Townlot Specific Plan Area One, Section B.
This request is a Categorical Exemption Class V, California Envir-
onmental Quality Act, 1970.
Chairman Spencer opened the public hearing. Mr Zehnder was present
at the meeting to describe his project and explain his rationale
in calculating the size of the building in relation to the unique
character of the lot. There being no other persons present to
address the Board on the proposal, the public hearing was closed.
Board discussion ensued, considering the original provisions for
varying lot sizes contained within the Specific Plan ordinance.

ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 77-18 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. The size of the lots was taken into consideration in the
adoption of the ordinance establishing the Specific Plan, and
that is the reason for the varying lot frontages in the calcu-
lation tables for density and number of units allowed.
2. Granting of this request would set an undesirable precedent
which would greatly increase the administrative load in the
application of the Specific Plan ordinance.
3. Sufficient hardship has not been demonstrated to justify the
granting of the request as submitted.

of the Huntington Beach Ordinance Code, located on the east side
of 15th Street approximately 50 feet north of Walnut Avenue in
the Townlot Specific Plan Area One, Section B.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
The Board advised Mr. Zehnder of alternative action which could
be taken on this application, as it cannot be approved as presently
submitted due to the denial of CE 77-18. The applicant indicated
his intention to appeal the denial and requested final action on
the plan as it stands.

USE PERMIT NO. 77-39
Applicant: Grover Long
To permit construction of an additional unit to a site having
an existing structure with a non -conforming front yard setback
pursuant to Section 9719 of the Huntington Beach Ordinance Code,
located on the west side of Huntington Street approximately 100
feet south of Hartford Avenue in an R2 Medium Density Residential
District.
This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
Chairman Spencer opened the public hearing. Grover Long was pre-
sent at the meeting. There being no one present to speak for or
against the project, the,public hearing was closed.
The Board noted that the plan provided insufficient parking spaces
on site, as the two tandem spaces shown are not permitted by
code. The applicant was cautioned that the Specific Plan for the
area which is soon to take effect might reduce the number of units
he could place on the lot and limit his flexibility in future de-
velopment once the present project is built.
Alternative courses -of -action -were discussed: approval of the plan
with the condition that the parking requirements be complied with,
filing of a conditional exception for the -reduction in onsite
parking, or revision of the plan to eliminate the second bedroom
(which would bring the parking into compliance). It was the appli-
cant's determination that he would redraw the plan.
ON MOTION BY SPENCER AND SECOND BY PALIN USE PERMIT NO. 77-39 WAS
CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING

This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE

1. The Ordinance Code contains provisions for establishment of
facilities of this type.
2. The Board has granted similar requests for other developments
within the industrial park, and granting of the request is

ance Code, located on the north side of System Drive approximately
116 feet east of the intersection of System and Chemical Lane in
a 100-M1-A-20,000, Restricted Manufacturinq District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
James L. Wood was present at the meeting.
Board review found the parking to be one space short of require-
ment and applicant was informed that he could provide the extra
space in the vicinity of the loading area. Mr. Wood was also in-
formed of the present ordinance requirement for installation of
community antenna television facilities.

ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW
NO. 77-70 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received April 13, 1977, shall be
the approved layout, subject to the modification described
herein: _
a. A minimum fifteen (15) foot wide landscaping strip shall be
provided between the curb and the parking area.
The plan submitted to the Department of Buiding and Community
Development upon application for building permits shall have
said modification delineated thereon.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
• Lot area;
. Lot width and lot depth;
• Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. The following plans shall be submitted to the Department of
Building and Community Development:
a. Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan, if applicable,
Said plan shall indicate screening of all rooftop mechani-
cal equipment and shall delineate the type of material
proposed to screen said equipment.

3. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systems, and any
other required fire protection and detection devices or systems,
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be submit
to the Fire Department and shall be subject to approval by the
Departments of Fire and Public Works.

