of Edinger Avenue approximately 1000 feet east of Santa Barbara

This request is covered by Negative Declaration No. 77-29.
Secretary Palin informed the Board that it will be necessary to
continue this request to a future date, as the precise plan of aligr-
ment for Saybrook will have to be processed prior to approval of
subject parcel map. Applicants have been contacted and so notified.

vironmental Quality Act, 1970.
Chairman Spencer reopened the public hearing. Nick Benedetto was
present to represent the District. He informed the Board that
flood -proof gates will be installed at the entry off Brookhurst
Street and that dedication will be made at the time of acceptance
of the project by ERA and various State funding agencies involved -
probably at the end of this year. There being no other persons
to address the Board in regard to this project, the public hearing
was closed.
The Board reviewed the distance from street centerline, the ex-
isting five (5) foot walkway, and the four (4) foot landscaping
strip to be installed between the walk and the proposed wall.
ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 77-22 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. Granting of the use will not be detrimental to the health,
safety, or welfare of persons working or residing in the area.
2. The wall has been mandated by the study on the flood plain and
the elevations of the property submitted to the City, in order
to flood -proof the facilities. The wall at the requested
height does, in fact, eliminate a health hazard which would
occur during any flooding in the vicinity.
3. The height of the bermed landscaping behind the wall as well as
the landscaping to be located between the wall and the sidewalk
will aesthetically improve the overall appearance of the
facility.

CONDITIONAL EXCEPTION NO. 77-25 (Cont. from 5-18-77)
Applicant: Michael C. Burkenfield
To permit a reduction of the required open space from the required
900 square feet to 660 square feet in lieu of Section 9103.3.1.1.1
of the Huntington Beach Ordinance Code in order to allow a proposed
addition to a single-family dwelling located on the north side of
Lakeview Drive approximately 50 feet east of Upperlake Circle in
an R1, Low Density Residential District.
This request is a Categorical Exemption, Class V, California Envir-
onmental Quality Act, 1970.
Chairman Spencer reopened the public hearing. Michael Burkenfield
was present at the meeting and submitted revised drawings and addi-
tional information on the proposal. There being no other -persons
present to speak for or against the proposed project, the public
hearing was closed.
Pat Spencer reported that field investigation has disclosed other
encroachments in the area. The Board discussed the size of the lot
and the open space requirements in comparison with that required
on larger properties and the original siting of the units onsite.
ON MOTION BY SPENCER AND SECOND BY PALIN CONDITIONAL EXCEPTION NO.
77-25 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The proposal is not inconsistent with the General Plan nor
detrimental to the health, safety, or welfare of people residing
or working in the vicinity.
2. The subject dwelling is a single -story structure and the addi-
tion will not affect the privacy of any abutting unit.
3. Requiring this substandard lot to provide the same square foot-
age of open space as required from 6000 square foot properties
developed within the same time period and general vicinity
imposes a hardship upon the property.
4. The base district setback requirements are still met on the lot
after construction of the addition to the dwelling.
5. Grantinq of this request does not constitute granting of special
privilege, since other similar encroachments exist on similar
properties in the vicinity.

west side of Newland Street between Atlanta and Indianapolis
Avenues in an Rl, Low Density Residential District.
This request is a Categorical Exemption, Class V, California En-
vironmental Quality Act, 1970.
Chairman Spencer opened the public hearing. Dick Kaupp was present
at the meeting. Bruce Crosby discussed with the applicant the need
for information on the design and depth of the proposed footings,
in order to ascertain that there will be no surcharge on the box
culvert within the easement. Mr. Kaupp agreed to submit sketches
of the modified footing and proof as requested. There being no
other persons to address the Board in regard to the request,, the
public hearing was closed.
Board review ensued.
ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION NO.
77-23 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. Granting of the request will not be materially detrimental to
public welfare or injurious to property in the same zone
classification.
2. The topographical features of the property impose certain con-
straints which require the variance to provide the developer
parity with surrounding properties.
3. The existing facility is a surface -type culvert and does not
require a setback greater than that required for framing.

