G. Williams To permit the construction of a 69-unit apartment complex pursuant to Section 9201.4(b) of the Huntington Beach Ordinance Code, loc- ated at the southeast corner of Adams Avenue and Huntington Street in an R3, Medium -High Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-26. The Chairman opened the public hearing on the negative declaration and the use permit. B.G. Williams was present at the meeting. Mr. Williams addressed the Board to ask that the requirement for providing gas stub -ins for cooking facilities not be imposed on this facility, as he is proposing to install a central boiler sys- tem convertible to alternate energy sources, making extra gas stub -ins unfeasible. The Board reviewed the project with the developer. There being no other persons to address the Board in regard to the proposed project, the public hearing was closed. Board discussion ensued on the negative declaration and applicable mitigation measures. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD ADOPTED NEGATIVE DECLARATION NO. 77-26, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE AN ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, WITH THE Minutes, H.B. Board of Zoning Adjustments March 30, 1977 Page 2 MITIGATING MEASURES AS CONTAINED IN CONDITIONS OF APPROVAL C-4 THROUGH C-11 IMPOSED UPON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE The Board reviewed the revised plans and additional documentation on the on -site oil operation submitted by the proponent. Secretary Palin noted that the application now reflects how the oil opera- tion is to be integrated into the total project, and that a secondary access to the existing wells from Delaware Street has been allowed by the City. Also reviewed in depth were drive and stall widths, parking provisions, open space, perimeter walls and provisions for walls around the oil operations, possible security gate provisions, and future abandonment of the oil operations. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-23 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated March 28, 1977, shall be the approved layout, subject to the modifications described herein: a. The parking on the site shall conform to Article 932 of the Huntington Beach Ordinance Code. b. If the developer is not successful in pursuit of a conditional exception for the location of the 6 foot BZA 3-30-77 Page 2 Minutes, H.B. Board of Zoning Adjustments March 30, 1977 Page 3 wall around the pr03ect, said wall shall either be re- duced in height or shall be set back a sufficient distance to comely with the setback provisions of the apartment standards. The plan submitted to the Department of Building and Community Development upon application for building permits shall have the above modifications delineated thereupon. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. A landscaping and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping speci- fications on file in the Department of Public works shall be submitted to the Board of Zoning Adjustments for review and approval action prior to the issuance of building permits. Such plan is to take into consideration intensified landscap- ing within the areas immediately outside the walls around the two onsite oil wells - more specifically, wells No. 5 and No. 2A. The plan will also show the ultimate treatment of these areas once the oil operations have been abandoned and the areas incorporated into the usable open space area for the tenants of the complex. 3. A rooftop mechanical equipment screening plan, if applicable, shall be submitted to the Department of Building and Community Development. Said plan shall indicate screening of all roof- top mechanical equipment and shall delineate the type of mat- erial proposed to screen said equipment. 4. In accordance with the City's standards and requirements, an additional twenty (20) feet of right-of-way on Adams Avenue, ten (10) feet of right-of-way on Delaware Street, and a thirty-two (32) foot radius at both the intersections of Adams Avenue and ;Huntington Street and Adams Avenue and Dela- ware Street shall be dedicated. 5., Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be sub]ect to approval by that Department. BZA 3-30-77 page 3 Minutes, H.B. Fire protection systems, including automatic sprinkler system standpipe systems, fire hydrants (to include at least one (1) onsite hydrant and two (2) offsite), fire alarm systems, and any other required fire protection and detection devices or systems shall comn_ly with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall he subject to approval by the Departments of Fire and Public Works. 7. The developer shall participate in the local drainage assess- ment district. 8. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Adams Avenue, Huntington and Delaware Streets shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. Such improvements shall take place for all parcels at the time of development of Parcel #2. C. GENERAL CONDITIONS: 1. The architectural treatment of the proposed wall shall be approved by the Planning Department prior to issuance of permits for said wall. 2. That portion of the wall around Parcel #1 shall include at least one open area with wrought iron (if that is the open treatment proposed) for visual access from Delaware Street. 3. The gating apparatus proposed on the through drive between Huntington and Delaware Streets shall be reviewed for approval action by the Police and Fire Departments prior to installa- tion within the project. 4. The masonry wall on the south and west sides of Parcel #1 shall be of a compatible color to the perimeter wall. 5. The developer shall file with the City bonds or other security in sufficient amount to assure that the onsite oil wells will be abandoned in compliance with City and State standards and that such area will be replaced into the usable open space area upon the termination of such oil operation. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 9. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of water heaters and central heating units. 10. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 11. Use of energy -saving lighting, such as high pressure sodium vapor lamps, shall be employed in parking lots and recreation areas. 12. Crime prevention techniques shall be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). 13. Low -volume heads shall be used on all spigots and water faucets. 14. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. Williams To permit the separation of one parcel of land into four (4) par- cles pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the south side of Adams Avenue between Huntington Street and Delaware Street in an R3-0, Medium High Density Resi- dential combined with Oil Production District. Chairman Lipps informed the Board that this request is also covered by Negative Declaration No. 77-26, adopted by the Board upon approval above of Use Permit 77-23. BZA 3-30-77 Paqe 5 Minutes, H.B. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 77-8 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The revised tentative parcel map received by the Planning Department on March 28, 1977, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. Huntington and Delaware Streets and Adams Avenue shall be dedi- cated and improved to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach sewer system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City ordinances. 8. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. 10. A plan depicting the disposition or treatment of existing onsite oil operations pursuant to Section 9682.1 of the Huntington Beach Ordinance Code shall be submitted to the Planning Department. The oil operations on Parcel #4 shall be granted access ease- ment over Parcel #3 during the life of such oil operation. No access shall be taken to Parcel #4 from the street to the south during the life of such oil operation. 12. Vehicular access rights shall be dedicated to the City of Huntington Beach except at locations as shown upon the site plan received and dated March 28, 1977 for temporary access to well #5 from Adams Avenue for the life of such oil opera- tion. 13. Parcel #1 shall be granted access via the location as shown upon the approved site plan for access to such parcel from Delaware Street, such access to continue for the life of the oil operation on said parcel. 14. Parcel #2 shall be granted permanent access from Delaware Street only as shown upon the approved site plan. 15. A drainage plan shall he approved prior to the issuance of building permits. Such plan shall take into consideration soils and erosion control both during and after construction of the pro]ect. This drainage plan is to include drainage for all four parcels. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-25 Applicant: Douglas Jobson To permit the establishment of a pinball arcade within an exist- ing pizza parlor pursuant to Section 9451 of the Huntington Beach Ordinance Code, located on the east side of Main Street approxi- mately 175 feet north of Pacific Coast Highway in a C3, General Business District. 4 Chairman Lipps informed the Board that this request is a Categori- cal Exemption, Class I, California Environmental Quality Act, 1970. -he Chairman opened the public hearing. Douglas Jobson was present at the meeting and submitted a lease for six (6) parking spaces across Main Street from his establishment. There being no other persons to speak for or against the proposal, the public hearing was closed. Secretary Palin reported to the Board on the closure of the facility, noting that the closure had been intended only for the pinball machines until such time as a license had been issued for their use. Board of Zoning Adjustments March 30, 1977 Page 8 The applicant was notified that revisions to the building would be required upon approval of a new use, to bring the building into compliance with Building and Fire Codes. It was the consen- sus of the Board that the parking provided by the new lease could be endorsed. ON MOTION BY LIPPS AND SECOND BY PALIN USE PERMIT NO. 77-25 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The building layout received and dated March 9, 1977, shall be the approved conceptual plan, subject to all requirements of the Fire Department and the Department of Buildinq and Community Development. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Parking provisions; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The six (6) parking spaces behind 123 Main Street (as indi- cated in the document received and dated March 25, 1977) shall run concurrently with the operation and use of the property as a pizza parlor and pinball arcade; approval of this use shall terminate with the termination of that park- ing agreement. All previous applicable conditions of approval imposed upon Administrative Review 76-16 (with the exception of the parking requirement) shall continue to apply. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-11 (Revised Plan) Applicant: George Renek & Ron Fought To permit revision to a previously approved Use Permit to allow construction of three (3) single-family dwellings pursuant to pro- visions of the Old Town Specific Plan, District One, located at the northeast corner of Atlanta Avenue and Huntington Street in an R3, Medium -High Density Residential District. Chairman Lzpps informed the Board that this request is covered by ND 77-16, adopted by the Board of March 9, 1977. The Chairman opened the public hearing. George Renek was present. There being on one to address the Board on this proposal, the public hearing was closed. The revised conceptual plan was reviewed by the Board in regard to setbacks, access, open space, etc. The applicant wag informed that the elevations of the unit abutting Atlanta Avenue would be required to come back to the Board for review and approval action prior to issuance of building permits. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 77-11 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWIPdG VOTE: REVISED CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PER11ITS: 1. The revised site plan received and dated March 22, 1977, shall be the conceptual plan, subject to the modifications outlined herein: a. The unit on Lot 20 shall be brought into compliance with provisions of the Oldtown Specific Plan as far as exterior setback, eave projection, and open space area. b. The exterior treatment on the brick block wall shall be substantially in compliance with that which the Board received and dated February 7, 1977, for the treatment along the Atlanta Avenue. The plan submitted to the Department of Building and Community Development upon application for building permits shall have the modifications delineated thereon, as listed above. Cirac (c/o John Sweeny) To permit the construction of a six (6) unit apartment building pursuant to Section 9161.4(b) of the Huntington Beach Ordinance Code, located on the west side of Ash Street approximately 375 feet south of Cypress Avenue in an R2 Medium Density Residential District. Chairman Lipps informed the Board that this request is covered by Negative Declaration No. 77-28. The Chairman opened the public hearing. Robert Cirac and John Sweeny were present at the meeting. Chuck Burney informed the applicants that the project will require installation of approximately 120 feet of water main to their north property line. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD APPROVED USE PER- MIT NO. 77-27 WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF TIIE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; h. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The plot plan received and dated March 11, 1977, shall be the approved layout, with a modification for the required seven (7) foot dedication on Ash Street in lieu of the 10- f_oot dedication shown on the plan.
