Vice Chairman Gibson conducted the meeting in the absence of
Chairman Slates.

SCHEDULED ITEMS:
ZONE CHANGE NO. 77-2
Applicant: Charles Hermansen
This is a request for a change of zone from C4 to R2. The staff
report indicated that as a result of recent public hearing and approval
by the City Council of Code Amendment No. 76-12, the subject property
is contained within District 2 of the Old Town Specific Plan. It
is therefore necessary that the legal notice on the pending request be
amended to reflect this zoning designation.
John Cope stated the applicant has concurred on a continuance to the
April 19, 1977 meeting.
Vice Chairman Gibson opened the public hearing. There was no one
present to speak on this application, and the public hearing was
closed.

CONDITIONAL USE PERMIT NO. 77-5 - NEGATIVE DECLARATION NO. 77-22
Applicant: Central Baptist Temple
This is a request to permit the development and operation of a
church and private school complex. The facilities will consist of
educational facilities including a pre-school to high school, gym-
nasium, church and administrative offices. The property is located
in an area general planned for industrial.
John Cope stated that he had no information to add to that contained
in the staff report.
The public hearing was opened.
Mr. Bob Zinngrabe, a member of the Board of Directors of the church,
addressed the Commission and spoke in favor of the proposed use.
Commissioner Boyle arrived at 7:25 P.M.
The public hearing was closed.

ON MOTION BY GIBSON AND SECOND BY SHEA NEGATIVE DECLARATION NO. 77-22
WAS APPROVED BY THE FOLLOWING VOTE:

ON MOTION BY SHEA AND SECOND BY NEWMAN CONDITIONAL USE PERMIT
NO. 77-5 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE:
1.- The proposed church and school facility will not be compatible
with future industrial uses on the surrounding properties.
2. The proposed use is not consistent with the land use con-
clusions of the recently completed Industrial Land Use Study
nor the industrial designation of the General Plan.
3. The proposed use will have a detrimental effect upon the value
of surrounding industrial properties.

4. There are other sites available in the immediate area for such
a use that would not hinder the development of future industrial
uses.

Commissioner Boyle abstained on the matter because he was not present
during the public hearing.
ZONE CASE NO. 77-3 "A - D"
Applicant: Initiated by Planning Department
77-3"A" is a request for a change of zone from R2-0 to RA south of
Yorktown Avenue west of Delaware Street.
77-311B" is a request for a change from R5 to Limited Use District
(LUD) on the north side of Pacific Coast Highway between Magnolia
Street and Brookhurst Street, and on the north side of Pacific
Coast Highway between Brookhurst Street and the Santa Ana River.
77-311C" is a request for a change of zone from C4 to RA southeast of
Atlanta Avenue and Beach Boulevard.
77-3"D" is a request for a change of zone from C3 to RA on the north-
west corner of Beach Boulevard and Pacific Coast Highway.
John Cope stated that he had nothing to add to the information con-
tained in the staff report. A vugraph was presented.
The public hearing was opened.
Mr. Mel Elliott spoke on Zone Change 77-3"A" and reau_ested time to discuss_
with staff the possible inclusion of the,oil suffix in the RA zoning.
Grace Poage requested clarification on the Limited Use District
zoning.
This item was tabled for further discussion with staff until the
next item was heard on the agenda. Also the public hearing was
closed.
The public hearing was later reopened.
Roy Woolsey spoke for his client, stating that part of the client's
property which is north of the existing freeway right-of-way had been
condemned by the Departmentof Transportation and that they were
interested in re -acquiring_ the property and therefore were in opposition
to the proposed rezoning.
The public hearing was closed.

AND TO READVERTISE ZONE CHANGE 77-3 "A" TO CHANGE TO RA-0 ZONING.
THE MOTION WAS SECONDED BY SHEA.
Commission and staff discussion ensued.
Commissioner Boyle withdrew his motion.

CONDITIONAL EXCEPTION NO. 77-1
Applicant: Mark C. Allen, Jr.
This application has been filed to allow the operation of a soil
amendment manufacturing facility, approved by the Board of Zoning
Adjustments on May 12, 1976 (Administrative Review No. 76-33 in
conjunction with Use Permit No. 76-17) and requesting a waiver of
street improvements as required by the Huntington Beach Ordinance
Code.
The public hearing was opened.
Mr. Mark C. Allen, applicant, addressed the Commission and reviewed
the history of the application.
The public hearing was closed.
Commission discussion ensued.
A MOTION WAS MADE BY SHEA AND SECONDED BY NEWMAN TO APPROVE CON-
DITIONAL EXCEPTION NO. 77-1 WITH THE FOLLOWING FINDINGS AND CON-
DITIONS OF APPROVAL:
Findings:
1. The proposed project is a temporary use of the property and will
not generate additional traffic count requiring full street
improvement.
2. Grades on Ellis west of Gothard have not been established, there-
fore the improvements at this time are unrealistic.
3. The granting of the Conditional Exception for the postponement of
the street improvements will not be detrimental to the public
safety, health, and welfare or injurious to properties or im-
provements in the neighborhood as the majority of the property

surrounding the use is vacant at this time and the Gothard/Main
extension has not been precise planned or improved at this time.

1. A postponement of street improvements can be granted as requested
by the applicant until April 1, 1981 or until such time as cash
contracts are let by the City for street improvements whichever
is sooner subject to the following:
a. That the developer install his Gothard Street improvements
concurrently with the cash contract to be let by the City
for the Ellis extension on the east side of Gothard Street
concurrently with the bridge construction at the railraod
tracks.
b. That the property owner participate with the City in the
Ellis Avenue improvements concurrently with a cash contract
for the Ellis Avenue improvements between Gothard and
Goldenwest and/or a cash contract for the construction of the
main Gothard extension to the south.