4. All applicable fees shall be paid prior to issuance of building

1. A parcel map shall be filed to consolidate the two parcels
into one.

Applicant: William Simpson Investments
To permit the construction of a 30,000 square foot retail commer-
cial center pursuant to Section 9472 of the Huntington Beach
Ordinance Code, located on the west side of Beach Boulevard
approximately 125 feet south of the intersection of Beach Boule-
vard and Main Street in a C2, Community Business District.
This request is covered by Negative Declaration No. 77-34.
Chairman Spencer opened the public hearing. Ted Rodriguez and
David Saxon were present to represent the application. There
being no other persons present to address the Board on this pro-
ject, the public hearing was closed.
Secretary Palin reported that a request has been received from
the Planning Commission for a continuance to permit the Commission
to review the site plan for this project. Commissioner Slates,
representing the Commission, explained that only final action need
be deferred until after the Planning Commission meeting on May 3
and that the Board could pursue its review of the application.
The Board discussed the project with the proponents, including
the following: 1) requirements for width, depth of penetration,
and design of the main entry; 2) site angle encroachment; 3) lands-
caping specifications; 4) access point from Main Street (includ-
ing prior actions in the area); 5) the architectural theme; and
6) signing program plans. After extensive discussion, applicants

concurred to the continuance. They will arrange meetings with
staff to work out the problems on the site; and schematic draw-
ings showing the proposed circulation and the architectural theme
for the project and a signing program will be prepared for
review by the Board and the Commission.
It was duly noted that the Huntington Beach Company has indicated
that it has not given written authorization for the project on
the portion of the site which it owns.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-41 WAS
CONTINUED, WITH THE CONCURRENCE OF THE APPLICANTS, TO THE REGULAR
MEETING OF MAY 4, 1977, BY THE FOLLOWING VOTE:

USE PERMIT NO. 77-42
Applicant: John DeLeonardi
To permit construction of a three (3) unit apartment building on
an arterial street pursuant to Section 9161.4(a) of the Hunting-
ton Beach Ordinance Code, located on the west side of Delaware
Street approximately 100 feet south of Memphis Avenue in an R2,
Medium Density Residential District.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Chairman Spencer opened the public hearing. There was no one
present to represent the application or to address the Board on
this project, and the public hearing was closed.
Board review found the project to be in compliance with code re-
quirements except that the fifteen (15) foot front setback must
be provided.
ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-42 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL-
LOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity.
b. Property and improvements in the vicinity of such use or
building.

CONDITIONS OF APPROVAL:

1. The site plan received April 6, 1977, shall be the approved
layout and elevations.
In its approval action, the Board of Zoning Adjustments considered

2. In accordance with the City's standards and requirements,
an additional two and one-half (2-1/2) feet of right-of-

systems, standpipe systems, fire hydrants, fire alarm sys-
tems, and any other required fire protection and detection
devices or systems shall comply with the specifications
of the Huntington Beach Fire Code. Plans for such systems
and devices shall be submitted to the Fire Department
and shall be subject to approval by the Departments of
Fire and Public works.
4. The developer shall participate in the local drainage
assessment district.
5. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Delaware Street and the alley shall be improved to the
centerlines of such rights -of -way. Said improvement shall
include curbs, gutters, sidewalks, paving, street trees,
street lights, street signs, street drainage, CATV facili-
ties, and sewer and water main extensions, in full com-
pliance with the City of Huntington Beach street standards
and requirements.

