Applicant: Houser Bros.
To permit a two (2) lot division of land pursuant to Section 9921
of the Huntington Beach Ordinance Code, located on the south side
of Edinger Avenue approximately 1000 feet east of Santa Barbara
Lane in a C4, Highway Commercial, R2 Medium Density Residential,
and MH Mdbilehome Districts.
Vince and Cliff Houser were present at the meeting.
Secretary Palin reported that the Department of Public Works has
determined to go ahead with a precise plan of street alignment for
the extension of Saybrook. The Board reviewed alternative courses
of action, noting that conditional approval at this time would not
expedite recordation of the parcel map and that the precise plan
might necessitate some changes on the parcel map as submitted.

Applicant: Charles and Marie Palmer
To permit the construction of two (2) commercial buildings (total
of 4,000 square feet) pursuant to Section 9472 of the Huntington
Beach Ordinance Code, located on the west side of Beach Boulevard
approximately 300 feet north of Clay Avenue in a C4, Highway Com-
mercial District.
This request is covered by Negative Declaration No. 77-36.
Chairman Spencer opened the public hearing. No one was present to
represent the application and no one wished to address the Board
from the audience. The public hearing was closed.
Secretary Palin informed the Board that the plan is not in compli-
ance with code requirements for front setback and parking provi-
sions.

Applicant: Joffre Loor
To permit a reduction in the required open space by reducing the
minimum dimension for said open space from 25 feet to 18 feet in
lieu of Section 9103.3.1.1.3 of the Huntington Beach Ordinance Code,
located at the east end of Kilda Circle approximately 400 feet east
of Kristopher Lane in an R1, Low Density Residential District.
This request is a Categorical Exemption, Class V, California Envir-
onmental Quality Act, 1970.
Chairman Spencer reopened the public hearing. Bob Brown was present
at the meeting and addressed the Board to report that the applicant
wishes to retain the floor plan and roofline as originally indicated
on his plan. There being no other persons to sneak for or against
the proposal, the public hearing was closed.
Board review ensued. The plan now takes into consideration the
drainage easement on the rear of the property.
ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 77-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,

FINDINGS OF THE BOARD:
1. The property in its present configuration together with the
public easement at the rear of the property and the required
setback from that easement prohibits the construction of the
addition at a normal placement.
2. The size and shape of the available building space mandates
that this addition be located either on the northerly or the
southerly side of the existing dwelling, unless applicant
should construct a two-story addition. Therefore, applicant
has demonstrated a hardship on the property.
3. Granting of this conditional exception does not constitute
the granting of special privilege.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plot plan received and dated April 11, 1977,
shall be the approved layout.

Jim Palin submitted the following reasons for his negative vote:
1. Additions proposed in an area where an architectural theme
has been established should carry forward that theme in order
not to degrade property values in the vicinity.

accommodate the proposed addition (even if such relocation
should mandate a second -story addition) and remain in com-
pliance with code requirements.
ADMINISTRATIVE REVIEW NO. 77-64 (Cont. from 4-6-77)
Applicant: Charles Hermansen
To permit the construction of two (2) single-family dwellings pur-
suant to Section 9354.16 of the Huntington Beach Ordinance Code,
located on the east side of 20th Street approximately 100 feet south
of Olive Avenue in the Townlot Specific Plan Area One, Section B.
This request is a Categorical Exemption, Class III, California En-
vironmental Quality Act, 1970.
Charles Hermansen was present at the meeting.
Board review found the revised plan to meet code requirements.

NO. 77-64 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised plot plan received and dated April 12, 1977,
shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
• Past administrative action regarding this property.
2. In accordance with the City's standards and requirements,
an additional two and one-half (2-1/2) feet of right-of-
way on the alley shall be dedicated.
3. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection and detec-

centerlines of such rights -of -way. Said improvement
shall include curbs, gutters, sidewalks, paving, street

the City of Huntington Beach street standards and require-
ments.

Applicant: Richard Seleine
To permit the construction of a seven (7) unit apartment building
pursuant to Section 9202.3.1.4 of the Huntington Beach Ordinance
Code, located on the south side of Aldrich Avenue approximately
125 feet east of Parkside Lane in an R3, Medium -High Density Resi-
dential District.
This request is covered by Negative Declaration No. 77-41.
Chairman Spencer opened the public hearing. Mr. Seleine was pre-
sent at the meeting. Secretary Palin reported that a letter has
been submitted to the file from the owner of subject property
stating that he did not sign the letter of authorization submitted
with this application; therefore, the office of the City Attorney
has recommended denial without pre]udice. There being no other
persons to speak for or against the request, the public hearing
was closed.

To permit the construction of a 3300 square foot restaurant pursu-
ant to Section 9472 of the Huntington Beach Ordinance Code,
located at the southeast corner of Beach Boulevard and Heil Avenue
in a C4, Highway Commercial District.
This request is covered by Negative Declaration No. 77-34.
Chairman Spencer opened the public hearing on the negative declara-
tion and the use permit. Ron Winterburn was present at the
meeting.
The Board reviewed the negative declaration request and the appli-
cable mitigation measures.
ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT

ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-34 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL-
LOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated March 23,
1977, shall be the approved layout, subject to the modi-
fication described herein:
a. The driveway approaches on Beach Boulevard and Heil
Avenue shall be increased to a width of thirty (30)
feet, with a radius type construction of the curb
returns.
The plan submitted to the Department of Building and Com-
munity Development upon application for building permits
shall have the above modification delineated thereupon.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

2. The following plans shall be submitted to the Department
of Building and Community Development:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan, if appli-
cable. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the
type of material proposed to screen said equipment.

