HomeMy WebLinkAbout1977-03-23I 1 MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, MARCH 23, 1977 - 1:15 PM BOARD MEMBERS PRESENT: PALIN, CROSBY, MORRIS CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT MINUTES: ON MOTION BY CROSBY AND SECOND BY PALIN THE MINUTES OF THE REGULAR MEETING OF MARCH 2, 1977, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 77-45 Applicant: Gloria Bray To establish a 24-hour care home for a maximum of six (6) non -related persons between the ages of 18 and 64 pursuant to Section 9730.27 of the Huntington Beach Ordinance Code, located on the west side of Flintstone Lane approximately 120 feet south of Fenley Drive in an R1, Low Density Residential District. Chairman Palin informed the Board that this request is exempt from environmental review per Section 15060 of the California State Envir- onmental guidelines. He also announced that the Board has received approximately 75 letters in opposition to the proposed project and that a petition has been entered into the file containing approxi- mately 900 signatures in opposition. The Chairman opened the public hearing. Gloria Bray was present at the meeting. Also present in behalf of the applicant were Dennis Carlsson, from the Orange County Department of Mental Health,_ -and__ _- Lynn Slevin and Lynda Martinez from the Department of Social Servic,Pc. ! Ms. Bray addressed the Board, explaining that the intended residents of the home are to be emotionally disturbed young girls and outlining her qualifications and experience in the field. Carlson, Slevin, and Martinez also addressed the Board, discussing the placement criteria and screening of the applicants, the licensing procedures, inspection of the premises, administration and care of medication for the residents, and interaction between the two involved depart- Minutes, H.B. Ms. Martinez emphasized that screening of the patients would take into consideration the elementary school across the street and that no girls would be placed in the home who might constitute any threat to school children. The following persons addressed the Board in opposition to the project: Russ Miltser, Warren Picken, Charles Arnold, Steven Douglas, David Tripoli, Blanche Swintek, Jerry Berger, and Sally Eisler. All of the above either reside in the vicinity of the proposed use or have children attending the elementary school. The speakers discussed the following points in regard to the proposal: 1. Location of the project and potential impact on the welfare and safety of the children attending the school. Also mentioned in this respect was the possible verbal harassment the patients in the facility might suffer from the children. 2. Liability for the actions of the residents. 3. The qualifications of the applicant to care for the disturbed persons, and the administration, type, and storing of any medications which might be necessary. 4. The precedent -setting nature of approval of the use - e.g., if such a facility can be established it could later be changed to a half -way house for alcoholics or narcotics offenders. It was also pointed out that speculators could lease homes in any area for the same purposes. 5. The use might constitute violation of the lease on the home, as the legal owner was not aware of and is not in concurrence with the proposed facility. 6. There will be nine persons residing in a three -bedroom house if the request is granted. (In regard to this, Jim Palin pointed out that the Board would condition any approval to not more than eight residents.) 7. Criteria for selection of residents and the possibility that patients would receive improper care in such a facility. 8. Increased criminal activity and citizen complaints to police which could result from such facility. 9. Property value decrease. 10. The right of people who have selected homes in an R1 area to continue to live in that environment without the encroachment of what they described as a commercial, rest -home type activity. The public hearing was closed. Board discussion ensued, with Board members questioning Carlson, Slevin, and Martinez on the points which had been raised in the pub- lic hearing. Board of Zoning Adjustments March 23, 1977 Page 3 Specific issues were the training and certification program for board and care home operators, which takes place only after placement of patients within a home; liability for the patients, which is taken care of by the operator through her own insurance policy with no specific requirements imposed by the State; and the difference between the subject use and the 601 program for adolescents also operated under the auspices of the Department of Social Services. ON MOTION BY PALIN AND SECOND BY MORRIS ADMINISTRATIVE REVIEW NO. 77-45 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The proposed site for this facility has been improperly selected, in that it would involve the placement of young girls with mental problems directly across the street from an elementary school, and there is overwhelming opposition from the residents of the neighborhood to such placement in the community. 2. The proponent in this case has not undergone any training program to assure that she is qualified to provide care for the proposed non -related persons. ' AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT:NONE USE PERMIT NO. 77-17 Applicant: Mike Clark Development To permit the construction of a three (3) unit apartment building abutting an arterial highway pursuant to Section 9161.4(a) of the Huntington Beach Ordinance Code, located on the west side of Delaware Street approximately 54 feet south of Indianapolis Avenue in an R2, Medium Density Residential District. Chairman Palin informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Gary Page was present to represent the application. There being no persons to speak for or against the proposal, the public hearing was closed. Board review found the plan to be in compliance with code with the exception of the turning radius off the alley, which will require addi- tional dedication because no dedication has been made on the offside of the alley. