ABSENT: NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 77-10 Applicant: Cager Properties Inc. To permit the construction of a six (6) unit apartment building on an arterial street pursuant to Section 9161.4(b) of the Hunting- ton Beach Ordinance Code, located on the west side of Newland Street approximately 480 feet south of Slater Avenue in an R2, Medium Density Residential District. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 77-13. The Chairman reopened the public hearing. There being no one present to address the Board in regard to the proposed *project, the public hearing was closed. The Board reviewed the information contained in the negative declara- tion request and discussed mitigation measures applicable to the project. ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED N.D. 77-13 WITH MITI- GATING MEASURES NOS. C-2 THROUGH C-9 APPLIED TO THE USE PERMIT, BY THE FOLLOWING VOTE: AYES; PALIN, CROSBY, SPENCER NOES: NONE. ABSENT:. NONE Minutes, H.B. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-10 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received and dated March 3, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regardinq this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifi- cations on file in the Department of Public Works shall be submitted to the Department of Building and Community Develop- ment. 3. In accordance with the City's standards and requirements, an additional twenty (20) feet of right-of-way on Newland Street shall be dedicated. BZA 3-16-77 Page 2 Minutes, H.B. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection devices or systems shall comply with the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assess- ment district. 7. The developer shall participate in the Orange County Sanitation District 43 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FI14AL INSPECTION 1. Newland Street shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A parcel map shall be filed to legalize the status of the property as a legal building site if it is determined by the Department of Building and Community Development to be necessary at the time of application for issuance of building permits. 2. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 4. Tlatural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. The structures on subject property, whether attached or detache shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 6. Energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots and recreation areas. 7. Crime prevention techniques shall be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). 8. Low -volume heads shall be used on all spigots and water faucets. 9. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-13 Applicant: Patricia Lockshaw To permit the conversion of an existing side entry garage to a front entry garage having a 12-foot setback in lieu of the required 22 feet per Section 9106.2 of the Huntington Beach Ordinance Code, located on the east side of Wanderer Lane approximately 240 feet north of Mistral Drive in an R1, Low Density Residential District. Chairman Spencer informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Patricia Lockshaw was present at the meeting and explained her reasons for requesting the variance. There being no other persons to speak on the pro- posed project, the public hearing was closed. The Board discussed the proposal extensively, considering the width of the proposed drive and the curb cut and the limitations this width would place on use of the drive for parkinq. Also reviewed were the center pillar construction within the garage and the height restrictions for landscaping at this location. ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-13 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 3-16-77 Page 4 Minutes, H.B. Board of Zoning Adjustments March 16, 1977 Page 5 FINDINGS OF THE BOARD: 1. The existing design, having a side -on entry with the drive- way immediately adjacent to the front entry of the dwelling, creates a nuisance value on the property in that there was not a proper drive apron provided at the time of original construction to attain the full 25 foot depth from the perpen- dicular to the face of the garage. 2. The City has in the past approved similar requests with a minimum dimension of 18 feet at the closest point subject to a single garage door with a full width drive approach, and this request is for a reduction of only two (2) feet in that minimum dimension (or 16 feet at oblique to the nearest corner of the garage door). 3. The two separate garage doors are proposed because there is a necessary support column required for the support of the remaining portion of the garage structure. 4. Granting of subject request will not be detrimental to persons residing or working in the vicinity, as there are both side -on and direct entry garages existing in the neighborhood. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated March 1, 1977, shall be the approved layout, subject to the following modifications: a. The driveway shall be a maximum width of ten (10) feet at curb, and lined up as close as possible to the easterly garage door. b. The plan, when submitted to the Department of Building and Community Development, shall be designed and con- structed in full compliance with that which has been submitted to the Board with the exceptions of the pro- posed hedge and the raised planter along the front property line, which shall comply with the provisions of the ordinance code. The above modifications shall be delineated upon the plan submitted to the Department of Buidinq and Community Devel- opment upon application for building permits. 2. The westerly garage door shall be provided with an auto- matic garage door opener. 