Zwick To permit construction of a 9,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the northwest corner of Argosy Drive and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. Secretary Palin reported that applicant has requested that this item be continued to permit incorporation of abutting properties into the application. It will be necessary also to amend the legal notice to incorporate said change. Mola To permit construction of an 11,000 square foot office building pursuant to Section 9401 of the Huntington Beach Ordinance Code, located on the northwest corner of Warner Avenue and Roosevelt Street in an R-5, Office -Professional District. This request is covered by Negative Declaration No. 77-77. Vice-chairman Palin opened the public hearing on the negative dec- laration. Frank Mola was present at the meeting. The Board reviewed the information contained in the negative declaration re- quest and considered mitigating measures applicable to the project. Board of Zoning Adjustments July 6, 1977 Page 2 ON MOTION BY PALIN AND'SECOND BY BEHRENS THE BOARD, HAVING FOUND THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE EFFECT UPON THE PHYSICAL ENVIRONMENT, ADOPTED ND 77-77 WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS NOS. Bl THROUGH B5 IMPOSED UPON THE ADMINISTRATIVE REVIEW, BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, BEHRENS NOES: NONE ABSENT: NONE The Board reviewed the history of the subject site, and determined that ZC 73-15, which established setbacks for the adjacent property, had no bearing on the present application. The FAA review and ac- ceptance of a previously approved project on the property was for a building greater in height and closer to an existing runway in Meadowlark Airport than the project presently proposed, and the con- sensus of the Board was that the applicant should be merely required to submit his project to the FAA for review. John Behrens noted for the record that the Building Department would determine that the 3.5 gallon capacity tanks, included in the mitigating measures for the project, are presently unavailable and would not now be required of the developer. The applicant was advised that minimum drive width would be twenty (20) feet in order to accommo- date two-way traffic, subject to prescribed radii at the end of the landscaped planters. ON MOTION BY PALIN AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-107 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: - 1. The plot plan received and dated June 9, 1977, shall be the approved conceptual layout. In its approval action, the Board of Zoning Adjustments considered the following issues in relation to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Energy -saving lighting, such as high pressure sodium vapor lamps, shall be used in parking lots. 3. Crime prevention techniques shall be applied to the design of the project (e.g., single -cylinder locks, etc.). 4. Low -volume heads shall be used on all spigots and water faucets. 5. All holding tanks for toilet facilities shall be equipped for a capacity of 3.5 gallons, if such facilities are available at the time of construction. ADMINISTRATIVE REVIEW NO. 77-109 (In Conj./CE 77-35) Applicant: Lee Segal To permit construction of two (2) industrial buildings totaling 36,147 square feet pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the north side of Argosy Drive approximately 365 feet east of Bolsa Chica Road in an M1-A, Re- stricted Manufacturing District. These requests are covered by EIR 73-16, adopted by the City Council on March 18, 1974. Vice -Chairman Palin opened the public hearing on the C.E. There being no one present to address the Board, the public hearing was closed. A request has been received from the applicant for a continuance of one week to permit revised plans to be submitted. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Hedley Beesley was present at the meeting and was advised by the Board of setback and turning radius requirements in the area. ON MOTION BY PALIN AND SECOND BY ELLSTROM ADMINISTRATIVE REVIEW NO. 77-118 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated June 21, 1977, shall be the approved layout, sub3ect to the modifications described herein: a. The plan shall be revised to reflect the full fifteen (15) foot setback from curb line (or ten (10) feet from the easement line). b. The parking on the site shall be adjusted accordingly to comply with the ordinance code requirements. The changes outlined above shall be reflected in the plot plan submitted to the Department of Building and Community Development upon application for building permits. AYES: PALIN, ELLSTROM, BEHRENS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 77-36 (In Conj./AR 77-121) Applicant: Century Transportation To permit a truck loading facility to face an arterial street in lieu of Section 9518(a) of the Huntington Beach Ordinance Code, located at the southeast corner of Bolsa Chica Street and Argosy Drive in an M1-A, Restricted Manufacturing District. This request is a Categorical Exemption, Class V, California Envir- onmental Quality Act, 1970. Vice -Chairman Palin opened the public hearing. John Tillotson was present to represent the