing its size. The Board also reviewed the history of the original division of the property. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-10 WAS DENIED WITHOUT PREJUDICE FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. Granting of the request for reduction in setback would afford applicant a privilege not otherwise realized by similar properties with similar design in the general area. 2. The City has recently determined that the reduced garage setback does create traffic hazards and blockage of sidewalks; there- fore, granting of this request would circumvent this recent legislative action by the City Council. 3. Granting of the variance would effect a greater intensity of use for this small exterior corner lot than is enjoyed by other properties in the area. AYES: PALIN, CROSBY NOES: LIPPS ABSENT: NONE Chairman Lipps apprised the applicants of the appeal procedure to the Planning Commission. USE PERMIT NO. 77-10 Applicant: Cager Properties To permit the construction of a seven (7) unit apartment building on an arterial street pursuant to Section 9161.4(b) of the Huntington Beach Ordinance Code, located on the west side of New- land Street approximately 480 feet south of Slater Avenue in an R2, Medium Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-13. The Chairman opened the public hearing. Dora Commissariet was present to represent the applicant. There being no one to speak on the proposed project, the public hearing was closed. The applicant was informed by the Board that the density proposed on the plans is not permitted under the regulations of the base zoning district , and it will be necessary either to reduce the unit count on the application or file for a zone change. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-18. The Chairman opened the public hearing. Richard Seleine was pre- sent at the meeting. There being no one to address the Board in re- gard to this request, the public hearing was closed. Board review concerned deficiencies on the plan in orientation and use of the reciprocal drive, turning radius, need for addi- tional onsite amenities on the site, provision of additional side yard setback for additional open space on the yards opposite the reciprocal drives, depth of the complex for fire fighting access, onsite parking requirements, etc. The applicant was informed that the code requires either that each parcel be designed to stand on its own or that the complex be developed pursuant to the apartment standards. It was the determination that the project should be continued to permit applicant to meet with staff and submit a re- vised plan. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Nick Becker was present to represent the application. No one was present to address the Board in regard to the project, and the public hearing was closed. Board review ensued. ON MOTION BY CROSBY AND SECOND BY LIPPS USE PERMIT NO. 77-15 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Rivett i To permit the construction of two (2) industrial buildings of 11,000 and 9,000 square feet respectively pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the northwest corner of Graham Street and Production Drive in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Nick Becker was present at the meeting and informed the Board that the buildings are to be constructed as one project and separated only for rental pur- poses. There being no other persons to address the Board, the public hearing was closed. The Board review found the plan to comply with code requirements. A tentative parcel map shall be filed, approved, and recorded to consolidate the parcels into one parcel, prior to certificate of occupancy. 2. The end parking stalls shall be increased by the re- quired three (3) feet. 3. The front exterior setback shall be fully landscaped for a minimum depth of ten (10) feet. 4. All conditions imposed upon Use Permit No. 77-15 shall apply. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. BZA 3-2-77 Page 12 Minutes, H.B. Nick Becker was present at the meeting; there being no one to address the Board on the proposal, the public hearing was closed. Secretary Palin noted that the Administrative Review for this structure has previously been approved. The proponents have re- moved two of the overhead doors from that plan, and the present door will be the only access for loading -unloading operations. It will be a ramp within the building, not visible from outside. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 77-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. Granting of this request constitutes granting parity with other similar uses in the industrial park. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated February 18, 1977, shall be the approved layout. 2. The overhead door shall be of similar color as that on the main portion of the building, to provide a compatible appearance to the project. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-33 Applicant: Doris Martinez To permit the construction of a four (4) unit apartment building which extends more than 150 feet from a public street pursuant to Section 9730.20 of the Huntington Beach Ordinance Code, located on the south side of Newman Avenue approximately 120 feet west of Beach Boulevard in an R2, Medium Density Residential District. Chairman Lipps informed the Board that this request is a Categori- cal Exemption, Class IV, California Environmental Quality Act, 1970. Doris Martinez was present at the meeting. The Board reviewed the open space calculations on the property and discussed the availability of water service to the site. The applicant was informed that getting water in to the project would entail construction of about 700 feet of main from the nearest line. BZA 3-2-77 Page 13 Minutes, H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated February 22, 1977, shall be the approved conceptual layout.
