This request is a Categorical Exemption, Class III, California En- vironmental Quality Act, 1970. Mrs. Ferry was present at the meeting. The plan has been revised to reflect front entry rather than side entry as shown previously. The Board noted that the floor area is over that allowed by code and there is a slight deficiency in open space which can, however, be corrected by decreasing coverage of the unit. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-81 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated May 11, 1977, shall be the approved conceptual layout, subject to the modifications described herein: a. Dimensions shall be shown from the centerline of 15th Street in order to make proper determination of the front property line. b. The plan shall reflect the 216" dedication required on the alley. The plan submitted to the Department of Building and Community Development upon application for building permits shall have the above modifications depicted thereupon. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. In accordance with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of- way on the alley shall be dedicated. 3. All applicable fees shall be paid prior to issuance of building permits. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-22 (Cont. from 5-11-77) Applicant: Orange County Sanitation Districts To permit construction of an 816" block wall exceeding the allowed wall height by 216" in lieu of Section 9519(a) of the Huntington Beach Ordinance Code, located on the east side of Brookhurst Street extending northerly for a distance of approximately 3900 feet from the Talbert Channel at the County Sanitation District Facilities. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Chairman Spencer reopened the public hearing. No one was present to represent the application or to speak in regard to the request, and the public hearing was closed. Secretary Palin noted that the City Council has issued direction that review by the City will be required for all Sanitation pro- jects within the City. It was the determination of the Board that this request should be continued to advise the District of that decision and permit a representative to be present when the request is considered. Board of Zoning Adjustments May 18, 1977 Page 3 ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-22 WAS CONTINUED TO THE MEETING OF MAY 25, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 77-51 (Cont. from 5-11-77) Applicant: Charles M. Hughes To permit the construction of a second -story apartment unit and garage on a site having a non -conforming yard pursuant to Section 9719 of the Huntington Beach Ordinance Code, located on the south side of Knoxville Avenue approximately 125 feet west of Huntington Street in an R2, Medium Density Residential District. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Chairman Spencer reopened the public hearing. Mr. and Mrs. Hughes were present at the meeting and explained to the Board the purpose for the shop area and the extra enclosed parking spaces provided, to serve as a hobby shop for restoration of old cars. There being no other persons present to speak for or against the proposed use, the public hearing was closed. The Board reviewed the plan, discussing balcony area and alley width and improvement. ON MOTIO14 BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-51 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the immediate vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated April 25, 1977, shall be the approved conceptual layout, subject to the modifications described herein: a. The plan shall reflect the minimum sixty (60) square feet of open space area for the unit proposed for construction over the garage in compliance with the present provisions of the ordinance code. b. The plan shall reflect the dimension from centerline of the abutting street to assure that the proper det- ermination on the location of the front property line can be made. c. The plan shall precisely locate the wall of the exist- ing structure and its relationship to the dedication proposed from the alley. The modifications outlined above shall be delineated upon the plan submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . In accordance with City standards and requirements, an addi- tional two and one-half (2-1/2) feet of right-of-way shall be dedicated on both the east -west and the north -south alleys. 3. All applicable fees shall be paid prior to issuance of building permits. 4. If there is sufficient room after survey to install pro- tective devices onsite between the existing wall of the garage and the right-of-way line on the alley, concrete - filled pipes with a minimum diameter of four (4) inches shall be installed at that location at a minimum distance of five (5) feet on center. Board of Zoning Adjustments May 18, 1977 Page 5 CONDITIONAL EXCEPTION No. 77-24 Applicant: Mr. and Mrs. Courtland Paul To permit construction of a wall and fence to within 7-1/2 feet of the front property line in lieu of the 15-foot setback required by Section 9104 of the Huntington Beach Ordinance Code, located on the north side of Intrepid Lane approximately 500 feet west of Broadway in an R1, Low Density Residential District. This request is a Categorical Exemption, Class V, California En- vironmental Quality Act, 1970. Chairman Spencer opened the public hearing. Courtland Paul was present at the meetinq and addressed the Board to outline his project and state his 3ustification for approval of the applica- tion. There being no other persons present to address the Board, the public hearing was closed. The Board reviewed the proposal, noting that adjacent properties are both constructed at 7'6" and that the request would not reduce the usability of the garage apron for guest parking. ON MOTION BY SPENCER AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 77-24 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Granting of the request will not adversely affect the Master Plan of the City of Huntington Beach. 