Applicant: The Janes Company
To permit the division of one (1) lot into two (2) separate par-
cels pursuant to Section 9921 of the Huntington Beach Ordinance
Code, located on the east side of Delaware Street approximately 732
feet north of Utica Avenue in an R2, Medium Density Residential
District.
This request is covered by Negative Declaration No. 77-74.
Jorge Alvarez was present at the meeting and presented a rough lay-
out of how the development can be sited on the parcels taking
access from England Street via an easement. Jim Palin reported that
a field investigation has been done and that most of the properties
in the area do take access from Delaware Street; however, it is
still the position of the Planninq Department that no further access
points be allowed on that arterial. The possibility of an alley
instead of an easement was discussed, and it was concluded that the
development to the north would preclude such treatment. Mr. Alvarez
indicated his company's receipt of and concurrence with the sug-
gested conditions of approval for the tentative map.

County Recorder.
3. Delaware and England Streets shall be dedicated and improved
at the time said parcels are developed.
4. Water supply shall be through the City of Huntington Beach

Vice-chairman Palin opened the public hearing on the Negative
Declaration and the Use Permit applications. Jorge Alvarez was
present at the meeting.
The Board reviewed the information contained in the negative
declaration request and considered mitigating measures applicable
to the project.
ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD, HAVING FOUND
THAT THE PROPOSED PROJECT WILL NOT HAVE A SIGNIFICANT ADVERSE
EFFECT UPON THE ENVIRONMENT, ADOPTED NEGATIVE DECLARATION NO. 77-74
WITH THE MITIGATING MEASURES CONTAINED IN CONDITIONS B-2 THROUGH
B-9 IMPOSED ON THE USE PERMIT, BY THE FOLLOWING VOTE:

There being no one present to address the Board in regard to the
Use Permit, the public hearing was closed.
The Board reviewed the revised plan submitted by the applicant
and considered the applicant's intent to flip the plan over if he
can obtain some sort of reciprocal access with the adjacent
property.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 77-60 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a use permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The revised site plan received and dated July 20, 1977,

shall be the approved layout for the total seven (7)
units, three on Parcel 2 and four on Parcel 1, subject to
the modification described herein:
a. The plan submitted to the Department of Building and
Community Development upon application for building
permits shall have depicted thereon the twenty (20)
foot easement over and across Parcel No. 2 to provide
access from England Street for Parcel No. 1, as required
in the conditions of approval imposed upon TPM 77-23.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
• Traffic circulation and drives;
• Parking layout;
. Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. All applicable fees shall be paid prior to issuance of building
permits.
3. In accordance with City standards and requirements, the bulb
design on England Street shall be dedicated to the City of
Huntington Beach and fully improved.
B. GENERAL CONDITIONS:
1. The approval of the site plan as submitted does not prohibit
the proponent from reversing the plan if it is more advantageous
to work with the property owner to the north for reciprocal
ingress -egress from England Street for both the subject property
and the abutting northerly parcel.
2. If the developer proposes to provide air conditioning, the in-
sulation in ceilings and exterior walls shall be a minimum of
R-19 and R-11, respectively. If no air conditioning is to be
provided, the insulation in ceilings and exterior walls shall be
a minimum of R-13 and R-7, respectively.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
offsite facility equipped to handle them.
4. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be stubbed in
at the locations of cooking facilities, water heaters, and
central heating units.

5. The structures on subject property, whether attached or
detached, shall be constructed in compliance with the
State acoustical standards set forth for all units that
lie within the 60 CNEL contours of the property.
6. Energy -saving lighting, such as high pressure sodium
vapor lamps, shall be used in parking lots and recreation
areas.
7. Crime prevention techniques shall be applied to the design
of the project (e.g., single -cylinder locks, etc.)
8. Low -volume heads shall be used on all spigots and water
faucets.
9. All holding tanks for restroom facilities shall be equipped
for a capacity of 3.5 gallons if such facilities are
available at the time of construction.

Jim Palin reported that a request has been received for continu-
ance of this request.

Vice-chairman Palin opened the public hearing on the request.
Lee Segal was present at the meeting. There being no persons to
address the Board on this project, the public hearing was closed.
The Board reviewed the request, considering the conditions which
had been imposed upon a previously granted application for a
similar project on Argosy. The applicant indicated his agreement
to the conditions and his willingness to construct the project
accordingly.
ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO.
77-35 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. When originally drafted, the ordinance code provisions had
not taken into consideration the layout and design of the
tentative tract map for this location which was subsequently
approved by the City.
2. Location of the truck well on the front of the building affords
ease of operation not otherwise available.
3. Granting of the Conditional Exception does not grant a special
privilege not realized by similar lots with similar design on
the local streets.
4. The proponent has proposed that the truck wells will not be
entered directly from the arterial highway and has proposed
adequate maneuverability to be provided onsite.
5. The granting of a Conditional Exception will not be materially
detrimental to the public welfare or injurious to property in
the same zone classification.
CONDITIONS OF APPROVAL:

be the approved layout, subject to the modifications
described herein:

a. Reciprocal easements for access and maneuverability
shall be recorded over each lot for the use by the
abutting lot to obtain access to the truck wells. Such
areas shall be along the common property line for a
width of twenty (20) feet on each property, to extend
from the face of the building to within thirty-three
(33) feet of the front property line.
The modification outlined above shall be delineated upon the
plan submitted to the Department of Building and Community
Development upon application for building permits.
2. Finished grade along the common property line shall be
provided in such a manner to eliminate surface drainage
from one property sheet flowing into the abutting loading
or truck well facility.
3. Screening of a minimum height of six (6) feet shall be
provided along the front property lines for a distance of
seventy (70) feet (if the plan is amended to locate the
truck well facilities at the common property line) for a
distance of thirty-five (35) feet on each lot, for screen-
ing of the overhead doors and truck loading facilities.
This screening may be a combination of berming, landscap-
ing, and screening wall, with the wall portion not to
exceed 50 percent of the overall six-foot height.

To permit construction of two (2) industrial buildings totaling
36,147 square feet pursuant to Section 9511 of the Huntington
Beach Ordinance Code, located on the north side of Argosy Drive
approximately 365 feet east of Bolsa Chica Road in an M1-A, Re-
stricted Manufacturing District.
This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Lee Segal was present at the meeting.
The site plan was reviewed in light of the reconsideration and
approval of C.E. 77-35 and was found to be in compliance with
code.

CONDITIONAL EXCEPTION NO. 77-38
Applicant: Harold J. Porter
To permit the reduction of the minimum open space dimension from
the required 20 feet to 15 feet in lieu of Section 9103.3.1.1.2
of the Huntington Beach Ordinance Code, located on the south
side of Spa Drive at the intersection of Spa and Hammon Lane in
an Rl, Low Density Residential District.
This request is a Categorical Exemption, Class V, California
Environmental Quality Act, 1970.
Vice-chairman Palin opened the public hearing. Harold Porter was
present and addressed the Board to explain further his reasons
for requesting the variance. There being no other persons present
to speak for or against the proposal, the public hearing was closed.
Board discussion included the prior standards in effect at the
time this project was originally constructed, the compliance of
the existing encroaching structure with building code requirements,
and the size and distribution of the remaining square footage of
open space on the lot.
ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION NO.
77-38 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The dwelling is located extremely far back on the property,
with a side -entry garage at 20 foot setback, which poses certain
constraints on addition to the single -story structure.
2. Since the property is abutting permanent open space, the addi-
tion could have been built at a five foot setback with a
slightly different configuragion.
3. The remaining open space on the lot exceeds the minimum required
open space by 303 square feet.
4. Granting of the request would not constitute granting of spec-
ial privilege.
5. The addition is a one-story structure; therefore, it does not
affect the privacy of open space on abutting properties.
6. The request will not be detrimental to the health, safety, or
welfare of persons working or residing in the community.

Charles Pancheri was present to represent the application.
The Board reviewed the submitted plot plan and discussed alterna-
tive means of providing the required -square footage of landscaping.

To permit the establishment of a seasonal parking lot pursuant
to Section 9730.28.1 of the Huntington Beach Ordinance Code,
located on the west side of 3rd Street approximately 100 feet
south of Walnut Avenue in a C3, General Business District.
This request is a Categorical Exemption, Class IV(e), California
Environmental Quality Act, 1970.
Fred Whiteacre was present at the meeting to represent the appli-
cant.
The requirements of the code in regard to seasonal parking lots
were reviewed with the applicant.

This request is covered by EIR 73-16, adopted by the City Council
on March 18, 1974.
Board review included discussion of required setbacks and land-
scaping; applicant was instructed to make sure that the City
receives a copy of the recorded tentative parcel map filed on the
property.

ADMINISTRATIVE REVIEW NO. 77-128
Applicant: F. V. Harrison & H. E. Combest
To permit the construction of a 22,000 square foot industrial
building pursuant to Section 9511 of the Huntington Beach Ordin-
ance Code, located on the west side of Redondo Circle approximately
200 feet south of Talbert Avenue in an M1-A, Restricted Manufactur-
ing District.
This request is covered by Negative Declaration No. 74-169, adopted
by the Board of Zoning Adjustments on January 29, 1975.
Mr. Combest was present at the meeting.
It was noted in review that the applicant had previously shown a
fifteen (15) foot reciprocal easement along the southerly property
line of subject property to provide access to both this parcel and
the adjacent parcel under the same ownership to the south. Mr.
Combest was informed by the Board that this full width of 15 feet
would not really be needed in order to provide the proper access
and turning radius and the easement could be reduced if desired.
Landscaping and Fire Department requirements were also reviewed;
Chuck Burney noted that a hydrant might be required on the property.