Jim Palin addressed the Commission and gave a brief history of the
background information contained in the staff report.
The public hearing was opened,
Reginald Axxe addressed the'Commission and discussed the problems
he had encountered with -the City with the conditions imposed on -
his application.
The public hearing was closed.

ZONE CASE NO. 77-8
Applicant: Initiated by the Planning Department
This is a request for a change of zone from R3 (Medium High Density
Residential) to R2 (Medium Density Residential) on the south side
of Garfield Avenue and north of Clay Street on both the east and
west side of Main Street.
The public hearing was opened. There was no one present to speak
on this application and the public hearing was closed.
Commission discussion ensued.
In response to the Commission's question on environmental status,
John Cope stated that an environmental assessment is performed
when a project is proposed.
ON MOTION BY SHEA AND SECOND BY BOYLE ZONE CASE NO. 77-8 WAS APPROVED
WITH THE FOLLOWING FINDINGS AND BY THE FOLLOWING VOTE:
1. The General Plan designates the subject properties as medium
density residential and therefore R2 zoning is necessary for
implementing consistency between the General Plan and zoning
as mandated by State Planning Law.
2. The proposed change of zone will provide for the most compatible
land uses within the subject area.

CONDITIONAL EXCEPTION NO. 77-03
Applicant: John Thomas
In Conjunction With
TENTATIVE PARCEL MAP 76-69 (APPROVED)
Applicant: John Thomas
This is a second request to permit a two lot division of land into
one 55 ft. lot and one 60 ft. lot in order that the developer can
construct a fourplex on the 60 ft. lot and a triplex on the 55 ft.
lot. The Planning Commission at its January 18, 1977 meeting
approved a two lot division of land for this applicant with each
lot having a frontage of 57.5 feet.
John Cope stated that he had no information to add to that contained
in the staff report.

John Thomas, the applicant, addressed the Commission and stated
that he wanted to present facts which were not previously presented
to the Commission at its January 18, 1977 meeting. He presented
photographs showing pictures of fourplexes in the area on 57.5 ft.
lot. He stated that he felt his property rights were being limited.
Commissioner Shea stated that she would approve a 60 ft. and 55 ft.
lot split.
Bob Wood spoke in favor of the applicant's request.
Ernie Miller felt that the applicant should have been allowed to
put a fourplex on each of the lots.
A property owner in the area stated he had bought property as an
investment and hoped that the applicant's request would be approved.
Reg de la Cuesta spoke against the uneven lot split.
A MOTION WAS MADE BY SHEA AND SECONDED BY NEWMAN TO APPROVE
CONDITIONAL EXCEPTION NO. 77-03 WITH THE FOLLOWING FINDINGS:
1. Such conditional exception is necessary for the preservation
and enjoyment of substantial property rights.
2. The granting of such conditional exception will not be
materially detrimental to the public health, safety, and welfare
or injurious to the conforming land, property, or improvements
in the neighborhood of the property for which such conditional
exception is sought.
3. There are exception or extraordinary circumstances or conditions
applicable to the land, buildings, or premises involved, or the
intended use of same that do not apply to the property or class
of uses in the same district.
4. The applicant is willing and able to carry out the purposes
for which the conditional exception is sought; that he will proceed
to do so without unnecessary delay.
Commissioner Finley stated that she felt that it would be granting
a special privilege to the applicant if the application was approved.
Commissioner Boyle did not feel a hardship existed since the law
has existed since 1957.
Commissioner Parkinson stated that he would vote against it for the same
reason as Commissioner Boyle.

This is a request for a one year extension of time for a previously
approved 442 lot subdivision located south of Talbert Avenue 500 ft.
west of Edwards Street.
Jim Palin briefly discussed the information contained in the staff
report.
The Chairman opened the public hearing. There was no one to speak
on this application and the public hearing was closed.
Commission discussion ensued.
ON MOTION BY SHEA AND SECOND BY BOYLE TENTATIVE TRACT 8995 WAS
APPROVED FOR A ONE YEAR EXTENSION OF TIME BY THE FOLLOWING VOTE:

CODE AMENDMENT NO. 77=4
"Revision to Miscellaneous Provisions"
Jim Palin briefly discussed the proposed code amendment which will
clarify application requirements for structures that are proposed
to be located more than 150 feet from a public street.
The public hearing was opened. There was no one present to speak
on this proposed code amendment, and the public hearing was closed.
Commission discussion ensued.

ON MOTION BY PARKINSON AND SECOND BY BOYLE THE ADAMS AVENUE BRIDGE
EXPANSION AND THE WATER MAIN ON BEACH BOULEVARD WERE FOUND BY THE
COMMISSION TO BE IN CONFORMANCE WITH THE GENERAL PLAN BY THE
FOLLOWING VOTE:

COMMISSIONERS' COMMENTS:
Commissioner Boyle stated that he felt because of the action taken
on Lake Street that the adjoining property should be zoned R1. There
was further discussion on the effect of Lake Street in redevelopment
activity in the downtown area.
Commissioner Finley discussed the recent trend of more property
being sold for industrial use in the City.
Commissioner Parkinson discussed the bike trails on Bushard and
expressed concern over them.
Vice Chairman Gibson discussed the possibility of having the staff
prepare a check list for people seeking applications and information
in the City Hall.
STAFF'S COMMENTS:
Secretary Selich discussed the action of the City Council meeting
held on April 4, 1977.
ADJOURNMENT:
