This is a proposal to precise plan an eighty (80) foot wide secondary
arterial street commencing from Ellis Avenue, curving westerly
to align with Crystal Street at Ernest Avenue and ending at Garfield
Avenue.

This is a proposal to precise plan cul-de-sac street closures on
Park Street and Pine Street at the intersections with Utica Avenue.
Chairman Slates stated that additional notification should be made
to.adjoining property owners before the public hearing should be
heard.

CONDITIONAL EXCEPTION NO. 77-1
Applicant: Mark C. Allen, Jr.
This is a request to permit the postponement of required street
improvements for a proposed compost manufacturing use located on the
northwest corner of Ellis Avenue and Gothard Street.
John Cope stated that the applicant has requested a second ton-
tinuance in order to further analyze the City's cost analysis for
the street improvements on Gothard and Ellis and that since it
appears that the applicant and staff are close to reaching a con-
sensus agreement on the matter the staff concurs with the request
for a continuance.
Commission discussion ensued.

John Cope stated that the applicant has agreed on an additional
continuance in order to work with staff on a revised proposal.

TENTATIVE TRACT NO. 9753
Applicant: Harold E. Tobin
Conditional Use Permit No. 77-6 is a request for a 10 unit planned
residential development located on the southeast corner of
Warner Avenue and Leslie Lane.
Tentative Tract No. 9753 is a request for a 14 lot subdivision lo-
cated on the southeast corner of Warner and Leslie Lane.
Jim Palin addressed the Commission and stated that the staff needed
additional information for the above applications. The applicant,
Ronald 0. Montgomery, did not have the additional information needed.
The public hearing was opened on Conditional Use Permit No. 77-6
and Negative Declaration No. 77-23.
Mr. Montgomery requested that this matter be tabled until later in
the evening when his engineer might be able to produce supplemental
information. However, Mr. Montgomery was not present at the end
of the meeting. The public hearing was closed.

Conditional Use Permit No. 77-7 filed in conjunction with Tentative
Tract Map 9757 is a request to allow the development of a 19 unit
planned residential development on approximately 3.0 acres of land
located on the west side of Graham Street 100 feet north of Overland
Drive.
Jim Palin discussed the suggested conditions of approval and noted
that supplemental information had been requested by the staff.
He stated that the staff recommended a continuance to allow the
applicant time to properly coordinate all plans to eliminate existing
conflicts.

The Chairman opened the public hearing on Conditional Use Permit
No. 77-7 and Negative Declaration No. 77-24.
Ron Montgomery addressed the Commission and stated that he would be
willing to comply with the suggested conditions of approval and
would be willing to answer any questions the Commission might have.
William Stegman, a resident of property adjacent to the development
read a letter from the Board of Governors of Fernhill #1 concerning
the grading of the property. The letter further requested that the
developer post a bond for a period of five years until such time as
an adequate masonry wall could be constructed. He discussed the
overload of sewage. He indicated that there had been an overflow
of sewage on Warner Avenue in the last seven days.
Austin Overhold, a resident of Fernhill, expressed concern over the
proposed development and further discussed sewer problems as well
as the grading.
Gail Hayes addressed the Commission on the problem with the retaining
wall.
The public hearing was closed.

NEGATIVE DECLARATION NO. 77-24, AND TENTATIVE TRACT NO. 9757 WERE

Ronald Montgomery concurred with the continuance. Commissioner Shea
suggested that the applicant might want to meet with the residents
of Fernhill to discuss the problems.
Commissioner Finley stated that she would like information on the
whole sewer system in that part of the City.
ZONE CASE NO. 77-3 "A - D" - NEGATIVE DECLARATION NO. 77-54
Applicant: Initiated by Planning Department
Zone Case No. 77-3"A" is a request for a change of zone from R2-0 to
RA south of Yorktown Avenue west of Delaware Street.
Zone Case No. 77-3"B" is a request for a change from R5 to Limited
Use District (LUD) on the north side of Pacific Coast Highway
between Magnolia Street and Brookhurst Street. It is also a
request for a change from R5 to Limited Use District (LUD) on the
north side of Pacific Coast Highway between Brookhurst Street and
the Santa Ana River.

Zone Case No. 77-3"C" is a request for a change from C4 to RA on
southeast of Atlanta Avenue and Beach Boulevard.
Zone Case No. 77-3"D" is a request for a change from C3 to RA on
the northwest corner of Beach Boulevard and Pacific Coast Highway.
Chairman Slates stated that he had received a letter from Daisy Thorpe
concerning Zone Case No. 77-3"B" and requested that this item be
submitted to the City Attorney's office for a legal opinion.
The public hearing was opened.
Ed Banks requested an explanation of the LUD zone.
The public hearing was closed.