application and addressed the Board to explain his reasons for requesting the variance. There being no other persons present to comment on the request, the public hearing was closed. The Board reviewed the request, considering number of loading doors for the facility, height of such doors, the landscap- ing and method proposed to screen the loading facility from the arterial street, and circulation and parking provided. It was the consensus of the Board that sufficient justification did not exist for granting of the conditional exception, and alternative building layouts were reviewed with the applicant. After extensive discussion among Board members and the applicant, Mr. Tillotson requested that the variance request be withdrawn. ON MOTION BY PALIN AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION NO. 77-36 WAS WITHDRAWN, AT THE APPLICANT'S REQUEST, BY THE FOLLOW- ING VOTE: AYES: PALIN, ELLSTROM, BEHRENS NOES: NONE ABSENT: NONE BZA 7-6-77 Page 5 Minutes, H.B. Board of Zoning Adjustments July 6, 1977 Page 6 ADMINISTRATIVE REVIEW NO. 77-121 Applicant: Century Transportation To permit the construction of a 28,300 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located at the southeast corner of Bolsa Chica Street and Argosy Drive in an Ml-A, Restricted Manufacturing District. John Tillotson was present to represent the application. The Board reviewed the application, taking into consideration the previous discussion on C.E. 77-36 and the suggested alternative layouts. ON MOTION BY PALIN AND SECOND BY BEHRENS ADMINISTRATIVE REVIEW NO. 77-121 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The site plan received and dated June 24, 1977, shall be the approved conceptual layout, subject to the modifica- tions described herein: a. The plan shall reflect an additional wing structure to accommodate and screen the loading facility from Argosy Drive, or b. The plan shall reflect a minimum thirty (30) foot set- back from Argosy Drive and the loading dock facility shall be moved to the rear of the building, in which case the parking to the south may also be revised to 900 if applicant chooses to do so. 2. The revised plan reflecting one of the options outlined above shall be reviewed by the Board of Zoning Adjustments prior to issuance of building permits. 3. Williams To permit construction of a six (6) foot high block and wrought iron fence within the required setbacks in lieu of Section 9320.6 of the Huntington Beach Ordinance Code, located on the south side of Adams Avenue between Huntington and Delaware Streets in the Oldtown Specific Plan Area. This request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Vice -Chairman Palin opened the public hearing. Bob Williams was present at the meeting and noted that the filing of this appli- cation had been a requirement of Use Permit 77-23 for the con- struction of the complex. There being no other persons to address the Board, the public hearing was closed. Board review ensued. ON MOTION BY PALIN AND SECOND BY BEHRENS CONDITIONAL EXCEPTION NO. 77-34 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. When Use Permit No. 77-23 (for the residential complex located on subject property) was originally reviewed by the Board of Zoning Adjustments, the Board attempted to restrict pedestrian access to the facility through the use of a physical barrier and recommended that the proponent pursue a masonry wall around the development. Said masonry wall was also intended to serve to attenuate noise impacts upon the project from the abutting major arterial highway, Adams Avenue. 2. Recent amendments to Division 9 have taken this type of wall construction into consideration for review of the environ- mental concerns, to serve as noise attenuation. BZA 7-6-77 Page 7 Minutes, H.B. Granting of this request will not establish a precedent along Adams Avenue, as conditions for a similar type of design and treatment have previously been imposed upon a development on the north side of that arterial, to serve as traffic control, noise abatement, and for aesthetic purposes. 4. The portion of the fence to be constructed around the on -site oil operation facility is a requirement of the Oil Code; therefore, approval of this request will permit continuity in setback and architectural design from the apartment complex to the oil operation site. 5. The granting of this variance will not have a detrimental effect upon the health, safety, or welfare of persons working or residing in the area, as it has been established that walled apartment developments provide additional safety for pedes- trians as well as for vehicular movements on the abutting arterials. CONDITIONS OF APPROVAL: 1. The plan received and dated June 21, 1977, shall be the approved layout for wall location and locations of recesses and wrought iron portions. 2. The wall shall be constructed of Mission slumpstone block, in a fawn color. 