TENTATIVE PARCEL MAP NO. 77-7 (Cont. from 3-30-77)
Applicant: Houser Bros.
To permit a two (2) lot division of land pursuant to Section 9921
of the Huntington Beach Ordinance Code, located on the south side
of Edinger Avenue approximately 1000 feet east of Santa Barbara
Lane in a C4, Highway Commercial, R2 Medium Density Residential,
and MH Mobilehome District.
Chairman Lipps informed the Board that this request is covered by
Negative Declaration No. 77-29.
The Chairman reopened the public hearing for the negative declara-
tion request. Vince and Cliff Houser were present. No one was
present to address the Board, and the public hearing was closed.
Secretary Palin reported that research of the files has revealed
that all of subject property abutting Monterey and the first unit
of the park abutting Saybrook had been previously conditioned for
dedication and street improvement, but that no improvements or
dedication had been required for the northerly leg of Saybrook
along the westerly boundary of the mobilehome park. Bruce Crosby
discussed the intent of the Department of Public Works to ask for
a precise plan of street alignment for the extension of Saybrook
and the possible closure of Monterey when that alignment is con-
structed, using Saybrook as access to Edinger Avenue. It was noted
that precise dimensions of the right-of-way already dedicated
would be required.
The applicants were informed that a previous zone change to R2
had made a portion of the park a non -conforming use and that it
would be necessary in the future to process a use permit applica-
tion on any projects in that area which require a building permit,
or apply for a zone change to MH. After further extensive discus-
sion it was determined to continue this item to obtain additional
information from the Director of Public Works.

ON MOTION BY LIPPS AND SECOND BY PALIN TENTATIVE PARCEL MAP NO.
77-7 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANTS, TO
THE REGULAR MEETING OF APRIL 13, 1977, BY THE FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 77-15
Applicant: James B. Foster
To permit a reduction in the required open space by reducing the
minimum dimension for said open space from 20 feet to 15 feet
in lieu of Section 9103.3.1.1.2 of the Huntington Beach Ordinance
Code, located on the east side of Hunter Lane approximately 185
feet north of Scotstown Drive in an R1, Low Density Residential
District.
Chairman Lipps informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. James Foster was present
at the meeting. He submitted a corrected site plan with proper
lot dimensions and addressed the Board to explain his reasons for
the application. There being no other persons present to address
the Board on this project, the public hearing was closed.
The Board discussed the original siting of the unit on the lot and
the orientation of the proposed addition to the existing. The
possibility of providing the major open space area in the front yard
was reviewed.
ON MOTION BY LIPPS AND SECOND BY PALIN CONDITIONAL EXCEPTION NO.
77-15 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS:
1. The plan is not detrimental to the surrounding neighborhood.
2. Granting of this request does not constitute granting of special
privilege.
3. The subject plan accomplishes a greater number of square feet of
open space than is required by code, providing an excess of 400
square feet.
4. The open space allocations and ratios are in compliance with the
code for lots recorded after March 19, 1969.

CONDITIONS OF APPROVAL:

across the sidewalk for entry.
A plan delineating said modification shall be submitted to
the Department of Building and Community Development upon
application for building permits.

south of McFadden Avenue in a 100-M1-A-20,000, Restricted Manu-
facturing District.
Chairman Lipps informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
The Chairman opened the public hearing. Lloyd Hamilton was present;
there being no one to address the Board on the project, the public
hearing was closed.
Board discussion ensued.
ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 77-30 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL-
LOWING VOTE:
FINDINGS OF THE BOARD:
1. The Board has approved other requests of a similar nature within
the industrial park and granting of this request will provide
parity with other similar properties.
2. The ordinance code contains provisions for facilities of this
type.

Code, located on the west side of Industry Lane approximately 200
feet south of McFadden Avenue in a 100-M1-A-20,000, Restricted
Manufacturing District.
Chairman Lipps informed the Board that this request is covered by
EIR 73-16, adopted by thee City Council on March 18, 1974.
Lloyd Hamilton was present at the meeting.
Board review found the request to be in compliance with code re-
quirements.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO.
77-50 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:

1. The revised conceptual plot plan and elevations received
March 16, 1977, shall be the approved layout, subject to

In its approval action, the Board of Zoning Adjustments considered

Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plans shall be submitted to the Department of
Building and Community Development:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screen plan, if applicable,
Said plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material proposed
to screen said equipment.
3. Soil and compaction reports, if applicable, shall be submitted
by a certified soils engineer. Said reports shall be sub-
mitted to the Department of Building and Community Development
and shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be sub-
mitted to the Fire Department and shall be subject to approval
by the Departments of Fire and Public Works.
5. All applicable fees shall be paid prior to issuance of building
permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Street trees shall be installed in compliance with the con-
ditions imposed on approval of Tentative Tract 6948.