TENTATIVE PARCEL MAP NO. 77-11
Applicant: Valley Consultants, Inc.
To permit a two -lot division of land pursuant to Section 9921
of the Huntington Beach Ordinance Code, located on the west side
of Lynn Street approximately 198 feet north of Milo Street in
an R2, Medium Density Residential District.
This request is covered by Negative Declaration No. 77-46.
Chairman Spencer opened the public hearing on the Negative Dec-
laration. The Board reviewed the information contained in the
request form and considered mitigation measures applicable to the
ultimate construction project on the site. The public hearing
was closed.
ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARA-
TION NO. 77-46 WITH THE MITIGATING MEASURES NOS. 10 THROUGH 17
IMPOSED UPON THE TENTATIVE PARCEL MAP, BY THE FOLLOWING VOTE:

No one was present at the meeting to represent the application,
but a letter has been received from the applicant concurring with
the suggested conditions of approval as forwarded to him.
Bruce Crosby noted that addition of the community antenna tele-
vision provisions would be necessary for this project.

1. The tentative parcel map received and dated March 30,

Said improvements shall include installation of community

Beach water system at the time said parcels are developed.
5. Sewage disposal shall be through the City of Huntington
Beach sewage system at the time said parcels are developed

said parcels are developed.
7. Compliance with all applicable City ordinances.
8. The property shall participate in the local drainage
assessment district at the time said parcels are developed.
9. A copy of the recorded parcel map shall be filed with the
Planning Department.
10. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a mini-
mum of R-19 and R-11, respectively. If no air conditioning
is to be provided, the insulation in ceilings and exterior
walls shall be a minimum of R-13 and R-7, respectively.
11. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
12. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
13. The structures on subject property, whether attached or
detached, shall be constructed in compliance with the
State acoustical standards set forth for all units that
lie within the 60 CNEL contours of the property.
14. Energy -saving lighting, such as high pressure sodium
vapor lamps, shall be used in parking lots and recreation
areas.
15. Crime prevention techniques shall be applied to the design
aspects of the project (e.g., single -cylinder locks, etc.).
16. Low -volume heads shall be used on all spigots and water
faucets.
17. All holding tanks for toilet facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are avail-
able at the time of construction.

north of Walnut Avenue in the Townlot Specific Plan Area One,
Section A.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
W. Friar was present to represent the application.
Board review found the following deficiencies in the plan: 1) the
entry width, 2) a six (6) inch encroachment into setback, and 3)
coverage is over code by 32 square feet. It was the consensus that
a revised plan would be required.

Applicant: Edwin C. Ross
To permit establishment of a temporary parking lot pursuant to
Section 9730.28 of the Huntington Beach Ordinance Code to serve
an existing church facility located on the south side of Adams
Avenue approximately 420 feet west of Main Street in an R1-O,
Low Density Residential combined with Oil Production District.
This request is a Categorical Exemption, Class 4, California
Environmental Quality Act, 1970.
Ed Ross was present at the meeting.
The Board reviewed the nature and duration of the use proposed and
past action on the church property. After extensive discussion it
was determined that a better approach to the problem would be for
the applicant to file for a conditional exception to waive certain
requirements of the ordinance for permanent parking lots, to
which the applicant agreed.

the Huntington Beach Ordinance Code, located on the south side of
Mountjoy Drive approximately 200 feet east of Gothard Avenue in an
Ml, Light Industrial District.
This request is covered by Exemption Declaration No. 74-150,
adopted by the Planning Commission on approval of TT8788 on Novem-
ber 19, 1974.
Mr. Quirk was present at the meeting.
Board review found the plan to be in compliance with code require-
ments. The applicant was informed of the necessity for a parcel
map to be filed if the parcels were conveyed separately.

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated April 12, 1977, shall
be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
Parking layout;
Lot area;
. Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.

2. The following plans shall be submitted to the Department
of Building and Community Development:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan, if appli-
cable. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the
type of material proposed to screen said equipment.
3. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to
the Department of Building and Community Development and
shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm sys-
tems, and any other required fire protection and detection
devices or systems shall comply with the specifications of
the Huntington Beach Fire Code. Plans for such systems
and devices shall be submitted to the Fire Department and
shall be subject to approval by the Departments of Fire
and Public Works.
5. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. One street tree (minimum size 20" box) shall be installed
per building.
2. Community antenna television facilities shall be installed
for the project.