This is a request to permit the construction of a veterinary
hospital and two rental units on the south side of Edinger, 170 ft.
west of Bolsa Chica in a C2 zone.
Chairman Slates opened the Public hearing.
Dr. Long addressed the Commission and spoke of the need for such
a facility in the area, emphasizing that it would not be a boarding
facility, that the runs would be enclosed, and that he had never
had any complaints on his present clinic.

George Psaros addressed the Commission and spoke in opposition to
the use. He presented a letter for the files which he stated had
53 signatures of people protesting the use. He cited the noise
factor such a use would create as one of his reasons. He further
stated that there were already sufficient veterinary hospitals in
the area. He also discussed the odor factor which might be involved.
Mr. Kay brought to the attention of the Planning Commission a re-
taining wall which should be fixed.
Loretta Iser spoke in opposition.
The public hearing was closed.
Don Hartfelder, architect, addressed the Commission and stated that
he had designed several veterinary clinics and felt that it was
definitely needed in the area. He stated that it was being designed
to be compatible with the rest of the shopping center.
Dr. Long stated that he eventually hoped to give 24 hour service.
Don Hartfelder stated that the building would be air conditioned.
J. L. Hartman addressed the Commission and stated that he had not
had any complaints from the tenants in the adjoining shopping
center.
The public hearing was closed.

ON MOTION BY SHEA AND SECOND BY GIBSON CONDITIONAL USE PERMIT
NO. 77-10 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed use is in substantial compliance with the applicable
development standards of the Huntington Beach Ordinance Code.
2. The proposed use will be compatible with the existing surround-
ing commercial and residential uses because of setback distances
-and building design considerations.
3. The proposed use will provide a service to the residents of
the surrounding areas.

CONDITIONS OF APPROVAL:
1. The site plan dated March 31, 1977 shall be the approved layout
subject to a 25 foot landscaped setback for the retail stores
that front onto Edinger Avenue.
2. Building materials and elevations shall be the same as the
existing adjacent commercial buildings. Said elevations and
materials shall be subject to approval by the Planning Depart-
ment staff.
3. Fire protection systems shall be subject to approval by the
Fire Department.
4. Signing for the proposed commercial buildings and animal
hospital shall be the same as and subject to the require-
ments of the sign program approved by the Board of Zoning
Adjustments for the center.
5. Prior to occupancy of the proposed structures, a recorded
reciprocal access agreement and parking agreement for the
entire center shall be submitted to the Planning Department
for review and approval.

Applicant: Robert F. Curtis Construction
Tentative Tract No. 9796, filed on March 16, 1977, is a request to
subdivide approximately 2.5 acres into a 10 lot medium density sub-
division for the purposes of constructing fourplex structures on
Lots 1 through 3 and 8 through 10, fiveplex structures on Lots 5
and 6, and eightplex structures on Lots 4 and 7_
Conditional Exception No. 77-2 has been filed to request a reduction
in the minimum lot frontage on Lots 4 and 7 to 43 feet in lieu of
the required 45 foot frontage.
Subject property is located on the west side of Green Street approxi-
mately 330 feet south of Warner Avenue.
Jim Palin stated that in view of the concerns expressed earlier
on the sewer system on Warner Avenue that perhaps the Commission
would want to continue these applications to allow staff to
report back on the sewer conditions.

MISCELLANEOUS:
Planning Department Communication on Energy Conservation and
Management.
The Commission was requested to review the City's Energy Manage-
ment Policy and the framework for an Energy Conservation and
Management Program.
ORAL COMMUNICATIONS:

COMMISSIONERS' COMMENTS:
Chairman Slates polled the Commission on the change of boundary
on the Downtown Redevelopment Area and received its concurrence
on the proposed change.
The staff was complimented by the Commission for its Annual Report
entitled "Direction 176".
Commissioners Newman and Shea stated that they would be attending
a Seminar at the University of California at Berkeley on June 2
and 3.
Commissioner Finley stated that she would be submitting a report
to the Commission on a recent meeting she attended at UCI.
The staff was directed to include on the front page of the Agenda
public hearing on Negative Declarations as well as on the staff
report.
STAFF'S COMMENTS:
Secretary Selich requested a date for a study session in May and
was advised that May 24, 1977 would be acceptable.

Jim Palin reviewed the shopping center site plan at Ellis and
Beach with the Commission. This application was scheduled to
be heard by the Board of Zoning Adjustments at its May 4, 1977
meeting.
