BOARD MEMBERS PRESENT: SPENCER, EADIE, CROSBY MINUTES: ON MOTION BY CROSBY AND SECOND BY SPENCER THE MINUTES OF THE REGULAR MEETINGS OF MAY 18 AND 25, AND JUNE 1, 1977, WERE AP- PROVED AS TRANSCRIBED BY THE FOLLOWING VOTE: AYES: SPENCER, CROSBY NOES: NONE ABSENT: NONE ABSTAIN: EADIE AGENDA ITEMS TO BE CONTINUED: ADMINISTRATIVE REVIEW NO. 77-101 (Cont. from 6-8-77) Applicant: Eugene B. Zwick To permit construction of a 9,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the northwest corner of Argosy Drive and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. This request is covered by Environmental Impact Report No. 73-16, adopted by the City Council on March 18, 1974. Acting Secretary Eadie informed the Board that a request had been received from the applicant for continuance of this item to the June 29, 1977 meeting. Board concurred with the applicant's request. ON MOTION BY EADIE AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 77-101 WAS CONTINUED TO JUNE 29, 1977 AT THE APPLICANT'S REQUEST, BY THE FOLLOWING VOTE: AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE -1- BZA 6-15-77 Minutes: H.B. Board of Zoning Adjustments June 15, 1977 Page 2 REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 77-21 (Cont. from 5-11-77) Applicant: Donald P. and Catherine A. Buchanan To permit the construction of a detached garage to within six (6) inches of the side property line in lieu of the required five-foot setback per Section 9105.3(b) of the Huntington Beach Ordinance Code. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Chairman Spencer reopened the public hearing. The applicant was not present. There being no one present to speak for or against the project, the public hearing was closed. Board discussion ensued. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 77-21 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The applicant failed to demonstrate sufficient hardship. 2. The garage could be constructed to Ordinance Code requirements without any encroachments. AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE USE PERMIT NO. 77-5£3 Applicant: Grage-Willson To permit the construction of a seven (7) unit apartment building pursuant to Section 9161.4(b) of the Huntington Beach Ordinance Code, located on the west side of Ash Street, approximately 150 feet north of Mandrell Drive in an R2, Medium Density Residential District. This request is covered by Negative Declaration No. 77-67, Chairman Spencer opened the public hearing. Mr. Grage, the applicant was present at the meeting. The Board discussed the boundary survey conducted by RMG Engineering of the east one-half of Lot 5, Block D, Tract No. 436. Trash bin location was also discussed as well as the necessity for a landscape plan. -2- BZA 6-15-77 E Minutes: H.B. Conditions of approval for the proposal were also discussed. There being no one present to speak for or against the project, the public hearing was closed. ON MOTION BY SPENCER AND SECOND BY EADIE THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT ON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-67 WITH THE MITIGATING MEASURES B1 THROUGH B4 IMPOSED ON THE USE PERMIT, BY THE FOLLOWING VOTE: AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ON MOTION BY SPENCER AND SECOND BY EADIE USE PERMIT NO. 77-58 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The design and layout of the proposed use is compatible with the surrounding uses. 2. The proposal is consistent with the City's General and Specific Plans of Land Use. CONDITIONS OF APPROVAL: A, TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received and dated May 24, 1977 shall be the approved layout subject to the modifications described herein: a. Trash bin shall be as shown on the revised plot plan. b. Seven ft. W) dedication on Ash Street shall be required. C. RMG Engineering Survey dated May 23, 1977 shall be recorded at the Office of the County Recorder and shall .be submitted to the Planning Department. -3- BZA 6-15-77 Minutes: H.B. Board of Zoning Adjustments June 15, 1977 Page 4 In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. B• GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insula- tion in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the location of cooking facilities, water heaters, and central heating units. 4. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. AYES: EADIE, SPENCER, CROSBY NOES: NONE ABSENT: NONE ' ADMINISTRATIVE REVIEW NO. 77-106 Applicant: Phillip Stivers To permit construction of two (2) single-family dwellings pursuant to Section 9354.16 of the Huntington Beach Ordinance Code, located on the southwest intersection of 18th and Olive Avenue in the Townlot Specific Plan Area One, Section B. This request is a Categorical Exemption, Class III, California Environ- mental Quality Act, 1970. -4- BZA 6/-15-77 Minutes: H.B. Board of Zoning Adustments June 15, 1977 Page 5 Mr. Stivers, the applicant, was present at the meeting. The Board reviewed the trash bin location with the applicant. The applicant was also informed that 216" of dedication on the alley is required and that A 20 ft. radius is required on Olive Avenue. Board discussion followed. ON MOTION BY CROSBY AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 77-106 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received June 8, 1977 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits.
