Buchanan To permit the construction of a detached garage to within six (6) inches of the side property line in lieu of the required five-foot setback per Section 9105.3(b) of the Huntington Beach Ordinance Code, located on the north side of Heil Avenue approximately 195 feet west of Delmar Street in an R1, Low DAnsity Residential District. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Chairman Spencer opened the public hearing. There being no one present to speak in regard to the request, the public hearing was closed. Secretary Palin reported that applicant has phoned and requested a continuance on this item to the June 15, 1977. meeting. Chairman Spencer opened the public hearing. No one was present to address the Board on this matter, and the public hearing was closed. Secretary Palin reported that the applicant has been contacted and has agreed to a week's further continuation. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCPETION NO. 77-22 WAS CONTINUED TO THE REGULAR MEETING OF MAY 18, 1977, WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-84 Applicant: Allan Garner To permit the twenty-four (24) hour care of six (6) non -related adult male persons between the ages of 18 and 64 pursuant to Section 9730.27 of the Huntington Beach Ordinance Code, located at 8162 Kiner Avenue on the south side of the street approximately 210 feet west of Lisa Street in an Rl, Low Density Residential District. This request is exempt from environmental review per Section 15060 of the California State Environmental guidelines. Chairman Spencer opened the public hearing on the request. Allan Garner was present at the meeting. Secretary Palin reviewed the past history of the subject use, which was originally approved under AR 76-37 and is presently up for annual review and authorization. He also noted that a petitior, opposing continuation of the use has been filed, as well as numer- ous letters and telephone calls in opposition having been received. 1 BZA 5-11-77 Page 2 1 Minutes, H.B. Board of Zoning Adjustments May 11, 1977 Page 3 Chairman Spencer opened the public hearing. Allan Garner, Lynn Slaven, and Linda Martinez were present to represent the applica- tion. Mr. Garner addressed the Board to review the history of his opera- tion, the alleged incidents which have occurred, the type of residents in the home, and the rules under which the residents are required to live within the home. He also read into the record a letter of support from Chris Springer, resident of the neighbor- hood. Lynn Slaven, County monitoring and recruiting supervisor, spoke in favor of the project, citing the State plans for normalization of patients through such projects as this and the legal issue of possible preemption by the State of a city's right to review these projects. He also discussed the savings in tax dollars to be effected through such projects in contrast to the cost of maintaining patients in the State hospitals. Linda Martinez, County monitoring worker, also discussed financial aspects of the project, in particular refuting the allegations that a large financial return results from the project, noting that the applicant would gross $1,710 per month before expenses of rent, utilities, food, etc., for seven adult men. Also speaking in favor of the project were Robert Green, executive director of the Mental Health Association of Orange County; Larry Sweet, former resident of the home; Fred Gonzales, resident of the neighborhood; and Paul Eickmier, former resident and assistant to Mr. Garner. The following people spoke in opposition to the proposal: Don and Marie Galusha, Barry Clark, G.L. Payne, Jim Johnson, John Mason, H. L. Schoonover, an4 Brian Burnett. The speakers challenges the proposed use on the following grounds: inadequate supervision has been maintained to guarantee that residents will not lose control and harm others, no matter how carefully they are screened by the County; the use will have an adverse effect on the Rl character of the neighborhood and the nearby elementary school children; and the possibility of criminal activity resulting from the use. Also discussed were the two alleged incidents which have already occurred, the rental status of the applicant, the possibility of alternative location for the use in a downtown or commercial district, and the possible adverse effect the use could have on adjacent property values. Board of Zoning Adjustments May 11, 1977 Page 4 Board discussion ensued, taking into consideration the pros and cons of the arguments presented by those present and the provisions of the Huntington Beach Ordinance Code allowing for review of such uses. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-84 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The facility does not meet the intent of the Ordinance Code requirements for maintaining the single-family residential character of the R1 neighborhood. 2. The facility does not meet the original intent of the legisla- tion authorizing such use, which was to provide a home atmosphere environment for its residents. 3. The Board finds that supervision has not been maintained at an adequate level to provide security both for residents of the facility or for the general neighborhood. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE Chairman Spencer advised the applicant of the appeal procedure. USE PERMIT NO. 77-51 Applicant: Charles M. Hughes To permit the construction of a second -story apartment unit and garage on a site having a non -conforming yard pursuant to Section 9719 of the Huntington Beach Ordinance Code, located on the south side of Knoxville Avenue approximately 125 feet west of Huntington Street in an R2, Medium Density Residential District. