Chairman Slates stated that as a result of discussions between staff and the applicant a number of issues have arisen which will require additional processing time. The public hearing was opened. There was no one present to speak on this zone change, and the Chairman closed the public hearing. ON MOTION BY PARKINSON AND SECOND BY FINLEY ZONE CHANGE NO. 77-2 WAS CONTINUED TO APRIL 5, 1977, BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None Chairman Slates requested that Zone Change 77-2 be scheduled for the first item on the agenda of April 5th. Chairman Slates stated that the ne::t iten on the Agenda, Code Amendment No. 77-1, "Pacifica Community Plan" would be chaired by Vice Chairman Gibson since he represented both the buyer and seller. Planning Commission Tuesday, March 15, 1977 Page Two CODE AMENDMENT NO. 77-1 "Pacifica Community Plan" The intent of this code amendment is to establish a specific plan consisting of office -professional and residential multiple story development provisions and requirements that will guide the orderly development and improvement of an area identified as Pacifica Community. Secretary Selich addressed the Commission in regard to the current status of the proposed code amendment and suggested several al- ternatives which could be pursued to resolve the issue. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY GIBSON CODE AMENDMENT NO. 77-1 WAS APPROVED BY ADOPTION OF RESOLUTION 1191 WITH PARKING RATIO TO READ THAT ONE PARKING SPACE PER THREE UNITS BE PROVIDED BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Newman, Boyle NOES: Parkinson, Shea ABSENT: None ABSTAIN: Slates Commissioner Shea stated that she voted against the motion because she felt that the original Code Amendment called for 3.5 parking spaces per unit and she was in favor of that parking ratio. Commissioner Finley stated that she had voted for the Code Amendment in order to be able to transmit the matter to the City Council. Commissioners Finley and Parkinson filed the following minority report: The Pacifica Specific Plan will.allow in District 2: a density of 100-125 units per gross acre (as opposed to the 15-35 units usual in high density development); units that will have 125. sq. ft. less space than required in our apartment standards; and, approximately, 425 units at full development. Examined in light of this intensity of development, it is im- portant that the socially desirable aspect of the project not obscure the need for careful and adequate early assessment. The 1974 multi -story study laid out procedures for analysis of a total area before high rise designation. Such'an early analysis can determine what obstacles to developing high rise uses exist and the means and alternatives available for overcoming such obstacles. In addition, an analysis can take into consideration existing and future uses in relation to high rise so that multi -story uses can be well integrated into the total area. In this case, we have not made such an assessment of the total Five Points area but instead reacted to a specific project in a small part of that area. -2- 3/15/77 - PC 1 Minutes: H.B. Planning Commission Tuesday, March 15, 1977 Page 3 Not only have we not made this total assessment, but we have, by granting a Negative Declaration, held off any in depth assess- ment of the project area until the proposal comes in for a Con- ditional Use Permit. We have done this even though the initial study raises serious concerns, such as: 1. The multi -story site is located in that part of the Specific Plan area closest to a fault line shown in our Seismic/Safety Element as being of "highest seismic risk." 2. Sewer lines are reputed at capacity. 3. Drainage problems exist. 4. Total circulation needs study. 5. Water pressure and other fire protection concerns should be addressed. The aforementioned concerns should be addressed at this early stage if early decisions are to be made on the basis of adequate in- formation. This is particularly important since we do not have a comprehensive assessment of high rise impacts developed from any, prior high rise environmental study in Huntington Beach. Chairman Slates returned to the Chair ZONE CASE NO. 77-6 Applicant: Initiated by Planning Department This is a request for a change of zone from C4, Highway Commercial, to R2, Medium Density Residential located on the east side of Beach Boulevard approximately 625 feet north of Atlanta Avenue. John Cope presented a vugraph of the area and stated that he had no additional information. The public hearing was opened. B. G. Williams addressed the Commission and stated that he was the owner of the property and concurred with the findings of the staff. Dick Amright addressed the Commission and stated that he wanted the property zoned RI or C4.• The public hearing was closed. Commission discussion ensued. -3- 3/15/77 - PC Minutes: H.B. Planning Commission Tuesday, March 15, 1977 Page 4 ON MOTION BY GIBSON AND SECOND BY SHEA ZONE CASE NO. 77-6 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The sub3ect property is designated Medium Density Residential on the adopted Land Use Element, and therefore, the requested change of zcne is consistent with the General Plan of the City. 2. The resulting zoning and land uses are enumerated in the General Plan and will provide for the highest and best use of the subject property. 3. The resulting zoning is compatible and complimentary with long range planning efforts on surrounding properties in the immediate vicinity. AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None PLOT PLAN AMENDMENT NO. 76-11 Applicant: Norm Haynie In Conjunction With REVISED TENTATIVE TRACT NO. 5813 Applicant: Conrad Cornfeldt & W. M. Rogers The Plot Plan Amendment No. 76-11 is a request to permit a minor plot plan amendment to a previously approved Planned Residential Development. Tentative Tract 5813 is a request for one lot subdivision. Norm Haynie addressed the Commission and stated that he felt they had done everything they could to meet the City's objectives and in complying with the Coastal Commission. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY SHEA PLOT PLAN AMENDMENT NO. 76-11 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: 1. The proposed use of the property as a high density planned residential development is the same use as originally approved. 2. The deletion.of 8 units from the project results in a less intense 3. Planning Commission Tuesday, March 15, 1977 Page 5 CONDITIONS OF APPROVAL: 1. The site plan dated January-26,. 1976 shall be the approved layout. 2. The sewer, water, and fire hydrant system shall be designed to City standards. 3. The water system shall be through the City of Huntington Beach water system. 4. The sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The property shall be subject to local drainage assessment district requirements and fees. 6. All required improvements shall be constructed under.the supervision of and to the approval of the City Engineer. Cost of the inspection shall be paid by the Subdivider. Three and one-half percent of the amount of the improvement bond shall be deposited with the City Engineer for inspection costs. 7. All utilities shall be installed underground. S. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion con- trol both during and after construction of the project. 9. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11 respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus and unusable material, shall be disposed of at an off site facility equipped to'handle them. 11. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. Natural gas shall be stubbed in at the lo- cations of cooking facilities, water heater, and central heating units. 12. An Engineering Geologist shall be engaged to submit a report in- dicating the ground surface acceleration from earth movement for the project property. 13. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's.report. 14. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. -5- 3/15/77 - PC Minutes: H.B. A chemical analysis, as well as tests for physical properties of the soil on subject property, shall be submitted to the.City for review prior to the issuance of building permits. 16. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State Acoustical Standards set forth for all units that lie within the 60 CNEL contours of the property. 17. The exterior elevations of all buildings proposed for construction within said project shall comply with the architectural design of the units submitted to the Planning Commission for approval in conjunction with the site plan and tentative map. 18. The developer shall be required to improve the westerly half of the easterly extension of Anderson Street for access from the development to Pacific Coast Highway. 19. Subdivider shall dredge the existing channel bottom to an ele- vation of a minus ten (10) feet below mean low lower water, for a distance of 200 feet beyond the bulkhead line along the entry channel frontage of the development. CONDITIONAL USE PERMIT NO. 77-4 Applicant: Jonbar Enterprises This is a request for a racquetball/health facility located on the northwest corner of Warner and Magnolia. John Cope stated that he had no information to add to that contained in the staff report. The public hearing was opened. There being no one present to speak on this, the hearing was closed. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY SHEA CONDITIONAL USE PERMIT NO. 77-4 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed design and layout of the use will provide for a com- patible land use with both proposed commercial uses and existing surrounding commercial uses. CnNDTTTnNS: 1. The site plan and floor plan dated February 14, 1977 shall be the approved layout. 2. Fire safety systems shall be subject to review and approval by the Fire Department prior to occupancy of the building. 3. All previous conditions of approval for Administrative Review No. 76-185 shall be complied with. AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None ZONE CASE NO. 76-26"B" Applicant: Initiated by Planning Department This is a request for a change of zone from RA-0-CD, RA-0, R3 and C1 to R2 and R2-0 north of Clay Avenue, south of Garfield Avenue, east of Goldenwest Street, and west of the Pacific Electric Railroad right-of-way. A vugraph was shown of the area. Chairman Slates and Commissioner Shea stated that they would abstain since they had a conflict of interest. Vice Chairman Gibson chaired the hearing on this item. Secretary Selich addressed the Commission after some discussion and stated that the Commission might want to table this zone change and direct staff to initiate zone changes on R3 properties to R2 until the industrial study is resolved. The public hearing was opened. There was no one to speak on this item and the public hearing was closed. Planning Commission Tuesday, March 15, 1977 Page 8 CONDITIONAL EXCEPTION NO. 77-9 Applicant: George Armstrong In Conjunction With USE PERMIT NO. 77-13 Applicant: George A. Armstrong Conditional Exception 77-9 and Use Permit 77-13 have been filed to allow an existing water tower to be used as habitable floor area in conjunction with a proposed single-family residence. Subject tower is approximately 60 feet in height and is located along the rear property line; therefore, the 30 foot height limit and the 10 foot rear yard setback of the R1 District make it necessary for these applications to be filed. Jim Palin discussed the staff report and presented slides. Commission discussion ensued. The public hearing was opened. George Armstrong, applicant, addressed the Commission and stated that he would be willing to do whatever the staff felt was necessary to ensure fire protection. The public hearing was closed. ON MOTION BY SHEA AND SECOND BY PARKINSON CONDITIONAL EXCEPTION NO. 77-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The exceptional or extraordinary circumstance applicable to the building is that this structure was constructed a number of years ago at the approximate height of 60 feet and the City, pursuant to Section 9730, exempts water towers from the height limitation of the district in which they are located. 