4. The applicant has already submitted a "hold harmless" letter
to the City and has agreed to provide proof to the Department
of Public Works that no surcharge will be placed on the box
culvert as a result of said encroachment.

proximately 100 feet east of Flagstaff Lane in an Rl, Low Density
Residential District.
This request is a Categorical Exemption, Class V, California En-
vironmental Quality Act, 1970.
Chairman Spencer opened the public hearing. Robert Gehlke was
present at the meeting and submitted revised drawings showing
improved visual clearance from the abutting property and outlined
his reasons for requesting the variance. There being no other
persons to address the Board in regard to this request, the public
hearing was closed.
The Board reviewed the site layout in conjunction with the size
and shape of the lot.

ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION
NO. 77-27 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The irregular shape of the lot and the ratio of lot frontage
to lot depth imposes a hardship upon the property.
2. The granting of the request will not constitute granting of
special privilege because of the original siting of the unit
at an oblique angle on the site.
3. Granting of the variance will not be detrimental to the health,
safety, or welfare of persons working or residing in the area.
4. The request has taken into consideration the required 10 by
10 cutoff necessary for vehicle maneuverability on the adjac-
ent approach on the abutting property.
5. The proposed fence will be an open type construction which
will afford the visual effect of landscaping blending through
the structure.
6. The proposal is to terminate the wall at a projection of the
front setback of the dwelling; therefore, the C.E. was only
necessary because of interpretation of setbacks, and upon any
other lot could have been allowed automatically for the
exterior side yard setback of a similarly shaped lot with the
same type of siting of the unit.

USE PERMIT NO. 77-56
Applicant: The Buccola Company
To permit construction of a shopping center with a total of
26,720 square feet pursuant to Section 9472 and Section 9472.1
of the Huntington Beach Ordinance Code, located on the east
side of Beach Boulevard approximately 150 feet north of Garfield
Avenue in a C4, Highway Commercial District.
This request is covered by Negative Declaration No. 77-63.
Chairman Spencer opened the public hearing on the negative dec-
laration and the use permit applications. John Praisler was
present at the meeting. The Board reviewed the information con-
tained in the negative declaration request and considered
mitigation measures applicable thereto.
ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED NEGATIVE DECLARATION
NO. 77-63 WITH THE MITIGATING MEASURES B3 THROUGH B7 IMPOSED
UPON THE USE PERMIT, BY THE FOLLOWING VOTE:

The following items were discussed in the Board's review:
1) Parking lot layout and parking ratios. The applicant was in-
structed to submit plans for Building D (Straw Hat Pizza) 9howingn
seating capacity so that required parking may be computed; 2) The
property directly to the north. Applicant indicated that ongoing
discussions are taking place with the developer of that property
with the object of developing for uniformity with reciprocal
access between the two projects; 3) The service station existing
on the corner. Mr. Praisler said that they are attempting to work
out with the owners a program for modernizing and upgrading said
property, with a cut at some location to permit inner circulation
between the shopping center and the station; and 4) The grade
differential between the subject site and adjoining properties.
Also reviewed were landscaping and walls, curb cuts on Beach
Boulevard, the number of required onsite fire hydrants to be in-
stalled, and the need for a tentative parcel map to be filed
carrying covenants and restrictions for reciprocal easements over
and across each parcel.
The public hearing was closed.
ON MOTION BY CROSBY AND SECOND BY SPENCER USE PERMIT NO. 77-56
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS AND WITH
THE RECOMMENDATION THAT THE PROPONENTS CONTINUE TO PURSUE THE
MODERNIZATION PROGRAM WITH THE ADJOINING SERVICE STATION, BY THE
FOLLOWING VOTE:

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity.
b. Property and improvements in the general vicinity of such
use or building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan,of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated May 9, 1977, shall be the
approved layout, subject to the modifications described
herein:
a. The plan shall reflect the maximum of two and one-half
(2-1/2) foot projection on the parking stall depth.
b. The revised plan shall evaluate the seating capacity
in relation to parking needs.
c. The plan shall indicate the proposed reciprocal ease-
ments between the subject property and the adjoining
property to the north.
d. Minimal raised landscaped planters shall be installed
at both the most easterly and westerly parking stalls
to the south of Building C, to protect vehicles in
those spaces from backing movements of the spaces
opposite.
The modifications outlined above shall be depicted upon the
plan submitted to the Department of Building and Community
Development upon application for building permits.
In its approval action, the Board of Zoning Adjustments considered