3. A landscaping and irrigation plan shall be submitted to the Department of Public Works for review and approval prior to framing inspection. Said plan shall delineate the treatment between the perimeter wall and the public right-of-way. AYES: PALIN, ELLSTROM, BEHRENS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 77-23 (In Conj./UP 77-60) Applicant: The Janes Company To permit the division of one (1) parcel into two (2) separate parcels pursuant to Section 9921 of the Huntington Beach Ordin- ance Code, located on the east side of Delaware Street approxi- mately 732 feet north of Utica Avenue in an R2, Medium Density Residential District. This request is covered by Negative Declaration No. 77-74. Mr. Janes and Mrs. Hamm were present to represent the applica- tion. BZA 7-6-77 Page 8 1 Minutes, H.B. Board of Zoning Adjustments July 6, 1977 Page 9 Jim Palin reviewed the history of this particular area on the west side of England between England and Delaware, citing other applications which had been rejected because of access problems. He informed the applicants that the Board would have to find permitting access to Delaware Street to be inconsistent with the General Plan and with policies and goals of the City. With access to be taken from the local street, the map would require an easement across Parcel 2 in order to provide ingress -egress for Parcel 1 from England Street. Mrs. Hamm informed the Board that there are other properties adjacent to the subject parcel which have recently been granted permission to take access from Delaware. The Board reviewed other pro3ects to the north and south of sub- ject request. John Behrens and Mel Ott expressed dissatisfaction with the easement approach, both because of existing access en- joyed by other properties and because of the difficulties taking access to Parcel 1 through this easement might pose for Fire De- partment equipment. It was the consensus of the Board that the applicant should pursue either the access easement noted above or consider the filing of a conditional exception request to permit access to be taken from the arterial. The applicant concurred with this approach. ON MOTION BY PALIN AND SECOND BY BEHRENS TENTATIVE PARCEL MAP NO. 77-23 WAS CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE REGULAR MEETING OF JULY 20, 1977, BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, BEHRENS NOES: NONE ABSENT: NONE USE PERMIT NO. 77-60 (In Conj./TPM 77-23) Applicant: The Janes Company To permit the construction of a four (4) unit apartment building facing an arterial highway pursuant to Section 9161.4(a) of the Huntington Beach Ordinance Code, located on the east side of Delaware Street appxoximately 732 feet north of Utica Avenue in an R2, Medium Density Residential District. In view of the continuance of the tentative parcel map, applicant requested a continuance on subject request also. This request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Vice -Chairman Palin opened the public hearing. Joe Martino and Evan James were present to represent the application. There being no other persons present to address the Board in regard to this pro3ect, the public hearing was closed. The Board reviewed the floor layout of the subject building, the space allotted for the retail sales operation, and the place of manufacture of the items to be sold. ON MOTION BY BEHRENS AND SECOND BY ELLSTROM USE PERMIT NO. 77-63 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan received and dated June 17, 1977, shall be the approved layout. 2. A maximum square footage of 300 feet ± shall be the allowed area permitted for sale of items manufactured on the site only. Board of Zoning Adjustments July 6, 1977 Page 11 USE PERMIT NO. 77-64 Applicant: Larry Andrews To permit the construction of an apartment unit of approximately 880 square feet on a site having an existing dwelling with a non -conforming side yard setback pursuant to Section 9719 of the Huntington Beach Ordinance Code, located on the west side of England Street approximately 50 feet north of Joliet Avenue in the Oldtown Specific Plan Area. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Vice -Chairman Palin opened the public hearing. Larry Andrews was present at the meeting. There being no other persons present to address the Board in regard to this request, the public hear- ing was closed. In its review the Board considered the indicated retention of the existing garage on the site, and noted that this would result in six covered parking spaces on the lot. For the record and the owner's information, it was noted that use of these spaces for any purpose other than parking would constitute an illegal use. The need for a fire wall to be added to this existing garage was also discussed. ON MOTION BY ELLSTROM AND SECOND BY BEHRENS USE PERMIT NO. 77-64 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. A fire wall complying with the requirements of the ordin- ance code for garage walls on a property line shall be installed on the garage existing on the subject property. This request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Santiago was present at the meeting. In the Board review, the plan was found to be in conformance with code, except that the dimension from street centerline is not depicted thereon. Jerry Ellstrom informed the applicant that this dimension from centerline will be 37.5 feet. Jim Palin reported that investigation has disclosed that this phase of the project was covered by the permit processed for the approval of the total shopping complex.
