It was noted in the staff report that the sewer issue should be resolved by mid -August. For that reason the staff requested that these tracts be continued to August 16, 1977. It was noted that the applicants for the projects have concurred with the request for a continuance. Acting Chairman opened the public hearing on the three items. There was no one present to speak on the applications and the public hearing was continued. Staff indicated that more sewer data is needed before action should be taken and further indicated that the applicant has concurred with the request for a continuance. DeLapp IN CONJUNCTION WITH: ADMINISTRATIVE REVIEW NO. 77-100 - APPEAL TO DENIAL Applicant: Henry G. DeLapp Conditional Exception No. 77-28 is a request to permit a 5 ft. encroach- ment into the 10 ft. interior side yard setback required where the unit or units are constructed at zero on the opposite side yard. Administrative Review No. 77-10 is a request to permit construction of two (2) dwelling units on Site 2 and one (1) dwelling unit on Site 1 at the southwest corner of California Street and Joliet Avenue. It was noted that the applicant has requested a continuance to August 16, 1977, because of personal schedule conflicts. The staff concurred with the request for a continuance. Planning Commission Wednesday, July 6, 1977 Page 3 ON MOTION BY FINLEY AND SECOND BY SHEA THE PUBLIC HEARING ON THE APPEAL TO DENIAL OF CONDITIONAL EXCEPTION NO. 77-28 AND APPEAL TO DENIAL OF ADMINISTRATIVE REVIEW NO. 77-100 WAS CONTINUED TO AUGUST 16, 1977, AT THE REQUEST OF APPLICANT AND WITH THE CONCURRENCE OF STAFF, BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Shea, Newman NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 77-19 - APPEAL TO APPROVAL Applicant: Kaiser Aetna Tentative Parcel Map No. 77-19 is a request to permit division of 2.06 acre parcel into two parcels located at the northwest corner of Argosy Drive and Graham Street. The applicant for the tentative parcel map appealed the Board of Zoning Adjustments' conditional approval because it was felt that the required north/south orientation of the parcels would not result in the best utilization of the property. Subsequent to this appeal the applicant evaluated the resultant development plan and found it to be acceptable. The applicant therefore withdrew his appeal to the Board's conditions. The public hearing was opened on this application. There was no one present to speak and the Acting Chairman closed the public hearing. ON MOTION BY SLATES AND SECOND BY FINLEY APPEAL TO APPROVAL OF TENTATIVE PARCEL MAP NO. 77-19 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Shea, Newman NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 76-26 ENVIRONMENTAL IMPACT REPORT 77-1 Applicant: W & B Builders, Inc. IN CONJUNCTION WITH TENTATIVE TRACT NO. 9580 Applicant: W & B Builders, Inc. Tentative Tract No. 9580 and Conditional Use Permit No. 76-26 are requests to permit the development of a 369 unit planned residential development. The project will include recreational facilities, common open space areas, and a 4.24 acre lake which will meander throughout the majority of the project. John Cope addressed the Commission and -indicated that the site plans for review by the Commission represented 10 months of processing. Frank Thompson, applicant, addressed the Commission and spoke in behalf of the project. He stated that he had read the suggested cQhditions.of approval and felt that he could comply with them. ON MOTION BY SHEA AND SECOND BY NEWMAN ENVIRONMENTAL IMPACT REPORT NO. 77-1 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Finley, Gibson, Slates, Shea, Newman NOES: None ABSENT: None ON MOTION BY SHEA AND SECOND BY NEWMAN CONDITIONAL USE PERMIT NO. 76-26 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan, floor plans, elevation plans, preliminary landscape plans and lake plan, all dated April 22, 1977, shall be the appro layout. 2. The design and materials for the perimeter wall of the develop- ment shall be subject to review and approval by the Planning Department. The design and materials of the wall shall be calculated to insure a noise level with a maximum of CNEL 65 for any portion of the site. This finding shall be certified by a licensed acoustical engineer. Said wall along Beach Boulevard, Atlanta Avenue, and Delaware Street shall be located on a raised landscaped berm which shall be a minimum of 24 inches in height measured from the finished grade of the adjacent street. 3. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insu- lation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the .locations of cooking facilities, water heaters, and central heati units. 6. Double -paned windows shall be installed within the units facing onto Beach Boulevard, Atlanta Avenue, and Delaware Street. -4- 7/6/77 - PC Minutes: H.B. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 8. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 9. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. 10. A chemical analysis, as well as tests for physical properties of the soil on subject property, shall be submitted to the City for review prior to the issuance of building permits. 11. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State Acoustical Standards set forth for all units that lie within the 60 CNEL contours of the property. 12. Low volume heads shall be used on all spigots and water faucets. 13. All holding tanks for restroom facilities shall be equipped for a capacity of 3.5 gallons if such facilities are available at the time of construction. 14. The CC&R's and Association rules shall prohibit the storage of recreational vehicles from being located within any portion of the development. 15. The developer shall construct a left turn pocket on Beach BoulevarC providing access from northbound traffic onto Sunrise Court, as required by the Department of Public Works. 16. The developer shall construct a sewage pump station and all necessary sewer line facilities for the project, from the site to the county line in Pacific Coast Highway. The design specifications -and location shall be as required by the Department of Public Works. 17. Prior to -the assumption by the Homeowner's Association of any of the lake facilities or recreational facilities, the developer shall certify that the proposed circulation and filtration systems for the lake are adequate to insure proper water quality. If upon determination by the City staff that additional pumping and filtering 'systems are necessary, the developer shall install the required additional equipment. -5- 7/6/77 - PC Minutes: H.B. The subject property is General Planned "Medium Density Residential and is zoned R2-PD which allows 15 units per gross acre and as the project is proposed to be developed at 9.16 units per gross acre it is consistent with the General Plan and zoning designations on the property. 2. The project is in compliance with the provisions and objectives of the*"Planned Residential Development" Ordinance of the City, which regulates the type of project that is proposed. 3. The subject property is suitable for the proposed residential project. 4. The development design and all improvement features of the sub- division are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and the City's Subdivision Ordinance. 5. The subject property is within General Plan Amendment No. 76-1 which was analyzed and found to be in conformance with the California Coastal Plan adopted by the State Legislature in November, 1976. The approval of this project will not restrict the City's ability to prepare a local coastal plan. The tentative map dated April 21, 1977 shall be the approved layout. 2. The sewer, water, and fire hydrant system shall be designed to City standards. 3. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. Jim Palin discussed the conditions of approval and the need for adding to those listed in the staff report. Commission discussion ensued. ON MOTION BY GIBSON AND SECOND BY SHEA TENTATIVE TRACT NO. 5664 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Should the City be able to provide the rights -of -way for street improvements on the not -a -part parcel at the intersection of Busharc and Brookhurst Streets, the developer shall be required to install full street improvements on this parcel in compliance with plans and specifications on file with the Department of Public Works. 3. The developer shall submit to the City a detailed and comprehensive drainage plan, including how the tract grading, in conjunction with ,the grading conveyance system (including adequate swales, channels, street flow, catch basins, storm drains, and flood water retardent), will allow building pads to be saved from inundation from all rain- fall runoff. 4. A permit shall be obtained from the Orange County Flood Control District for any work within the Talbert Channel rights -of -way. 5.• The developer shall construct a minimum five (5) foot high chain link fence or equivalent along that portion of the tract adjacent to the Talbert Channel in a manner meeting with the approval of the Chief Engineer of the Orange County Flood Control District. 6. A decorative masonry wall shall be constructed to City speci- fications along Brookhurst and Bushard Streets. Said wall shall be six inches wide and six feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said -wall shall be approved by the Planning Department. The structural design shall be approved by the Department of Public Works and shall be included as a part of the street improvement plan. 7. Landscaped areas shall be provided along Bushard and Brookhurst Streets in conformance with plans and specifications on file in the Department of Public Works. It is the developer's responsi- bility to landscape section planters and provide irrigation facilities in conformance with the specifications on file with the Department of Public Works. 8. The project shall comply with the standards and requirements in effect for the FIA Program approved for flood insurance within the City of Huntington Beach in effect at the time the project is constructed. 9. Drainage for the subdivision shall be approved by the Department of Public Works prior to the issuance of grading permits and/or recordation of a final map for the project. Drainage facilities shall take into consideration siltation and erosion control both during and after construction of the project. 10. PI.ND1 NG,11 1. The proposed subdivision of this 13.3+ acre parcel of land zoned R-2 (which allows 15 units per gross acre) is proposed to be constructed having only 4.7 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for medium density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map and supplementary City Subdivision Ordinance. Dubov 1 This is a request to permit a 3 ft. encroachment into the required 10 ft. rear yard setback located on the east side of Deervale Lane at the southeast corner of the intersection of Deervale and Candlewood Drive. A vugraph was shown. The public hearing was opened. Mr. Leon Dubov addressed the Commission and spoke in favor of the proposed project. The public hearing was closed. Planning Commission Wednesday, July 6, 1977 Page 11 REASONS FOR APPROVAL: 1. The subject request is for only a minor encroachment of the one- story structure into the rear yard setback adjacent to an arterial highway, and will not affect the privacy of any adjacent property owner. 2. The granting of the conditional exception will not be materially detrimental to the public welfare or injurious to properties in the neighborhood, as it is -only a single -story structure and a perimeter wall separates such addition from the arterial highway. 3. The original siting of the dwelling on the lot at the time of initial construction at zero interior side yard setback with the open space area to the north of the dwelling did not take into consideration the future needs of the residents for additional floor area. 4. The granting of the conditional exception will not adversely affect the General Plan, as provisions have been set forth therein for diversification of housing types and sizes and there is no restriction on a maximum floor area for single-family dwellings. CONDITIONS OF APPROVAL: 1. The plot plan and elevations received May 23, 1977, shall be the approved layout. 2. All applicable fees shall be paid prior to issuance of building permits. 3. The single -story structure shall be constructed in compliance with State Acoustical Standards. 4. Restroom facilities within such structure shall be equipped for a capacity of 3.5 gallons, if such facilities are available at the time of construction.
