Mayor Pattinson called the adjourned regular meeting of the City Council of the
City of Huntington Beach to order at 6:00 P.M.
ROLL CALL
Present: Pattinson, Coen, Gibbs, Shenkman
(Bartlett, Siebert, Wieder arrived 6:30 P.M.)
Absent: None
EXECUTIVE SESSION CALLED
Mayor Pattinson called an Executive Session of the City Council to discuss
personnel and litigation matters.
RECESS - RECONVENE
The Mayor recessed the Council at 6:05 P.M. The meeting was reconvened at 7:10
by the Mayor.
APPOINTMENTS - O.C. SANITATION DISTRICTS # 3 & 11
On motion by Bartlett, second Shenkman, Council ratified the appointments made by
the Mayor to the Orange County Sanitation Districts No. 3 and No. 11 as follows:
O.C. Sanitation District #11 - Mayor Ronald R. Pattinson
Councilman Ron Shenkman
Councilwoman Norma Brandel Gibbs (Alternate)
O.C. Sanitation District # 3 - Councilwoman Harriett M. Wieder
Mayor Ronald R. Pattinson (Alternate)
The motion carried by unanimous vote.
REPRESENTATION AUTHORIZED.-_HUNTINGTON, LTD. BANKRUPTCY HEARING
On motion by Wieder,.second Gibbs, Council directed that Mr. Charles Polyea,
representing Charles Polyea & Associates, and Mr. Joseph Karol, Attorney at Law,
represent the City in the bankruptcy hearing on the Driftwood Inn Lease .(Huntington
Ltd.) to be held on May 24, 1977. The motion was carried unanimously.
AMENDED FINDINGS - GRANT OF CE 76-62 DISAPP
The Clerk presented a communication from the Planning Director containing amended
findings in support of the March 21, 1977 decision of the City Council, sustaining
the Planning Commission's grant of Conditional Exception No. 76-62 on the appeal

filed by Vanderwood Corporation. CE 76-62 would have permitted a five-foot encroach-
ment in the required ten -foot setback per Section 9203.1 of the Huntington Beach
Ordinance Code on property located on the west side of Delaware Street, approximately
twenty-seven feet north of Elmira Avenue.
A motion was made by Wieder, seconded by Bartlett to approve the amended findings as
act forth on pages 1 and 2 of the Planning Department transmittal dated April 26,
1977. Councilman Coen spoke regarding the motion.
The motion failed to pass by the following roll call vote:
A7ZES: Bartlett, Wieder; Pattinson
NOES: Coen, Gibbs, Siebert, Shenkman
ABSENT: None
Discussion was held between the Council and the City Attorney regarding procedure
and the status of CE 76-62 in view of the failure of the Council to adopt findings.
Mr. James Van Derhyden, representing Vanderwood Corporation, the appellant.,
addressed Council regarding the matter.
The City Attorney ruled that the Council action of sustaining the Planning Commission's
grant of the Conditional Exception was void because of lack of findings in support
thereof and, therefore, a new motion would be in order.
A motion was made by Coen, seconded by Siebert, to overrule the decision of the
Planning Commission and deny Conditional Exception No. 76-62. The motion carried
by the following roll call vote:
AYES: Coen, Gibbs, Siebert, Shenkman
NOES: Bartlett, Wieder, Pattinson
ABSENT: None
On motion by Coen, second Siebert, Council made the finding that no hardship
exists because of the failure of the applicant in the initial action to satisfy
the Council that any of the conditions or criteria set forth in the ordinance code
were, in fact, found to exist. The motion carried by the following roll call vote:.
AYES: Coen, Gibbs, Siebert, Shenkman

WATER RATE STUDY — FURTHER STUDY DIRECTED - DEFERRED TO 6/6/77 MEETING
1!ayor Pattinson introduced John Mandrell, Consultant, representing R.M.G. Engineering,,
who had been employed by the City Council to conduct a water rate study. The
Director of Public Works informed Council that Mr. Mandrell had in the -past served
the City as Acting Water Superintendent at which time he had prepared a water rate
study which indicated that in 1977/78 there would be a water deficiency, and as a
result, a further study was undertaken by the City, with the aid of John Mandrell.
A chart was displayed showing four alternate rates for Councils consideration,
together with charts showing the effect of each alternative on the various types
(1 water users; comparison of resickential water rates and industrial water rates.

Discussion was held between Council, Mr. Mandrell, and the Director of Public Works.
Councilman Shenkman commented on the need for Council to state their goals and
objectives relative to the matter, and that he believed more study was necessary.
Mayor Pattinson requested that this subject be placed on the June $, 1977 Council_
Agenda and stated that a Council committee, consisting of Councilwoman Wieder,
representatives of the Environmental Council, Chamber of Commerce, and the Home
Council would study the matter.
RECESS - RECONVENE
Mayor Pattinson called a recess of Council at 8:20 P.M. The meeting was reconvened
at 8:40 P.M.

PRELIMINARY 1977-78 BUDGET REVIEW
The City Administrator presented the Fiscal Year 1977-78 Preliminary City Budget.
He also presented a 30 minute film prepared by City staff, which explained the
zero -base budget process. He announced the film would be made available to the
public at the City library.
Following the viewing of the film, the City Administrator requested that Council
evaluate all of the programs which had been prioritized.
Erich Matthews, Administrative Assistant, informed Council that there had been a
correction to Roman Numeral III of the Preliminary Budget, which refers to revenue
sources.
Discussion was also held regarding the source of the funding of the proposed Ocean
View Swimming Pool and the Handicapped Pool complex.
The City Administrator invited members of the Council and staff with questions
regarding the budget to contact his office.
PUBLIC HEARING - BUDGET REVIEW - JUNE 13,__1977
Mayor Pattinson announced that there would be a public hearing on the Fiscal Year
1977-78 budget on June 13, 1977.
ADJOURNMENT
On motion by Bartlett, second Gibbs, the regular adjourned meeting of the City
Council of the City of Huntington Beach adjourned at 10:00 P.M. to Tuesday, May 31,
1977 at 7:00 P.M. in Room B-8, Civic Center. Motion carried unanimously.