2. A landscape and irrigation plan shall be submitted to
the Board of Zoning Adjustments for review and approval
action.
3. A rooftop mechanical equipment screening plan, if appli-
cable, shall be submitted to the Planning Department. Said
plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material proposed
to screen said equipment.
4. The elevations received and dated May 24, 1977, shall be
the approved elevations for the facility.
5. Subject property shall be graded to bring it as close as
possible to the grade on the abutting property to the
north, if such common elevation does not already exist.
B. GENERAL CONDITIONS:
1. A tentative parcel map shall be filed and recorded prior
to issuance of a certificate of occupancy.
2. Covenants shall be filed and recorded to cover the recip-
rocal parking and access agreements on each parcel.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. Energy -saving lighting, such as high pressure sodium
vapor lamps, shall be used in parking lots.
5. Crime prevention techniques shall be applied to the project
(e.g., single -cylinder locks,Etc.).
6. Low -volume heads shall be used on all spigots and water
faucets.
7. All holding tanks for toilet facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are
available at the time of construction.

To permit modification of a church facility to change a portion
of the parking area to grass to accommodate overflow parking and
to add storage area pursuant to Section 9811.4 of the Huntington
Beach Ordinance Code, located on the southwest corner of Main
Street and Adams Avenue in an Rl-O, Low Density Residential
combined with Oil District.
This request is covered by Negative Declaration No. 76-43, adopted
by the Planning Commission upon approval of the church remodeling
(C.U.P. 76-11) .
Chairman Spencer opened the public hearing. No one was present to
represent the application or to speak in regard to the proposal;
the public hearing was closed.
Board review ensued.
ON MOTION BY SPENCER AND SECOND BY PALIN PLOT PLAN AMENDMENT NO.
77-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The amendment does not constitute a substantial change in the
plan.
2. The proposed use of the property remains the same.
CONDITIONS OF APPROVAL:
The revised plot plan received and dated May 17, 1977, shall be
the approved layout for the addition of the storage facility and
the turf grass parking area to be used for overflow parking until
such time as the building program approved by Conditional Use
Permit No. 76-11 has been finished, at which time permanent park-

This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
John Hile and Roy Gohara were present at the meeting to represent
the application.
Secretary Palin informed the applicants that Public Works is con-
cerned about the number of curb cuts proposed on Graham Street
for these two parcels and stated the Department's understanding
that this parcel was to take access from the local street, accord-
ing to the prior conditions on the map. After discussion, it was
the determination of the Board that this request should be con-
tinued to permit a meeting between staff and the proponents to
consider the 8688 "X" map and work out proper driveway access
points.

Roy Hall was present at the meeting. In view of the continuance
of the tentative parcel map (above) at this location, it was the
consensus of the Board that this request also should be continued
to permit access points to be fixed.

This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Gary Hargrove was present at the meeting.
Board review found the plan to be in compliance with code require-
ments.

ADMINISTRATIVE REVIEW NO. 77-101
Applicant: Eugene B. Zwick
To permit construction of a 9,000 square foot industrial building
pursuant to Section 9511 of the Huntington Beach Ordinance Code,
located on the northwest corner of Argosy Drive and Graham Street
in a 100-M1-A-20,000, Restricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Eugene Zwick was present at the meeting and corrected errors on
his plan in mezzanine area, total square footage (which he indi-
cated was 13,198 rather than the 9,000 shown on the request), and
parking space count. He explained the nature of his operation
and the types of equipment manufactured.
Secretary Palin informed the applicant that the plan as submitted
does not meet the intent of the code in regard to circulation,
parking, and turning movements onsite. He also noted that the
City discourages the drives as close to Argosy as shown and that
a portion of the required setback cannot be used for drive purposes,
although 50 percent may be used for parking. The staff and the
applicant discussed the plan in depth and it was the consensus
that a meeting should be arranged to try to work out alternative
layouts.

The owners and operators of the restaurant submitted a site plan
and explained their intended operation. The band is to be set
up in such a fashion that the sound will be directed into the
parking lot and not toward the residential development across
Goldenwest Street.

ON MOTION BY PALIN AND SECOND BY SPENCER SPECIAL EVENT NO. 77-6
WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
1. The plot plan received May 25, 1977, shall be the approved
layout.
2. The applicant shall obtain all necessary electrical permits.
3. An onsite inspection by the Fire Department shall be required
prior to the event.
4. A certificate of insurance form shall be filed in the License
Division of the Finance Department ten (10) days prior to the
event (if required by the License Division).
