Yorktown Avenue west of Delaware Street.

(LUD) on the north side of Pacific Coast Highway between Magnolia
Street and Brookhurst Street, and on the north side of Pacific
Coast Highway between Brookhurst Street and the Santa Ana River.

this matter to the May 3, 1977 meeting to allow staff ample time to
complete an environmental status of the proposal as well as to allow
further research to be completed in order to determine whether the

Applicant: Ken Thompson
This is a request to allow the modification of an existing boat marina
located on the south side of Davenport, on the west side of Edinger Lane
in an R1, Low Density Residential District.
Mr. John Cope addressed the Commission and stated that the Planning
Department had received a written request from the Huntington Harbour
Property Owner's Association for a two week continuance on the matter.
Mr. Cope further stated that the Planning Commission has received
a petition signed by 15 residents of the area stating their opposition
to the Conditional Use Permit, and furthermore, these residents re-
quested that the petition be made a part of the record.

Chairman Slates stated that he has listened to the tape of the April 5,
1977 meeting and had concluded that the applicant failed to demonstrate
justifiable hardship warranting a Conditional Exception and he felt that
by granting these proposals, the applicant would be granted a special
priviledge inconsistent with other properties in the vicinity. Chairman
Slates also felt that the Revised Tentative Parcel Map application
was not in conformance with standards of the Huntington Beach Zoning
Ordinance.
ON MOTION BY SLATES AND SECOND BY BOYLE CONDITIONAL EXCEPTION NO. 77-03
WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE:
Reasons for Denial
1. The granting of the Conditional Exception will constitute a grant
of special privilege inconsistent upon other properties in the
vicinity and under an identical zone classification.
2. Applicant failed to demonstrate sufficient hardship.

Mr. John Cope addressed the Commission and stated that the applicant
had made a request for a continuance of the matter to the May 3, 1977
Planning Commission meeting due to a schedule conflict.

ZONE CHANGE NO. 77-2
Applicant: Charles Hermansen
This is a request for a change of zone from C4 to Old Town Specific
Plan District 2 located on the east side of Alabama Street from
Adams to Portland Circle.
Mr. John Cope addressed the Commission and briefly reviewed the
staff report. Mr. Cope stated that the subject property is contained
within the physical boundaries of the specific plan but was excluded
because of the existing commercial zoning designation. The applicant
has indicated a desire to develop the site in accordance with the
residential densities and requirements allowed under the specific
plan ordinance.
Mr. Cope reviewed the nature of the surrounding land uses and zoning.
He further stated that staff felt that the request had some merit,
however, staff feels that lots 2, 4, and 6.of the subject site would
be more compatible with surrounding uses as a residential zone.
Additionally, residential uses on the site would be the highest and
best use because of the questionable viability.of the property as
commercial. He further stated that staff also feels that the northerly
lots 8, 10, and 12, are better suited for commercial uses because of
their orientation to existing commercial uses to the east and west,
and the arterial frontage on Adams Avenue.
The Chairman opened the public hearing.
Mr. Charles Hermansen addressed the Commission and reserved the right
to address the Commission after opposition testimony has been heard.
He further stated that he does not agree entirely with the staff report
but that he would be agreeable to staff's recommendations.
Charles Gears addressed the Commission and stated his opposition to the
change of zone. Mr. Gears stated that he owns and operates a plumbing
supply business adjacent to the property in question. Mr. Gears stated
that the small businesses in that area generate a great amount of tax
revenue to the City and it was his belief that the City needed more
commercial service type operations. He was concerned that housing would
take away valuable land in which to operate their business. Mr. Gears
further cited traffic problems connected with possible apartment units
in that area, and that it would cost the City considerably larger
amounts of money to have this property built with apartment units in
Police protection, trash pickup, etc.
Mr. James DeGuelle addressed the Commission and stated his opposition
to the change of zone. Mr. DeGuelle cited the need for more commercial
service type operations in this City, and economically this area was
logical for these types of services. He also stated that the businesse
now in operation generate a great deal of revenue to the City.