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 77-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 3-23-77 Page 3 Minutes, H.B. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect,the Master Plan of the City of Huntington Beach. ' 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: if 1. The revised conceptual plot plan and elevations received !{ March 18, 1977 shall be,the approved layout, subject to the modification described herein: a. Proper setback on the alley shall be,shown if the,2.5 ft. dedication has not been made by the property across the alley. A plan delineating said modification shall be submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of,ZoningAdjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. j 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Department of Building and Com- munity Development. 3. In accordance with the City's standards and requirements, an additional 2-1/2 ft. of,right-of-way on the Alley shall be dedicated. BZA 3-23-77 Page 4 Minutes, H.B. Soil and compaction reports shall be submitted by a certified soils engineer, Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be sub- mitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. All applicable fees shall be paid prior to issuance of building �I permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Delaware Street and the Alley shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The elevations submitted concurrently with the approved plan shall be the approved elevations for the front of the structure. AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-20 Applicant: Max Schreiber To permit the construction of a three (3) unit apartment building abutting an arterial street pursuant to Section 9161.4(a) of the Hunt- ington Beach Ordinance Code, located on the south side of Alhambra Avenue approximately 320 feet west of Beach Boulevard in an R2, Medium Density Residential District. i Chairman Palin informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Jim Palin informed the Board that the applicant has submitted proof in the form of a grant deed to indicate that the property was originally divided in March of 1947; this was in advance of the requirement for a parcel map and constitutes legal division of the lot. The request was reviewed by the Board. Mel Ott indicated that the Fire Department would like to have an access gate through the front for access for fire equipment, and Bruce Crosby informed the applicant that the top of the drive on Alhambra will have to be a minimum of 2.5 feet from the property line. Walls and landscaping treatment were also discussed. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be sub- mitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Heil Avenue and Alhambra Drive shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. All vehicular and pedestrian access rights on Heil Avenue shall be dedicated to the City of Huntington Beach. 2. The architectural design of the wall on Heil Avenue shall be to the approval of the Planning Department and the structural design of said wall shall be to the approval of the Department of Public Works, in compliance with a design theme for the total perimeter wall along that Section of the street. AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-22 Applicant: Buck-Tater Enterprises To permit the construction of a four (4) unit apartment building abutting an arterial street pursuant to Section 9161.4(a) of the Huntington Beach Ordinance Code, located at the northwest corner of Yorktown Avenue and Delaware Street in an R2, Medium Density Residential District. Chairman Palin informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Rav Hart was present to repre- sent the application. There being no persons to speak in regard to the proposed project, the public hearing was closed. A revised plan has been submitted indicating the type and location of patio walls and the proposed landscaping. Revised elevations have a been received and were reviewed by the Board. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-22 WAS APP IED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residinq or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: The plot plan received and dated February 28, 1977, shall be the conceptual layout, subject to the following modification: BZA 3-23-77 Page 8 Minutes, H.B. The plan shall be revised to reflect the,conditions imposed by the Board on September 8, 1976, on Tentative Parcel Map No. 76-37, to,reflect a 20-foot dedication in lieu of the 25-foot dedication as shown thereon. i b. The plan shall essentially comply with the revised land- scaping plan received and dated March 21, 1977, for type of patio fencing and the preliminary indication of planting material. c. The elevations of subject structure shall be the revised elevations received and dated March 21, 1977. The plan submitted to the Department of Building and Community Development upon application for building permits shall delineate the above modifications. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; . Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. C. GENERAL CONDITIONS: 1. A parcel map shall be recorded prior to occupancy of any unit within subject project. Williams To permit the construction of a 69-unit apartment complex pursuant to Section 9201.4(b) of the Huntington Beach Ordinance Code, loc- ated at the southeast corner of Adams Avenue and Huntington Street in an R3, Medium -High Density Residential District. Chairman Palin informed the Board that this request is covered by Negative Declaration request No. 77-26. The Chairman opened the public hearing. No one was present to rep- resent the application or to address the Board for or against the proposed project, and the public hearing was closed. Jim Palin informed the Board that the applicant has submitted a request for continuance to permit revisions to the plans. Williams To permit the separation of one parcel of land into four (4) parcels pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the south side of Adams Avenue between Huntington Street and Delaware Street in an R3-0, Medium -High Density Resi- dential District combined with Oil Production. Chairman Palin informed the Board that this request is covered by Negative Declaration No. 77-26. Mr. Palin informed the Board that the applicant has requested con- tinuance of the request to permit revisions to the map. ON MOTION BY CROSBY AND SECOND BY MORRIS TENTATIVE PARCEL MAP NO. 77-8 WAS CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE MEETING OF MARCH 30, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-24 Applicant: Hugh Myers To permit the facing of a truck loading facility onto a public street pursuant to Section 9518 of the Huntington Beach Ordinance Code, located on the south side of Research Drive at the intersection of Research Drive and Product Lane in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Palin informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Hugh Myers was present at the meeting. There being no one present to address the Board in regard to the proposed use, the public hearing was closed. The request was reviewed by the Board. The applicant was instructed that he could reduce the turning radius from 27 to 25 feet if he so desired, and timing of construction in relation to a previously approved administrative review was considered. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-24 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: Applications for this type facility have been granted to other ind- ustrial developers within the subdivision, and the Board has reviewed variation in the street scene in its consideration. The conceptual plot plan received March 8, 1977, shall be the approved layout, subject to the modifications described herein: a. Plan shall reflect zero setback if adjacent to an exist- ing or approved facility constructed at zero; otherwise, the six (6) inch setback shall be permitted only where adjacent to an existing or approved facility with open yard immediately abutting subject structure. b. The proponent shall comply with all applicable conditions of approval imposed on Administrative Review No. 76-62. The Board has discussed timing of the project and has hereby granted an extension of�time of six (6) months from the expiration date of the original administrative review approval (from May 19, 1977). c. The facility shall be striped for loading -unloading only to a depth of forty-five (45) feet from the curb line. c. The door for the loading facility shall be of a compat I e color to that used on the front of the building. d. The door to the loading facility shall remain closed at all times except when in use for loading -unloading purposes and shall not be used for purposes of ventila- tion and lighting. AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-25 Applicant: Douglas Jobson To permit the establishment of a pinball arcade within an existing pizza parlor pursuant to Section 9451 of the Huntington Beach Ord- inance Code, located on the east side of Main Street approximately 175 feet north of Pacific Coast Highway in a C3, General Business District. Chairman Palin informed the Board that this request is a Categori- cal Exemption, Class I, California Environmental Quality Act, 1970 The Chairman opened the public hearing. Douglas Jobson was presen at the meeting and reported to the Board that he has cancelled the lease held _j�y the,former owner for offstreet parking for the use. BZA 3-----23-77 Page 12 Minutes, H.B. Board of Zoning Adjustments March 23, 1977 Page 13 Mr. Jobson also discussed the alleged illegal closure of this establishment by the City for a period of three weeks. There being no other persons present to speak for or against the proposal, the public hearing was closed. Board discussion considered the history of the facility, the need for offstreet parking to replace the cancelled spaces, and Fire and Building Department requirements for the structure itself. It was the determination of the Board that the cancellation of the lease placed the pizza parlor in violation of the code requirements even without the extension of the use as an arcade, and the appli- cant would either have to provide parking at some other location or file for a variance for both uses. After further extensive dis- cussion it was the consensus that the applicant would pursue added parking and the staff would investigate the closure. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-25 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF MARCH 30, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, MORRIS NOES: NONE ABSENT: NONE I USE PERMIT NO. 77-26 (In Conj./AR77-46) Applicant: Sid Lance Construction To permit truck loading facilities to face a public street pursuant to Section 9518 of the Huntington Beach Ordinance Code, located on the north side of Production Drive approximately 255 feet west of Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Palin informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Sid Lance was present at the meeting. No one was present to address the Board, and the pub- lic hearing was closed. Board review found the proposed loading facility in conformance with standards for the industrial park. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-26 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: Applications for this type facility have been granted to other ind- ustrial developers within the subdivision, and the Board has reviewed variation in the street scene in its consideration.