3. The landscaped area immediately adjacent to the westerly side of the driveway shall be designed and constructed at an angle, as shown upon the March 1, 1977, plan. BZA 3-16-77 Page 5 Minutes, H.B. PERMIT NO. 77-14 Applicant: Doris Martinez To permit the construction of a 4,400 square foot commercial building pursuant to Section 9472 of the Huntington Beach Ordin- ance Code, located at the southwest corner of Beach Boulevard and Knoxville Avenue in a C4, Highway Commercial District. Chairman Spencer informed the Board that this request is covered by Negative Declaration No. 77-21. The Chairman opened the public hearing. Doris Martinez and Gene Kermin were present to represent the application. There being no one present to address the Board in regard to the request, the public hearing was closed. The Board reviewed the request, discussing the legality of the lot split, and applicants were advised to submit a preliminary title report to the Department of Building and Community Develop- ment upon application for permits. Also, the applicants were informed of the requirement that they extend the water line to serve subject property. The Board reviewed the negative declaration request and discussed mitigating measures applicable to the project. The following plans shall be submitted to the Department of Building and Community Development: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan if appli- cable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's standards and requirements, an additional 25 foot radius at the intersection of Knoxville Avenue and Beach Boulevard shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications BZA 3-16-77 Page 7 Minutes, March 16, Page 8 of the Huntington Beach Fire Code. Beach Boulevard and Knoxville Avenue shall be improved to the centerline of such rights -of -way. Said improve- ment shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drain- age, and sewer and water main extensions, in full compli- ance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A tentative parcel map shall be filed. Said parcel map shall have delineated thereon the reciprocal easements for ingress -egress along the south property line adjacent to Beach Boulevard. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Chairman Spencer informed the Board that this request is a Categ- orical Exemption, Class III, California Fnvironmental Quality Act, 1970. The Chairman opened the public hearing. No one was present to speak for or against the proposed project; the public hearing was closed. Secretary Palin reported that applicant has requested a continuance to permit the plans to be brought into compliance with code. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-17 WAS CONTINUED AT THE APPLICANT'S REQUEST TO THE MEETING OF MARCH 23, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 77-18 Applicant: Conder Construction To permit the construction of a six (6) unit apartment building pursuant to Section 9161.4(b) of the Huntington Beach Ordinance Code, located on the west side of Elm Street approximately 100 feet south of Sycamore Street in an R2, Medium Density Residential District. Chairman Spencer informed the Board that this request is covered by Negative Declaration request No. 77-25. The Chairman opened the public hearing. Mike Conder was present to represent the application, and indicated to the Board that the inadequate separation between the recreation room and the main structure will be resolved by connecting the buildings by trellis- work. There being no other persons to address the Board on this request, the public hearing was closed. The Board reviewed the request, discussing roofing proposed, loca- tion of the screening wall, and the legality and timing of the original lot split. The Board reviewed the information contained in the negative dec- laration request and considered mitigating measures applicable to the project. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-19 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The request is similar to other requests of this nature in the industrial zone, and therefore does not constitute grant- ing of special privilege. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated February 23, 1977, shall be the approved layout. 2. The loading facility shall be striped for a distance of forty-five (45) feet from the curb line of the property into the building and posted "truck loading -unloading only." 3. The overhead door shall be of a compatible material and color to the material used on the remaining portion of the building. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: :NONE ADMINISTRATIVE REVIEW NO. 77-34 (In Conj./UP 77-19) Applicant: Howard Foster To permit the construction of a 10,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located on the north side of Commercial Drive approxi- mately 280 feet west of Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Spencer informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Evelyn Evans, agent for the applicant, was present at the meeting. The Board reviewed the request, discussing landscaping, parking provisions, setbacks, and location of trash bins. The applicant was informed that one concrete bumper for every two parking stalls is permissible rather than the one -for -one as shown on the plan. BZA 3-16-77 Page 13 Minutes, H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plan received February 23, 1977, shall be the approved layout, subject to the following modifications: a. The landscaping along the front property line shall be a minimum depth of fifteen (15) feet. b. The end parking stall along the southwesterly portion of the project shall be increased by three (3) feet. C. The building shall reflect a true zero setback on the interior property line if not ad3acent to an open yard or parking area on the abutting industrial use. A plan delineating said modifications shall be submitted to the Department of Building and Community Development upon application for building permits. Board review ensued, with extensive discussion of the intent of the treatment of reciprocal easements along the common property lines for opening up the opposite side yards for open space. Alternative layouts were suggested, and the applicants agreed to pursue ways of providing more meaningful open space which would not require total redesign of the project.
