HomeMy WebLinkAbout1977-03-09MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, MARCH 9, 1977 - 1:15 PM BOARD MEMBERS: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT REGULAR AGENDA ITEMS: USE PERMIT NO. 77-11 Applicant: George Renek & Ron Fought To permit the construction of a 7-unit apartment on an arterial street pursuant to Section 9201.4(a) of the Huntington Beach Ordinance Code, located at the northeast corner of Atlanta Ave- nue and Huntington Street in an R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-16. Chairman Lipps reopened the public hearing. George Renek and John King were present to represent the application. A gentleman in the audience requested clarification on the alley abandonment, noting that the hammerhead for the 2-way alley northerly from the abandoned alley would take considerable square footage from his property abutting that alley, making it difficult to construct a second unit thereon and reducing the value of his lot. Sec- retary Palin advised him that the present plan leaves the alley as it is and that any future precise plan would be a separate pro- ject upon which public hearings would be held. There being no other persons to address the Board in regard to the project, the public hearing was closed. The Board reviewed the information contained in the request for negative declaration and considered mitigating measures for the project. These plans were reviewed and found to reflect the proper setback from the public alley and access from Huntington Street as required. One parking space has been deleted, but the revised plan does not otherwise significantly deviate from the original plan submitted as far as calculations for open space, coverage, etc. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 77-11 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received and dated March 9, 1977, shall be the approved layout, subject to the following: The plan shall be subject to a complete plan check in the Department of Building and Community Development at the time of application for building permits to determine compliance with code requirements for.coverage, bulk of structures, allowed density, parking, open space, setbacks, etc. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; . The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if applicable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equip- ment. 3. In accordance with the City's standards and requirements, a 32 foot radius shall be dedicated at the intersection of Huntington Street and Atlanta Avenue. 4. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detec- tion devices or systems, shall comply with the specifica- tions of the Huntington Beach Fire Code. Plans for such devices and systems shall be submitted to the Huntington Beach Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District 43 Sewer Annex District. 11 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Huntington Street and Atlanta Avenue shall be improved to the centerlines of such rights -of -way. Said improve- ment shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drain- age, and sewer and water main extensions, in full compli- ance with the City of Huntington Beach street standards and requirements. Should the City complete abandonment of the eleven (11) foot public alley existing across the rear of the sub- ject property prior to construction of the complex, the masonry wall shall be extended to the rear property line. 2. A compatible wall shall be constructed along the easterly property line of subject property (in the event the alley is abandoned prior to construction) to separate this de- velopment from the property to the east. 3. Parking spaces 12 and 13 shall be converted to open space landscaped area if not required to fulfill onsite parking requirements by the zoning ordinance of the City of Hunt- ington Beach. 4. Should the alley abandonment take place prior to occupancy, the area to the rear extending to the easterly property line along Atlanta Avenue shall be incorporated into a landscaped area for use by the tenants of the project. 5. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a mini- mum of R-19 and R-11, respectively. If no air condition- ing is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respec- tively. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped -to handle them. 7. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 C14EL contours of the property. 9. Use of energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots and recreation areas. 10. Low -volume heads shall be used on all spigots and water faucets. 11. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. BZA 3-9-77 Page 4 Minutes, H.B. Seleine To permit the construction of four (4) 8-unit apartment buildings on contiguous properties all having drives extending more than 150 feet from a public street in lieu of Section 9202.3.1.4 of the Huntington Beach Ordinance Code, located on the south side of Aldrich Street approximately 150 feet west of Beach Boulevard in an R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-18. The Chairman reopened the public hearing. Richard Seleine was present at the meeting and addressed the Board to explain the changes on the plan - he has submitted three alternative plans and it is his opinion that Plan B provided more space for tenant use than Plans A or C. No one else was present to speak for or against the proposed project, and the public hearing was closed. The Board reviewed the information contained in Negative Declara- tion request No. 77-18 and considered mitigation measures appli- cable to the project. ON MOTION BY CROSBY AND SECOND BY LIPPS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED N.D. 77-18 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS OF APPROVAL C-1 THROUGH C-8 IMPOSED UPON THE USE PERMIT, BY THE FOLLOW+?ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE The Board reviewed the revised conceptual plans. It was noted that reorientation of the rear structure could provide more meaningful open space, break up the depth of the project visually, and pull landscaping up into the project itself. Past procedure versus present policy was also taken into consideration in review of this project. The back one -bedroom unit shall be turned as out- lined on the approved plan, to reflect a north -south rather than an east -west configuration. The plan submitted to the -Department of Building and Com- munity Development upon application for -building permits shall delineate the modification described above. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; • Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan -complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and det- ection devices or systems shall comply with the specifi- cations of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District, if applicable. S. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Aldrich Street shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Hunting- ton Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air con- ditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. The dwellings existing on subject site shall be offered for relocation prior to their demolition. Montgomery To permit the construction of one (1) single-family dwelling pur- suant to Section 9354. 16 of the Huntington Beach Ordinance Code, located on the west side of 8th Street approximately 75 feet south of Orange Avenue in the Townlot Specific Plan Area One, Section A. Chairman Lipps informed the Board that this request is a Categori- cal Exemption, Class III, California Environmental Quality Act, 1970. No one was present to represent the application. Revised plans have been submitted and were reviewed by the Board. The plan now provides the offset as previously requested, as well as provision for some ground floor patio area. Stagliano To permit the construction of two (2) 11,500 square foot indus- trial buildings pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the southwest intersection of Chemical Lane and Industrial Drive in a 100-M1-A-20,000, Restricted -Manu- facturing District. Chairman Lipps informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Mr. Stagliano was present at the meeting. The Board reviewed the reciprocal drive provided between the two properties and the turning radius at the rear of the buildings.
