Applicant: Carl Karcher Enterprises, Inc.
To permit the addition of a drive -through window and related
facilities pursuant to Section 9472 of the Huntington Beach
Ordinance Code, located on the south side of Warner Avenue approxi-
mately 630 feet west of Goldenwest Street in a C4, Highway Commer-
cial District.
This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
Chairman Lipps reopened the public hearing. David Garrison was
present at the meeting. There being no persons present to address
the Board in regard to this request, the public hearing was closed.
Secretary Palin reviewed prior action on the site (UP 71-17 and
UP 72-33) in regard to reciprocal drive access and parking alloca-
tions, and indicated that the parking count proposed in the request
does comply with prior conditions and the code requirements. The
layout of the parking was reviewed, and it was the consensus of
the Board that the parallel spaces be replaced with angled spaces
striped to head in the same direction as the flow of traffic.
Revisions to the onsite landscaping were also discussed.

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated March 29, 1977,
shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relatinq to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
2. A landscaping and irrigation plan shall be submitted to the
Planning Department for review and approval action. Said
plan shall comply with Article 979 of the Huntington Beach
Ordinance Code and landscaping specifications on file in
the Department of Public Works.
B. GENERAL CONDITIONS:
1. The parking along the westerly property line between the
intertying drive and the most northerly landscaped area
shall be striped as diagonal parking spaces, with a land-
scaped planter provided along the northerly portion of the
most northerly parking stall.
2. Parking spaces 14 and 15 shall be eliminated and a land-
scaped planter of a minimum width of twelve (12) feet shal
be provided at that location.

3. The parking for the use shall be restriped in compliance
with Article 979 for double striping.

Applicant: Grover Long
To permit construction of an additional unit on a site having an
existing structure with a non -conforming front yard setback
pursuant to Section 9719 of the Huntington Beach Ordinance Code,
located on the west side of Huntington Street approximately 100
feet south of Hartford Avenue in an R2, Medium Density Residential
District.
This request is a Categorical Exemption, Class I, California Envir-
onmental Quality Act, 1970.
Chairman Lipps reopened the public hearing. Grover Long was pre-
sent and explained his revised plan, which labels the original
second bedroom as a den. There being no other persons present to
address the Board on this request, the public hearing was closed.
The Board reviewed the revised plan, again advising the applicant
of the constraints he may be placing on future development of his
property in light of the pending specific plan for the area.
ON MOTION BY LIPPS AND SECOND BY PALIN USE PERMIT NO. 77-39 WAS
APPROVED WITH THE FOLLOWING FINDIGNS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated April 21,
1977, shall be the approved layout, subject to the modi-
fication described herein:
a. The plan submitted to the Department of Building and
Community Development upon application for building
permits shall eliminate the entry into the den from the
hall.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan: _
. Parking layout;
. Lot area;
• Lot width and lot depth;
• Type of use and its relation to property and improvements in
the immediate vicinity;
• Past administrative actions regarding this property.
2. In accordance with the City's standards and requirements,
an additional two and one-half (2-1/2) feet of right-of-
way on the alley shall be dedicated.
3. The developer shall participate in the local drainage
assessment district.
4. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Huntington Street and the alley shall be fully improved to
the centerlines of such rights -of -way. Said improvements
shall include curbs, gutters, sidewalks, paving, street
trees, street lights, street signs, street drainage, and
sewer and water main extensions, in full compliance with the
City standards and requirements.

located on the east side of Oak Street approximately 192 feet south
of Sycamore Avenue in an R2, Medium Density Residential District.

This request is a Categorical Exemption, Class V, California
Environmental Quality Act, 1970.
Chairman Lipps opened the public hearing. Robert Hollingsworth
was present at the meeting. Joe D'Salme, owner of adjoining
property, was present to question whether the subject project
would adversely affect his lot. There being no other persons to
address the Board, the public hearing was closed.
Board discussion ensued, centering on the type of materials to
be used on the zero walls and how said walls could be maintained.
Mr. D'Salme indicated that he would be amenable to granting a
maintenance agreement to the project proponent.
ON MOTION BY PALIN AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION
NO. 77-20 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1.
The ratio of lot width to lot depth creates a hardship
in obtaining a logical, feasible layout on the property to
accommodate both the necessary turning radii and access to
the required parking as well as access for emergency vehicle
response on the site.
2.
The layout is one which has been recommended numerous times
to open up a development and provide a greater degree of
landscaping and open space.
3.
The layout has eliminated the massive amount of curb cut from
the plan as originally proposed. Said layout provided one
twenty (20) foot drive cut and has afforded a larger area for
planting and beautification of the street scene.
4.
The proposed plan is not detrimental to the health, safety,
and welfare of persons residing or working in the vicinity.
CONDITIONS OF APPROVAL:
A.
TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised,conceptual plan received and dated April 14,
1977, shall be the approved layout.
2. If the applicant is not,successful in obtaining a three
(3) foot maintenance easement along the rear property
lines of the properties immediately to the south in the
vicinity of Building A, the separation wall between the
two properties shall be constructed of maintenance -free,
decorative masonry material of earth -tone color.

ADMINISTRATIVE REVIEW NO. 77-71 (Cont. from 4-20-77)(In Conj./CE 77-
Ap2licant: Robert F. Hollingsworth
To permit the construction of a four (4) unit apartment extending
more than 150 feet from a public street pursuant to Section
9730.28 of the Huntington Beach Ordinance Code, located on the
east side of Oak Street approximately 192 feet south of Sycamore
Avenue in an R2, Medium Density Residential District.
This request is a Categorical Exemption, Class III, California En-
vironmental Quality Act, 1970.
Robert F. Hollingsworth was present at the meeting.
Secretary Palin informed the Board that this request was continued
to permit revision to the original plan and the filing of Condi-
tional Exception 77-20, in order to obtain a more workable plan
on the property. The revised plan was reviewed by the Board.
ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO.
77-71 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:

5. The developer shall participate in the Orange County Sani-
tation District #3 Sewer Annex District.
6. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Oak Street shall be improved to the centerline of such
right-of-way. Said improvement shall include curbs,
gutters, sidewalks, paving, street trees, street lights,
street signs, street drainage, underground installation
of community antenna television facilities, and sewer and
water main extensions, in full compliance with the City of
Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. The approval of this administrative review shall become
null and void if Conditional Exception No. 77-20 should be
appealed to a higher body and denied.
2. All conditions imposed upon CE 77-20 shall apply to this
approval.
3. A fence or wall of a minimum height of six (6) feet shall
be constructed along the south property line from the most
easterly garage wall to the east property line, to pro-
hibit intrusion of vehicles or vehicle lights from the open
parking spaces of subject project onto abutting property.
4. A minimum four (4) inch, concrete -filled pipe shall be
imbedded into the ground three (3) feet along the south
property line adjacent to parking stall #1 along the front
property line, for the protection of the property to the
south.

To permit construction of two (2) single-family dwellings pur-
suant to Section 9354.16 of the Huntington Beach Ordinance Code,
located on the west side of 7th Street approximately 100 feet
north of Walnut Avenue in the Townlot Specific Plan Area One,
Section A.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Mr. Pryor was present to represent the applicant, and submitted
a revised plan as required at the previous meeting. Noting that
the plan should have been submitted prior to the meeting to permit
plan check, the Board determined that a continuance would be
required.

77-72 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO

Residential District.
This request is a Categorical Exemption, Class I, California
Environmental Quality Act, 1970.
Chairman Lipps opened the public hearing. James Lane was present
at the meeting and explained his planned addition, noting that
access is to be taken to the addition from the existing family
room. There being no other persons to address the Board on this
request, the public hearing was closed.
Board discussion ensued.

This request,is covered by Negative Declaration No. 77-51.
Chairman Lipps opened the public hearing on the Use Permit and
the Negative Declaration applications. The Board reviewed the
information contained in the negative declaration request and
mitigating measures applicable to the project.
ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-51 WITH THE
MITIGATING MEASURES CONTAINED IN CONDITIONS Cl THROUGH C6 IMPOSED

Board review included drive separation, building elevations,
site angle encroachment of proposed Building C, and parking pro-
visions for the total site.

1. Atlanta Avenue and Beach Bouelvard shall be improved to
the centerlines of such rights -of -way. Said improvement
shall include curbs, gutters, sidewalks, paving, street
trees, street lights, street signs, street drainage, under-
ground installation of community antenna television facili-
ties, and sewer and water main extensions, in full com-
pliance with the City standards and requirements.
C. GENERAL CONDITIONS:
1. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
2. A chemical analysis, as well as tests for physical prop-
erties of the soil on subject property, shall be submitted
to the City for review prior to the issuance of building
permits.
3. Energy -saving lighting, such as high pressure sodium vapor
lamps, shall be used in parking lots.

4. Crime prevention techniques shall be applied to design
aspects of the project (e.g., single -cylinder locks, etc.).
5. Low -volume heads shall be used on all spigots and water
faucets.
6. All holding tanks for toilet facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are
available at the time of construction.
7. Building C, Phase II, shall be redesigned to be brought
into compliance with sight angle encroachment requirements.
8. Maximum pro3ection on the parking at all locations within
the development shall be two (2) feet, with a net dimen-
sion of seventeen (17) feet on the parking stalls.
9. A six (6) foot high chain link fence shall be installed
along the easterly property line where adjacent to the
Talbert Flood Control Channel, if applicable.
10. A masonry wall of a minimum height of six (6) feet shall
be constructed along the northerly property line of
Phase IV, either prior to or concurrently with the con-
struction and development of the project to the north.
Said wall shall be located upon the commercial site.

To permit construction of a four-plex extending more than 150
feet from a public street pursuant to Section 9202.3.1.4 of the

Holt Avenue approximately 50 feet east of Parkside Lane in an R3,
Medium -High Density Residential District.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Chairman Lipps opened the public hearing. No one was present to
address the Board on this request, and the public hearing was
closed.
Secretary Palin reviewed the Board's concerns on the need for
reciprocal drives within this project, and recommended continu-
ance to permit applicant to be present and attempt to obtain said
reciprocals.

Applicant: Allen W. Mitchell
To permit a 6-foot chain link security fence to be located within
the required front setback in lieu of Section 9434.1 of the
Huntington Beach Ordinance Code, located on the north side of
Pacific Coast Highway approximately 137 feet east of Mariner Drive
in a C4, Highway Commercial District.

Applicant: Allen W. Mitchell
To permit a yacht sales facility in an existing building pursuant
to Section 9472.1 of the Huntington Beach Ordinance Code, located
on the north side of Pacific Coast Highway approximately 137 feet
east of Mariner Drive in a C4, Highway Commercial District.
This request is a Categorical Exemption, Class I, California En-
vironmental Quality Act, 1970.
Chairman Lipps opened the public hearing on the conditional ex-
ception and the use permit applications. Mr. Mitchell was present
at the meeting. Max Cobb, 16531 23rd Street, Sunset Beach,
addressed the Board to indicate that the authorization granted for
the filing of these applications is invalid, as he has a recorded
sales contract on the sub3ect property making him in fact the
legal owner. He further noted that establishment of the requested
use on the property does not coincide with his plans for the site.
There being no other persons present to speak on the proposed use,
the public hearing was closed.
Secretary Patin expressed the opinion that sufficient questions
of legality have been raised to preclude any action on the proposal
until the issue has been resolved. Mr. Mitchell informed the
Board that he had submitted a letter from Mr. Marinella represent-
ing himself as the owner and agreeing to lease the property to
the applicant. In view of the title problem he asked for with-
drawal of the requests; he also asked for the letters from the
Mr. Marinella, which were given to him from the files.