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Chairman Spencer opened the public hearing. There were no persons present to represent the request and the public hearing was closed. Secretary Palin reported that the applicant has verbally requested a week's continuance on this item. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-51 WAS CONTINUED TO THE REGULAR MEETING OF MAY 18, 1977, AT THE REQUEST OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE BZA 5-11-77 Page 4 Minutes, H.B. Board of Zoning Adjustments May 11, 1977 Page 5 USE PERMIT NO. 77-52 (In Conj./AR 77-87) Applicant: Mike Quagletti To permit truck loading facilities to face a public street pur- suant to Section 9518 of the Huntington Beach Ordinance Code, located on the east side of Chemical Lane between Business and Commercial Drives in a 100-M1-A-20,000, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Chairman Spencer opened the public hearing. Mr. Quagletti was present. There being no one to address the Board in relation to the request, the public hearing was closed. Board discussion followed. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-52 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The ordinance code contains provisions allowing uses of this nature in the industrial park. 2. The Board has granted requests for similar uses on similar projects within the industrial park; granting of this request therefore grants parity with other properties in the general area. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated April 27, 1977, shall be the approved layout, subject to the modifications delineated in the conditions of approval imposed upon AR 77-87. 2. The overhead doors shall be of a similar color to that used on the remaining portions of the buildings. Board of Zoning Adjustments May 11, 1977 Page 6 Ordinance Code, located on the east side of Chemical Lane between Business and Commercial Drives in a 100-M1-A-20,000, Restricted Manufacturing District. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Mike Quagletti was present at the meeting. Board review noted that the parking as shown is very inefficient and demonstrated how rearrangement of the access to Chemical Lane only could increase parking count and efficiency, provide area for outside trash location, and increase usable building area. The applicant agreed to this approach. The required setbacks were also explained to the applicant. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-87 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated April 27, 1977, shall be the approved layout, subject to the modifications outlined herein: a. The plan shall be revised to show deletion of the driveways on Business Diive, with access to parking provided from Chemical Lane for both lots and build- ings A and B. b. The five (5) inch setback at the rear of the buildings as indicated on the plan shall be permitted only if said setback is adjacent to open yard area on an already constructed (or already approved for construc- tion) facility on the abutting property; otherwise, the setback shall be zero. The plan submitted to the Department of Building and Community Development upon application for building per- mits shall have the above modifications depicted there- upon. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; . TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Street trees shall be installed in compliance with conditions of approval imposed on TT 6948. C. GENERAL CONDITIONS: 1. The conditions imposed on Use Permit No. 77-52 shall apply. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 77-17 Applicant: Western Cement Contractors To permit consolidation of two (2) lots to permit creation of two (2) new lots pursuant to Section 9921 of the Huntington Beach Ordinance Code, located at the southeast corner of Aldrich Street and Parkside Lane in an R3, Medium -High Density Residential District. This request is covered by Negative Declaration No. 77-57. Chairman Spencer opened the public hearing on the negative dec- laration request. Jay Panchal was present at the meeting. There being no other persons present to address the Board in regard to the request, the public hearing was closed. The Board reviewed the negative declaration and considered miti- gating measures applicable to the ultimate project to be con- structed on the parcels. ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-57 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS 10 THROUGH 16 IMPOSED UPON THE TENTATIVE PARCEL MAP, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE BZA 5-11-77 Page 7 Minutes, H.B. The appli- cant indicated his receipt of and concurrence with the suggested conditions oP approval previously forwarded to him. ON MOTION BY CROSBY AND SECOND BY PALIN TENTATIVE PARCEL MAP NO. 77-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR,: ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on April 25, 1977, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Parkside Lane and Aldrich Street shall be dedicated and improved to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City ordinances. 8. The property shall participate in the local drainage assessment district at the time said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. 10. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a mini- mum of R-19 and R-11, respectively. If no air condition- ing is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12. Energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots and recrea- tion areas. 14. Crime prevention techniques shall be applied to the pro- ject (e.g., single -cylinder locks, etc.). 15. Low -volume heads shall be used on all spigots and water faucets. 