Applicant: Charles and Marie Palmer
To permit the construction of two (2) commercial buildings (total
of 4,000 square feet) pursuant to Section 9472 of the Huntington
Beach Ordinance Code, located on the west side of Beach Boulevard
approximately 300 feet north of Clay Avenue in a C4, Highway Com-
mercial District.
This request is covered by Negative Declaration No. 77-36.
Chairman Spencer opened the public hearing on the negative declara-
tion and the use permit. Charles Palmer was present at the meeting.
The Board reviewed the information contained in the negative dec-
laration request and considgred mitigating measures applicable to
the pro]ect.

The Board reviewed the revised plan, which now complies with
code requirements. Mr. Palmer indicated his willingness to stipu-
late that the commercial usage on the site shall be limited to
1,000 square feet of space, but that it might be located within
the buildings at locations other than shown on the plan.
ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-31
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity.
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City`s General Plan of

CONDITIONS OF APPROVAL:

1. The revised plan received and dated April 25, 1977, shall
be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

2. A landscape and irrigation plan complying with Article 979

B. GENERAL CONDITIONS:
1. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed of
at an offsite facility equipped to handle them.

sodium vapor lamps, shall be utilized in parking lots
and recreation areas.

4. Low -volume heads shall be used on all spigots and water
faucets.
5. All holding tanks for toilet facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are
available at the time of construction.

USE PERMIT NO. 77-41 (Cont. from 4-20-77)
Applicant: William Simpson Investments
To permit the construction of a 30,000 square foot retail com-
mercial center pursuant to Section 9472 of the Huntington Beach
Ordinance Code, located on the west side of Beach Boulevard
approximately 125 feet south of the intersection of Beach Boule-
vard and Main Street in a C2, Community Business District.
This request is covered by Negative Declaration No. 77-34.
Chairman Spencer reopened the public hearing on the negative dec-
laration and the use permit applications. Ted Rodriguez was
present to represent the developer. The Board reviewed the in-
formation contained in the negative declaration request and consid-
ered mitigation measures applicable to the project.
ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-34 WITH THE

Mr. Rodriguez, in response to a comment from the Board, indicated
that the developer would meet all code requirements in regard to
percentage of landscaping on the site. There being no other per-
sons present to address the Board on the project, the public
hearing was closed.
The Board reviewed the revised plan. Secretary Palin discussed
the Planning Commission's prior review of this project, for the
information of the Board. The reciprocal access at the southerly
end of the project on Beach Boulevard was discussed and changes
suggested for improved circulation pattern on the site and reduc-
tion of the hazardous situation created by said access.

WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE

1977, shall be the approved conceptual layout, sub]ect to
the modifications described herein:
a. The most southerly driveway is to be eliminated as a
mutual curb cut and a landscaping island and pocket
installed within that location to restrict ingress -
egress to the site.
b. The alley -type entry shall be designed and constructed
in compliance with the provisions for said type of
entry as contained in Article 979.
C. A new drive approach shall be constructed midway be-
tween the main entry on Beach Boulevard and the south-
erly property line, to align fairly closely with the
east -west drive between the Taco de Carlos and Wendy's
Hamburger facilities shown on the approved plan.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
• Parking layout;
• Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
• Past administrative action regarding this property.
2. A landscaping and irrigation plan shall be submitted to
the Planning Department. Said plan shall comply with
Article 979 of the Huntington Beach Ordinance Code and
landscaping specifications on file in the Department of
Public Works.
3. The specific elevations for all buildings located on the
Beach Boulevard portion of the center shall be submitted
to the Board of Zoning Adjustments for review and approval
action prior to the issuance of building permits.
4. The elevations on the area shown for future building shall
be submitted to the Board of Zoning Adjustments for review
and approval action prior to the issuance of building per-

mits. Said elevations shall take into consideration
special treatment on the side of the building siding
onto Main Street as well as the rear of the building, to
assure architectural theme continuity and concept and use
of compatible materials on all street vistas.

1. The site plan is to comply with the provisions of the
Huntinqton Beach Ordinance Code for total landscaping.

USE PERMIT NO. 77-45 (Cont. from 4-27-77)
Applicant: James W. Moore
To permit construction of a four-plex extending more than 150
feet from a nublic street pursuant to Section 9202.3.1.4 of the
Huntington Beach Ordinance Code, located on the south side of
Holt Avenue approximately 50 feet east of Parkside Lane in an
R3, Medium -High Density Residential District.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Chairman Spencer opened the public hearing. James Moore was
present at the meeting, and discussed the possibility of recipro-
cal drives with the Board. He indicated that it would be a
practical impossibility to obtain such an agreement from the
property owner to the west since there are garages built to within
three or four feet of the property line at that location.
There being no other persons present to address the Board, the
public hearing was closed.
The Board explained the need for the reciprocal ingress -egress to
provide two-way access to the rear parking court, and discussed
the possibility of reversing the plan and pursuing a reciprocal
with the property owner to the east. The proponent agreed to
attempt to obtain such agreement. Mel Ott informed Mr. Moore
that the fire hydrant he had proposed to install onsite would not
be required.
ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-45 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL-
LOWING VOTE:

10 feet of the abutting lot shall be submitted the Planning
Department prior to the issuance of building permits.
Such easement shall penetrate both properties for a mini-
mum depth of fifty-five (55) feet from the ultimate right-
of-way line.