Mr. Charles Lamb addressed the Commission and stated his opposition
to the change of zone. He stated that in 12 years this area only had
4 vacancies, thus insuring the success of small business type of oper-
ations in that area. Mr. Lamb stated that the service type of business
operations do not need heavy arterial exposure, for people seek these
operations, and consequently find them.
Mr. Hermansen, applicant, addressed the Commission again and stated
that there is a probability that he may build the area with single
family homes instead of apartment units. Mr. Hermansen reiterated
that he will adhere to staff's recommendations, even though it is
not entirely what his application requested.
The Chairman closed the public hearing.
Commission discussion ensued.
ON MOTION BY BOYLE AND SECOND BY NEWMAN ZONE CHANGE NO. 77-2 WAS
DENIED BY THE FOLLOWING VOTE:

Applicant: William Simpson Investments
This is a request for a change of zone from R5 and C4 to C2 located
on the southwest corner of Beach Boulevard and Main Street, approximately
150 ft. south of the intersection.
Mr. John Cope gave a brief summary of the staff report presented to
the Commission.
The Chairman opened the public hearing.
There being no one present to speak on the proposal, the Chairman
closed the public hearing.
Commission discussion ensued.
ON MOTION BY SHEA AND SECOND BY NEWMAN ZONE CHANGE NO. 77-7 WAS
APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE:
1. The proposed change to commercial zoning is consistent with the
commercial/retail land use designation of the General Plan.
2. The resultant change is minor in nature and is compatible with
surrounding zoning and land uses.

This is a proposal for a 25 lot subdivision located on the northeast
corner of Green and Los Patos Streets.
Mr. Jim Palin gave a brief summary of the staff report presented to
the Commission.

ON MOTION BY BOYLE AND SECOND BY SHEA TENTATIVE TRACT NO. 9771 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING
VOTE:
FINDINGS:
The Planning Commission of the City of Huntington Beach does hereby
find that the proposed subdivision, along with its design and improve-
ments, is consistent with general and specific plans for the area in
that:

1. The proposed subdivision of this 5.2 acre parcel of land zoned R1
(which allows 6.5 units per gross acre) is proposed to be con-
structed having only 4.8 units per gross acre.
2. The General Plan has set forth provisions for this type of land use
as well as setting forth objectives for implementation for this type
of housing.
3. The property was previously studied for this intensity of land use
at the time the land use designation for low density residential was
placed on said property.
4. The lot size, depth, frontage, street widths, and all other design
and improvements features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifications
on file with the City, as well as in compliance with the State Map
Act and supplementary City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. The Tentative Map received and dated March 18, 1977 shall be the
approved layout.

2. The sewer, water, fire hydrant system shall be designed to City
standards.
3. The water shall be through the City of Huntington Beach's water system.
4. The sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The property shall be subject to local drainage assessment require-
ments and fees.
6. All utilities shall be installed underground.
7. A fire alarm system, conduit, and appurtenances shall be installed
by the developer at locations and to specifications of the Fire
Department.
8. Sewer and water systems shall be installed in Green Street and
Los Patos Avenue for an intertie system from Warner to Bolsa Chica
Street. The water system shall be subject to the Water Department
and Fire Department approval.
9. Green Street, Los Patos Avenue, and Bolsa Chica Street shall be
dedicated and fully improved to City standards. An additional
minimum of 12' travel lane shall be improved on the west side of
the centerline of Green Street and on the south side of the center-
line of Los Patos Avenue concurrently with the street improvements
required of this subdivision. Such construction shall be in
compliance with the standard plans and specifications of the Depart-
ment of Public Works.
10. Vehicular access rights to Bolsa Chica shall be dedicated to the
City of Huntington Beach except at the street intersection of Los
Patos Avenue.
11. Standard 705 shall be constructed at the intersection of Los Patos
with Bolsa Chica Street. The masonry wall constructed behind the
standard 705 shall be a decorative masonry slumpstone and shall
continue along the northeasterly property line of Lot 9 to a
point adjacent to the masonry wall along the carports of the
apartment complex to the north.
12. The landscaping at the end of "A" Street as well as the masonry
wall at this location shall be subject to the Planning Department
and Department of Public Works approval. It shall be the responsi-
bility of the developer to install this landscaping with the
initial construction of the subdivision.
13. The drainage of the subdivision shall be approved by the Department
of Public Works prior to the recordation'of the final map. This
system shall be designed to provide for siltation and erosion control
both during and after construction of the project.

14. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum of
R-19 -ind P.-11, respectively. If no air conditioning is to be
provided, the insulation in cei l in(ls and exterior walls shall he
a minimum of R-13 and R-7, respectively.
15. All building spoils such as unusable lumber, wire, pipe and other
surplus and unusable material shall be disposed of at an offsite
facility equipped to handle them.
16. Natural gas and 220V electrical shall be stubbed in at locations of
clothes dryers. Natural gas shall be stubbed in at locations of units
of cooking facilities, water heaters, and central heating units.
17. The use of energy saving lighting shall be incorporated into all
interior and exterior areas of the project.
18. Crime prevention techniques shall be designed into the project.
(e.g. single cylinder locks, etc.)
19. Low volume heads shall be used on all spigots and/or water faucets.
20. All holding tanks for restroom facilities shall be equipped for a
capacity of 3, gallons if such facilities are available at time
of construction.
21. The structures on subject property, whether attached or detached,
shall be constructed in compliance with the State acoustical
standards set forth for all units that lie within the 60 CNEL
contours of the property.
22. Community antenna facilities shall be installed by the developer
in compliance with the specifications as set forth by Resolution
No. 4281 adopted by the City Council July 19, 1976.

FINDINGS:
The Planning Commission of the City of Huntington Beach does hereby find

MISCELLANEOUS:

COMMISSIONERS' COMMENTS:
Commissioner Shea expressed concern regarding a nearly completed
office structure in the Huntington Executive Office Complex. Her
concern was whether the structure met code requirements regarding
height limitation. She also expressed concern about the parking
situation in that same area.
Mr. Pat Spencer, staff member, was directed to investigate the
office structure in question and report back to Commission if this
structure meets all code requirements.
Commissioner Gibson cited concern about the consistency of conditions
of approval on tentative tract maps. Staff was directed to prepare
a policy for the next Commission meeting to be discussed and adopted.
Commissioner Gibson also expressed concern about the sewage problem
existing within Huntington Beach, and asked staff to further research
the problems now in existence.
Commissioner Finley requested that the Planning Commission's rationale
be expressed to Council on Zone Case 77-2, should this item be appealed
to Council.
Commissioner Finley cited concern about the lack of industrial land
within Huntington Beach. She requested that a policy decision be
made by Council on whether additional land will be rezoned for
industrial purposes.
Commissioner Parkinson stated that he had noticed that billboards
have been installed in the northeast corner of Beach and Edinger,
he further stated that although the property is within the Westminster
City limits, the Planning Commission's disapproval of these boards
should be addressed to the City of Westminster.
Mr. Selich, Planning Director, stated that he would direct a letter
to that effect to the City of Westminster, and that the Planning
Commission of the City of Huntington Beach was opposed to any develop-
ment in that triangle.
Commissioner Parkinson addressed the striping on Bushard. He stated
that Bushard had been restriped with two lanes on each side and that
parking had been eliminated along that strip on both sides.

Commissioner Finley inquired about the computer billboard that
was approved previously before the Planning Commission to be in-
stalled in the Huntington Executive Park. Mr. Selich stated that
he would research the matter as to why construction has not begun
of this billboard.
STAFF'S COMMENTS:
Mr. Ed Selich stated that the Council would be taking a field trip
sometime in May to study the industrial land use within this City
and perhaps the Planning Commission would like to join the Council
on this field trip.
Mr. Ed Selich reviewed action taken by the City Council on Monday,
April 18, 1977.