16. All holding tanks for toilet facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. O'Neal To permit the construction of two (2) industrial buildings (total of 21,000 square feet) pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the southeast corner of Talbert Avenue and Redondo Circle in an M1-A, Restricted Manufacturing District. This request is covered by ED 74-150, adopted by the Planning Com- mission on November 19, 1974, upon approval of TT 8788. Mr. O'Neal was present at the meeting. The Board discussed the proposal with the applicant, informing him of the required setbacks from the utility easement on the easterly property line and Redondo Circle. The use of the easement over the water main was reviewed, and the Board instructed Bruce Crosby to check with the Director of Public Works to determine if parking could be permitted within that area. Also discussed was the lot configuration and the applicant was informed of the need to file a tentative parcel map to consolidate the two legal sites he is building upon into one legal lot. ON MOTION BY PALIN AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 77-88 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated April 27, BZA 5-11-77 Page 9 Minutes, H.B . The plan shall be revised to reflect the required five (5) foot setback of all structures from the 25- foot utility easement at the rear of the property, and to reflect the 15-foot setback from the curb line of Redondo Circle (to provide a 10-foot setback from the 5-foot easement at that location). b. The revised plan shall reflect onsite parking as re- quired in compliance with Article 979 of the Hunting- ton Beach Ordinance Code. C. Landscaping and the trash enclosure area shall be relocated off the 25-foot easement of the rear (east) property line. No trees shall be planted within that easement over the water main. The plan submitted to the Department of Building and Com- munity Development upon application for building permits shall have the above modifications delineated thereupon. If there is no masonry wall along the west property line of the adjoining property to the east, the applicant shall construct a decorative masonry wall of a minimum height of six (6) feet for a depth of sixty (60) feet from the property line on Talbert Avenue southerly, for screen ing of parking and yard areas; from that point on a chain link fence with slatting may be constructed. Wheeler To permit establishment of a new use in an existing building and construction of a new garage on the site pursuant to Section 9471 of the Huntington Beach Ordinance Code, located on the west side of Cameron Street approximately 360 feet south of Slater Avenue in a C4, Highway Commercial District. This request is a Categorical Exemption, Classes I and III, re- spectively, California Environmental Quality Act, 1970. Bob Milholland, Pearl Wheeler, and Charles Pentelli were present to represent the application. Mrs. Wheeler explained the proposed use (a termite control business) to the Board and outlined how storage of the required chemicals will be handled. The applicants were informed that open parking per code would be required in addition to the parking provided in the garage. The applicants were also instructed to research the question of when the lots were legally created; if this did not take place prior to 1957, filing of a tentative parcel map will be required. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO, 77-89 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual site plan received and dated April 28, 1977, shall be the approved layout, subject to the modi- fications described herein: a. The property line dimension from the centerline of Cameron Street shall be revised to reflect the thirty (30) foot half street section as required by standard plans and specifications on file in the Departments of Fire and Public Works. b. Open parking shall be delineated upon the site behind the office structure along the northerly property line in compliance with requirements of Article 979. c. The plan shall reflect locking apparatus and doors for the proposed garage structures, which will provide storage of the chemical trucks. The plan submitted to the Department of Building and Com- munity Development upon application for building permits shall have the above modifications delineated thereupon. In accordance with the City's standards and requirements, an additional ten (10) feet of right-of-way on Cameron Street shall be dedicated. B. GENERAL CONDITIONS: 1. At the time of application for building permits evidence shall be submitted to the Department of Building and Community Development that the lots legally existed in their present configuration prior to 1957 or a parcel map shall be filed to effect such legal separation. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. No one was present to represent the application. The request was reviewed by the Board. ON MOTION BY SPENCER AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 77-90 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 5-11-77 Page 12 Minutes, H.B. This request is a Categorical Exemption, Class IV(e) of the California Environmental Quality Act, 1970. Jack Wallace was present to represent the application. The Board reviewed the request. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 77-92 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. 4. The Board reviewed the proposed changes and found that they are satisfactory, based on code requirements. However, it was recom- mended that a final check of the parking calculations be done by the Land Use section prior to issuance of a certificate of occu- pancy for the use. The Board reviewed the revised plan as submitted. The purpose of the revisions was to relocate the parking in order to pre- serve existing trees on the site.