The Board noted in its review that the plan has been revised to
provide the 5-foot setback as requested, but that the plan still
shows front entries directly opposite each other and alternative
layout of the dwellings on the site was suqgested to provide
adequate privacy to residents.

Chairman Spencer opened the public hearing. Mr. and Mrs. Buchanan
were present at the meeting to present justification for the
request as follows: 1) a number of variances have already been
granted in the area in the past; 2) the wall between the proposed
project and the neighboring yard is higher than normal (about
8'6") and thus the structure would not be visible from that
property; 3) solar heating pipes for the pool as well as sewer
lines exist on the site at the location where the garage would have
to be located if constructed per code setback requirements; and
4) existing mature trees would have to be removed if the garage
were to be constructed according to code.
Mrs. Tibbetts, owner of the ad3oining property, submitted a letter
of protest and spoke against the proposed project. There being
no other persons to address the Board in regard to the proposal,
the public hearing was closed.

Chairman Spencer opened the public hearing. Dennis Reid was
present at the meeting and addressed the Board, explaining that
the purpose of the wall is for a flood wall to protect the facility
against the 100-year storm in compliance with EPA requirements.
The Board reviewed with the applicant the berming and landscaping
proposed in conjunction with said wall and the elevation from which
the finished height of the wall had been calculated. There being
no other persons present to speak for or against the proposed
project, the public hearing was closed.
Board discussion centered on the applicability of the requirements
of the zoning ordinances to the Sanitation District facilities.
After extensive discussion it was the determination of the Board
that a continuance was necessary to permit research into the orig-
inal permits for the facility and to analyze jurisidiction on the
site.

ing District.
This request is covered by EIR 73-16, adopted by the Citv Council
on March 18, 1974.
Chairman Spencer opened the public hearing. Sid Lance and Webb
Morrow were present at the meeting. There being no other persons
present in regard to this request, the public hearing was closed.

trial buildings pursuant to Section 9511 of the Huntington Beach
Ordinance Code, located on the north side of Engineer Drive
approximately 150 feet from Transistor Lane in a 100-M1-A-20,000,
Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Sid Lance was present at the meeting.
Board review included discussion of the wall or landscaping neces-
sary to screen the parking and the number of driveways into the
property. Both Mel Ott and Bruce Crosby indicated that their re-
spective departments found no problem with that number of drives
on a local street.

This request is covered by Negative Declaration No. 77-53.
Chairman Spencer opened the public hearing op the negative declara-
tion. Jack Wallace was present to represent the applicant, and
explained that all shipments and handling will be done through an
existing closed system recently modified and improved. No new
undergrounding of lines or additional storage facilities will be
required. There being no other Persons present to address the
Board in regard to the proposal, the public hearing was closed.
The Board reviewed the information contained in the negative
declaration request and the application.

1. The applicant shall comply with all applicable provisions of
the Huntington Beach Municipal Code governing oil operations
on all modification or addition to the subject facility.

To permit construction of two (2) single-family dwellings pursuant
to Section 9354.16 of the Huntington Beach Ordinance Code, located
on the west side of 15th Street approximately 125 feet south of
Palm Avenue in the Townlot Specific Plan Area One, Section B.
This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Robert Ferry was present at the meeting.
Board review determined that the plan will need revision to pro-
vide the five (5) foot front entry or relocation of the entries
to the front elevations of the dwellings. Alternatives were re-
viewed and it was agreed that a revised plan would be submitted.

NO. 77-81 WAS CONTINUED TO THE REGULAR MEETING OF MAY 18, 1977,

This request is a Categorical Exemption, Class III, California
Environmental Quality Act, 1970.
Gene Clark was present to represent the applicant and indicated
that he would revise his plan to provide the 5-foot front entry
setback, with the second story cantilevering over that area.
Board review found the plan to be otherwise in compliance.
ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW
NO. 77-82 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received and
dated- April 22, 1977, shall be the approved layout and
elevations, subject to the modification described herein:
a. An entryway of a minimum width of five (5) feet shall
be provided at the front entrance of the unit.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in
the immediate vicinity;
Past administrative action regarding this property.
2. In accordance with the City's standards and requirements,
an additional two and one-half (2-1/2) feet of right-of-
way on the alley shall be dedicated.

RESOLUTION NO. 1
A Resolution of the Board of Zoning Adjustments of
the City of Huntington Beach adopting a conflict of interest
code.
WHEREAS, pursuant to the Political Reform Act
of 1974, a conflict of interest code must be prepared
for those City_ boards, commissions, and committees
which make or participate in the making of governmental
decisions which may foreseeable have a material effect
on any financial interest; and
A conflict of interest code has been prepared for
all City departments and for those boards, commissions,
and committees required to have a conflict of interest
code,
NOW, THEREFORE, BE IT RESOLVED by the Board of
Zoning Adjustments that it hereby adopts the Conflict
of Interest Code attached hereto and made Dart hereof.
Passed and adopted by the Board of Zoning Adjustments of the
Citv of Huntington Beach, California, on the llth day of May,
1977, by the following roll call vote:
