To permit a two (2) lot division of land pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the south side of Edinger Avenue approximately 1000 feet east of Santa Barbara Lane in a C4 Highway Commercial, R2 Medium Density Residential, and MH Mobilehome District. This request is covered by Negative Declaration No. 77-29. Chairman Spencer opened the public hearing on the negative declara- tion. Vern and Cliff Houser were present at the meeting. There being no one to address the Board in relation to this project, the public hearing was closed. The Board reviewed the information contained in the request for exemption. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-29 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE The applicants indicated their receipt of and concurrence with the suggested conditions of approval previously forwarded to them. Secretary Palin reported that this request had been continued to permit processing of a precise plan of alignment for the extension of Saybrook, which has now been accomplished. The Board discussed required dedication and possible small vacation of a portion of the existing street section back to the applicants. ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 77-7 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments June 8, 1977 Page 2 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on March 11, 1977, shall be the approved layout. 2. A parcel map shall be filed with and approved by the Depart- ment of Public Works and recorded with the Orange County Recorder. 3. A thirty-two (32) foot radius at the intersection of the extension of Saybrook Lane and Edinger Avenue shall be dedicated to the City of Huntington Beach. 4. Edinger Avenue and Saybrook Lane shall be dedicated and improved to City standards at the time said parcels are developed. 5. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 6. The easement within the private Monterey Drive containing the existing 8" water main shall be dedicated to the City of Huntington Beach. 7. Sewage disposal shall be through the City of Huntington Beach sewer system at the time said parcels are developed. 8. All utilities shall be installed underground at the time said parcels are developed. 9. Compliance with all applicable City ordinances. 10. The property shall participate in the local drainage assessment district at the time said parcels are developed. 11. A copy of the recorded parcel map shall be filed with the Planning Department. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-29 (Cont. from 6-1-77) Applicant: Sally Likens To permit the construction of a 182 square foot garage addition which encroaches five (5) feet into the required rear yard set- back in lieu of Section 9103.3 of the Huntington Beach Ordinance Code, located on the southwest corner of Prescott Lane and Fenley Drive in an Rl, Low Density Residential District. Secretary Palin reported that research of the files for the entire City has indicated that similar variances of this nature have been granted in the past for the reverse corner lots, thereby establish- ing a precedent justifying the subject request. ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-29 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The original siting within the City of single-family, single - story homes on reverse corner lots did not take into considera- tion any future add-ons or provide any flexibility for such add-ons when the units were originally constructed. 2. Research of the files indicated that a precedent has been set in prior requests of this nature for encroachment into a rear yard area where that rear yard encroachment is adjacent to an interior side yard setback of only five (5) feet on an adjacent lot. 3. In the case in question, the proponent is proposing only a single -story addition at the rear yard; therefore, the addition will not affect the privacy of the property owner of the adjacent lot, as the adjoining dwelling is a two-story structure at five ( 5 ) foot setback. 4. There is sufficient separation between the drive on the abutting property and the new apron, as it is proposed to utilize the existing curb cut for access. 5. The addition will not affect or reduce any other amenities on subject property which are required by code. CONDITIONS OF APPROVAL: The conceptual plot plan received and dated May 18, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. Zwick To permit construction of a 9,000 square foot industrial build- ing pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the northwest corner of Argosy Drive and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. Secretary Palin reported that the applicant has requested a week's continuance on this item to permit plans to be changed in confor- mance with the recent changes in the configuration of the tentative parcel map of which subject site is a part. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 77-101 WAS CONTINUED TO THE MEETING OF JUNE 15, 1977, AT THE APPLICANT'S REQUEST, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTI Applicant: Stephen To permit a six (6) corner cutoff along 9104.1.1 of the Hun northwest corner of Density Residential 3N NO. 77-32 B. Lux foot wall to enclose the required 10 by 10 the exterior property line in lieu of Section tington Beach Ordinance Code, located on the Elliot Circle and Winslow Drive in an R1, Low District. This request is a Categorical Exemption, Class I, California En- vironmental Quality Act, 1970. Chairman Spencer opened the public hearing. Stephen Lux was present and addressed the Board in support of his request. There being no other persons to speak in regard to the proposal, the public hearing was closed. Board review considered the eleven (11) foot separation between the proposed wall and the drive on the abutting property. Also reviewed were the timing of the code requirement for the 10 x 10 corner cutoffs and the time of construction of the tract in which the subject property is located. ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION NO. 77-32 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 6-8-77 Page 4 1 Minutes, H.B. The map for Tract 4459 in which subject property is located was recorded in 1962 and the requirement for the 10 by 10 corner cutoffs did not become effective until 1964. There- fore, granting of the conditional exception does not consti- tute granting of any special privilege but only grants parity with other properties in the development. 2. The proposal will not be detrimental to the health, safety, or welfare of persons working or residing in the vicinity. 3. The location of the wall is such that it does not block visibility at the intersection of the driveway adjacent to the encroachment and the sidewalk area. CONDITIONS OF APPROVAL: The wall location on the site drawings submitted to the Planning Department on May 26, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the proposal: • Traffic circulation and drives; . Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative actions regarding this property. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 77-103 Applicant: Terence and Debra Harper To permit the construction of a fourplex pursuant to Section 9730.20 of the Huntington Beach Ordinance Code, located on the west side of Ash Street approximately 158 feet south of Sycamore Avenue in an R2, Medium Density Residential District. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Doris Martinez was present to represent the application. Secretary Palin noted that a revised plan has been submitted indi- cating that the lots can individually stand alone. The revised plan conforms to code requirements. Lot area; • Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. In accordance with the City's standards and requirements, an additional seven (7) feet of right-of-way on Ash Street shall be dedicated. 3. All applicable fees shall be paid prior to issuance of building permits. 4. Reciprocal easements shall be recorded over the south ten (10) feet of the north lot and the north ten (10) feet of the south lot for a depth of 135 feet from the ultimate right-of-way line on Ash Street to provide ingress -egress and turning radius for each property. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received and dated June 7, 1977, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . The Board reviewed the availability of customer parking and access to the rear of the property for emergency vehicles.