2. There has been a wave of opinion within the community to retain tho water tower at its present location and height because of the historical significance attached to the structure, and the Coastal Commission has requested that the tower remain. Therefore, the exceptions for the setback and height are necessary for the preservation and enjoyment of the owner's property rights. 3. The granting of a conditional exception will not be materially detrimental to the public health, safety, and welfare nor in- jurious to properties in the vicinity, as this is the only water tower in the City which can be converted to habitable quarters and the tower will be modified structurally to comply with -. present day codes. -8- 3/15/77 - PC Minutes: H.B. The applicant has indicated his willingness and ability to carry out the modifications required for habitable quarters to be established within the existing tower in compliance with all building and safety codes. 5. To deprive the proponent of a reasonable use of the tower because of height and location upon the subject property would have a ' detrimental effect upon the siting of a dwelling on the lot as well as obtaining reasonable use of the property normal to an R1 district. CONDITIONS OF APPROVAL: 1. The site plan received and dated March 8, 1977, shall be the approved layout for the water tower portion of the structure only. 2. All other applicable ordinances shall be complied with in full compliance with the Rl district. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or buildings. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. Implementation of a 100 ft. building setback line measured from the centerline of Edinger Avenue, on that property generally located south of Warner Avenue, approximately 300 ft. west of Gothard Street. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY NEWMAN THE FOLLOWING AMENDED CONDITIONS WERE APPROVED ON TENTATIVE TRACT 8688"X" BY THE FOLLOWING VOTE: AMENDED CONDITIONS OF APPROVAL 1. The map received and dated February 24, 1977 shall be the approved layout. 10. Full street improvements shall be constructed on each of the streets prior to the recordation of a parcel map or maps on the property that abuts that street except that "A" Street may be phased in no more than 3 phases subject to approval of the Depart- ment of Public Works. All modifications to the existing raised median in Bolsa as well as the restriping in Argosy -Avenue and Graham Street shall be constructed by the developer. 17. The irrigation system and plant material for the raised median within Bolsa Avenue, between Bolsa Chica and Graham Street shall be provided by the developer prior to recordation of the last parcel map for property that abuts Bolsa Avenue and the develop- ment of which would require a modification to the raised median. -11- 3/15/77 - PC Minutes: H.B. Only right turn entering and right turn exiting movements will be available for driveway locations 1, 3, 5, 8, 9, and 10. b. Left and right turns access will be available subject to modification by the developer of existing raised median for driveway numbers 2, 4, 6, and 7. c. Future driveways to Graham and Argosy Avenue to be reviewed and approved by the Department of Public Works and Planning Department at the time an application has been filed for development on each of the parcels. AYES: Parkinson, Finley, Gibson, Slates, Shea, Newman, Boyle NOES: None ABSENT: None ORAL COMMUNICATIONS Norm Haynie addressed the Commission and expressed his appreciation for the efforts of Staff and Commission on Plot Plan Amendment No. 76-11. COMMISSIONERS' COMMENTS Commission discussed methods of fire systems in connection with high rise buildings. Commissioner Finley stated that she felt the transmittals on the Multi -Story Suffix and the Pacifica should be sent separately to City Council. Chairman Slates stated that Commissioner Gibson would not be able to attend Planning Commission meetings from July 12 to the end of that month. Chairman Slates requested that the staff investigate the amount of money being paid to other Planning Commissioners in the County to see how it compared to Huntington Beach. , Commissioner Boyle discussed with Mike Zambory the need for bridges over the Santa Ana River. He was advised that Adams and Hamilton bridges will be under construction within 12 months. STAFF'S COMMENTS: Secretary Selich discussed the meeting with Mr. Mel Carpenter of the Coastal Commission, and stated that Mr. Carpenter agreed to have a staff member of the Coastal Commission present during preliminary reviews of significant developments in which they would be involved. -12- 3/15/77 - PC Minutes: H.B. Planning Commission Tuesday, March 15, 1977 Page 13 He also discussed the transfer of the Land Use Section from the Building Department to the Planning Department, as well as Jim Palin and Monica Florian exchanging positions in the Department for a temporary length of time. He then gave a brief review of the action of City Council at its March 14th meeting.