USE PERMIT NO. 77-31
Applicant: Charles and Marie Palmer
To permit the construction of two (2) commercial buidings (total
of 4,000 square feet) pursuant to Section 9472 of the Huntington
Beach Ordinance Code, located on the west side of Beach Boulevard
approximately 300 feet north of Clay Avenue in a C4, Highway Com-
mercial District.
Chairman Lipps informed the Board that this request is covered by
Negative Declaration No. 77-36.
The Chairman opened the public hearing. No one was present to rep-
resent the application. Sylvia Shandrick addressed the Board from
the audience to Question the use which might be going into subject
buildings. There being no other persons present to speak for or
against the proposal, the public hearing was closed.
Secretary Palin reported that applicant has submitted a request
for continuance.

at the meeting. No one was present to address the Board, and the
public hearing was closed. The Board reviewed the request.

This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Jorge de Mottos was present at the meeting. Board review found the
application to be in compliance with code requirements.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO.
77-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-

March 21, 1977, shall be the approved layout, subject

a. A ten by ten (10 x 10) foot corner cut-off shall be

CONDITIONAL EXCEPTION NO. 77-16
Applicant: Joffre Loor
To permit a reduction in the required open space by reducing the
minimum dimension for said open space from 25 feet to 18 feet
in lieu of Section 9103.3.1.1.3 of the Huntington Beach Ordinance
Code, located at the east end of Kilda Circle approximately 400
feet east of Kristopher Lane in an R1, Low Density Residential
District.
This request is a Categorical Exemption, Class V, California En-
vironmental Quality Act, 1970.
Chairman Lipps opened the public hearing. Robert Brown was present
to represent the application and addressed the Board, stating that the
hardship consists of the size and configuration of the subject lot.
There being no other persons to speak on the proposed project, the
public hearing was closed.
Board review included discussion of the architectural treatment
(i.e., the flat roof in conjunction with the existing gable) and
the floor plan of the existing house. Bruce Crosby informed the
applicant's representative of an existing storm drain easement over
the rear portion of the property and the requirements for setback
from that easement. It was the consensus that a revised plan should
be submitted reflecting the discussion.

Oil Production.
This request is covered by Negative Declaration No. 77-38.
Chairman Lipps opened the public hearing on the negative declara-
tion request. Herb Day was present to represent the application.
No one was present to speak on the negative declaration, and the
public hearing was closed. The Board reviewed the information
contained in the negative declaration request.

Secretary Palin noted that the applicant has filed a Conditional
Use Permit application on the subject property and this parcel map
should be referred to the Planning Commission to be heard concur-
rently with that application (C.U.P. 77-8).

TENTATIVE PARCEL 11AP NO. 77-9
Applicant: Raymond E Grage
To permit the consolidation of two (2) parcels and division into
two (2) new parcels pursuant to Section 9921 of the Huntington
Beach Ordinance Code, located at the southwest corner of Pearce
Drive and Roosevelt Lane in an R2, Medium Density Residential
District.
This request is a Categorical Exemption, Class V, California En-
vironmental Quality Act, 1970.
Raymond Grage and John Mandrell were present at the meeting and
indicated their receipt of and concurrence with the suggested
conditions of approval.
Secretary Palin informed the applicants that preliminary review
has revealed that there has been no resolution on improvements for
Roosevelt Lane at this time and in order to expedite processing
of the map it will be necessary to make an offer of dedication.
John Mandrell submitted a revised parcel map delineating required
dedication on both streets, including the radius at the intersec-
tion. The offer can be rejected for Roosevelt Lane at the dis-
cretion of the City Council until such time as it is needed.
ON MOTION BY CROSBY AND SECOND BY PALIN TENTATIVE PARCEL MAP NO.
77-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY
PURPOSE.
1. The tentative parcel map received April 6, 1977 by the
Planning Department shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works, and recorded with the Orange
County Recorder.
3. Pearce Drive and Roosevelt Lane shall be dedicated and im-
proved to City standards at the time said parcels are developed.
4. Water supply shall be through the City of Huntington Beach's
water system at the time said parcels are developed.
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcels are developed.
6. All utilities shall be installed underground at the time said
parcels are developed.

This request is covered by Negative Declaration No. 77-35.
Chairman Lipps opened the public hearing on the negative declaration.
John Cowles was present at the meeting. There being no persons to
address the Board in regard to this project, the public hearing was
closed.
The Board reviewed the information contained in the negative declara-
tion request and applicable mitigating measures.

Chairman Lipps discussed this retail interior decorator's shop
located in a single-family dwelling in a residential area, indi-
cating that it had previously been permitted under the home
occupation classification. The parking for the use, which had
been supplied by use of spaces in the mortuary parking lot across
the street, has been rescinded; the use is therefore in violation
of code requirements.
Protests to the continuation of the use have been received from
adjacent property owners.
After extensive discussion it was the determination of the Board
that, subject to a review by this body, the Department of Building
and Community Development should notify the operator of the use
to bring the facility into compliance with all code requirements
and prior conditions of approval or abate such use.