In accordance with the City's standards and requirements,
an additional ten (10) feet of right-of-way on Heil
Avenue shall be dedicated.
4.
Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection dev-
ices or systems, shall comply with the specifications of
the Huntington Beach Fire Code. Plans for such systems or
devices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and
Public Works.
5.
The developer shall participate in the local drainage

6.
The developer shall participate in the Orange County Sani-
tation District #3 Sewer Annex District.
7.
All applicable fees shall be paid prior to issuance of
building permits.
B. TO
BE COMPLETED PRIOR TO FINAL INSPECTION:
1.

C. GENERAL CONDITIONS:
1. A masonry block wall of a minimum height of six (6)
feet shall be constructed on the easterly property line
on the west side of the alley.
2. If the alley is not at its ultimate width an additional
two (2) feet of right-of-way on said alley shall be dedi-
cated and accepted by the City.
3. The developer shall be responsible for relocation costs
for moving the traffic signal devices at the southeasterly
corner of the intersection.
4. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
5. Use of energy -saving lighting, such as high pressure
sodium vapor lamps, shall be utilized in parking lots and
recreation areas.
6. Crime prevention techniques shall be applied to the design
aspects of the project (e.g., single -cylinder locks, etc.).
7. Low -volume heads shall be used on all spigots and water
faucets.
8. All holding tanks for toilet facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are
available at the time of construction.

located on the north side of Industrial Drive approximately 200
feet west of Graham Street in a 100-M1-A-20,000, Restricted Manu-
facturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Chairman Spencer opened the public hearing. No one was present to
address the Board or to represent the application, and the public
hearing was closed.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The Board has previously granted similar requests for similar
facilities within the industrial park; therefore, granting
of this use constitutes granting parity with other uses.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated March 25, 1977, shall be
the approved conceptual layout.
2. An area extending for a minimum depth of forty-five (45)
feet from back of curb on the inside of the building shall
be striped and designated for loading -unloading purposes
only.
3. The overhead door for this facility shall be of a compatible
color to that used on the remaining portion of the face
of the building.

building pursuant to Section 9511 of the Huntington Beach Ordinance
Code, located on the north side of Industrial Drive approximately
237 feet west of Graham Street in a 100-M1-A-20,000, Restricted
Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
No one was present to represent the application. Board review
found the application to be in compliance with code, except that
the .79 foot setback can only be allowed if the building is adjac-
ent to open yard area on developed property.

NO. 77-60 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-

plan shall be revised to reflect zero setback on both

said modifications, if required, shall be submitted to the
Department of Building and Community Development.

This request is a Categorical Exemption, Class I, California Envir-
onmental Quality Act, 1970.
Chairman Spencer reopened the public hearing. Dave Garrison was
present at the meeting and submitted a copy of a survey of the park-
ing lot occupancy taken in January during lunch and dinner hours.
This survey indicated that at no time were there less than 18
available empty parking spaces on the site. There being no other
persons present to speak for or against the proposal, the public
hearing was closed.
The Board expressed concern with the number of spaces proposed to
be deleted and with the location of parallel spaces immediately
adjacent to perpendicular spaces as outlined on the plan. Also
discussed were turning radii, reciprocal drives and onsite circu-
lation, prior agreements and allocation of parking spaces on the
original shopping center, and the prior history of applications
on the total site.
After extensive discussion it was the consensus of the Board that
a continuation would be required to permit further field investi-
gation and staff research into previous approvals and conditions
on the total complex.
ON MOTION BY SPENCER AND SECOND BY PALIN USE PERMIT NO. 77-37 WAS
CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR
MEETING OF APRIL 20, 1977, BY THE FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 77-17
Applicant: Keith Grace
To permit the reduction of the minimum open space requirements by
reducing the minimum open space dimension from 25 feet to 15 feet

Code, located on the south side of Kilda Circle approximately 310
feet east of Kristopher Street in an R1, Low Density Residential
District.
This request is a Categorical Exemption, Class V, California En-

ON MOTION BY CROSBY AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 77-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The original siting of the dwelling at an oblique arrangement
on the lot creates problems in placing room additions or add-
ons, in effect mandating either a substandard addition or a
second story.
2. The total open space remaining on the lot exceeds the minimum
required by code except that it does not provide the required
dimension.
3. The addition as requested will not be detrimental to the health,
safety, and welfare of residents of the surrounding neighbor-
hood.
4. Granting of this request will not constitute granting of spec-
ial privilege.

4. The developer shall participate in the local drainage

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Eighteenth Street and the alley shall be improved to the
centerlines of such rights -of -way. Said improvement shall
include curbs, gutters, sidewalks, paving, street trees,
street lights, street signs, street drainage, and sewer and
water main extensions, in full compliance with the City of
Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a mini-
mum of R-19 and R-11, respectively. If no air condition-
ing is to be provided, the insulation in ceilings and
exterior walls shall be a minimum of R-13 and R-7, respec-
tively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
3. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
4. The structures on subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for all units that lie
within the 60 CNEL contours of the property.
5. Crime prevention techniques shall be applied to the design
aspects of the project (e.g., single -cylinder locks, etc.).
6. Low -volume heads shall be used on all spigots and water
faucets.
7. All holding tanks for restroom toilet facilities shall be
equipped for a capacity of 3.5 gallons if such facilities
are available at the time of construction.