2. The project will not be materially detrimental to public wel- fare in the adjacent neighborhood or be injurious to other properties in the same zone classification. 3. At least 50 percent of the dwelling units in the neighborhood were originally constructed at the 716" setback; the granting of the request is therefore granting parity with surrounding properties. 4. The project does not encroach into the sight angle from the abutting street. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated May 2, 1977, shall be the approved layout. Burkenfield To permit a reduction of the required open space from the required 900 square feet to 660 square feet in lieu of Section 9103.3.1.1.1 of the Huntington Beach Ordinance Code in order to allow a proposed addition to a single-family dwelling located on the north side of Lakeview Drive approximately 50 feet east of Upperlake Circle in an R1, Low Density Residential District. This request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Chairman Spencer opened the public hearing. No one was present to represent the application or to address the Board; the public hearing was closed. Board review included discussion on the size of the lots and the comparative lack of flexibility on the properties because of restrictions imposed on the waterfront lots at the time of original construction. It was the consensus of the Board that the request should be continued to allow staff analysis of the possible effect of granting the request upon the remainder of the lots in the area and to allow applicant to be present to discuss alternative layouts. ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-25 WAS CONTINUED TO THE MEETING OF MAY 25, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-26 Applicant: Home Federal Savings To permit installation of a 6'8" by 17'0" freestanding sign at a site having an existing freestanding sign, in lieu of Section 9760.7 of the Huntington Beach Ordinance Code, located on the west side of Main Street at the intersection of Main Street and Yorktown Avenue in a C2-O-CD, Community Business District combined with Oil Production and Civic District. Chairman Spencer opened the public hearing. Dan Beagle and Vicky Hanson were present to represent the application. They informed the Board that this sign had been included in the approval of the building and was a condition in their lease from the Huntington Beach Company. There being no other persons to address the Board in regard to this request, the public hearing was closed. Secretary Palin reviewed the existing sign program approved for the total shopping center noting that no sign was allocated there- on for this location. He also noted that the freestanding signs existing within the center are not constructed of precast concrete as spelled out in the approved sign program. Although the center has not constructed all of the freestanding signs permitted under the original program, it was the opinion of the Board that it would be premature to select one of the prior sign locations and move it without first seeing an overall sign program, since other uses on the site will no doubt have signing needs of their own in the future. It was the consensus that this request should be continued to permit the applicants to contact the Huntington Beach Company and review both this proposal and the total signing program with them. ON MOTION BY SPENCER AND SECOND BY PALIN CONDITIONAL EXCEPTION NO. 77-26 WAS CONTINUED TO THE MEETING OF JUNE 1, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 77-53 Applicant: A. A. Sugarman To permit construction of a twenty-eight (28) unit apartment com- plex pursuant to Section 9320 of the Huntington Beach Ordinance Code, located on the south side of Hamilton Avenue approximately 356 feet west of Brookhurst Street in an R3, Medium -High Density Residential District. This request is covered by ND 77-20, adopted by the Board on February 24, 1977, in conjunction with approval of Tentative Par- cel Map 77-6. Chairman Spencer opened the public hearing. Mr. Sugarman was present at the meeting. There being no other persons present in regard to this proposal, the public hearing was closed. BZA 5-18-77 Page 7 Minutes, II.B. Board of Zoning Adjustments May 18, 1977 Page 8 The Board reviewed the application with the proponent, pointing out discrepancies and missing dimensions on the plan which will have to be corrected. Mel Ott informed Mr. Sugarman that a fire hydrant will be required somewhere at the rear of the project, and indicated that the Fire Department will require a turn -around at the end of the drive. Deficiencies in the plan in regard to open space, permitted floor areas, building heights, garage setbacks, assigned parking, etc., were discussed. Also discussed were the types of building and roofing materials and the treatment at the property lines between subject property and the church and athletic club facilities. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-53 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the immediate vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated April 27, 1977, shall be the approved conceptual layout, subject to the modifications described herein: a. Proper dimensions shall be delineated upon the plan. b. Building separations shall be shown in all cases. C. Floor areas shall be spelled out for all units. d. Building heights shall be delineated upon the plan. e. Setbacks for the garages shall be zero or ten (10) feet. f. Open space shall be increased to meet the minimum. BZA 5-18-77 Page 8 Minutes, H.B. Open parking stalls shall be shown projecting over landscaping rather than with the use of wheel stops as shown on the conceptual plan. j. A turn around with a minimum radius of twenty (20) feet shall be provided at the end of the drive at the southwesterly corner of the project. The above modifications shall be delineated upon the plan sub- mitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscaping and irrigation plan shall be submitted to the Planning Department concurrently with application for building permits. Said plan shall comply with the require- ments of Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Depart- ment of Public Works. 3. All applicable fees shall be paid prior to issuance of building permits. 4. Roofing material shall be a minimum of cedar shingles. Any alternative material proposed to be used other than wood shall be brought to the Board of Zoning Adjustments for review and approval action. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. A masonry wall of a minimum height of six (6) feet shall be constructed on the east and west property lines of subject property. 2. The developer shall comply with the requirements of Article 932 of the Huntington Beach Ordinance Code for installation of trees on the proposed facility. BZA 5-18-77 Page 9 Minutes, H.B. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air con- ditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. A chemical analysis, as well as tests for physical proper- ties of the soil on subject property, shall be submitted to the City for review prior to issuance of building permits. 5. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. 6. Energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots and recreation areas. 7. Crime prevention techniques shall be applied to the pro- ject (e.g., single -cylinder locks, etc.). 8. Low -volume heads shall be used on all spigots and water faucets. 9. All holding tanks for toilet facilities shall be equipped for a capacity of 3.5 gallons if such facilities are avail- able at the time of construction. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 77-54 Applicant: John David King To permit construction of two (2) 8-unit apartment buildings extending more than 150 feet from a public street pursuant to Section 9202.3.1.4 of the Huntington Beach Ordinance Code, located on the south side of Stark Street approximately 150 feet west of Beach Boulevard in an R3, Medium -High Density Residential District. BZA 5-18-77 Page 10 Minutes, H.B. Board of Zoning Adjustments May 18, 1977 Page 11 This request is covered by Negative Declaration No. 77-60. Chairman Spencer opened the public hearing. Mr. Fryer was pre- sent to represent the application. The Board reviewed with the applicant the many deficiencies on the plan: excessive lot cov- erage, lack of dimensions, use of reciprocals without providing additional amenities on -site, inability of the separate parcels to stand on their own individually, etc. There being no other persons to address the Board in regard to this request, the public hearing was closed. It was the determination of the Board that a meeting should be arranged between staff and the developers to attempt to work our some of the problems on the plan. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-54 WAS CONTINUED TO THE MEETING OF JUNE 1, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT N0. 77-55 Applicant: Chris William Caras To permit construction of an 11,300 square foot office -commercial building pursuant to Section 9472 of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard approximately 255 feet north of Newman Avenue in a C4, Highway Commercial District. This request is covered by Negative Declaration No. 77-62. Chairman Spencer opened the public hearing. Chris Caras and Judy Economokos were present to represent the application. The Board reviewed the information contained within the negative declaration and considered mitigation measures applicable to the project. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-62 WITH THE MITIGATION MEASURES CONTAINED IN CONDITIONS B2 THROUGH B8 IMPOSED UPON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE Mr. Caras discussed possible preservation of the trees on the site with the Board. He also outlined the proposed uses for the pro- ject, stipulating that he would definitely consult with the City prior to leasing out any portion of the building to medical facili- ties. Board review included extensive discussion on the tree preserva- tion. Also reviewed were parking ratios in relation to use of the building and the inner circulation patterns onsite. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 77-55 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the immediate vicinity. b. Property and improvments in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated May 3, 1977, shall be the approved layout, subject to the modifications described herein: a. A landscaped area shall be shown around the one tree within the parking area if the tree is to be preserved. b. Proper dimension shall be shown from the centerline of the abutting street to the front property line to assist City staff in determining parcel size and loca- tion. C. Drive width shall be shown at thirty-five (35) feet with a radius type curb return. The modifications outlined above shall be delineated upon the plan submitted at the time of application for building permits. Past administrative action regarding this property. 2. A landscaping and irrigation plan shall be submitted to the Planning Department. Said plan shall comply with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works; said plan shall also depict the location of the thirty-seven (37) inch eucalyptus tree onsite which developer is to attempt to preserve. 3. A rooftop mechanical equipment screening plan, if applicable, shall be submitted to the Planning Department. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 4. In accordance with City standards and requirements, an addi- tional ten (10) feet of right-of-way on Cameron Street shall be dedicated. 5. All applicable fees shall be paid prior to issuance of building permits. 6. Elevations for both buildings shall be submitted to the Board of Zoning Adjustments for review and approval action prior to the issuance of building permits for either build- ing. Said elevations shall depict building elevations on both Beach Boulevard and Cameron Street. B. GENERAL CONDITIONS: 1. The Board has discussed the loss of one parking space to offset preservation of the onsite eucalyptus tree, and has concurred with such reduction in the parking onsite. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots. 5. Low -volume heads shall be used on all spigots and water faucets. 7. All holding tanks for toilet facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. 8. The thirty-seven (37) inch diameter tree located within the parking area shall be incorporated into a landscaped area unless sufficient evidence is submitted to the Board of Zoning Adjustments to show that the tree is in an un- healthy condition and cannot be salvaged. In such case, the tree may be removed and replaced on the ratio of two (2) thirty -inch (30") box trees per tree removed. Bainbridge To permit construction of a 5,760 square foot commercial building pursuant to Section 9430 of the Huntington Beach Ordinance Code, located at the southwest corner of Edinger Avenue and Newland Street in a C2, Community Business District. This request is covered by Negative Declaration No. 77-58. Chairman Spencer opened the public hearing on the negative declara- tion. Sam Hirt was present to represent the application. The Board reviewed the information contained in the negative declaration request and considered mitigation measures applicable thereto. This request is covered by Negative Declaration No. 77-61. The Chairman opened the public hearing on the negative declaration. Max Schreiber was present at the meeting. There being no persons to address the Board in regard to this request, the public hearing was closed. The Board reviewed the proposed layout with the applicant, point- ing out deficiencies on the plan and suggesting an alternate layout which would move the garages over, provide a common access drive, and allow increase in the open yard area. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE MISCELLANEOUS AGENDA ITEMS: USE PERMIT NO. 76-52 (Revision of Conditions) Applicant: Glenn Busby Request for modification to condition of approval requiring certain insulation in walls and ceilings for a previously approved shopping center located at Edinger Avenue and Goldenwest Street in a C4, Highway Commercial District. Glenn Busby, Pat Doyle, and Mr. Moffi were present to represent the request. The proponents submitted an energy consumption study prepared by A. C. Morton Company. This study, based on the climatic and atmospheric conditions in the City of Huntington Beach and the proposed method of heating and cooling the store, concluded that installation of the insulation as originally required would actually result in use of more, not less, energy. The applicants requested that the condition be amended to require R-11 insulation in ceilings only and none in the walls. The Board discussed ex- tensively the energy saving techniques proposed and the computer analysis contained in the study, and determined that deletion of the requirement would still permit the structure to meet the BZA 5-18-77 Page 21 Minutes, H.B. Secretary Palin also noted that research has indicated that other shopping centers within the city have had no such condition imposed.
